on the application of specific measures to combat terrorismBrussels, 27 June 2002

The Central and Eastern European countries associated with the European Union, the associated countriesCyprus, Malta and Turkey, and the EFTA countries, members of the European Economic Area, declare thatthey share the objectives of Council Common Position 2002/462/CFSP of 17 June 2002 updating CommonPosition 2001/931/CFSP on the application of specific measures to combat terrorism and repealing CommonPosition 2002/340/CFSP. They will ensure that their national policies conform to that common position.

The European Union takes note of this commitment and welcomes it.

Declaration by the Presidency on behalf of the European Unionon the peace process in Sri Lanka

Brussels, 26 June 2002

The European Union reiterates its support for the conclusion of a lasting peace which takes into account theaspirations of all communities in Sri Lanka and does not undermine the principles of territorial integrity andthe unity of Sri Lanka.

The European Union urges the full implementation of the cease-fire agreement by the two parties and callson both sides to agree an early date for talks.

The European Union invites the LTTE to renounce terrorism and all forms of violence completely and urgesall parties to respect the principles of pluralism and Human Rights.

The European Union notes the important role played by Norway and the Sri Lanka Monitoring Mission(SLMM) and calls on the parties to actively co-operate with the SLMM on the national as well as districtlevel in the efforts to monitor the cease-fire agreement.

The Central and Eastern European countries associated with the European Union, the associated countriesCyprus, Malta and Turkey, and Iceland and Liechtenstein countries members of the European EconomicArea, align themselves with this declaration.

Declaration by the Presidency on behalf of the European Unionon the situation in Southern Sudan

Brussels, 25 June 2002

While welcoming the opening of substantive negotiations within the IGAD framework the European Unionremains highly concerned about the humanitarian situation in many parts of the Sudan and in particular inWestern Upper Nile, Eastern Equatoria and Bahr-El-Ghazal.

The European Union recalls the universal humanitarian principle, that civilian populations must be protectedfrom the consequences of military operations. The EU calls for unrestricted, immediate and unlimited accessby international humanitarian agencies, for the purpose of providing humanitarian assistance to these civilianpopulations, wherever they are directly or indirectly affected by the conflict.

The European Union calls on both the Government of Sudan and the SPLM/A to decisively engage in theIGAD Peace Process. In this respect, the EU reiterates its appeal for a comprehensive cease fire as part of acomprehensive and just peace negotiation process.

Subject to progress toward a peace settlement, the EU is ready to support the process of economic and socialdevelopment through the linkages between relief, rehabilitation and development with a view to alleviatingpoverty.

Declaration by the Presidency on behalf of the European Unionto mark the entry into force of the Rome Statute of the International Criminal Court

Brussels, 1 July 2002

The entry into force today of the Statute for the International Criminal Court is a major leap in theprogressive development of international law.

Although many states, including European Union Member States, have since the time of the League ofNations supported the establishment of a permanent international criminal court, the drafting of a statute forsuch a court within the United Nations framework was delayed for many years. However, in the 1990�s, wesaw that the creation of international institutions for bringing to justice individuals suspected of grossviolations of human rights had become possible. A growing consensus was emerging as to the need for astrengthened international order. Although criminal law has traditionally been a national matter, theinternational community was increasingly willing to accept a criminal jurisdiction exercised by internationallegal bodies as a substitute to national jurisdiction with a view to enhancing international humanitarian lawand human rights. The setting up of the ad hoc tribunals for the Former Yugoslavia in 1993 and Rwanda in

1994 constituted a turning point. The European Union fully supported their establishment and continues tosupport their operation.

However, many states continued to feel that a permanent court was called for - in other words, that furthersteps should be taken to develop the international legal order. The adoption of the Statute for a permanentInternational Criminal Court at the diplomatic conference in Rome in July 1998 was, therefore, a trulyhistoric moment in this process of furthering the rule of law and the fight against impunity.

So today we are at another historic milestone: Only four years after the adoption of the Statute of theInternational Criminal Court in Rome, we are celebrating its entry into force. No less than 74 States from allparts of the world have already become party to the Statute, and 139 States have signed it.

