Looking at the global countries, theenergetic workforce is also the determiningfactor in differences in their growth apartfrom possession of natural resources andtechnological power. Our nation already hasnatural resources and national integrity andonly needs to equip with a sense of duty to beable to keep abreast of internationalcommunity.

Generally, almost every one does not eventhink about what his responsibility is. Onlywhen one knows well what his duty is, dutifulcan be he. For a person who does not knowwhat responsibility he shoulders, to performhis duty is highly unlikely. One should exert theequal amount of efforts for what he is paideven if he is not willing to do more than he ispaid for.

Whoever assigns the duty, once it is takenwith own commitment, it become yours. Andcompleting that duty means adding spiritualvalues to your soul. One who is imbued with asense of duty will all the way try to complete hisduty once assigned.

Having a sense of duty is maintaining owndignity rather than showing respect for others.Neglect of duty, demands for benefits,bureaucratic attitude and parasitic-to-powerattitude are acts of undutiful persons. Thosewho have a strong sense of duty try to bedutiful as best as they can with innovativemind. Persons with a sense of duty and habit ofassuming responsibility are urgently in need inlarge numbers in establishing a new nation.

ORLANDO, 16 Nov—Give people free prescriptiondrugs and many of them still won’t bother to taketheir medicine. Doctors were stunned to see thathappen in a major study involving heart attacksurvivors. The patients were offered well-establisheddrugs to prevent a recurrence of heart trouble,including cholesterol-lowering statins andmedicines that slow the heart and help it pumpmore effectively.

“My God, we gave these people the medicinesfor free and only half took it,” said one of thestudy’s authors, Dr Elliott Antman of Harvard-affiliated Brigham and Women’s Hospital in Boston.

In fact, the researchers couldn’t even give thestuff away: They had trouble just signing up patientsto take part in the study. Nevertheless, Aetna, theinsurance company that footed the bill, thinks thisapproach will save money in the long run and plansto start offering certain heart drugs free to somepatients. In the study, patients offered medicines atno cost suffered fewer heart problems and saved$500 on average over roughly a year. It is no secretmany Americans don’t follow their doctors’

Fannie, Freddie cut lenders’risk in refinance programme

WASHINGTON, 16 Nov—Fannie Mae and FreddieMac , the largest sources of US housing finance,both said on Tuesday they would relieve lendersfrom certain risks associated with refinanced loansin an effort to help a government programme reachmore distressed homeowners.

In new guidelines for the Home AffordableRefinance Programme, both companies saidseparately they are relieving lenders of certainrepresentations and warranties that are related tothe value and condition of mortgaged property.

HARP seeks to provide refinancing options forborrowers who have little or no equity in theirhomes. It is open only to loans sold to Fannie andFreddie.

The changes are designed to encourage lendersto participate by reducing their potential liabilityfor bad loans.

The Obama administration programme aims tohelp troubled borrowers get new loans at lowerrates. So far, it has helped about 894,000 borrowers,far fewer than the White House had hoped.

Fannie Mae, in its revised HARP guidelines,said, “The lender is not responsible for any of therepresentations and warranties associated with theoriginal loan.”

Freddie Mac said the changes in its policiesregarding representation and warranties is mainlyfor mortgages valued at more than 80 percent of aproperty’s worth.—Reuters

NASA hiring astronauts online — but where’s the rocket?WASHINGTON, 16 Nov— Looking for a job?

NASA is hiring astronauts. You can even applyonline at a giant government jobs website.

There’s only one hitch: NASA doesn’t have itsown spaceship anymore and is sending fewer fliersinto orbit right now.

“The experience is well worth the wait,”promised NASA flight crew operations directorJanet Kavandi as the space agency started a publicsearch Tuesday for new astronauts.

There will be flights, but not many, with thespace shuttle fleet retired. A handful of astronautseach year are launching on a Russian Soyuzspaceship to the International Space Station for six-month stays.

NASA needs about 55 astronauts, and with anew class of nine graduating earlier this month, theastronaut roster is up to 58. One of those newastronauts will get to fly to the space station as earlyas 2013, Kavandi said.

Disturbing images spread on Facebook due tospam attack

SAN FRANCISCO, 16 Nov—Disturbing graphiccontents like pornographic pictures and mutilatesanimal images are spreading across Facebook onTuesday in a likely widespread spam attack.

Technology news site ZDNet, first to report theattack, said that it started a few days ago and hasbecome an out-of-control exploit that has usersangry and disgusted.

