Building Code 2016 – generally applies to all EWP building projects. Workplace Relations
Management Plan required if tendered cost is equal or greater than $5 million (inclusive
of GST) or if listed as an additional condition of participation regardless of tendered cost.
Information Security - Sensitive and Classified - If this applies review Tender Conditions
clause 18 and Contract Special Conditions clause 26
Indigenous Procurement Policy – Needs to be reviewed in conjunction with Clause 30 of
the Tender Conditions. Different clauses apply based on the value of the tender. If the
value is under $7.5m inc GST the Tenderer will be required to use ‘best endeavours’ to
increase Indigenous Participation on the contract. If the value is over $7.5m inc GST the
Tenderer must submit an Indigenous Participation Plan as part of their submission which

will then be appended to the contract should they be successful. The successful
contractor must outline how they will achieve the mandatory minimum requirements of
their Plan throughout the life of the contract.
Federal Safety Commissioner (FSC) Accreditation Scheme - Applies for construction works
if contract >$4M inc GST. If applicable, a contract cannot be signed with a tenderer who
doesn’t have this accreditation.
Special Conditions of Tender – can vary from tender to tender and should be examined
and understood by the Tenderer

transition to the project if successful and how any timing conflict will be
managed

TENDER SCHEDULE B - Task Appreciation and Methodology
Provide and demonstrate clear understanding of the nature and scope of the

project including criticality of tasks, and methodology for undertaking each task.
Provide insight into project specific issues/risks and mitigation strategies, avoid
brief and generic examples.
Provide an outline of project specific project plans – generic samples can be
attached but the outline should be specific.
Provide an outline of project management methodology and construction
methodology – not just one or the other.
Demonstrate an understanding of defence specific processes - DCACs/security
requirements, CIOG, stakeholder engagement, HOTO, EDT /GDL and allowing
sufficient time for these on the program (including reviews and approvals)

TENDER SCHEDULE C - Previous Performance
All relevant projects carried out or completed in the 12 months
3 projects with a nominated contract value (or thereabouts)
Fully complete tables and provide adequate detail to support capacity to
undertake the project
Highlight the relevance of the past projects to the project
Highlight proposed key personnel in past projects
Highlight areas where value has been added (not included in scope)
Highlight unexpected changes that occurred during previous projects and how
these were dealt with (if any).
If any issues/problems occurred, how were these dealt with and what was the
result?
Ensure cost and time variations are adequately explained.
Projects that are not yet complete do not count at previous performance and
should not be listed.
Additionally, projects that are very aged (over 4-5 years old) start to lose
relevance and should be avoided.

TENDER SCHEDULE I – Local Industry Capability Plan
Estimated value in AUD of the overall industry participation outcomes expected
for the Works. Table must be complicated and must be in line with the Contract
Price.
Further information must be provided on the strategy for local industry
participation.
Be prepared to report on the achievements against this Plan.
TENDER SCHEDULE J - Indigenous Procurement Policy
if not designated a HIGH VALUE contract in the tender particulars provide details
of how the tenderer proposes to use best endeavours to increase engagement
with Indigenous Enterprises and/or individuals in line with the Commonwealth’s
Indigenous Procurement Policy
if designated a HIGH VALUE contract in the tender particulars the declaration
must be signed and submitted with the tender and along with an Indigenous
Participation Plan as outlined in the schedule

Declaration of Compliance – fully complete all questions and details required;

Declaration of Compliance must be signed correctly AND evidence of eligibility to
lodge a tender must be attached (i.e. ABCC Letter of Compliance or Self-
declaration of eligibility depending on the Contractor’s enterprise agreements).

Workplace Relations Management Plan (WRMP)
WRMP is required for all tender submitted above $5m (including GST). WRMP
template is provided on the ABCC website at https://www.abcc.gov.au/building-
code/workplace-relations-management-plans which also provides a guide to
assessment of the plan. A contract cannot be awarded until the plan is approved
by ABCC.
Where required, the WRMP should be submitted as part of Tender Schedule J. The
tenderer does NOT submit directly to ABCC.

NB: this schedule is for alternatives to the design ONLY and not for changes to the tender
or contract documents.
Note: Schedule M is the only schedule where an alternative proposal should be outlined.
All other schedules (ie. Task Appreciation and Methodology) should be detailed in line
with the original design.

Tenders must be conforming as noted below or they may NOT be evaluated.
Tender Conditions clause 3.1 Conforming Tender, including ATM Close Date and ATM
Close Time, Minimum Form and Content Requirements and Conditions for Participation
Must be lodged on Austender by closing time and date in accordance with lodgement

Tender must be completely self-contained, without hyperlinks for other material
incorporated by reference; and
Tenderer must, at the time of lodging its Tender, satisfy each condition for
participation as follows:
if clause 16 applies, the Tenderer meets the eligibility requirements in section 23
of the Building Code 2016; and
each additional condition for participation specified in the Tender Particulars (if

any).

Tenders are evaluated in three stages:
Stage 1 - an initial screening based on the compliance criteria;
Stage 2 - a detailed evaluation against the evaluation criteria;
Stage 3 - an assessment of value for money and final ranking.
The Tender Evaluation Board can choose to develop a shortlist at the end of any stage
and Tenderers that do not make the shortlist will not proceed further in the evaluation.
Alternative proposals with respect to the Design Documents are evaluated on value for
money
Set out in the Tender Conditions Clause 4 – can change but is typically as below

A few key things to remember during the tender period and when submitting your
tender….
Tenderers who have not registered for the Industry Briefing will not be allowed to take
part in the Industry Briefing.
Late Tenders or Tenders not lodged via AusTender cannot be accepted unless there is a
proven issue with AusTender.
Whilst not a requirement, the submission of tenders in parts is to be kept to a minimum.
If in multiple parts, please number each document to assist in compilation. Submitting
an excessive number of individual files, folders and zip files can be confusing.
Not completing all minimum form and content requirements resulting in Tender non-
compliant and therefore not evaluated.
Pay particular attention to Tender Particulars: Conditions of Tender. If these aren’t
followed, this will result in a non-compliance.
Consider the audience and don’t rely on implied details. Responses should be succinct,
relevant to the project, include accurate and sufficient detail and not presume the
reader knows anything about the company.
Communication during a tender – must be in writing and through the Contact Officer as
specified on AusTender
Please ensure all questions in the Schedules are answered. If you don’t answer all of
them, it makes it hard to achieve a high technical score.
Exclusion of scope for reasons unknown/not explained – submitting an alternate bid

without a complying one may be deemed non-conforming.
Tender submissions need to be specific to the project (not generic).
It is not uncommon to receive information in an altered format. Ensure that all
information conforms with the information requested in each schedule. Missing
information is likely to equate to a lower score.
The Tender Documents are designed in such a way that if a tenderer followed the
template, it would be adequate information for the Board to make a decision.
Reformatting the document generally makes it harder to evaluate.
Recommend successful tenderers request a tender debrief, as well as unsuccessful
tenderers.
Debriefs are a two-way street – feel free to give us feedback!