The European Union would like to take this opportunity to pay tribute to those who promoted the idea of apermanent international criminal court during the years when even optimists thought the idea impossible. Itis also worth noting the powerful joining of efforts, which the idea of the court inspired. States, groups ofstates, international institutions and civil society, including academia - all have worked together, joined bythe common goal of putting an end to impunity for the most serious crimes of concern to the internationalcommunity as a whole. The European Union wishes to express in particular its acknowledgement andappreciation of the great work undertaken by the coalition of NGOs without which the project would nothave come this far.

We are now on a fast track towards the actual establishment of the International Criminal Court at TheHague. Much work still needs to be done. We must ensure through meticulous planning that the Court willbe in a position to carry out its work. In particular, we have to ensure that the appropriate mechanisms are inplace for the Court to begin functioning effectively as early as possible. The weighty responsibility forgetting the Court off to a successful start - for bringing it alive - rests on all of our shoulders. The EuropeanUnion will do its utmost to assist the Preparatory Commission and its Bureau in this task.

However, the European Union is of the opinion that contributing to the finalising of the outstanding issues isonly one of our responsibilities. The European Union is working towards making the Court truly universal byencouraging as many states as possible to ratify the Statute as the Court�s credibility and chances of workingeffectively are largely dependent on its general acceptance in the international community.

The European Union expresses a strong hope that also those countries hesitant at present towards adhering tothe Statute will join as soon as possible, so much so because we believe that the court will prove itself as aneffective, competent and fair legal institution. Furthermore, the European Union confirms that it stands readyto cooperate with those countries, which may request advice on the scope or operational modalities of theICC.

The EU deeply regrets that the US veto yesterday of a resolution extending the mandate of the UN mission inBosnia-Herzegovina has placed the Security Council members in a difficult situation with regard to supportfor UN peacekeeping and adherence to their commitment to the ICC Statute. The EU welcomes and affirmsthe positions set out in the statements made in explanation of vote in the Security Council by EU membersFrance, Ireland and the United Kingdom, concerning immunity of peacekeepers. The EU hopes thatmembers of the Security Council will adhere to the Secretary General�s strong appeal within the comingdays. The EU would accept any solution that respects the Statute and does not undermine the effectivefunctioning of the Court in conformity with the amended EU Council Common Position of 20 June 2002endorsed by a number of associated states.

Declaration by the Presidency, on behalf of the European Union,on the situation in Nicaragua

Brussels, 28 juin 2002

Now that President Bolaños has been in office for almost six months, the European Union welcomes themeasures taken by the new administration to achieve good governance and fight corruption.

The European Union fully supports the efforts of President Bolaños to raise ethical standards in public lifeand to modernise and rationalise the Nicaraguan economy. Those efforts enjoy the support of the people ofNicaragua. The reforms advocated by the Government are essential in order to strengthen the rule of law andall the democratic institutions.

It is with concern that the European Union has been following recent events in Nicaragua, which evidence adeterioration in the political climate in the country. The situation will make it difficult to achieve theconsensus which Nicaraguan society requires to implement the reforms mentioned. The European Unionaccordingly urges the other institutions of State to collaborate with the Government so that the challengesahead may be met.

The European Union hopes that a constructive dialogue between the various political forces will enable thenecessary legislative reforms to be approved and will facilitate the new appointments at the Supreme Courtof Justice and the Supreme Electoral Council.

The European Union is convinced that it is only through national dialogue that the initiatives necessary forthe development of the country can be carried through to a successful conclusion.

The European Union warmly welcomes the inauguration today of the African Union at its first summit inDurban. With this historic event, African nations have taken an important step towards creating a strongerand more coherent framework for peace, stability, good governance and economic development in Africa.

The tasks of the South African AU Presidency are enormous, especially with regard to giving impetus to thetransformation process and operationalizing links with the subregional organizations. The European Union isencouraged by the perspectives presented for the implementation of the AU, and looks to African leaders todemonstrate the resolve and take the concrete actions necessary to make it operational. The EU is fullysupportive of the AU Presidency in this process.

In this context, the European Union also reiterates its support for NEPAD as a catalyst for Africa'sdevelopment, in line with the aims of the African Union. The EU attaches special importance to the NEPADprinciples of democracy, human rights, the rule of law and political and economic good governance as wellas conflict prevention as cornerstones for the creation of a more conducive environment for peace, stabilityand development in Africa.

