The Ontario Ministry of Transportation (MTO) has retained WSP Canada Group Limited to undertakethe Detail Design and Class Environmental Assessment (Class EA) Study for the reconstruction andsignalization of the Highway 12 / Fairgrounds Road / Atlantis Drive intersection in the Townships ofOro-Medonte, Severn and City of Orillia, Simcoe County. The location of the intersection is shownin the attached notice.
The study has followed the Class Environmental Assessment for Provincial Transportation Facilities(2000) process for a Group 'B' project. In August 2016 the Preliminary Design phase of the projectwas completed and a Transportation Environmental Study Report was filed and receivedenvironmental approval. A Design and Construction Report (DCR) has been prepared to outline theenvironmental impacts and mitigations measures for the Detail Design plan.
Please make the enclosed DCR available for a 30-day public review period from March 8, 2018
to April 9, 2018 at the Township of Severn.
A copy of the Notice of Filing of the DCR is attached for your reference. The notice will be publishedin the following newspaper, on the noted date:

1 PROJECT OVERVIEW
1. 1 Background
Highway 12 runs approximately 145 km from Midland to Whitby passing to the east of LakeSimcoe. An Environmental Assessment (EA) study was completed by the Ministry ofTransportation (MTO) in 2003 for the section of Highway 12 from Horseshoe Valley Road toMurphy Road (Orillia West Limits). The study recommended and received EA approval for theultimate widening of Highway 12 from two to four lanes, including identification of associatedproperty; requirements. The study also identified rehabilitation requirements as well as localizedsafety and operational improvements at various intersections along the corridor, including BassLine / Digby Road, Wainman Line / Line 15 North and Fairgrounds Road / Atlantic Drive.Following completion of the 2003 study, a rehabilitation of Highway 12 was undertaken whichincluded pavement rehabilitation and minor drainage and electrical improvements.
Following this work, a Preliminary Design and Class Environmental Assessment Study wascarried out for the 10 km stretch of Highway 12 from Memorial Avenue in the City of Orillia toHorseshoe Valley Road in the Townships of Severn and Oro-Medonte within the County ofSimcoe, and documented in a Transportation Environmental Study Report (TESR). The studywas carried out in accordance with the approved environmental planning process for a Group'B' project under the Ministry of Transportation's C/ass Environmental Assessment for ProvincialTransportation Facilities (2000) and included the Highway 12 / Fairgrounds Road / Atlantis DriveIntersection, which is the focus of this study. The purpose of the Preliminary Design andEnvironmental Assessment Study was to examine all aspects of the corridor to identifyrehabilitation needs, as welt as potential operational and safety improvements along this sectionof Highway 12. Three design alternatives were identified for the Highway 12 / Fairgrounds Road/Atlantis Drive Intersection, and the following was preferred:
> Alternative 1: Localized re-atignment of the intersection to the west to address the highexisting intersection skew angle, and provision of traffic signals and left-turning lanes alongHighway 12 approaching Fairgrounds Road /Atlantis Drive.
A TESR was prepared and filed for public and external review. The report described therecommended improvements on Highway 12, anticipated environmental effects and proposedmitigation "icasures. The TESR received environmental clearance to proceed in August 2016.

MTO initiated the Detail Design for the preferred alternative for the Highway 12 / FairgroundsRoad / Atlantis Drive Intersection (hereby referred to as 'Highway 12 intersectionimprovements'). The Detail Design involves the following works, which are described in greaterdetail in Section 3. 0:
> Realignment of Fairgrounds Road and Atlantis Drive to improve geometry approaching theintersection;
> Installation of traffic signals;
> Widen Highway 12 to four lanes through the intersection and connect to the existing fourlane section to the east; and
^ Transition to the existing two lane section on Highway 12 to the west.
The study area / project limits for the Highway 12 intersection improvements are shown inExhibit 1-1.

1. 3 Environmental Assessment Act Process

The MTO C/ass Environmental Assessment for Provincial Transportation Facilities (Class EA)was approved under the Ontario Environmental Assessment Act in the Fall of 1999 andamended in 2000. The Class EA defines the group of projects and activities, and theenvironmental assessment processes that MTO has committed to follow to plan, design, andimplement these types of projects. Provided that this process is followed, projects and activitiesincluded under the Class EA do not require formal review and approval under the OntarioEnvironmental Assessment Act.
The Detail Design study for the Highway 12 intersection improvements followed the MTO ClassEA process for Group 'B' projects, which generally includes re-aiignments and improvements toexisting highways and freeways, new interchanges or modifications to existing interchanges,new or modified water crossings or watercourse alterations, or new highway service facilities.Group 'B' projects are generally similar in nature, recur frequently, and have a generallypredictable range of environmental effects for which standard mitigation can be used. The MTOClass EA process for Group 'B' projects is shown in Exhibit 1-2.
Following the Preliminary Design phase for the improvements to Highway 12, a TESR wasprepared for a 30-day review period and, subsequently, received environmental clearance toproceed in August 2016.
This project addresses the Detail Design phase for the Highway 12 intersection improvementsand documents how the EA commitments outlined in the TESR are being addressed. Designfeatures, refined environmental impacts, and mitigation measures are also described in thisreport. Exhibit 1-3 highlights the key steps in this Detail Design and Class EA Study.
1.4 Canadian Environmental Assessment Act
Under the Canadian Environmental Assessment Act, 2012 (CEAA 2012), an environmentalassessment is required for "designated projects. " A designated project is one that includes oneor more physical activities that are set out in the regulations under CEAA 2012 or by order of thefederal Minister of the Environment.
This Detail Design and Class EA Study was reviewed by the Project Team against theRegulations Designating Physical Activities, and it was determined that the study is not"designated" and therefore, will not require consideration of a federal environmental assessment.

