    Who Regulates, Monitors Photo Radar Companies inArizona/

    Almost every economic transaction I make to obtain goods andservices involves regulators. In Arizona, The Arizona Department ofWeights and Measures monitors various scales to measure quantitiesof commodities bought and sold in the state. They have jurisdiction

    over scales measuring weight, volume etc utilized by businessesthroughout the state. Government agencies monitor restaurants,preschools, manufacturing, food safety, licensing for variousprofessionals etc. I cannot count on the fingers of one hand, legalbusinesses or professionals who are not regulated or licensed by oneof these agencies.

    Yet despite hours of talking to city, state, or Federal officials includingthe officer prosecuting me in my trial, none had any idea what agencymonitors or regulates the photo radar cameras. In the transcript ofthe Court Record on page 3 paragraph 7 at about 5 minutes (Exhibit1A) the police officer admits a document into the record showing howthe camera checks itself to see that it is accurate. The document wasfrom American Traffic Solutions. In the transcript of the court recordon page 7 paragraphs 3-6 about at the 17 minute mark (Exhibit 1A)when I question the officer about relying on the Camera company totell the truth he flatly states that the court accepts there data as true.

    To understand the illogical absurdity of the stance of the court

    consider this theoretical occurrence that is very similar to what hashappened to me. While I am taking out the trash a man serves mewith a paper demanding that I pay $330 dollars to a clown who claimsthat his hair dryer sitting above a street light on Oracle and RiverRoad recorded me driving my car into an intersection after the lighthad turned red. I am given the option of paying the clown $330

    dollars, contesting the charge in court, or if I refuse to pay, the clownwill take my car away.

    I spend hours trying to find out who this clown is and who regulateshis business but no one can tell me. Finally someone gives me hisnumber so I ask him, who regulates his hair dryers in terms of theiraccuracy reliability and who monitors his hair dryer camera business.He proclaims what I ask is proprietary and I must get a courtsubpoena to obtain that data. I dont know how to do and am told it iscomplicated to do so I decide I will contest the clown in court.

    I show up in court and the clown with one of his hair dryers shows upwith a green hair and a large red nose. He shows me the video of medriving into the intersection after the light turned red and proclaimsme guilty. I ask him for information about the accuracy and reliabilityof his dryer, the timings on his traffic light and attempt to investigatehis character. Again he refused to answer any of my questions in thisregard. I present evidence that his hair dryer cameras are not asreliable as it seems. I also show the court that no person or agencyhas independently verified the accuracy or reliability of his cameras orlights. Yet, the court throws out most of my evidence, because thecourt has decided that the clown s evidence of my guilt is accuratebecause the clown told the court that his evidence is accurate.Despite the fact that no independent party has checked that theclowns evidence is accurate but the court for some reason hasdecided that it is accurate

    I plead with the court to allow me to examine the character of myaccuser but the court explains to me that I do not have this rightbecause I am not being accused of a criminal offence. In this case Ican be deprived of property because I was caught traveling into theintersection after the light was red. It doesnt matter if the clownshorted the yellow light making it difficult for me to stop in time. Itdoes not matter if his cameras or the lights are faulty. I have no rightto question his evidence. I am guilty because his evidence proves Iam guilty.

    On the next pages are all the Federal City and local agencies I calledto determine, what local, state or Federal agencies monitor andcertify the accuracy of the photo radar ticket companies I found none!

    Who Regulates and Certifies PhotoEnforcement Camera Equipment?

    Questions for Police Traffic Control

    I called Police Traffic Control in Tucson on Monday 8/19/13 and asked

    Do you regulate and maintain red light cameras? The officer said, Nocheck with American Traffic Solutions. I talked with an ATSrepresentative on Wednesday August 28 th 2013 and he told me that he wouldonly release company records if I obtain a court subpoena. See Exhibit 3

    page 2.

    I contacted the people below on Monday September 30 th 2013.

    I contacted Denise Prather at NIST in Maryland a Federalgovernment regulatory agency, at 301-975-4004 and askedwho regulates and certifies the red light camera companiesfor their accuracy? Who regulates and certifies theaccuracy of stop watches? She referred me to John Lomax

    John Lomax 303-497-3842 10:53 He works for NIST inBoulder CO. The Federal agencies to not regulate orcalibrate weights and measures. Each state has adepartment that regulates businesses in their state. For AZit is http://www.azdwm.gov/

    I called Marquez Shawn 1:15 and asked him the same question.He said the Arizona Department of Weights and Measures doesnot regulate the calibration on the photo enforcement cameras.He did not know who did.

    I called the Director of Arizona Weights and Measures and talkedto Jazmin at 1:20. She gave me the same answer and transferredme a ADOT.

    Rusty at ADOT at 1:25 He responded, I have no idea and told meto contact Tucson Streets Department under the Tucson CityDepartment of Transportation.

    Paul Burtons secretary at Tucson Streets Department 791-43711:32 p.m. She transferred me to Paul Burtons voice mail where Istated my 2 questions. Who regulates and certifies the photoradar camera companies monitoring the accuracy of theircameras? Paul Burton never responded to my voice mail. PaulBurton was one of the city officials I sent a letter to on August 20 th asking these questions among others. He sent my letter on toMichael Hicks of the Traffic Engineering Division of the City ofTucson Department of Transportation. Michael Hicks told me inlate August, he did not know who regulates or certifies theequipment for the traffic cameras. He told me to check with the

    Tucson Police Department. The officers at the Tucson Trafficpolice told me to contact American Traffic Solutions on August19, 2013. That is my first entry for this exhibit. American Trafficsolutions told me they would only provide this information with acourt subpoena as can be seen on page 2 in Exhibit 3. This pagecontains the notes from my phone conversation with the officialfrom American Traffic Solutions.