The European Union congratulates His Excellency Mr Alvaro Uribe on his inauguration as constitutionalPresident of the Republic of Colombia and offers its most sincere good wishes for his success in the highoffice to which he has been elected, for his personal well-being and for that of the Colombian people.

The new Government of Colombia is facing substantial political, economic and social challenges. TheEuropean Union and its Member States will support President Uribe in his efforts to meet these challenges.In this respect the EU welcomes the commitment of the new Government to the principles of democracy,respect for human rights and the rule of law as well as its intentions to strengthen the institutions of the stateand to work for increased security and to fight against terrorism and drug trafficking.

The EU condemns vigorously all violations of human rights and of international humanitarian law inColombia and calls upon all parties to work for a negotiated solution to the conflict as the only way to bringabout a lasting peace. The EU also denounces vigorously the campaign of intimidation against the mayorsand the town councillors, which represents an unacceptable offence against the local liberties and the runningof the democratic institutions.

Against this background the EU attaches great importance to President Uribe's commitment to seek anegotiated solution and would welcome discussions between the Government of Colombia and the illegalarmed groups once the necessary conditions are met. The EU welcomes the invitation to the UN to play acentral role as facilitator.

The EU will fully support the efforts of the new Government to end impunity and recalls the importance ofbringing the full force of the law to bear on those responsible for the crimes committed.

The European Union expresses its deep concern about the attack carried out on 10 July 2002 against theLiberty Institute Centre in Tbilisi. This attack, as well as other incidents against non-governmental andreligious organisations, undermines freedom of thought and religion in Georgia.

The European Union calls on the Government of Georgia to respect its commitments as a member of theCouncil of Europe and the OSCE. All Georgian citizens have the legitimate right to engage in peacefulactivities, without fear of criminal and violent acts. Failure to improve the current security environment andconsolidate the rule of law will negatively influence both the political and economic situation in Georgia.

The European Union calls upon the Government of Georgia to do all in its power to ensure a rapid andthorough investigation into the incident, so as to bring to justice those responsible for the attack. The EUfurther invites the Georgian authorities to take appropriate measures to ensure the security of non-governmental and religious organisations as well as their staff.

The European Union has closely monitored the legal proceedings in Egypt against Dr. Saad Eddin Ibrahimand the employees of the Ibn Khaldoun Centre and Hoda Association (League of Egyptian Women Voters).

The European Union believes that a vibrant civil society is a prerequisite for the social and economicdevelopment of Egypt.

The European Union is deeply concerned about the sentences passed by the Egyptian State Security Court on29 July against Dr. Saad Eddin Ibrahim and his co-defendants.

The European Union expresses its surprise at the hasty manner in which the ruling was delivered which mayquestion the respect for due process in the trial.

The Ibn Khaldoun Centre and the Hoda Association have - on the basis of duly signed contracts - receivedproject funds worth a total of EURO 315.000 from the European Commission. On the basis of independentaudits, there is no evidence of the alleged falsification of documents which seem to have been central to thecase for the prosecution. In this respect, the EU reiterates its full support of the defendants whom in the viewof the European Union only have carried out their scientific work in a responsible manner.

The European Union is of the opinion that the verdict against Dr. Ibrahim and his co-defendants has doneserious damage to Egypt�s image abroad.

In view of possible new cassation or appeals proceedings, which are allowed under Egyptian law, theEuropean Union will continue to follow Dr. Ibrahim�s case with attention and will remain in contact with theEgyptian authorities.

The EU noted with satisfaction the early promises of political and economic reform in Syria immediatelyfollowing President Bashar Al-Assad�s accession to office, but is concerned about the limited progress so far.The EU therefore invites the Syrian Government to urgently proceed with the reform efforts as initiallyenvisaged.

The ongoing dialogue between Syria and the EU includes matters pertaining to human rights andfundamental freedoms. The dialogue takes place inter alia on the basis of the mutually accepted principles on

respect for human rights of the Barcelona Declaration, and will be reinforced by the future AssociationAgreement now being negotiated between Syria and the EU. Both parties have recognized that a respectfuland continued dialogue is natural between partners and the EU appreciates the positive attitude by the Syrianside towards the ongoing dialogue.

In the context of the human rights dialogue, the EU has on several occasions during the last few years voicedits concern to the Syrian Government on politically motivated arrests and trials of prominent members ofcivil society for peacefully exercising their right to freedom of speech.