1. 5 Purpose of the Design and Construction Report
This Design and Construction Report (DCR) documents the environmentally significant aspectsof the planning, design, and construction of the Highway 12 intersection improvements. Thisstudy followed MTO Class EA process for a Group 'B' project as defined in the C/assEnvironmental Assessment for Provincial Transportation Facilities (2000)
This DCR has been prepared to:
> Describe the design of the Highway 12 intersection improvements;
> Document specific environmental effects associated with the project and proposedmitigation;
^ Identify mitigation measures that have been incorporated into the design and will be includedin the contract drawings;
> Address any commitments to future work identified in the 2016 TESR;
> Detail the impacts on traffic and access during construction of the recommended design,and,
> Summarize the consultation undertaken with external agencies, municipalities, Indigenouscommunities, interest groups, utilities, adjacent property owners and interested members ofthe public during the Detail Design and Class EA Study.
This DCR is not eligible for a Part II Order (i. e. "bump-up") under the provisions of the MTO ClassEA. However, there is an opportunity at any time during the MTO Class EA process for interestedpersons to provide comments and review outstanding issues. The DCR is available for a publicperiod from March 8, 2018 to April 9, 2018. Any concerns raised by external agencies,municipalities, Indigenous communities, interest groups, utilities, adjacent property owners andinterested members of the public during this review period should be discussed with MTO ortheir consultants identified below, as all comments received during the review period will beconsidered by the MTO.
Additional information about the Class EA process for Group 'B' projects is contained in theC/ass Environmental Assessment for Provincial Transportation Facilities (2000).

2 CONSULTATION / ENGAGEMENTThe Highway 12 intersection improvements Detail Design and Class EA Study includedconsultation / engagement with external agencies, municipalities, Indigenous communities,interest groups, utilities, adjacent property owners and members of the public.
2. 1 Public Consultation
A Notice of Study Commencement was published in the Orillia Packet & Times and Orillia Todayon Thursday, June, 29, 2017. The notice included an overview of the study, a map showing theproject limits, and Project Team contact details. A copy of the notice is included in Appendix A.
In June / July 2017, a Notice of Study Commencement letter was mailed to the local MPP,external agencies, municipalities, Indigenous communities, interest groups, utilities andimpacted property owners to announce commencement of the Detail Design Study. A copy ofthis notification is included in Appendix A. Comment forms were enclosed with the letters toagencies and interest groups to provide them with an opportunity to express their interest andany comments on the project.
Adjacent property owners within a 2 km buffer from the centre of the intersection were provideda copy of the Notice of Study Commencement via Canada Post's unaddressed ad mail (i. e. bulkmailing). Approximately 2, 533 properties were notified of the study commencement.
French Language Service Act (FLSA) requirements were not required for this study as the studyarea is not within a FLSA designated area.
A total of 23 comments were received in response to the Notice of Study Commencement. Allcomments were responded to and there are no outstanding concerns. Comments receivedincluded acknowledgement of the Study Commencement notice, requests to either be added orremoved from the project contact list, a request to speak with a member of the project team, anda request for the installation of a traffic circle. Further details on the comments received fromexternal agencies and Indigenous communities are provided in Sections 2. 2 and 2.3.

3 DETAILED DESCRIPTION OF THERECOMMENDED DESIGN
3 1 Major Features of the Proposed Work
As noted in Section 1.2, the Highway 12 intersection improvements will include reconstructionand signalization of the intersection to address the existing geometric and safety concerns. Ingeneral, this will involve installation of traffic signals to Accessibility to Ontarians with DisabilitiesAct requirements; the realignment of Fairgrounds Road and Atlantis Drive to improve geometryapproaching the intersection; and widening of Highway 12 to four lanes through the intersectionincluding left turn lanes. The highway widening will connect to the existing four lane section tothe east and transition to the existing two lane section on Highway 12 to the west.
Exhibit 3-1 illustrates the final Detail Design plan.
3. 2 Construction Staging and Traffic Management
Construction for the Highway 12 intersection improvements is anticipated to occur for fourmonths and involves the stages outlined in Exhibit 3-2.

4 POTENTIAL ENVIRONMENTAL EFFECTS,MITIGATION MEASURES ANDCOMMITMENTS TO FURTHER WORK
This section outlines the direct and indirect environmental effects associated with the project,the mitigation measures that will be implemented to minimize effects and ensure compliancewith legislated requirements, and any commitments to further work. Exhibit 4-1 illustrates theexisting environmental features in the Highway 12 intersection improvements study area.
Mitigation measures were considered in planning decisions, design features, constructionrequirements, and construction constraints. The mitigation measures documented in this reporthave been developed with due consideration for the potential adverse effects of the project. Theidentified mitigation measures have been carried forward into the Detail Design and will beapplied during the construction of the project, as applicable. Refinements and enhancements tothe mitigation measures will be made as necessary to ensure that this project does not result inany significant adverse environmental effects.
The key to ensuring effective environmental quality control and risk management during theproject is the development and proactive implementation of an approach that:
> Identifies the environmental sensitivities;
> Presents environmental protection measures in a way that can be translated into contractualrequirements and for which compliance can be verified; and
> Includes a monitoring program that verifies that the environmental protection measures arebeing implemented and are effective.
It is important to ensure that the Contract Administrator and Contractor are made aware of, andare prepared to deal with, all environmental issues that may arise during construction.Environmental controls will be included in the contract documents to address specificenvironmental and operational concerns.