The report said that the material is being spreadvia a “ linkspam virus” which appears to be aninnocuous story link. Once clicked, the user’snewsfeeds will be turned into unstoppable torrentsof pornographic and violent images.

SAN FRANCISCO, 16 Nov—Microsoft chief SteveBallmer proclaimed an everlasting “Windows Era”as the software giant’s board easily won re-electionat an annual meeting of shareholders on Tuesday.

Ballmer along with Microsoft co-founder BillGates, Netflix co-founder Reed Hastings and sixothers saw their positions on the Microsoft boardsecured with more than 92 percent of votes cast byinvestors. The departmentsare also to abide by the law and acceptinspection of Electrical Inspector.Therefore, the Electricity Law shouldbe amended and added.

The Industrial Supervision andInspection Department under theMinistry of Industry-1 has drawn thebill for amending the law. Therefore,Ministry of Industry-1, Ministry ofIndustry-2 and Ministry of ElectricPower No. 2 are to make concertedefforts for emergence of the improvedElectricity Law as soon as possible. Inaddition to the Ministry of Industry-1that compiled the law, the PyithuHluttaw should coordinate theemergence of amended ElectricityLaw and other laws by forming theone committee.

U Win Oo of Yebyu Constituencysaid that efforts are being made forconstruction of small-scalehydropower projects to generate 500kilowatts to be supplied to villages ofDawei District under the ruralelectricity supply and povertyalleviation. Although the Unionministries allowed region and stategovernments to undertake small-scaleelectricity generating tasks, thesegovernments delay to issue permitsdue to lack of separate laws.

Thus, it is not enough to allowprivate entrepreneurs for doingbusiness on electricity supply and salesunder the MIC Law. Therefore, No 1and No 2 Electric Power Ministriesare to jointly draw the separatethorough electricity law and theHluttaw should approve it.

With regard to the proposal, UnionMinister for Electric Power No. 2 UKhin Maung Soe said that the ministrywas extended with the aim of effectivelytaking responsibility of generating,feeding and supply of electricity to beable to rapidly supply electricitydemand in development task of theState.

In the past, the Electricity Act waspromulgated in 1910 for electricitysupply tasks of Myanmar, and 1948Electricity Act was enacted in 1948for formation of an electricity supplyboard of Myanmar. Under theinstruction of the Ministry of Industry,the Electrical Inspector drew anelectricity law in 1974. The ElectricityLaw was approved as law No. 7 ofPyithu Hluttaw in 1984. Moreover,the Ministry of Industry-1 under theagreement of the Cabinet issued the

Rules of Electricity Law 1985 basedon Electricity Rules 1937 of India.

Due to submission of the Ministryof Energy in 1990, the State Law andOrder Restoration Councilpromulgated the law amending theSections 30 and 31 of the ElectricityLaw as its law No. 3/90. In 2005, theYangon Electricity Supply Board wasformed for effective undertakingelectricity task in the area of YESBand then the Yangon Electricity SupplyBoard Law.

In 1984-85 when the MyanmarElectricity Law was being drawn, therewere one hydropower plant, six gaspower plants, 19 main power stationsand 1193.81 miles of national grids in

Myanmar electricity system. Atpresent, Myanmar has 17 hydropowerplants, 10 gas power plants, one coal-fired power plant, 154 main powerstations and 5756.51 miles long powergrids.

In the time of the State Peace andDevelopment Council, the PrimeMinister instructed the ElectricalInspector under Ministry of Industry-1 to be assigned under Ministry ofElectric Power No. 2 as the ministryconcerned should inspect electricalmatters. Moreover, the Office of thePrime Minister informed that theMinistry of Electric Power No. 2should take responsibility for realizingthe rules of Electricity Law inconformity with the current periodand Ministry of Industry-1 andMinistry of Industry-2 are tocoordinate with the EP-2 Ministry ifnecessary. Therefore, three ministriesheld many meetings.

In the time of the government ofthe Republic of the Union of Myanmar,instructions have been issued that if itis necessary to amend, add, revokeand redraw the laws inappropriate withthe current period, ideas of the UnionAttorney-General’s Office are to besought. Under the leadership of theMinistry of Industry that drew theElectricity Law in 1984, the workcoordination meeting was held on 9August, attended by officials ofMinistry of Electric Power No. 1, No.2, other ministries and the UnionAttorney-General’s office in additionto Myanmar Engineering Society andMyanmar Construction EntrepreneursAssociation and electricians.

