Statement by the Presidency on behalf of the European Union on the Ethiopian Elections Brussels, 29 August 2005

The European Union notes the balanced and impartial preliminary statement of 25 August issued by the European Union Observation Mission's Chief Observer. While we await the EUOM final report due next month before commenting on the overall electoral process, we note the Chief Observer's preliminary comment that the picture was mixed, with some positive aspects up to the 15th May, and some negative aspects thereafter. We also note that the preliminary statement revealed deficiencies and irregularities in aspects of the complaints process, re-runs and Somali regional elections. However, the EU trusts that all aspects of the report will be received and addressed by the Government and all political parties in the constructive spirit in which they were intended. The EU congratulates once more the Ethiopian government for launching a more open electoral process, and for the decision to invite international observers. While the EU notes continuing issues of concern, including respect for human rights and balanced access to the media, the EU regards the elections as an important step forward in the democratisation process. We urge all political actors to use the coming period to work together peacefully and constitutionally to further embed multi-party democracy. Above all, the EU again congratulates the Ethiopian people for their faith in democracy shown by such high voter turn-out on 15 May. The EU request Ethiopia's political leaders of all parties to respond to that faith by continuing the process of reform and positive change in the democratic institutions and media- and by participating actively in the new Parliament, City Administration and other institutions. The EU reiterates its firm commitment to sustain and strengthen its partnership with Ethiopia and its people in all areas including that of further democratisation. 93/2005 Declaration from the Presidency on behalf of the European Union

on Restrictions on technical assistance to Belarus Brussels, 30 August 2005

The European Union reaffirms its determination to support the needs of the population and democratisation in Belarus. It is the firm belief of the European Union that technical assistance to Belarus is of mutual benefit. Our goal is to help to develop civil society and independent media, strengthen the social and health sectors, improve the rule of law and the human rights situation, and develop small and medium enterprises. This assistance also aims to help the Belarusian government fulfil its international commitments, including its commitments in the framework of OSCE. The Belarusian government has agreed together with the EU on several programmes, e.g. TACIS and CORE. The EU is concerned that the restrictions introduced by President Lukashenko's decree on foreign aid (issued on 17. August) may seriously hamper the implementation of a wide range of mutually beneficial programmes and activities. The restrictions may lead to increased self-isolation of Belarus and adversely affect the population. The European Union calls on Belarus to seriously reconsider the implementation of the decree, particularly in the light of its negative impact on the people of Belarus. Declaration by the Presidency on behalf of the European Union concerning Council Decision 2005/592/CFSP of 29 July 2005 implementing Common Position 2004/161/CFSP renewing restrictive

measures against Zimbabwe Brussels, 5 September 2005

The Acceding Countries Bulgaria and Romania, the Candidate Countries Turkey and Croatia*, the Countries of the Stabilisation and Association Process and potential candidates Albania, Bosnia and Herzegovina, the former Yugoslav Republic of Macedonia, Serbia and Montenegro, EFTA countries Iceland, Liechtenstein and Norway, members of the European Economic Area, as well as Ukraine and the Republic of Moldova, declare that they share the objectives of Council Decision 2005/592/CFSP of 29 July 2005 implementing Common Position 2004/161/CFSP renewing restrictive measures against Zimbabwe. They will ensure that their national policies conform to this Decision. The European Union takes note of this commitment and welcomes it. * Croatia continues to be part of the Stabilisation and Association Process.

Declaration by the Presidency on behalf of the European Union on recent disturbances in the Maldives

Brussels, 8 September 2005 The Heads of Mission of the European Union (EU) based in Colombo and accredited to the Maldives sent a fact-finding mission to the Maldives from 24-26 August to evaluate the civil disturbances of 12-14 August 2005, the arrests of demonstrators, including the Chairperson of the Maldivian Democratic Party (MDP), and the implications for the reform process. The mission spoke to several Cabinet Ministers, the Commissioner of Police, members of the Human Rights Commission, the National Security Service (NSS), the acting UN Resident Representative, the Chief Government Spokesperson, members of the MDP, and some of those detained following the unrest. The EU expresses its concern at the recent disturbances, coming as they do a full year after previous disturbances in Male'. The latest events underline the continuing and urgent need for the Government of the Maldives, the opposition and all stakeholders in the Maldives to show genuine commitment to dialogue, democratic freedoms and proportionality in their actions. Having taken account of the mission's findings and without pre-empting planned court action, the EU takes note of the fact that only a few months after political parties were allowed to register for the first time, a number of opposition activists are now facing very serious charges. The credibility of the trial process and the evidence will come under close scrutiny. It is essential that the fundamental rights of all detainees are upheld. The EU calls on the Maldivian authorities to ensure that due process is observed. This includes adequate notice of court hearings to allow legal representatives sufficient time to prepare, and adherence to correct procedures. In relation to this the EU welcomes the permission granted by the government to allow the International Commission of Jurists (ICJ) to observe trial proceedings. The EU will be paying close attention to the conduct and progress of the court cases. Given that those arrested have made allegations of human rights violations it is essential that the Human Rights Commission be able to conduct investigations into any complaints submitted. The EU encourages the Members of the People's Majlis to ensure that the Human Rights Commission Bill presented to the Majlis for its consideration is fully aligned with international standards, guarantees autonomy for the Commission and provides sufficient resources and investigative powers. The EU welcomes the fact that the government has now begun work on a draft paper to identify reform process milestones to be achieved within two years. This needs to be undertaken in a genuinely consultative manner involving all stakeholders and the wider public of the Maldives in order to raise awareness of and confidence in, the reform process. The EU urges the government to move forward with this without delay. Measures to allow the registration of political parties for the first time was an important democratic step forward. It is essential that the government of the Maldives continues to allow political parties to meet freely and to carry out peaceful political activities. An effective political party system requires all parties to work within agreed parameters. The EU urges the government of the Maldives and all political parties to engage in a constructive dialogue to make clear what these parameters are. In this regard the EU commends the good offices of the Commonwealth Secretary-General's Special Envoy.