4. 1 Natural Environment
4. 1 1 Erosion and Sediment Control
Mitigation measures for erosion and sediment control will be used to prohibit sediment fromentering forested areas. Erosion and sediment control measures will be implemented prior toconstruction and will be maintained throughout construction as per Ontario Provincial StandardSpecification (OPSS) 805. Erosion and sediment best management control practices will bedesigned and implemented in accordance with the Ontario Ministry of Transportation'sEnvironmental Guide for Erosion and Sediment Control During Construction of Highway Projects(February 2007).
4. 1.2 Vegetation
The Terrestrial Ecosystems Existing Conditions and Impact Assessment Report (SLR, 2015)prepared during the Preliminary Design phase was reviewed. To update this information,background data was obtained by WSP from the Ministry of Natural Resources and Forestry(MNRF) Natural Heritage Information Centre (NHIC) database, and Ecological LandClassification for Ontario - Southern Region. The MNRF Midhurst District was also contacted toobtain background information about the study area. Field investigations for vegetation wereconducted by WSP on July 11, 2017.
The Preliminary Design report identified five community types including Dry - Moist Old FieldMeadow Type (CUM1-1), Sumac Cultural Thicket Type (CUT1-1), Mineral Cultural WoodlandEcosites (CUW1), Scotch Pine Coniferous Plantations Type (CUP3-3) and White PineConiferous Plantations Type (CUP3-2), and/or areas with a combination of the community types(e. g. CUW1/CUT1). These communities and their species are consistent with the findings of the2017 WSP survey.
Two updates to the vegetation types were identified by WSP. The deciduous forest foundsoutheast of the Fairgrounds Road / Highway 12 intersection, was previously categorized asDry-Fresh Sugar Maple Deciduous Forest Ecosite (FOD5) in the Preliminary Design report. Thishas been revised to a Dry- Fresh Oak - Hardwood Deciduous Forest Type (FOD2-4) based onthe species found in the 2017 WSP survey. The second includes updating the Dry-FreshDeciduous Forest Ecosite (FOD4) found south of Highway 12, to a mixed community made upof a Deciduous Swamp (SDW) and Fresh - Moist Poplar Deciduous Forest Type (FOD8-1).Locations of these vegetation communities are shown previously in Exhibit 4-1.
A number of Butternut (Juglans cinerea) species were identified at the time of the 2017 survey,and a Butternut Health Assessment (BHA) was performed by WSP in October 2017. Vegetationcommunities with known Butternut occurrences include Dry - Fresh Oak - Hardwood DeciduousForest Type (FOD2-4), which is found between Highway 12 and Bass Lake Side Rd Esubdivision, and one was found in a hedgerow (HR7) northwest of the Highway 12 andFairgrounds Road intersection. Butternut, and the associated recommendations for mitigation,is discussed further in Section 4. 1.5

Potential Im acts
Desi n and Construction Re crt
The reconstruction and signalization of the Fairgrounds Road / Atlantis Drive / Highway 12intersection will occur through Cultural Meadows (CUM1-1) including a mowed lawn of the NotreDame Catholic School yard currently acting as the school's baseball field, and as smallnaturalized patches of meadow found in the right-of-way (ROW) ditches. These units have anabundance of non-native/introduced and a few invasive species plant species includingCommon Buckthorn and Tartarian Honeysuckle (Lonicera tatarica). While these units do providesome limited field habitat, they are disturbed (e. g. frequently mowed). None of these ecositesrepresent natural heritage features and are considered low in ecological value.
Removal of vegetation as a result of the proposed works are contained to Cultural Meadows(CUM1-1); edges of Cultural Woodlots (CUW1); edges of Sumac Culture Thickets (CUT1-1);hedgerow (HR7) adjacent to the ROWs; hedgerow (HR5) on the east side of Fairgrounds Road;and a few standing trees adjacent to residential properties (CVR-4). Thus, these units have anabundance of non-native/introduced and a few invasive species plant species. None of theseecosites represent natural heritage features and are considered low in ecological value.
Individual trees at the edge of Dry - Fresh Oak -Hardwood Deciduous Forest Type (FOD2-4) ateast side of Atlantis Drive have the potential to be impacted by the proposed works. Theproposed works will occur on the existing roadway and shoulder with grading expected to be 2m from the shoulder, and will result in no vegetation or tree removals. Tree protection fencing isrecommended for the boulevard trees found adjacent to the works.
Standard mitigation measures are appropriate and will ensure that impacts from the proposedworks to vegetation are minimal. Mitigation measures are presented in Exhibit 4-5.
4. 1. 3 Designated Natural Areas and Significant Wildlife Habitat
Provincially designated natural areas include: Areas of Natural and Scientific Interest (ANSI),Provincially Significant Wetland (PSW), Environmentally Significant Area, Provincial Parks andConservation Areas. For this Detail Design and Class EA study, the MNRF Midhurst District wascontacted by WSP on July 10, 2017. Graham Findlay (MNRF) responded on January 10, 2018and identified that there are limited natural heritage values associated with the study area. NoPSW, ANSI, or deer wintering areas are identified in the immediate area.
4. 1.4 Wildlife
WSP 2017 wildlife findings were consistent with the Preliminary Design report. The locallandscape is primarily agricultural, with a few treed communities including forest, swamps, andplantations that contribute to wildlife potential. Air photo interpretation was used to identifymeadows that may contribute to Eastern Meadowlark and Bobolink habitat. Wildlife surveyswere conducted on July 6 and 14, 2017 to specifically confirm the presence of EasternMeadowlark and Bobolink habitat, as well as to collect general wildlife sightings and habitatstructures such as bat cavity trees. No ground nesting habitat for Eastern Meadowlark andBobolink was identified during the survey. Meadows identified during air photo interpretationwere found to be heavily disturbed (e.g. frequently mowed), and not large enough to support thetargeted Species at Risk (SAR) grassland nesting birds. sandwichensis), a bird that typically is a ground / low to ground shrub nester, was sighted in themost westerly agricultural field (OAGM1), on a hay bale, during the survey.
Potential Im acts
BIRDS
Small sections of vegetation are expected to be impacted for works in the ROW and the AtlantisDrive realignment in the mowed Cultural Meadow (CUM1 -1). Birds protected under the federalMigratory Birds Convention Act 1994 (MBCA) may be impacted if they are nesting in vegetationto be removed or in vegetation adjacent to the construction zone. No bird nests, SAR groundnesting birds were found in the study area during the survey, however, a ground nestingSavannah Sparrow was sighted at the west end of the study area. Timing of the vegetationremoval during the breeding bird season could still result in removal of migratory or breedingbird habitat.
HERPTILES
Amphibians and reptiles associated with small wetland habitats may use the Cattail MineralShallow Marsh Type (MAS2-1) wetlands as breeding, foraging and overwinter sites. This site isoutside the study area and is not anticipated to be impacted by proposed works.
There is no existing movement corridor in the study area, however, reptiles and amphibians mayuse the existing ditches and low lying ground areas as movement corridors, and may travel intothe construction zone. SAR Snapping Turtles are known to reside in this area, and may possiblyuse the road shoulders as a nesting site.
MAMMALS
The mammals observed in the study area are typical rural mammals. There is no existingmovement corridor in the study area; however, mammals may travel into the construction zoneand could be harmed.
ODONATESAND LEPIDOPTERA
It is recognized that in the Old-field cultural meadows of the ROW butterflies, such as SARMonarch, could use meadow plants as a food source. However, given the small footprint of theproposed works, impact on these populations or on other insect species observed in the culturalmeadow are not expected
Standard mitigation measures are appropriate and will ensure that impacts from the proposedworks to wildlife are minimal. Mitigation measures are presented in Exhibit 4-5.
4. 1. 5 Species of Conservation Concern
Efforts were made during field investigations to identify plant and wildlife SAR while in the field,and to search for migratory bird nests.
Two SAR identified during the 2017 WSP survey were Monarch and Butternut. Monarch is listedas Special Concern under the Endangered Species Act (ESA) and Species at Risk Act (SARA).Butternut is listed as Endangered under the ESA and SARA.