The provision in the ElectricityLaw 1984 said that “it must beconcerned with exploration,

generating, feeding, supplying andconsumption of electricity across thenation and with electrical inspectionsto be free from danger of electricityfor above mentioned tasks.” TheElectrical Inspector under the Ministryof Industry-1 is running its functionsto be free from danger of electricityunder law and procedures. However,the law did not prescribe control ofelectric power system in conformitywith power plants, power station,control of national grids, generatingpower and consumption, generatingelectricity for supplying the demandof increasing power consumption,feeding of power, and drawing ofelectricity supply plan for extended

supply of electricity.Sub-paragraph (a) under

paragraph 4 energy, electricity,mining and forest sector underSchedule 2 of the region or statelegislative list in accord with theSection 189 of the Constitution saidthat “except the heavy electricityproduction and supply to be managedby the Union, the region or state thatdo not connect with national grid mayrun the small- and medium-scaleelectricity generating and supply.”Therefore, it is necessary to draw theplans of electricity supply to beundertaken by regions and states inline with the Electricity Law.

The existing law does not compriseprovisions on supply of electricity inrural areas. Therefore, he said he hasreplied to promulgating the law forsupply of electricity in rural areas.Now, entrepreneurs and foreignershave been allowed to invest inelectrical sector of the State. Therefore,electricity from Shweli-1 and Tarpein-1 power plants is being sold at homefor domestic consumption and to thePeople’s Republic of China. Thus, itis necessary to prescribe clear andexact provisions for local and foreignelectricity sales. Moreover,Thaukyaykhat-2 and UpperBiluchaung Power Plant are beingimplemented with the investments ofentrepreneurs. There should besuitable laws for purchase of electricityfrom the power plants through powersystem as well as direct sales forconsumers.

As it is important that type ofelectricity (volt, frequency and circuit)must be in conformity with electricitydemand of consumers, powerconsumers are playing an important

role in the electrical sector.The government commenced to

draw the new Electricity Law for allministries, private entrepreneurs andpower consumers included in theelectricity generating, feedingsupplying, consuming, controllingpower system, selling electricity anddrawing power system plans.

As ministries concernedcommenced the tasks related to theproposal of U Kyi Tha, the proposalwill be put on record. The Hluttawapproved that the Hluttaw will providenecessary assistance for the task.

Member of the Bill Committee USoe Soe submitted the report of thecommittee concerning the Vacant,Fallow and Virgin Land ManagementBill approved by the AmyothaHluttaw.

He said that in reviewing theVacant, Fallow and Virgin LandManagement Bill, the Pyithu HluttawBill Committee found that AmyothaHluttaw has approved the bill with 15points in 34 paragraphs in 10 chapters.Depending on 12 points ofscrutinizing the bills and amendmentsof the Amyotha Hluttaw, the PyithuHluttaw Bill Committee will submitthe findings in line with Pyithu HluttawRule-44. The original provision ofparagraph 2 (b) in Chapter I said that“the Ministry means Ministry ofAgriculture and Irrigation of the Uniongovernment”, so the amendment ofAmyotha Hluttaw was perfect.

The ordinary provision inparagraph 2 (f) in Chapter I said that“the virgin land means new land andfallow land regardless of forests,bamboo grooves, bushes, smooth ornot geographical conditions. The wordincludes pasture lands, lake and landsof forest reserve officially cancelledfor carrying out agriculture andlivestock breeding tasks.” AmyothaHluttaw amended it as “the virginland means new land and fallow landregardless of forests, bamboo grooves,

The original provision in paragraph 2 (h) in ChapterI said that “the land tax means the money for tax to be paidto the State by the person with right of doing business onvacant, fallow and virgin lands in line with the law.” Theamendment of the Amyotha Hluttaw said that “the landtax means the money for tax to be paid to the State by theperson with right of doing respective businesses onvacant, fallow and virgin lands in line with the rules of thislaw.” Therefore, it was found that the amendment ofAmyotha Hluttaw was more perfect.

The paragraph 3 of Chapter II said that “the Presidentshall constitute the Vacant, Fallow and Virgin LandsManagement Central Committee with the Union Ministerfor Agriculture and Irrigation as Chairman, the director-general of Settlement and Land Records Department assecretary and suitable persons of ministries concerned asmembers with the aim of effectively managing the tasksconcerning the agriculture and livestock breeding on acommercial scale with the use of vacant, fallow and virginlands for development of the State economy.” TheAmyotha Hluttaw approved that “with the aim ofeffectively managing the tasks in line with the lawsallowed by the government for agriculture, livestockbreeding and mining tasks on a commercial scale, theVacant, Fallow and Virgin Lands Management CentralCommittee must be formed as follows:-(1) Union Minister Chairman

The original text of paragraph (10), subparagraph (a)of Chapter (4) is “In Sub-section (4), rural farmers andthose who want to run manageable farm shall be allowedto use not more than 10 acres of vacant land, fallow landand virgin land.” The amendment of Amyotha Hluttaw is“It shall make arrangement to allow rural farmers andthose who want to run manageable farm shall to use notmore than 10 acres of vacant land, fallow land and virginland by any local authority concerned.” As it is found thatthe permitted land for rural farmers should be 50 acres,the subparagraph should be “It shall make arrangement toallow rural farmers and those who want to run manageablefarm shall to use not more than 50 acres of vacant land,fallow land and virgin land by any local authorityconcerned.”