The EU reaffirms its support for further democratic reform in the Maldives and urges the Government and opposition to take steps to facilitate this and to avoid actions which will make it more difficult. Genuine commitment to democracy requires living up to the spirit as well as the letter of reform. A representative from the Canadian High Commission participated in the fact-finding mission and the Government of Canada wishes to be associated with this statement. Declaration by the Presidency on behalf of the European Union on the Death Penalty in Iraq Brussels, 2 September 2005

The European Union was saddened to learn that three Iraqi nationals were executed on 1 September 2005 following a judicial process in Iraq. The EU is of the view that the death penalty does not serve as an effective deterrent and any miscarriage of justice, which might arise in any legal system, would be irreversible. The EU therefore regrets that the Government of Iraq has elected to implement the death penalty in these cases. The EU is strongly opposed to the death penalty and condemns its use. While recognising the sovereign right of the Government of Iraq to decide on judicial sentencing, we strongly urge that the death penalty should be abolished. Declaration by the Presidency on behalf of the European Union in response to the statement of cease-fire by Chairman Prachanda, CPN(M)

Brussels, 8 September 2005 The EU welcomes the declaration by the CPN(M) of a unilateral cease-fire. The EU urges the CPN(M) to take concrete steps towards a permanent end to the use of violence for political ends. The EU condemns such violence by the Maoists, which has caused considerable suffering and hardship to the Nepalese people. All political forces now need to work strenuously for a democratically based peace process leading to a durable negotiated solution, involving a national consensus and reintegration of the CPN(M) into a multi-party democracy. The EU therefore urges the CPN(M) to implement their latest undertakings in good faith, and the government to respond positively and concretely, with a view to building the necessary confidence required for a political solution to the conflict. The EU continues to believe that such a solution will require the assistance of an independent and credible external partner and the active support of the international community. In the wider context, the EU stands ready to consider positively requests for whatever types of assistance the Nepalese political forces agree are appropriate. Declaration by the Presidency on behalf of the European Union

regarding the formation of a new government of Albania Brussels, 15 September 2005

The EU welcomes the conclusion of the election process in Albania, which has resulted in the first peaceful transfer of power since the fall of Communism. The Union congratulates the Government of Prime Minister Berisha on its appointment by the new Parliament. It calls on the new Parliament and the new Government to advance Albania's progress towards EU integration by beginning work without delay and with genuine commitment on a clear and strong reform agenda. Tangible progress is required, on strengthening the rule of law and on electoral reform in particular. Recalling the conclusions of the General Affairs and External Relations Council on 18 July 2005, the EU reaffirms its commitment to support Albania's ambition of moving closer to the EU and stresses that the key to further progress is in the hands of the Albanian authorities. The Union encourages all political forces in Albania to unify their efforts to accelerate that process.

Declaration by the Presidency on behalf of the European Union

on the presidential elections in Egypt Brussels, 8 September 2005

The EU welcomes the first multi-candidate Presidential elections in Egypt's history which took place there on 7 September and congratulates the Government and people of Egypt on this important step towards political reform. The EU has followed the elections with close interest. The EU welcomes the open debate which has taken place, and the atmosphere of calm in which the campaign has been held. It welcomes the efforts by the state-owned broadcast media to ensure fair and balanced election coverage. The EU also welcomes commitments made during the campaign to further political reform. The EU takes note of the judicial supervision of the election and the efforts by civil society groups to observe it. The EU attaches great importance to the role played by civil society groups in the preparation and observation of elections and stands ready to support their efforts. The EU encourages the government of Egypt to build on what has been achieved in preparing for future elections, including the forthcoming parliamentary ones. It notes that international observation can play an important role in complementing domestic efforts to ensure fairness and transparency, and in reflecting their success to the wider international community, and underlines its readiness to assist in this regard in future elections, should it be invited to do so.