The EU deeply regrets the prison sentences passed recently against Riad al-Turk, Habib Saleh, Mamoun al-Homsi, Riad Seif, Aref Dalila, Walid al-Bunni, and other individuals peacefully exercising their legitimateright to freedom of speech and urges Syria to release all political prisoners.

The EU welcomes the fact that its diplomatic representatives were allowed to observe the civil court trialagainst the two members of Parliament, Riad Seif and Mamoun al-Homsi, but regrets having been preventedfrom attending other trials taking place in the State Security Court.

In the context of freedom of speech the EU is also concerned about the continued worsening of workingconditions of the regional and international media in Syria.

The EU will continue to monitor the human rights situation in Syria, in particular in the context of a futureAssociation Agreement. The EU calls on the Syrian Government to respect human rights, including the ruleof law and freedom of expression, in accordance inter alia with the International Covenant on Civil andPolitical Rights, to which both Syria and the Member States of the EU are parties.

The EU looks forward to continuing the dialogue on human rights with the Syrian Government.

The European Union welcomes the orderly holding of municipal elections in Southern Serbia on28 July 2002 and the fact that they were generally conducted in accordance with international standards.

It commends the outstanding job done by the OSCE and the Council of Europe and other internationalobservers which enabled polling to pass smoothly.

These elections are a further step towards the stabilisation of the region. The participation of all communitiesin the process is a sign of maturity, conducive to an environment of political stability as well as economicand social development.

The EU invites all parties involved to continue working in a spirit of dialogue and cooperation and to set upthe new municipal bodies as soon as final results have been certified.

The European Union remains highly preoccupied by the human rights situation in Liberia and urges thegovernment of Liberia to fully respect its recent assurances that the fundamental rights of all citizens andresidents in Liberia would be upheld.

In particular, the European Union strongly condemns the arbitrary detention of Hassan Bility, the editor of'The Analyst' newspaper and two others. The three were arrested on 24 June and accused of being dissidentactivists. They failed to appear in court as scheduled on 1 July.

The EU calls upon the Government of Liberia to take immediate action to reassure the EU of the welfare ofall three and to initiate legal proceedings against them or release them.

The European Union fully supports every effort towards Turkey meeting all the priorities in the AccessionPartnership.

Accordingly, the European Union warmly welcomes the package of reforms adopted by the TurkishParliament on 3 August. It is a first impression that the present reform package constitutes an important stepin the right direction. In its forthcoming Regular Report, the Commission will assess more thoroughly thepackage, as well as all other initiatives and legal amendments undertaken since the last Regular Report. TheCommission�s Regular Report will also evaluate effective implementation and enforcement of the reforms.

The European Union would like to encourage Turkey to continue the efforts made. The European Unionunderlines the need for swift and comprehensive implementation. In this regard, we encourage the Turkishauthorities to enact the regulations mentioned in the present package quickly in order for the letter and spiritof the reforms to take effect without delay.

As underlined by the European Council in Seville, new decisions regarding Turkey's candidature could betaken in the light of developments between the Seville and Copenhagen European Councils, on the basis ofthe Regular Report to be submitted by the Commission in October 2002 and in accordance with the Helsinkiand Laeken conclusions.

Statement by the Presidency on behalf of the European Union on BurundiBrussels, 5 August 2002

The European Union condemns, in the strongest possible terms, the new outbreak of violence against thecivil population and, in particular, the recent indiscriminate bombing of the capital, Bujumbura, by armedgroups. It shares the suffering of the entire population, which is being severely tested.

Confronted by this insane spiral of violence, it takes note with confidence of the announcement of talks inTanzania between the Transitional Government and the armed groups on the conclusion of a cease-fire. Itagain urges the latter to return to the negotiating table and urgently calls on all parties to embark on thisprocess with the firm resolve to give precedence to peace and stability. It calls on countries of the region tocease all support for the military activities of the armed groups involved in the Burundi conflict.

The EU finally repeats its support for South Africa's efforts at mediation and the regional initiative forBurundi. It supports the undertaking by the countries of the sub-region, in particular by Tanzania, to bringan end to the violence and to achieve a cease-fire at the earliest possible date for the greatest good of Burundiand the whole region.