A Monarch was found on a Common Milkweed plant in the Highway 12 ROW. Under currentlegislation Monarchs and their habitat on provincial land do not receive protection.
One Butternut was found in the Hedgerow (HR7), well outside the study limit, and is not expectedto be impacted by the proposed works. Nine Butternuts were located on a property south ofHighway 12 between Atlantis Drive and West Ridge Boulevard. The locations of these trees areshown in Exhibit 4-1. None of the Butternut trees are expected to be physically removed,however, one tree is approximately 20 m from the proposed road works, so could be harmedduring the widening of Highway 12 and the construction of the new ditching. Next steps includeconsultation with the MNRF to determine the effect to this and other Butternut trees in the studyarea, and the type of mitigation required.
Proposed mitigation measures are presented in Exhibit 4-5.
4. 1. 6 Drainage and Surface Water
Drainage improvements include the replacement and installation of culverts at residential andcommercial driveways along Highway 12. These works will not directly remove natural features.The addition of ditches that direct flow through these culverts will also be installed along theroad's ROW. Work areas for construction are contained to Cultural Meadows (CUM1-1), edgesof Cultural Woodlots (CUW1), and edges of Sumac Cultural Thickets (CUT1-1). The largestimpact to a vegetation community for the culvert and ditching additions will take place in themowed Cultural Meadows (CUM1-1) for the Atlantis Drive realignment. All works are containedto units that have an abundance of non-native/introduced species and a few invasive plantspecies. None of the ecosites represent natural heritage features and all are considered low inecological value.
New culverts and a culvert extension on the south side of Highway 12 and on the west side ofthe Atlantis Drive realignment directs water along the slope of the new embankment and then,diffuses flow into a Cultural Woodlot (CUW1). This Cultural Woodlot (CUW1) buffers a smallopen water (OAO) farm pond and two small Cattail Mineral Shallow Marsh Type (MAS2-1). Theamount of surface runoffwill be unchanged and the concentrated flow and discharge in the newditch system is not expected to impact additional water towards the pond. For these reasonsthere is no anticipated impact to the pond.
4. 1.7 Groundwater
The water well survey for the Highway 12 intersection improvements was completed byWSP onNovember 3 to 13, 2017. This included completing interviews and collecting groundwatersamples for participating well owners in the study area. In total, 12 properties were solicited byWSP for the water well survey. Interviews were carried out at 4 properties and 4 water sampleswere collected. One additional property was partially surveyed, however, a sample was notcollected at this property due to the owner being unavailable at the time of the well survey. Allsurveyed wells were drilled wells.

Groundwater at the surveyed wells was determined to be located at depths ranging from 34.7 to44.4 meters below the top of casing (mbtoc). These water levels are consistent with informationprovided in MOECC well records for the study area. The records also indicated that wells in thestudy area obtain groundwater from the overburden aquifers, present at elevations of 220-250meters about sea level (masl) and 130-210 masl, respectively.
Since deep excavations are not required for the reconstruction and signalization of the Highway12 intersection improvements and the water wells survey indicated that wells in the study areaare supplied by groundwater from depths ranging between 29 to 85 metres below ground surface(mbgs), impacts to water quality and quantity are not expected during construction.
Given construction work is expected to be surficial and impacts to deep groundwater resourcesin the study area are not expected and there are no watercourses in the study area, which wouldtrigger impacts to surface water, a PTTW/EASR is not needed for this project.
Standard mitigation measures are appropriate and will ensure that impacts from the proposedworks to groundwater are minimal. Mitigation measures are presented in Exhibit 4-5.
4. 1. 8 Tree Protection and Landscape
An Arborist Report and Tree Protection Plan (WSP, 2018) was prepared during Detail Design.Each tree in the study area was inventoried and analyzed to optimize tree protection during theconstruction and installation of the project. Of the 62 individually trees inventoried, 31 trees arerecommended for removal due to unavoidable and significant encroachment into their treeprotection zones (TPZ). At total of 48 trees within the six hedgerows are also recommended forremoval. The remaining 31 individually assessed trees will be retained and protected usinggeneral tree protection measures, namely protection of the designated TPZ and installation oftree protection fencing. The Tree Protection Plan minimizes the number of trees that are to beremoved and provides recommended actions to protect and retain the maximum number of treesin good condition. These and additional mitigation measures are presented in Exhibit 4-5.
The recommended landscape plans for the study area, including replanting plans, are inAppendix B. The Arbohst Report and Tree Protection Plan (WSP, 2018) should be referencedfor detailed mitigation measures.
4. 2 Socio-Economic Environment
4. 2. 1 Excess Materials and Waste Management
Most of the excess materials to be generated during this project can be managed through re-use on site (i.e. proposed berm located at the intersection realignment), recycling or disposal. Itis recommended that all excess materials generated during this project be managed inaccordance with Ontario Provincial Standard Specification 180, November 2016 (OPSS. PROV180).

