1 EXECUTIVE SUMMARY

1. This environmental monitoring report covers the implementation of environmental management plan (EMP) of the nine subprojects funded in the Tranche III of Multi-Funding Facilities (MFF) in the period of 2017 Q3 and Q4 (from July to December).

2. According to the subproject IEEs approved by ADB, the subproject environmental monitoring reports (EMRs) are quarterly prepared and submitted to ADB. The 2017 Q1 and Q2 EMRs have been prepared and disclosed on ADB website in December 2017 and March 2018 respectively. However, the 2017 Q3 EMR was not completed because of lacking the data and information collected through site visits. The flooding due to high tide and heavy raining occurred from 20 to the end of September 2017 prevented NES from visiting the working sites for 2017 Q3 EMR. The 2017 Q3 site visits were replanned to carry out in 2017 Q4 period (October 2017 and December 2017) to review all data recorded by contractors during the 2017 Q3 and Q4 periods while interviewing related stakeholders and observing the working sites to find out the evidences of contractors’ implementation of Environmental Management Plans (EMPs). Therefore, this environmental monitoring report combines the implementation of EMPs of the nine subprojects funded in the Tranche III of Multi-Funding Facilities (MFF) in the period of 2017 Q3 and Q4 (from July to December).

3. Brief subproject construction status: until the end of 2017 Q4 period, there have been six subprojects managed by SPMB under construction. These are 500 kV My Tho – Duc Hoa TL subproject and five subprojects of the second transformer banks for the substations of 220 kV Tra Vinh; 220 kV Duc Hoa, 220 kV Vung Tau; 220 kV Uyen Hung and 500 kV Cau Bong. The subproject construction progress achieved variously. The 500 kV My Tho – Duc Hoa TL subproject had been constructed about 35% of the total plan, of which the construction of tower foundation had gained about 62%, 69 out of 112 towers had been constructed. The construction of the five second transformer banks for the substations achieved about 75.5% in average of the total plan, of which the construction part and electricity section had gained about 91% and 60% respectively, as of 31 December 2017.

4. Monitoring activities taken in this period: Besides the environmental compliant monitoring taken daily by the Construction Supervision Consultants (CSCs), the National Environmental Specialist (NES) conducted the field visits to the six subprojects under construction from 18 to 28 October 2017 and 13 to 29 December 2017. The monitoring activities concentrated on the compliance with EMP implementation, the environmental Loan Covenant, the status of implementing the corrective action plan set up in the previous monitoring period (2017 Q2) and any complaints of the affected communities related to the environmental performance.

5. Implementation of corrective action proposed by the previous report: All shortcomings found in the previous monitoring period (2017 Q2) were corrected by 30 September 2017 and all corrected evidences were collected by NES during the monitoring periods from 18 – 28 October 2017 (Table 9).

6. Shortcomings: there were no shortcomings in all subprojects under construction found during this monitoring period (2017 Q3 and Q4).

7. Electricity Viet Nam (EVN) is developing transmission networks and substations in Viet Nam to support economic growth and ensure access to a reliable supply of electricity throughout

the country. The Government of the Socialist Republic of Viet Nam hopes to connect 90% of the population to electricity by 2020 and provide 100% coverage by 2025. The Master Plan for Power Development of Viet Nam No. VI includes a program for development of transmission lines and substations, provision of meters, and rehabilitation of urban and rural low voltage distribution networks.

8. The Asian Development Bank (ADB) is co-financing the Power Transmission Investment Program (PTIP) through a Multi-Tranche Financing Facility (MFF). The PTIP will enhance the capacity of the transmission network to balance power loads in northern, central, and southern Viet Nam. It will i) expand the electricity transmission infrastructure by constructing and upgrading 500 kilovolt (kV) and 220 kV transmission lines (TLs) and associated substations; ii) improve the operational effectiveness and efficiency of the NPT; and iii) support the implementation of the investment program. The expected total number of MFF tranches is 4.

9. The NPT is the PTIP Executing Agency (EA). The Northern Power Projects Management Board (NPMB) is the Implementing Agency (IA) for the subprojects in northern Viet Nam; the Central Power Projects Management Board (CPMB) is the IA for the subproject in central Viet Nam; and the Southern Power Projects Management Board (SPMB) is the IA for subprojects in southern Viet Nam.