As fixed duration mayimpact on those who obtain the permit, it should be drawnas Rule. The original text, “The implementation will haveto be finished as designed within designated period”, ismore appropriate.

The original text in paragraph (16), subparagraph (e)of Chapter (6) is “It is required to adhere to regulationsissued by the central committee regarding the use ofvacant land, fallow land and virgin land at any time”. Theamendment of Amyotha Hluttaw is “It is required toadhere to regulations issued by the central committeeregarding the use of vacant land, fallow land and virginland”. The phrase “at any time” bares intended meaningand enables the central committee to issue orders anddirectives at any time. The subparagraph should be keptas in the original.

The original text in paragraph (17) of Chapter (7) is

“The central committee will have to form and task supportinggroups and separate groups for management of vacant land,fallow land and virgin land in respective Regions or Statesto review and coordinate cases regarding the use of vacantland, fallow land and virgin land”. The amendment ofAmyotha Hluttaw is “The central committee will have toform and task working groups and separate groups formanagement of vacant land, fallow land and virgin land inrespective Regions or States to review and coordinate casesregarding the use of vacant land, fallow land and virginland”. The phrase in amendment of Amyotha Hluttaw“working groups and separate groups” is more appropriate.

The amendments of Amyotha Hluttaw to paragraph(18) of Chapter (7) “The central committee shall formspecial group inclusive of respective departments to vetwhether those who obtain permit for the use of vacantland, fallow land and virgin land manage the land inaccord with designated rules”, to paragraph (19) “Thecentral committee shall reoccupy the least area of landfrom the permitted vacant land, fallow land and virginland if a situation arises”, and to paragraph (22),subparagraph (c) “Vacant land, fallow land and virginland which are not reclaimed till the end of the permittedperiod are deemed to be reoccupied by the State” are morecomplete than the original ones. The amendments ofAmyotha Hluttaw should be approved.

Regarding the amendment of Amyotha Hluttaw toparagraph (25), subparagraph (b) of Chapter (8) “Thecentral committee (a) shall coordinate with departmentsand organizations concerned for protecting againstdisturbance, invasion and encroachment on the vacantland, fallow land and virgin land, (b) coordinate in accordwith the law with local small entrepreneurs engaging infamily trade on permitted vacant and virgin lands not tosuffer loss”, the phrase “coordinate in accord with the lawwith” should be replaced with “designate appropriatecompensation at current price for”.

The original text in paragraph (30) of Chapter (10) is“Offences in Sections 27, 28 and 29 are cognizableoffences”. The amendment of Amyotha Hluttaw is“Offences in Chapter (9) are cognizable offences”. Theamendment of Amyotha Hluttaw should be approved.

Vacant Land, Fallow Land and Virgin LandManagement Bill would be sent back to Amyotha Hluttawwith amendments.

The discussion date would be announced and Hluttawrepresentatives who want to participate in discussion wereto submit their request not later than 18 November noon.

(2) The commission shall invite responsiblepersons of related organizations and discusswith them.

(3) The commission members could freelymake discussions if not contrary toprovisions in the Constitution of theRepublic of the Union of Myanmar andPyithu Hluttaw Laws.

(4) Behaviours and words of a member in thecommission meeting are not to bepublicized. The commission will have toapprove the meeting record with detaileddiscussions. The records shall not bedistributed. Copy of the report of theHluttaw will have to be sent to the HluttawOffice to file as a case.

(5) The commission meeting could be convenedas and when necessary and the meeting isvalid if half of the members attend it.

Rights and opportunities of the commission(1) The commission members shall enjoy

allowances of Hluttaw representatives inaddition to rights designated by the Hluttawwhen they are in the commission-basedregion to perform the duty of thecommission and to attend commissionmeeting and whey they are traveling onduty.

(2) The commission members are immunefrom other laws regarding discussions incommission meetings apart from PyithuHluttaw Law.