If excavated soils from areas outlined in the Contaminated Overview Study completed duringPreliminary Design is intended to be re-used within MTO's ROW, the soil should be comparedto generic site condition standards established by the MOECC document So//, Ground Waterand Sediment Standards for Use Under Part XV. I of the Environmental Protection Act (April2011).
Standard mitigation measures are appropriate and will ensure that impacts from the proposedworks related to excess materials and waste management are minimal. Mitigation measures arepresented in Exhibit 4-5.
4. 2. 2 Adjacent Land Uses and Properties
Lands adjacent to the ROW consist predominantly of residential, institutional, automotivecommercial and agricultural uses. On the south side of Highway 12, land uses include a church,a school with a large grass covered recreational field, residences and agricultural fields. Thenorth side of Highway 12 includes agricultural fields, residences and automotive commercialbusinesses.
Permanent property acquisitions are required from eight properties adjacent to the Highway 12intersection improvements. These areas are required for the widening of Highway 12 to fourlanes through the intersection and for the proposed realignment of Fairgrounds Road andAtlantis Drive. Minor regrading at entrances is also required to tie-in the highway widening to theexisting entrances.
No further impact on adjacent land uses will occur as a result of the Highway 12 intersectionimprovements.
4.2. 3 Air Quality
During Preliminary Design it was identified that the contribution of the Highway 12 intersectionimprovements is projected to be below applicable government guidelines for air quality andwould have an unnoticeable and insignificant impact on local air quality.
Standard mitigation measures and best practices will be used to protect air quality duringconstruction and are presented in Exhibit 4-5.
4.2.4 Noise
Noise Assessment
A noise assessment was completed during Preliminary Design and was documented in theNoise Study Report (fi^ECOM, September 2015). The noise study conducted during PreliminaryDesign concluded that residential receptors adjacent to the Highway 12 intersectionimprovements are predicted to have a sound level increase of less than 5 dBA, with one NoiseSensitive Area (NSA) showing a reduction in 1 to 2 dBA. However, in line with the MTOEnvironmental Guide for Noise, only those NSAs where noise levels are equal to or greater than65 dBA following implementation of the proposed works, warrant review of mitigation. Thisapplied to three NSAs adjacent to the Highway 12 intersection improvements. Following reviewof noise mitigation at the NSAs, it was assessed that implementation of noise barriers would notbe technically feasible.

Construction

There is the potential for noise to result from construction activities. Standard mitigationmeasures will be implemented to keep construction noise impacts to a minimum and arepresented in Exhibit 4-5. The Contractor will be required to keep idling of construction equipmentto a minimum and to maintain equipment in good working order to reduce noise resulting fromconstruction activities.
If complaints regarding construction noise arise during construction, they will be investigatedaccording to the provisions of the MTO Noise Guide (October 2006). The Guide states that anyinitial complaint from the public will require verification by MTO that the general noise controlmeasures agreed to are in effect. If not, the Contract Administrator will apprise the Contractorof any problems, and enforce the contract.
Noise Bylaws
Night-time work is required to minimize impacts to traffic during short-term lane closures and tominimize the duration of construction. Due to the nature of the works, it is anticipated that night-time work will be occasional rather than a planned regular occurrence. Noise bylaw exemptionletters were sent to the City of Orillia and Township of Oro-Medonte, as per their noise by-laws,and approved on February 13 and 15th, 2018. The Township of Severn does not have a noiseby-law in effect.
4. 3 Cultural Environment
4. 3. 1 Built Heritage and Cultural Landscapes
A Built Heritage and Cultural Heritage Landscape Assessment was completed during thePreliminary Design, in accordance with the MTO Environmental Guide for Built Heritage andCultural Heritage Landscapes (February 2007). The assessment included review of the heritagevalue of the property present in the northeast quadrant of the Highway 12 intersectionimprovements. This evaluation is .documented in the Built Heritage and Cultural HeritageLandscape Assessment Report (July 2014).
The Preliminary Design indicated that the built heritage property present in the north eastquadrant of the Highway 12 intersection improvements is not designated under the OntarioHeritage Act or listed on the Municipal Heritage Registers or Inventory Lists. The PreliminaryDesign resulted in minor fringe impacts to the land holding of the property.
The Detail Design has minimized this fringe impact as much as possible. Given the minor natureof the impact and minimal impact on the property's setting it has been determined that theheritage value of the property will be retained.

4. 3.2 Archaeology

A search of the Ontario Archaeological Sites Database (OASDB) of the MTCS indicated thatthere are no archaeological sites within a 1 km radius of the study area. There are nolisted/designated heritage properties within 1 km of the study area. Two previous archaeologicalassessments have been conducted within the study area. In 2013, URS conducted a Stage 1archaeological assessment which encompassed the study area and determined that the studyarea required a Stage 2 archaeological assessment. In 2015, AECOM conducted the Stage 2archaeological assessment of the study area assessed by URS. Permission to Enter (PTE) forthe current study area was not available during AECOM's assessment. It was determined byURS that the study area held archeological potential and required Stage 2 pedestrian surveyand test pitting. WSP conducted the Stage 2 archaeological assessment at the Highway 12intersection on November 9, 2017. No archaeological resources were identified and thereforeno further assessment is required.
Standard mitigation measures are appropriate and will ensure that impacts from the proposedworks to any potential archaeological resources are minimal. Mitigation measures are presentedin Exhibit 4-5.
4. 4 Transportation
4.4. 1 Construction Staging
Traffic construction staging will be implemented to minimize interruptions to traffic flow as muchas possible during construction. Section 3.5 provides an overview of the construction stagingstrategy during construction.
Advance road signage notifying motorists of the construction and detour route will be providedprior to the start of construction and closures.
4. 4. 2 Utilities
Hydro One, Rogers Communications, Bell Canada, and Union Gas will be relocated where theyhave utility infrastructure that will be in conflict with the design
4.4.3 Illumination
New partial illumination will be installed at the intersection and temporary illumination will beprovided during construction.

4.4.4 Emergency Services
Notification will be sent to the Ontario Provincial Police, City of Orillia, Township of Severn,Township of Oro-Medonte and other emergency service providers to advise them of the detailedconstruction staging plan and the timing for construction. Access for Emergency Medical Service(EMS) vehicles will be permitted during construction. Consultation with OPP, City of Orillia,Township of Severn, Township of Oro-Medonte and EMS will be carried out as required toensure minimal impacts during construction.