2.1.2 Tranche 03 Overview

10. Tranche 03 consists of 09 subprojects, of which the two subprojects of 220kV Binh Long – Tay Ninh TL and 500kV Chon Thanh substation and 220kV and 500kV connections are managed by CPMB, the remaining 07 subprojects are undertaken by SPMB. All subprojects are located in the central or southern areas of Vietnam. The locations of subproject are outlined in Table 1. The brief description of each subproject is detailed in Item 2.1.3 of the environmental monitoring report for 2017 Q21.

5.2 Report purpose

- Monitoring the environmental compliance with both policies of ADB and the Government of subprojects’ implementation activities including the compliance with loan covenant.

- Monitoring the construction contractors to comply with the mitigation measures in accordance with the approved EMPs and supporting them in bringing back any environmentally incompliant issues into the EMPs’ compliance throughout corrective action plans.

- Recommending measures and conducting short training courses at sites to the contractors and workers to improve the effectiveness of mitigating the environmentally negative impacts during the subprojects’ construction period.

- Identifying the environmental impacts non-determined in the designing stage, based on which solutions for monitoring and mitigating the impacts shall be recommended.

3 ENVIRONMENT SAFEGUARD REQUIREMENT

5.3 Relevant environmental policies

3.1.1 ADB environmental policies

11. The environment safeguards requirements of ADB are presented in the following guidelines:

a) Safeguard Policy Statement (2009)

b) Operational Manual Section F1/BP12

and c) Public Communications Policy (PCP) 2011.

3.1.2 Government of Vietnam’s Environmental Policies

12. The status of compliance with GoV’s environmental requirements is summarized in Table 2.

Decree No. 18/2015/ND-CP, dated Feb. 14, 2015 Provides the requirements for Environmental Protection Plan, Strategic Environmental Assessment, Environmental Impact Assessment and Environmental Protection Plan and took effect on April 01, 2015 (replaces Decree 29/2011/ND-CP)

Comply with: Although Decree 18/2015 requires EIA prepared for only the works of TLs and substations from 110 kV and 500 kV respectively, the EIAs of all subprojects funded in Tranche III with the voltages from 220 kV to 500 kV of TLs and substations were prepared under the regulation of Decree 29/2011/ND-CP dated on 18 April 2011 and the mitigation measures have been implemented. This means that meeting the environmental protection required by Decree 29/2011/ND-CP satisfies the regulations of Decree 18/2015/ND-CP in terms of environmental assessment.

Circular No. 27/2015/BTNMT dated on May 29, 2015 that provides guidance for Strategic Environmental Assessment, Environmental Impact Assessment, and Environmental Protection Commitment. (Replaces Circular 26/2011/TT-BTNMT)

Complied with The structure and content of subproject EIAs were in compliance with the Annex 2.5 of Circular No. 26/2011/BTNMT because the EIAs were approved in 2014. In comparison with that in the Circular No. 27/2015/BTNMT specified in Annex 2.3 there are just some minor changes related to public consultation and monitoring parameters.

Decree No. 80/2014/ND-CP issued on August 6, 2014. This Decree regulates drainage and treatment of wastewater in urban areas, industrial zones, economic zones, processing and export zones, and rural residential areas and took effect on 01 January 2015

Complied with: Runoff was properly managed at the working sites. For the second transformer banks for the substations, runoff from the stockpiles was kept clear before discharging into the existing drainage system of substations; for the TL working sites, runoff was collected at foundation holes of towers, kept clear and pumped out to the existing drainage system. All waste water was collected and treated to meet the regulation of Decree in rural areas.

Decree No.38/2015/NĐ-CP dated 24 May 2015 provides for the management of waste including hazardous waste, domestic waste, industrial solid waste regular, liquid waste, waste water, industrial emissions and other special wastes; environmental protection for imported scrap and took effect on June 15, 2015.

Complied with: The solid and liquid domestic waste at sites and rented houses were collected and treated as per local regulation; construction waste mainly iron stuff, cement bags were collected for reusing or recycling.