The European Union has followed the deliberations of the People's Consultative Assembly (MPR)concerning the amendment of the Indonesian constitution with interest and considers the decisions taken animportant step towards the further strengthening of democracy in Indonesia.

The fourth amendment to the Constitution of 1945 paves the way for the direct election of the President andVice-President and for a future composition of the MPR consisting entirely of members elected, therebybecoming directly accountable to the Indonesian people.

With the amended constitution and the decision to establish a constitutional commission the MPR hasprepared the ground for the elections in 2004 as well as for a more thorough review of the constitution.

The European Union will follow the implementation of the new regulations with interest and is willing toprovide support if needed and where possible.

Representatives of Donor Missions and UN Agencies in Khartoum welcome the recent progress at the IGADpeace talks in Machakos, Kenya, the meeting between President Bashir and SPLM Chairman Garang inKampala, and the reconvening of the peace talks in Kenya on August 12. However, we are concerned aboutthe serious humanitarian situation that exists in parts of southern Sudan, due to continuing militaryoperations and lack of humanitarian access.

We urge the Government of Sudan and SPLM to make a dramatic gesture on the humanitarian front to matchthe progress in the peace talks, by allowing relevant humanitarian agencies to have immediate free andunimpeded access to all populations in need.

The European Union has been following closely the trials of the Indonesian Ad Hoc Human Rights Tribunalon East Timor and is concerned that the proceedings, so far, have not taken full account of the violence thattook place in East Timor in 1999. The European Union has noted with concern the limited number ofvictims that have been summoned to testify, as well as the absence of witnesses from UNAMET andindependent observers who were in East Timor at that time.

Finally, the European Union would like to underline that only by bringing the perpetrators of serious humanrights violations and crimes against humanity to justice can trust in the judiciary be enhanced. The EuropeanUnion urges the Indonesian authorities to ensure that the proceedings of the Tribunal takes place inconformity with the rule of law � and in full respect of the international human rights standards.

Declaration by the Presidency on behalf of the European Unionregarding Belarus

The European Union reiterates its wish to welcome Belarus among the democratic states in Europe. Howeverthe EU is seriously concerned about the situation on human rights and democracy in the country.

The EU is concerned about the draft of the law �On freedom of conscience and religious organisations�which was approved on June 27 by the House of Representatives to be submitted later to the Council of theRepublic for final approval.

If the said law receives final approval this will further weaken the freedom of conscience in Belarus. The EUis concerned that the draft law will open up for discrimination of religious communities by dividing religionsaccording to their �value� with respect to Belarus, that it will provide a basis for censorship by demandingreligious literature to be submitted to Belarusian authorities before distribution, and that it will be a means togovernment control of religious organisations and make them subjects to sanctions for which circumstancesare not clearly defined.

It is questionable whether the law - if approved - would be in accordance with international agreements towhich Belarus has subscribed.

The European Union encourages the Council of the Republic not to approve the law in question.

The Funtua Upper Sharia Court in Katsina State dismissed the appeal on 19 August lodged by Amina Lawalagainst her conviction in March 2002 for adultery and sentence of stoning to death. The panel of judgesruled that the original trial had been conducted properly and the verdict had been a correct one under Sharialaw and the penal code. They further ruled that, in line with earlier decision by the lower court, Lawal wouldnot be executed until she had weaned the child born out of wedlock - a period set to end in January 2004.

The European Union is deeply concerned about the decision of the court of appeal. The European Unionexpects that Ms Lawal will have all opportunities for appeal at federal level. The European Union willfollow the further proceedings of the case closely. The European Union considers that abolition of the deathpenalty contributes to the enhancement of human dignity and the progressive development of human rights.

Services of general interest play a vital role in the daily lives of citizens and are one of the values underlyingthe European social model. Accordingly, the Committee believes that:

� Article 3 of the EC Treaty should include a reference to the provision of services of general interest

in the list of activities to be undertaken by the Community to achieve its objectives;� there is a need for the Commission to present a proposal for a flexible framework Directive

consolidating the political principles governing services of general economic interest. In somecases, there will be a need for sector-specific Directives in addition to the framework Directive;

Starting from the results so far achieved and the objective difficulties which the policy will encounter inthe short term, the Committee points out the challenges confronting the EU (enlargement, globalisation,worsening of core-periphery imbalances, macroeconomic stability etc.) and goes on to sketch out thesteps which in its view should be taken, in particular:

The objective of a harmonised tax base for all EU companies is compatible with the tax sovereignty of theEU's Member States and regions because it preserves their power to fix the level of tax. It must bestressed here that the transparency of a harmonised tax base would enable economic players to put strongpressure on national authorities, which is not the case today because tax codes are so opaque. The Committee thinks the process for having a harmonised tax base should be tried by companies thathave opted for a European statute, on the understanding that they will have no tax privileges comparedwith other companies. To help them, however, and to make European statutes attractive, one couldpropose to them a consolidated tax base in accordance with the European Commission's second option,which would simplify matters for companies with transnational activities.

Nevertheless, the Committee concurs with the Commission�s assessment that the major portion of theblame for this lack of progress must be laid at the door of the European Parliament, the Council and theMember States.

The incorporation of European legislation into national law in such a way as to produce the necessary

degree of harmony to make a reality of the Internal Market requires the fulfilment of a number ofconditions so the process can be completed. Cardinal among them are:• transposition of the legislation in a uniform and timely manner;• creation of the necessary administrative capacity to enable effective implementation;• exercise of the political will to secure enforcement.

The Committee hails the progress Slovenia has made towards accession.

The Committee stresses that Slovenia has shown its considerable ability to forge links with theEuropean Union in all aspects: politics and institutions, economy and society, culture andcommunications. This is confirmed by the fact that 90% of the chapters contained in the acquiscommunautaire have been transposed and implemented, and also by the development of trade andcooperation with the following countries in particular, in order of importance: Germany, Italy, Franceand Austria.

The Committee highlights the strategic importance of Slovenia's EU accession for stability in theBalkan region. It notes Slovenia has asserted and is strengthening its position in markets of considerable interest to theEU. In its opinion, the Committee analyses:� Slovenia's historical and cultural identity and minorities in the run-up to accession;� the transition process, the progress of privatisation, opening up to foreign investment, employment

policy and the labour market;� the role of the social partners and strategies for future development;� the state of affairs in Slovenia regarding environment, transport, tourism, social services and

consumer protection. The Committee notes that the transformation from a monocracy to a pluralist democracy, from a stateeconomy to a market economy, and the subsequent changes to society, social relations and the needsand aspirations that shape both individual and collective behaviour have all been guided by existingmodels in the EU.

� Key points: The European Economic and Social Committee draws attention to its earlier Exploratory Opinion, muchof which has been taken on board by the Commission. The main problems in occupational health andsafety are addressed; what is clearly missing is an action plan. This omission is worrying. TheCommittee relates it directly to the concerns it has expressed repeatedly in several opinions about thelack of resources. The Committee calls on the Commission to present as soon as possible an action planon implementation of the strategy.

Sections on gender and age in the analytical part of the Communication have not been reflected in theaction-oriented part of the document. The figures regarding consequences of "non-quality" of workappear to be far too low.

Important elements deal with the planned legislative action on ergonomic issues. The VDU Directive isnot an adequate vehicle for additional measures, as there are many more RSI risk factors which are notlinked to visual display screen work. The Committee refers to its observations on psychosocial riskfactors in its previous Opinion.

The Committee notes with interest the way the Commission envisages promoting well-being at work.

A major element in the Committee's Exploratory Opinion comprised suggestions for open coordination.It would have liked to see firmer support for it. Member States should be expected, rather than simplybe encouraged, to achieve joint precise targets in order to reduce work-related accidents and work-related illnesses.

The Committee is somewhat disappointed by the relative lack of attention paid to small and medium-sized enterprises.

There is nothing in the Communication on the recognition of work-related diseases. The Committeeunderscores the importance of harmonising statistics on work-related accidents and illnesses.

The Committee would like to support the idea of setting up a "risk observatory", especially on newrisks.

The Committee strongly recommends that public procurement policy contain a health and safetyparagraph. Contracts should only be granted to contractors who have proper safety and health policiesand practices.

� Key points: The Committee welcomes the fact that the Commission has presented a non-binding instrument. It does,however, regret that the Commission has failed to take adequate account of the difference between self-employed workers and employed workers. The EESC takes the view that self-employed workers shouldonly be included in health and safety legislation in cases where such workers may place employedworkers at risk.