Vegetation damage and removal will be minimized to the smallest footprint of work needed.The Dry - Fresh Oak -Hardwood Deciduous Forest Type (FOD2-4) located at the south extent of the AtlantisDnve will be protected using protection zone fencing adjacent to road works.Any exposed soils shall be revegetated using an MTO approved seed mu< suitable to the ROW conditions. Seedmixes that complement SAR Monarch habitat species (e. g. milkweed species) are encouraged.Minimize the encroachment of construction activities into the natural vegetation as much as possible.

Monitoring will include the Contractor/Contract Administrator observing, inspecting and ensure proper installationand maintenance of mitigation measures during construction and for a specified period of time following thecompletion of construction.
All trees sought for removal should be removed after the installation of tree protection fencing and beforeconstruction begins.
Trees should be felled into the ROW to avoid damaging other standing vegetation. Trees will be felled away fromany watercourse where it is safe to do so.
Upon completion of the tree removals, all felled trees are to be removed from the site, and all brush chipped. Allbrush, roots and wood debris must be shredded into pieces that are smaller than 25 mm in size to ensure thatany insect pest that could be present within the wood are destroyed. This work must be completed outside of thenesting season.
Tree hoarding fence (i. e. tree protection fence) should be established along the edge of disturbance to preventintrusion and stockpiling of materials into adjacent forest and swamp areas etc.Slopes should be vegetated with deep rooted, suckering plant stock for stabilization and to reduce erosion.
Establish a tree protection zone fTPZ) through the installation of tree protection fencing which follows standardarboricultural procedures (per OPSS 801).Upon receiving the necessary approvals and prior to commencement of tree removals, all trees and areasdesignated for tree protection must be staked or flagged in the field. All trees within the tree protection zone mustbe left standing. The removals are to be completed outside of the migratory bird nesting season, approximatelyend of March to end of August.
Tree protection fencing should be installed and labelled as per details in drawings and specifications around treesand areas designated for preservation. Tree protection fencing should be 1. 2m high paige wire fencing (or asotherwise specified by the City of Orillia) and installed as per details in the Tree Protection Plan fTPP).To avoid root zone impacts on trees to be retained, excavated material will not be stored against or in the treeprotection zone.
In the event that it is necessary to remove additional limbs or portions of trees after construction has commenced,the Consulting Arborist or Contract Administrator is to be informed and the removal is to be executed carefullyand in full accordance with arboricultural techniques, by a certified arborist.Berms and slopes along the transportation corridor will be vegetated with colony forming/suckering and deeprooted plant species to reduce erosion, improve soil stability, increase infiltration and reduce overland flow. Uselow maintenance, salt tolerant, hardy materials (Refer to Appendix A). Organize plantings in large masses topromote dense colony formation and enhance visual quality.
Provide additional landscape plantings using native species to compensate for vegetation removals. Use EdgeProtection/Management at locations where tree removals have exposed remaining trees to wind andenvironmental conditions, which they were not exposed to before removals. Refer to Appendix B for details.

In the event that deeply buried archaeological deposits are discovered in the course of construction, the Ministryof Tourism, Culture and Sport (416-314-1177) should be notified immediately. Should previously undocumentedarchaeological resources be discovered, they may be new archaeological sites and therefore subject to Section48 (1) of the Ontario Heritage Act. The proponent or person discovering the archaeological resources mustcease alteration of the site immediately and engage a licensed consultant archaeologist to carry out adetermination of their nature and significance.
In the event that human remains are encountered during construction, the Cemeteries Regulation Unit of theMinistry of Consumer Service (1-800-889-9768) should be notified. In situations where human remains areassociated with archaeological resources, the Ministry of Tourism, Culture and Sport should also be contactedto ensure that the site is not subject to unlicensed alterations which would be a contravention of the OntarioHeritage Act.

5 MONITORINGThe Contract Administrator will ensure that the environmental protection measures outlined inthis DCR are carried out. If the impacts of construction are different than anticipated, or if themethod of construction is such that there are greater than anticipated impacts, the Contractor'smethods of operation will be changed or modified to reduce those impacts. During construction,the on-site Contract Administrator ensures that implementation of mitigating measures and keydesign features are consistent with the contract and external commitments. In addition, theeffectiveness of the environmental mitigating measures is assessed to ensure that:
> Individual mitigating measures are providing the expected control and/or protection;
> Composite control and/or protection provided by the mitigating measures is adequate,
> Mitigation measures are maintained and any unnecessary repairs are completed quickly;and
> Additional mitigating measures are provided, as required, for any unanticipatedenvironmental problems that may develop during construction.
On-site construction administration staff will ensure that the environmental measures outlined inthe contract documents are carried out. Post-construction monitoring will be carried out asrequired. The Ministry of Transportation (MTO) is commencing a Detail Design and Class Environmental Assessment Studyfor the reconstruction and signalization of the Highway 12 / Fairgrounds Road / Atlantis Drive intersection, inthe Townships ofOro-Medonte, Severn and City ofOrillia, Simcoe County.
This project will follow the approved environmental planning process for Group 'B' projects under the ClassEnvironmental Assessment for Provincial Transportation Facilities (2000). WSP Canada Group Limited has been retainedto complete the detail design and the environmental assessment (EA) stajdy. A Design and Construction Report(DCR) will be prepared to document the recommended design, consultation undertaken, EA process,environmental impacts, and mitigation measures. The DCR will be placed for public review.
A Transportation Environmental Study Report for the Preliminary Design of the overarching Highway 12Improvements, which included recommendations for the reconstruction and signalization of the Highway 12 /Fairgrounds Road / Atlantis Drive intersection, was completed and received environmental assessment approvalin August 2016.
A notice will be delivered to potentially affected residents and businesses within Highway 12 / Fairgrounds Road/ Atlantis Drive study area to inform them directly of study commencement. A copy of the notice is included foryour information.