3.3.2 Incorporation of Environmental Safeguards into Project Contracts

15. All mitigation measures were incorporated into the project contracts, concretely: All measures set forth in the approved IEEs/EMPs in the construction phase were incorporated into civil work bidding documents and work contractors.

5.6 EMP implementation roles and responsibilities

16. The institutional arrangement is described in the approved IEEs for the nine subprojects funded under the Tranche 3 of MFF.

17. The NPT/EVN, PMBs are the key institutions that will play crucial roles in the implementation of the subproject as well as in ensuring environment safeguards. The administrative and environmental management responsibilities of relevant institutions are explained in Item 3.4 of the environmental monitoring report for 2017 Q24:

5.7 Environmental Monitoring and Reporting

3.5.1 Environmental Monitoring Program

3.5.1.1 Pre-construction

18. During pre-construction, the PMBs’ EOs will monitor the tasks identified within the EMPs.

3.5.1.2 Construction

19. During construction period, monitoring of construction activities is carried out to ensure that construction work complies with the requirements of the EMPs. Monitoring responsibilities are arranged as follows:

20. The contractor has the initial responsibility for monitoring compliance with the IEEs as reflected in the Contractors Environmental Management Plan (CEMPs). The responsibility for undertaking this is identical and similar to the contractor’s responsibilities for monitoring the civil construction works.

21. Through CSC, Technical Departments of PMBs are responsible for monitoring the contractor’s compliance with the technical requirements and implementation of the CEMPs. The SEs and CSCs will be assisted in the role of environmental safeguard by the PMBs’ EOs under the support of NES that is recruited by PMBs and approved by ADB. In the initial stage of the project, the PMBs’ EOs is assisted by the environmental officer of NPT.

22. The PMBs’ EOs also monitor the work but has more of an auditing role. The PMBs’ EOs can issue Defect Notices for non-compliant work and depending on the seriousness of the issue may instruct the contractor that this is to be completed by a certain date. The Defect Notice is given to the SE who directs the contractor to undertake the work as shown in the Defect Notice. If the work is not completed by the due date, then the SE can arrange for the work to be completed by another contractor and the cost deducted from the contract plus 10% as a management charge.

23. The NPT EO may audit the EMPs as required and provide assistance to the PMBs’ EOs for monitoring the EMPs.

3.5.1.3 Operation

24. During operation monitoring, the operation agencies (PTC) will replace the role of PMBs’ EOs.

3.5.2 Environmental Reporting Requirements

3.5.2.1 Monthly

25. Contractor’s report to PMBs on compliance with the CEMPs: The contractor will be responsible for preparing this report that establishes how the CEMPs are being implemented, problems and alterations that may have been made to the CEMPs to address these issues. Attachments to the contractor’s report include: the Control Record and the Record of Accidents.

3.5.2.2 Quarterly report

26. From NPT and PMBs to ADB concerning monitoring compliance with the EMPs: the quarterly EMRs will be prepared by the PMBs’ Eos assisted by NES through the information from the monthly environmental compliance reports prepared by the contractors and the field visit observations and interviews of the communities surrounding the facilities. The EMRs will cover how the EMPs are being addressed by the contractors, progress with the work and implementation of the EMPs, problems encountered, issuing of Defect.

4 SUBPROJECT CONSTRUCTION/OPERATION STATUS

4.1 Summary of work done in the previous and current monitoring periods

27. As of 31 December 2017, the two subprojects managed by CPMB being 220kV Binh Long–Tay Ninh transmission line and 500 kV Chon Thanh substation and 220kV and 500kV connections had not been constructed yet as CPMB was in the process of approval of the technical design and recruiting qualified construction contractors in compliance with regulations.

28. Of the seven subprojects managed by SPMB, the 500 kV Duc Hoa substation and connections had not been constructed because of the obstacle in site clearance. The remaining 06 subprojects including 500 kV My Tho – Duc Hoa TL, and the five second transformer banks for the substations were under construction.