The commission is Union-level institution inaccord with Sub-section (h) of Section (2) of PyithuHluttaw Law and its term is not more than one year.

The Pyithu Hluttaw Speaker explained that the

commission has done its functions about five monthsago. In so doing, occasionally encountering with irregularcases such as legal affairs, political and internationalaffairs, economic and social affairs is very likely. Withregard to legal affairs, it has been tried to include retiredpersonnel and currently discharging personnel fromjudicial departments, personnel discharging at and retiredfrom the Attorney-General Office of the Union andcourts at different levels, advocates and lawyers, andinstructors giving lectures on law in the commission.Likewise, ambassadors, directors-general, and officialsfrom the Ministry of Foreign Affairs Ministry who haveexperience in political and international affairs areassigned to the commission to be able to deal withpolitical and international affairs.

So, the commission thanks to its comprehensiveorganizational structure can contribute greatly inanalyzing special cases which emerge occasionally.Hluttaws are mainly promoting the interests of thenation and the public. The commission was formed withselected members for it is assumed that the commissionmembers can contribute to not only the Hluttaw but alsothe national and public interests with their knowledge,experience and goodwill.

In seeking the approval of the Hluttaw with regardto the Environmental Conservation Bill, U Htay Myintof Myeik Constituency discussed that according to theconstitution, the main responsibility of the Hluttaws isdrafting bills. Amending bills at the Hluttaw includesprocess of submitting and approving of newly-draftedbills and amending and assessing the existing laws. Itneeds to take time to enact a new law making least errors.

Then amended paragraphs and sub-paragraphs ofthe bill are discussed and sought approval of the Hluttaw.Dr Sai Kyaw Ohn of Namkham Constituency madeamendment to Sub-paragraph (e) of Paragraph-2 of thebill and Union Minister for Environmental Conservationand Forestry U Win Tun replied that he had no remarksas the amendment made no difference in meaning.

As no representative raised objection to theamendment, it is passed. Member of the Bill CommitteeU Thein Tun Oo proposed that the Sub-paragraph (f) ofParagraph-2 should be left unchanged as first proposedby the ministry explain that the changing may lead tomisunderstanding and Union Minister U Win Tun repliedthat he seconded the proposal. All representatives showedsupport for the proposal and it was approved.

Again, Dr Sai Ohn Kyaw of Namkham Constituency

proposed that Sub-paragraph (p) of Paragraph-2 shouldbe left unchanged as proposed by the ministry sayingthat the amendment of Amyotha Hluttaw is unnecessaryand Union Minister U Win Tun approved the proposal.The proposal was then approved as no representativesrejected it.

U Thein Lwin of Chauk Constituency proposed toadd a sub-paragraph under Paragraph-3 and UnionMinister U Win Tun replied that the proposal is a goodsuggestion but it would be more appropriate to beincluded in by-laws. The proposal was approved by theHluttaw as no representatives turned it down.

U Thein Lwin of Chauk Constituency again proposedto amendment to Sub-paragraph (e) of Paragraph-3 andUnion Minister U Win Tun replied that the proposal isacceptable and the Hluttaw approved the proposal.

U Khin Maung Shwe of the Bill Committee madeamendment to Sub-paragraph (a) of Paragraph-4 andUnion Minister U Win Tun replied that he had no reasonto reject the proposal as it has certain relation.

U Khaing Maung Yi of Ahlon Constituency proposedto amend the same paragraph and Union Minister U WinTun said that the committee is formed representing theincumbent government and he is willing to accept ifHluttaw thinks the amendment is necessary and he hasno reason to reject as the amendment will be morecomprehensive.

U Thein Swe of An Constituency proposed thatthose amendments could be included in the by-laws andU Htay Myint of Myeik Constituency, U Htay Oo ofHinthada Constituency and U Soe Tha of TwantayConstituency seconded his proposal.

The Pyithu Hluttaw Speaker said that it needs toinclude chapters and paragraphs that can promote of theinterests of the nation and the people and that have notyet been included in the bill. Pyithu Hluttaw had a wishto supplement necessary paragraphs in coordinationwith related ministries and there are chances to write andsubmit new paragraphs that should be included in thebill. Proposals of amendment are to be send by 12 noon20 November and date for discussion will be fixed later.He urged Hluttaw representatives to take necessarymeasures in discussing the bill again.

The fourth day second regular session of FirstPyidaungsu Hluttaw will be held on 18 November.

In Paragraph 2 of Chapter (1) of the Bill Committee,

Paragraph (h) “guardian is defined as one who wasvested with authority to keep under-age person or lunaticor their possessions by authoritative court.” As Hluttawapproved above-mentioned amendment, Paragraph 2(h) of Chapter (1) shall be part of this bill.