The Ministry of Transportation (MTO) is commencing a Detail Design and Class EnvironmentalAssessment Study for the reconstruction and signalization of the Highway 12 / Fairgrounds Road /Atlahtis Drive intersection, in the Townships of Oro-Medonte, Severn and City of Orillia. The locationof the intersection is shown on the attached key plan.
This project will follow the approved environmental planning process for Group 'B' projects under the C/assEnvironmental Assessment for ProvjndQl Transportation Facilities (2000). WSP Canada Group Limited hasbeen retained to commence the study and complete the Detail Design. A Design and Construction Reportwill be prepared to record the final design and filed on the public record.
A Transportation Environmental Study Report for the Preliminary Design of the overarching Highway 12Improvements, which included recommendations for the reconstruction and signalization of FairgroundsRoad / Atlantis Drive / Highway 12, was completed and received environmental assessment approval inAugust 2016.
Stage 1 and Stage 2 archaeological assessments were completed for the study area duringPreliminary Design with the exception of a parcel of land to the north-east of the existing intersectiondue to access issues. A Stage 2 archaeological assessment for the parcel of land not assessed willbe completed as part of this Detail Design. The Stage 2 Archaeological Assessment Report will besubmitted to the Ministry of Tourism, Culture and Sport for concurrence, with either arecommendation for further investigations or no further investigations dependent on the outcome ofthe field work / assessment.

The Ministry of Transportation (MTO) is commencing a Detail Design and Class EnvironmentalAssessment Study for the reconstruction and signalization of the Highway 12 / Fairgrounds Road /Atlantis Drive intersection, in the Townships of Oro-Medonte, Severn and City of Orillia. The locationof the intersection is shown on the attached key plan.
This project will follow the approved environmental planning process for Group 'B' projects under the C/assEnvironmental Assessment for Provincial Transportation Facilities (2000). WSP Canada Group Limited hasbeen retained to commence the study and complete the Detail Design. A Design and Construction Reportwill be prepared to record the final design and filed on the public record.

Hi Alastair,
The Bell Canada Mangers for this project will be myself and Carol O'Brien. Both of our contact information isbelow. Bell does have cable, pedestals, manholes and cabinets in this area. Carol and her team will be responsible forany cable and pedestal relocations and I wilt be responsible for any concrete encased structure and manholes in thearea that may be in conflict.
If you can let me us know as soon as possible when you have test pits done and conflict plans available so weknow what we will need to relocate. Our design time and relocation for any of the structure is usually 1.5 to 2 years, sothe sooner you can get the information to us, the sooner we can start on the design.

Thank you for providing the Ministry of Tourism, Culture and Sport (MTCS) with the Notice ofCommencement for your project. MTCS's interest in this Environmental Assessment (EA) project relatesto its mandate of conserving Ontario's cultural heritage, which includes:
. Archaeological resources, including land-based and marine;
. Built heritage resources, including bridges and monuments; and,
. Cultural heritage landscapes.
Under the EA process, the proponent is required to determine a project's potential impact on culturalheritage resources.
Please note that the Standards and Guidelines for Conservation of Provincial Herita e Pro erties (S&G),prepared pursuant to Section 25.2 of the Ontario Heritage Act {OHA), came into effect on July 1, 2010. AllOntario government ministries and public bodies that are prescribed under Ontario Regulation 157/10must comply with the S&Gs. They apply to property that is owned or controlled by the Crown in right ofOntario or by a prescribed public body.
While some cultural heritage resources may have already been formally identified, others may beidentified through screening and evaluation. Aboriginal communities may have knowledge that cancontribute to the identification of cultural heritage resources, and we suggest that any engagement withAboriginal communities includes a discussion about known or potential cultural heritage resources thatare of value to these communities. Municipal hleritage Committees, historical societies and other localheritage organizations may also have knowledge that contributes to the identification of cultural heritageresources.
Archaeological ResourcesYour EA project may impact archaeological resources and you should screen the project with theMTCS Criteria for Evaluatin Archaeolo ical Potential to determine if an archaeological assessment isneeded. MTCS archaeological sites data are available at archaeolo ontario. ca. If your EA project areaexhibits archaeological potential, then an archaeological assessment (AA) should be undertaken by anarchaeologist licenced under the OHA, who is responsible for submitting the report directly to MTCS forreview.
Built Heritage and Cultural Heritage LandscapesThe MTCS Criteria for Evaluatin Potential for Built Herita e Resources and Cultural Herita eLandsca es should be completed to help determine whether your EA project may impact cultural heritageresources. The Clerk/s for the municipalities encompassing the EA project can provide information onproperty registered or designated under the Ontario Heritage Act. Municipal Heritage Planners can alsoprovide information that will assist you in completing the checklist
A Cultural Heritage Evaluation Report (CHER) is used to determine the cultural heritage value or interestof a potential Provincial Heritage Property. If potential or known heritage resources exist, MTCSrecommends that a Heritage Impact Assessment (HIA), prepared by a qualified consultant, should becompleted to assess potential project impacts. Our Ministry's Info Sheet #5: Herita e Im actAssessments and Conservation Plans outlines the scope of HIAs. Please send the HIA to MTCS and thelocal municipality as appropriate for review, and make it available to local organizations or individuals whohave expressed interest in review.
Environmental Assessment ReportingAll technical heritage studies and their recommendations are to be addressed and incorporated into EAprojects. Please advise MTCS whether any technical heritage studies will be completed for your EAproject, and provide them to MTCS before issuing a Notice of Completion. If your screening has identifiedno known or potential cultural heritage resources, or no impacts to these resources, please include thecompleted checklists and supporting documentation in the EA report or file.

If human remains are encountered, all activities must cease immediately and the local police as well as the Cemeteries RegulationUnit of the Ministry of Government and Consumer Services must be contacted. In situations where human remains are associatedwith archaeological resources, MTCS should also be notified to ensure that the site is not subject to unlicensed alterations whichwould be a contravention of the Ontario Heritage Act.