4.2 Working progress of 500 kV My Tho – Duc Hoa TL subproject

30. The 500 kV My Tho – Duc Hoa TL subproject that is divided into two construction packages of 8.1 and 8.2 is constructed under two separate associations. The consortium of SD11, INCO and IEC are in charge of constructing 56 towers (No. 01 to 56), meanwhile the association of PCC1, VNECO and TBD construct the remaining 56 towers (No. 57 to 112). The subproject started construction in February 2017. As of 31 December 2017, the progress of subproject construction had achieved about 35% of the overall plan, of which 69 out of 112 tower foundations had been constructed under 06 contractors with various construction progress, accounting for 62% in average. Detail is summarized in Table 6 and Table 7.

4.3 Five subprojects of construction of second transformer banks for substations

32. As of 31 December 2017, the average working progress of five second transformer banks for the substations had achieved in average about 91% of the construction section and 60% of the electric part. The detail works done of the five second transformer banks for the substations were summarized in Table 5. The status of working during the 2017 Q3 &Q4 period mainly included the construction of cable canals, completion of the foundations and return of the grounds (Table 8).

5 EMP COMPLIANCE

5.1 Monitoring activities

33. The EMP implementation was monitored daily by the Environment Health and safety (EHS) staff of contractors under supervision of the CSCs. The monthly EMP implementation compliance reports were prepared by the contractors and submitted to the EO of SPMB and forwarded to NES for reviewing.

34. The monitoring methods by NES consisted of (i) reviewing monthly CEMP implementation compliance reports of contractors, the contractors’ work diaries and the minute meetings on borrowing temporary sites, site clearance between the contractors and affected land owners and returning ground after the completion of tower constructions (ii) the site observation and (iii) interviewing EHS staff, workers and local people potentially affected by the subproject construction activities.

35. Based on NES’s review of the contractors’ monthly compliance reports, 2017 Q4 site visits had been planned and approved by EO of SPMB before NES conducted the monitoring activities. Site visits for EMP compliance monitoring were conducted by NES from 18 – 28 October 2017 under Introduction Letter of SPMB No.7635/SPMB-DB and No. 7636/SPMB-DB dated 16 October 2017 and from 13 – 29 December 2017 under SPMB’s Introduction Letter No. 9712 and No 9714 dated 12 December 2017 for the 06 subprojects which were under construction activities in period of July to December of 2017 (i) 500 kV My Tho – Duc Hoa TL subproject; (ii) the five second transformer banks for substations of 220 kV Duc Hoa; 220kV Tra Vinh; 220kV Vung Tau; 220kV Uyen Hung and 500kV Cau Bong. The monitoring activities concentrated on the status of EMP compliance, implementation of the corrective action plan of contractors at sites raised in the previous monitoring period and any complaints of the communities to the environmental performance.

36. The specific sites of subproject of 500 kV My Tho – Duc Hoa TL are: (i) SD11 contractor: Constructed and returned grounds of towers No. 41, 42, and 43 in Tan Hoa Dong commune, Tan Phuoc district, Tien Giang province; (ii) PCC1 contractor: returned grounds of tower foundations No. 76,77,78 and 79 in Tan Lap, Thu Thua, Long An province (iii) VNECO contractor: Constructed and returned the ground of Towers No. 88, 94 and 101 in Thanh Loi commune, Duc Hoa district, Long An province; (iv) TBD contractor: constructed and returned the ground of towers No 80,81 and 82 in Tan Lap, Thu Thua, Long An (v) INCO contractor: Constructed Towers No 3,4,5 and 7 in Diem Hy commune, Chau Thanh district, Tien Giang province; (vi) IEC contractor: Constructed and returned ground of Tower No 20 in My Phuoc, Tan Phuoc, Tien Giang province. The specific sites of second transformer banks for substations are: (i) Consortium of Licogi and Licogi 16 contractors: Second transformer banks for 220 kV Tra Vinh; 220 kV Duc Hoa, 220 kV Uyen Hung and 220 kV Vung Tau; and (ii) Association of PCC1 & Alphanam E &C contractors: Second transformer bank for 500 kV Cau Bong substation.

5.3.1.2 Environmental effect monitoring

40. The environmental effect monitoring plan included in the IEEs approved by ADB requires monitoring of (i) Ground water quality; (ii) Surface water quality (quarterly); (iii) Waste water quality; (iv) Air quality; (v) Noise and (vi) Vibration. However, considering the base line data (meeting national standards) and environmental impact caused by the project (not significant), SPMB decided to measure only surface water quality only for semi-annually. In case of any issues or complaints which may affect air quality, noise, vibration, underground water or wastewater, relevant environmental effect monitoring will be conducted as necessary (cf. Item 5.3.1.2 of 2017 Q2 Environmental Monitoring Report5).