U Khin Maung Yi of Ayeyawady RegionConstituency No. 6 submitted Paragraph 2 (k) of Chapter(1) “peasant organization is the one that is formed to helprural development in conformity with law.” As Hluttawapproved above-mentioned amendment, Paragraph 2(k) of Chapter (1) shall be part of this bill.

In Paragraph 3 of Chapter (2) of the Bill Committee,“household or person or organization that acts withincompetence of following rules will be vested withauthority. (b) head of household or a member or guardianmust be one who runs family trade in conformity withexisting farming laws before enacting this law. AsHluttaw approved above-mentioned amendment,Paragraph 3 (b) of Chapter (2) shall be part of this bill.

As Hluttaw approved the proposal submitted by USai Thant Zin of Shan State Constituency No. 4 toreplace the phrase “rights relating to using land” with thephrase “rights relating to permitted farms”, the headingof Chapter (3) shall be part of this bill.As Hluttaw approved the phrase prescribed in Paragraph4 (a) of Chapter (3) that “right to have such land in handand gain benefit of such farm”, Paragraph 4 (a) ofChapter (3) shall be part of this bill.

As Hluttaw approved the phrase prescribed inParagraph 7 (e) of Chapter (4) that “it is needed to

In Paragraph 12 (a) of Chapter (5) of the BillCommittee, it is stated that “central farm managementorganization is to be formed with the Union Minister forAgriculture and Irrigation appointed as chairman, thedeputy minister for Agriculture and Irrigation as vice-chairman, director-general of Settlement and LandRecords Department as secretary, and departmentalofficials concerned as members”. As Hluttaw approvedabove-mentioned amendment, Paragraph 12 (a) ofChapter (5) shall be part of this bill.

In Paragraph 22 of Chapter (9) of the Bill Committee,it is stated that Paragraph 23 of Chapter 9 “despite existinglaw, confiscated farms for national interest are to becompensated according to law. If farm is upgraded withbuilding, it is required to compensate for such building.As Hluttaw approved above-mentioned amendment,Paragraph 23 of Chapter (9) shall be part of this bill.

In Paragraph 26 of Chapter (10) of the Bill Committee,it is stated that “in confiscating farms in the interests ofnation, it is a must to confiscate required least measurementof farm. It is necessary to implement projects withinprescribed period as soon as possible. If projects areterminated, farms are to be given back to original farmowner.” As Hluttaw approved above-mentionedamendment, Paragraph 26 of Chapter (10) shall be partof this bill.

In Paragraph 27 of Chapter (10) of the Bill Committee,it is stated that “except order or summons of the Presidentor authorities appointed by the President, pasture land andcommon village land are to remain unchanged. AsHluttaw approved above-mentioned amendment,Paragraph 27 of Chapter (10) shall be part of this bill.

The Hluttaw decided to approve the paragraph-30 ofthe Chapter 11 that states “Ministry can leave any virginand vacant when necessary for the State. According to therules and regulations of the central committee for managingvacant and virgin land, when the term of land tax exemptionexpires, the land shall be a part of this law as the lands canbe used for the agricultural farming”, as a part of this bill.

Regarding the paragraph-34 (A) of Chapter 13expressed in the paragraph-31 of the Chapter 13 of the billcommittee, the Hluttaw decided to approve the amendedparagraph-34 (A) of Chapter 13 “the Ministry shall makenecessary rules and regulations for agricultural landmanagement with the agreement of the UnionGovernment” as a part of the this bill.

Regarding the paragraph-35 of Chapter 13 expressedin the paragraph-32 of the Chapter 13 of the bill committee,the Hluttaw decided to approve the amended paragraph-35 of Chapter 13 stated that “this law revoked the lawsamendment of the 1953 Land Nationalization Act, 1963Tenancy Law, the 1963 Farmers Rights Protection Lawand 1965 Tenancy Law. When the laws are revoked, thecases handled by the previous laws are not ceased. Theunfinished or remaining cases shall be handled in accordancewith the existing laws to be part of the this bill.

The Hluttaw also approved the newly addedparagraph-36 of the Chapter-13 submitted by U TheinHlaing of Sagaing Region Constituency No.8 stated that“agriculturlists associations are allowed to organize inaccordance with the laws enacted for improvement of thesocio economy of farmers.” as a part of the bill as majorityagreed with the new paragraph.