1.0 INTRODUCTION OF MINISTRY, MUNICIPALITIES AND CONSULTANT TEAMS
1. 1 All attendees introduced themselves and their area of expertise on the Project Team.
2.0 PROJECT OVERVIEW- WSP provided an overview of the Project background and noted the following:- Highway 12 / Fairgrounds intersection will be reconstructed including the realignment of
Fairgrounds Road and Atlantis Drive, installation of traffic signals and widening of Highway12 in the vicinity of the intersection.
- The Environmental Assessment study for Highway 12 from Memorial Avenue in the City ofOrillia to Horseshoe Valley Road in the Townships of Severn and Oro-Medonte wascompleted in 2016.
- MTO is finalizing the PDR, however the highway section applicable to this project is notaffected by outstanding PDR comments.The Environmental Assessment study at the west end of the project was completed in 2003.
- The MTO project is programmed for 2018 construction with detail design to be completedearly 2018.MTO noted the legal survey field work and property acquisition is underway.MTO also noted that given the targeted construction start of 2018, the design and pre-construction activities (property acquisition and utility relocation) timelines are very tight.There is a significant amount of utilities, including bell, hydro and gas, at this intersection.The extent of utility relocations (if required), is yet to be determined.
- City ofOriUia noted the tendering of the contract at the east end of the MTO project isscheduled for January 2018 and construction scheduled for April 2018.
- City of Orillia/WSP to review and confirm the limit of construction for the City ofOrillia/MTO contract.
3.0 TOWNSHIP ROAD STANDARDS / TyPICAL CROSS SECTIONS.- Township of Oro-Medonte and Township of Severn noted to refer to the design standards
on the township website.
4.0 PEDESTRIAN SIGNALS, SIDEWALKS- WSP noted the preliminary design does not include sidewalks; however, an AODA
compliant pedestrian crossing will be provided as part of the project,- MTO noted that if the municipalities are interested in sidewalks, they can be provided at
the respective municipality's cost; although provisions of sidewalks as part of this projectwill only be possible if no additional property is required or an amicable property purchaseis possible (additional property costs for sidewalk would also be at the municipalities cost)
- City of Orillia noted only pedestrian signals are required as the bicycle trail will notcontinue west of Murphy Road intersection.
- City of Orillia requested tactile plates at sidewalk ramps.5.0 CONSTRUCTION WITHIN MUNICIPAL RIGHT-OF-WAY
Township of Oro-Medonte noted the Contractor requires a Road Occupancy Permit.Township of Oro-Medonte noted Atlantis Drive is owned by Oro-Medonte and maintainedbyCityofOrillia.
- Township of Oro-Medonte noted the realigned Atlantis Drive on the existing schoolproperty will be maintained by MTO until a transfer is completed. MTO noted that they WSP/MTOwould be responsible for the road condition and lifecycle maintenance while the newAtlantis Drive alignment is owned by MTO, but would like the municipalities to continue toprovide the seasonal maintenance including snow plowing (since Orillia currentlymaintains this road, Orillia would continue to provide seasonal maintenance.)
- Township of Severn noted they don't have a Road Occupancy Permit but they would beagreeable to a Permission to Enter and Construct or a legal agreement for roadconstruction activity within their right-of-way. WSP will provide the Permission to Enterform for the completion of field investigations.

MATTERS ARISING ACTION
1.0 INTRODUCTION / PROJECT OVERVIEWAll attendees introduced themselves and their area of expertise.
- WSP provided an overview of the project and noted Highway 12 / Fairgrounds Roadintersection will be reconstructed including the realignment of Fairgrounds Road andAtlantis Drive, installation of traffic signals and widening of Highway 12 in the vicinity ofthe intersection.
MTO noted the property request is awaiting signatures to start legal survey, appraisals andproperty acquisition.
2.0 PROJECT SCHEDULE- The project is programmed for 2018 late summer construction with detail design to be
completed early 2018. The project is expected to be tendered in April 2018.
3.0 UTILITY IMPACTS/ REQUIREMENTSHydro One:
- Hydro One noted the east end of the project will be under Orillia Power.Post Meeting Note: WSP confirmed the east end of the project is within Township of Severn and Oro-Medonte limits and Orillia Power poles are not within the project limit.
- Hydro One noted the timeline to complete the relocation work depends on the number ofpoles to be moved. For a Class C estimate, it takes approximately two weeks.
- Hydro indicated the maximum span between the poles is 90m.MTO noted no poles can be placed in the fore slope.
- WSP will provide a utility conflict plan to Hydro One to prepare a relocation plan, scheduleand cost estimate. Hydro prefers the grading plan to be included for reference.Rogers:
- Roger noted their design will be based on the Hydro One pole locations.- Roger noted usually their underground fibre cable is in 50 mm or 100 mm duct.- Rogers noted the cable is underground along Fairgrounds Road.
Post Meeting Note: MTO provided a plan showing the underground Rogers plant crossing Highway 12and continuing along the west side of Fairgrounds Road on August 24, 2017.Union Gas:
Union Gas noted they have a 4 inch high pressure steel pipeline along Highway 12 and a 3inch pipeline along Fairgrounds Road.
- Union Gas noted they have a pressure drop valve near the Toyota car dealership onHighway 12 and various gas crossings along Highway 12.Post Meeting Note: WSP added the additional gas pipeline crossings of Highway 12.Bell Canada:
- Bell noted they have 2 major cabinets and two manholes near the intersection.Bell noted their cables are in a 9 duct concrete structure along the north side of Highway12.
Bell to confirm if the underground Bell structure is abandoned along the centerline at theeast end of the project.Bell noted their design period is approximately 3-4 months for the 9 duct cable stmctureand constmction duration for civil work is approximately 6 months.
4.0 UTIUTY LOCATES / TEST PITSMTO noted to circulate the test pit plans to utilities prior to conducting test pits. WSPMTO noted to avoid asphalt locations for test pits if possible.
- MTO suggested WSP to confirm if the grading limit falls within the existing right-of-way asHydro One can start relocating before property acquisition is complete.
- Rogers noted their cables are approximately 1m deep.Union Gas noted their pipelines are typically 3-4 ft deep.Union Gas requested their representative to be on site during the test pit excavations for

pits but would like to receive the results.