41. Four samplings of the surface water sources in 500 kV My Tho – Duc Hoa TL subproject area were taken for analysis on 29 December 2017 and the results that reflected the quality of surface water in the project area in six months from July to December of 2017 were shown in Table 12 (Appendix 5).

42. The analysis revealed that all parameters of the surface water sources at the sampled locations measured on 29 December 2017 were within the allowable limitations of QCVN 08/2015/BTNMT column B1 (The surface water quality regulated for irrigation purpose) and there were no significant changes in compared with those measured on 26 June 2017. It is concluded that the subproject construction had not caused any remarkable negative impact on the surface water quality in the subproject areas until the end of 2017 Q4 period.

5.3.1.3 Complaints

43. There had been no complaints raised by locals regarding environmental performance and environmental impacts until the end of 2017 Q3 & Q4 period.

5.3.2.2 Environmental effect monitoring

46. The environmental effect monitoring plan included in the IEEs approved by ADB requires monitoring of (i) waste water quality; (ii) air quality; (iii) noise and vibration; (iv) underground water quality; (v) surface water quality; and (vi) soil quality. However, considering the base line data (meeting national standards) and environmental impact caused by the project (not significant), SPMB decided not to measure these parameters regularly. In case of any issues or complaints which may affect air quality, noise, vibration, underground water or wastewater, relevant environmental effect monitoring will be conducted as necessary (cf. Item 5.3.2.2 of 2017 Q2 Environmental Monitoring Report6).

5.3.2.3 Complaints

47. There were no complaints raised by locals living surrounding the substations, workers and the substation staff during the 2017 Q3 & Q4 period.

6 COMPLIANCE WITH LOAN COVENANTS

48. The monitoring results reflected that the NPT/SPMB had complied with the requirements of environmental safeguards specified in Loan Agreement No. 3374 VIE. The compliance status of the Environmental Loan Agreement is detailed in Table 15.

The 2017 Q2 EMR was approved and disclosed on ADB website on 8 March 2018 and its summary in Vietnamese was disclosed to the affected people and workers through the contractors on 23 March 2018; No unanticipated environmental risks or impacts during the construction phase were found not to be considered in the IEEs/EMPs. No actual or potential breach with compliance with measure and requirements set forth in the IEEs/EMPs were found.

a. EMR for 2017 Q1 were submitted to ADB and disclosed on ADB website, while the 2017 Q2 EMR is under revision. The summary of the 2017 Q1 EMR was translated into Vietnamese by NES, reviewed by EO of SPMB, printed out and distributed to the offices of contractors, existing substations and relevant Commune People’s Committees (CPCs) so that affected people can review when they want.

b. No unanticipated environmental risks or impacts during the construction phase were found not to be considered in the IEEs/EMPs.

c. No actual or potential breach with compliance with measure and requirements set forth in the IEEs/EMPs were found.

Appendix 3: Status of overcome the shortcomings found in the second monitoring period (Pictures taken on 24 October 2017)

Interview Mr. Nguyen Van Noi on his agricultural land polluted was compensated by VNECO contractor by 30 September 2017 and he was satisfied with the compensation.

VNECO rented latrine toilet of the household located beside the tower foundation No. 89 for workers when working at the site.

Contractors rented the available latrine toilets of households located about 50m from the working sites for worker to use when working at the sites.

Cement bags were given to the local people for reuse by their request. They are stored on their own land. (Picture taken on 26 June 2017)

According to the interview of the land owner (Mr. Nguyen Van Duc) of tower No. 108 conducted by NES on 26 June 2017, VNECO contractor gathered all scattered cement bags around the tower foundation and handed over the cleaned land to the land owner on 10 June 2017. On 11

June 2017, the land owner signed the minute meeting with the contractor on the land handing over (Appendix 4). All cement bags were given to the local people upon their request for reusing by 30 June 2017, and stored on their own land.