The Hlutaw decided the correction of the billcommittee stated that “The 2011 Land Act (UnionHluttaw Law No.——, 2011) —— (Day), —— (Month),—( 1373 ME), —— (Day), —— (Month), ——(2011),the Union Hluttaw enacted this law”, as part of the bill.In the discussion session, U Soe Myint of the ConstituencyNo (6) of Magway Region discussed the proposal toconstruct sluice gates at necessary places for perpetuityof the Ayeyawady River and to implement the projectson maintaining the water course at downstream ofthe river.

Dr Aye Maung of Rakhine State Constituency No 1suggested to draw a master plan to maintain the river andto draw a special plan to maintain the basin of the river.

U Hla Swe of Magway Region constituency No 12suggested that it is sine qua non to implement a tame riverproject so that there is abundant of water in the AyeyawadyRiver in the summer and no floods in the rainy season, theriver can handle over-2000-ton ships and farmers cangrow crops in islands in the river.

Dr Banya Aung Moe of Mon State Constituency No7 suggested to invite experts, NGOs at home abroad andgovernmental departments to be able to make detailassessment to the long-term project of conserving theriver. He stressed the need for carrying out the conservationtasks systematically and cost effectively.

U Zaw Myint Pe of Mandalay Region ConstituencyNo 5 seconded the proposal and suggested that to be ableto use the Ayeyawady River effectively, a group ofexperts should make assess where and which kind of damswill be constructed over the river, to carry out thedevelopment projects while conserving the river, to makeefforts for attracting assistance from foreign countries orinvestment as part of win-win cooperation.

Dr Myat Nyana Soe of Yangon Region ConstituencyNo 4 suggested to calculate the risk to security of thepeople when dams are destroyed by disasters such asearthquakes and record rains. He also suggested not todamage the environment and socio-economy when damsare built. He also suggested to release reports on assessmentof the experts and and to consider the voice of the people.He also urged the ministries concerned to be wise whenthey handle every thing.

Regarding the proposal submitted by U Soe Myint,Deputy Minister for Transport U Win Shein said thatthe big rivers such as the Ayeyawady, Thanlwin,Chindwin, Sittoung are flowing in Myanmar and thereare many tributaries and creeks in the country. Twothird of the country’s area lies in the tropical region,and the rivers in Myanmar are fed by monsoon rain asthe country is located in the Asian Monsoon Region.The rainfall from May to October has reached 90% or95% of the rain fall in a year and the rain fall is heavyin July, August and September. Therefore, the waterlevel in rivers rises in May and June and reaches its peakin July, August and September and decreases in October.Last year’s average rain fall is 29.02 inches in PakokkuTownship and 178.23 inches in Kyaukphyu township.The average rain fall per year in Myanmar in 10 yearsis 96 inches, falling around 58 million cubic feet.

Of them, about 22 million cubic feet equivalent to 38per cent the total rainfall had flowed into the sea throughthe rivers. The remaining 62 per cent of the total rainfallhas sunk into the soil and evaporated.

The flowing rate of the Ayeyawady River has reached

40393 cubic meter/second in the rainy season and 2102cubic meter per second in summer. Therefore, the rivercauses floods in the rainy season and it is difficult tohandle ships in some places of the river in summer.Therefore, the system of the river needs to be maintainedin summer for navigation.

The reason why rivers are damaged is nature andactivities of the man. Floods, bad situation for navigationin summer, erosion and sand banks in rivers show thatrivers are damaged.

Around 278 tons of sand are silted up the AyeyawadyRiver every year and 131 tons of sand the Chindwin Riverevery year, limiting the navigation along the rivers.

To over come the hardships to navigation in summer

along the Ayeyawady River, the Water Resources andRivers System Development Department has applied thebed regulation way.

As about 38 per cent of the total rainfall in Myanmarflows into the sea, it is beneficial to construct a damproject to store the water. However, if the catchmentarea is damaged due to the environmental degradation,the amount of water flowing into the rivers can bedecreased.

Myanmar’s rivers which are beneficial to the countryare experiencing the floods in rainy season and droughts insummer. Therefore, low head dams along the rivers cancontrol the flowing and can help regular flow of the rivers,decreasing floods in June and August and preventingerosion in rainy season and helping navigation in summer.The systems of building dams to control flow of rivers needheavy investment and produce enormous benefits. To reapthe such benefits in the navigation, it is necessary to carryout bed regulation along the rivers section by section.

Therefore, plans should be made to calculate thebenefits and risks of sluice gates on rivers by experts.Building dams to store water is the integrated waterresources management and could help generating hydropower, irrigation and navigation. To implement theseprojects, physical model and numerical model should bebuilt to get the safety designs of the facilities not todamage the environment. Therefore, long-term plansshould be drawn and implemented systematically to buildsluice gates on the Ayeyawady River and to maintainnavigation along the river in the interests of the State.

The Hluttaw agreed to approve the proposal toconstruct sluice gates at necessary places for perpetuityof the Ayeyawady River and to implement the projectson maintaining the water course at downstream ofthe river as majority seconded the proposal.

The Speaker of Amyotha Hluttaw sought the approvalfrom the representatives to send message of condolencesto Japan for Mr. Takeo Nichioka, Speaker of the upperhouse of Japan, passed at the age of 75 on Saturday, 5,November, 2011, and the Hluttaw agreed to send themessage of condolence to Japan.

COPENHAGEN, 16 Nov—Denmark’snational football coach Morten Olsensaid Monday that it was a mistake toexpand from 16 to 24 the number ofteams competing in the final round ofthe UEFA European Football Champi-onships 2016. the Pyithu Hluttaw was held at Pyithu Hluttaw Hallof Hluttaw Building, here, at 10.15 am today,attended by Speaker of Pyithu Hluttaw Thura UShwe Mann and 369 Pyithu Hluttaw representatives.

One proposal was discussed, information forenlisting given, formation of commission submittedand approval for one bill sought.

Two Hluttaw representatives discussed theproposal submitted by U Kyi Than of GwaConstituency that it should not amend or add theElectricity Law.

U Aye Mauk of Mahlaing Constituencydiscussed that electricity was used by Burma RubyMine in Mogok in 1908 for the first time. In 1910,supply of electricity was added in Yangon andMandalay. To be free from danger of electricity,the Electricity Act (1910) was enacted and theElectricity Rules was issued in 1937. As an electricitysupply board should be formed, the ElectricitySupply Act was promulgated in 1948. TheElectricity Law as the Law No. 7 of Pyithu Hluttawwas enacted in 1984 and then electricity rulesissued in 1985.

Although the law and rules were in conformity

with a designated period, the Electricity Law 1984must be amended compulsory due to improvementof electricity consumption, use of modern electronicequipment and supply system. Such law is beingrealized by Electrical Inspector-EI under theIndustrial Supervision and Inspection Department

of the Ministry of Industry-1.Electrical Inspector is taking responsibility as

medium to inspect and suggest prevention againstdanger of electricity and to avoid loss ofopportunities between producers and consumers.

Approval was sought for one bill and oneproposal was discussed.

Hluttaw representatives discussed mattersrelated to the Farmland Bill sent and approved byPyithu Hluttaw. As the order of Hluttaw, officialsof Ministry of Agriculture and Irrigation wereinvited to discuss and scrutinize again. And report

was sent to Chairman U Mya Nyein of BillCommittee.

In searching approval of Hluttaw for theFarmland Bill sent and approved by Pyithu Hluttawto approve it paragraph by paragraph, Paragraph2 (a) of Chapter (1) of the Bill Committee prescribesthat “farmland means virgin lands suitable forfarming and land suitable to grow perennial treesand nipa and garden lands, lands suitable to growvegetable and flowery plants, designated lands,alluvial land, and land on which residentialbuildings are constructed without permission thatcan be used as the wish of the State, excluding

residential building within the boundary oftownship and village, religious buildings andprecinct, and private land unable to be used fordeveloping purpose”.

As U Ohn Tin of Rakhine State ConstituencyNo. 10 submitted to take out the phrase “used asthe wish of the State” of Paragraph 2 (a) ofChapter (1) to search approval of Hluttaw, theapproval of Hluttaw was sought. It is decided notto take out that phrase as the representatives whoopposed the proposal outnumbered other ones.

So, it is decided that Paragraph 2 (a) of Chapter(1) shall be part of the bill.

In Paragraph 2 (b) of Chapter (1) of BillCommittee, as amendment “right for farming isdefined that as the State is original owner of all lands,giving permission for farming in conformity withthis law and bylaw, rule and regulation of this law sothat agricultural production capacity develop,excluding exploring gems, mines, petroleum, gasand natural resources below and above ground” wasapproved by Hluttaw, it was decided that Paragraph2 (b) of Chapter (1) shall be part of the bill.

“Peasant is defined as anyone who falls withinthe competence of following points in Paragraph 2(c) of Chapter (1) of the Bill Committee. (1) Oneusing land by oneself or by oneself consistently asown major profession, (2) one who supervisesagricultural process all along as own majorprofession, (3) one who invests capital and carriesout growing process all along by oneself or manages