The Committee also draws attention to the fact that Framework Directive 89/391, which has beentransposed into national law by the Member States, sets out rights and duties for employees andemployers. This clear division of rights and duties embodied in the Framework Directive would not befeasible if its scope were extended to include self-employed workers.

It would be desirable for the Proposal for a Recommendation to make provision not just for legislativemeasures but also for measures to help increase the level of awareness of self-employed workersconcerning their own health and safety.

The Committee welcomes and supports the recommendations on access for self-employed workers toservices or bodies with a view to ensuring that these workers have the relevant information at theirdisposal. The EESC also welcomes the recommendation on access to training.

level and to involve welfare associations and foundations;� to approve an EU directive based on Article 13 making it unlawful to discriminate against disabled

people in all spheres of life. In order to increase the employment levels of disabled people: EU Member States should ensure theimplementation of the EU directive on equal treatment in the workplace; the European Commissionshould propose strengthening current guideline 7 in the Employment Guidelines; the social partners atEU level should propose new initiatives for the employment of disabled people; EU directives on publicprocurement should allow for public authorities to include the employment of disabled people as anaward criteria and, finally, the EU Labour Force Survey should include information on the situation ofdisabled people. The Committee hereby commits itself to mainstream disability throughout its work and it will beactively involved in the evaluation of the European Year of People with Disabilities.

The Committee intends to participate actively in the mid-term assessment of the Agenda in 2003, whichis not so far away. However, the Committee wishes at this stage to stress the following:

The recognition of the multi-dimensional nature of poverty is an important step forward. However,

further progress is needed in this direction. The ultimate target must be access to all fundamental rights.The European Union should be more attentive and imaginative vis-à-vis the right to asylum andimmigration, and be more concerned about the social impact of "enlargement". This scoreboard does notalways emphasise sufficiently the role played by "not-for-profit private social services" that work for thegeneral interest in Europe. When it comes to implementing the Social Agenda, consideration must begiven to non-institutional groups set up and led by the so-called "excluded". With regard todiscrepancies in terms of unemployment and exclusion within the Union, the Committee stresses theneed to improve synergies between employment policies and regional policies. Finally, it reiterates theneed to continue with the difficult task of putting into place quality indicators.

The Committee supports the tightening-up of PDO and PGI systems as an effective way of protectingthe rights of the consumer and meeting the consumer's legitimate wish for safe, high-quality food.

The Committee is convinced that action must be taken to stamp out fraudulent use of a designation,and calls on the Commission and Council to tighten up monitoring provisions; it also call son theCommission to devise an aggressive strategy to improve protection of PDO and PGI under the TRIPSagreements so that the level of protection and requirements are on a par with those that apply within theCommunity market.

With a view to encouraging the development of a larger number of rural areas, the Committee considersthat Annex II of Regulation 2081/92 could easily be extended to other agricultural products.

The Committee supports the amendments proposed by the Commission as a way of protecting EUdesignations at world level. This will make it possible for all members to object to a registration andwill also help avoid conflicts.

� Key points: The EESC welcomes the objective system of environmental liability proposed, since its deterrent and

� Key points:

While greeting the White Paper on transport with interest, the EESC would criticise the excessivelyuniform treatment of the problems discussed and the solutions proposed, both on a territorial and on aneconomic, social, environmental and cultural level. Situations and circumstances vary across the fifteenMember States, and different approaches are thus required wherever possible. It also considers that: � some of the measures proposed to shift the balance between modes of transport must not distort

competition. The EESC shares the view, however, that the principle of "regulated competition"

should apply to services of general economic interest, including the various forms of publictransport;

� the strategic importance of goods transport for countries' development and in supplying

mountainous, isolated or very remote regions or areas with lower economic potential must not beoverlooked. Incorporating transport into sustainable development policy and strategy should begeared to steering demand towards the most underused, safe and environmentally-friendly modesof transport, with a view to achieving a more balanced modal distribution;

� insufficient account is taken of the role of public transport regarding the mobility of persons.

Attempts must be made to promote alternatives to private road transport, rather than penalising it; � finally, improving energy and transport efficiency should be made a stated objective of transport

policy and action programmes. Practical measures could include the use of more efficient heavygoods vehicles and alternative fuels.

� Key points:

The Committee generally endorses the proposal for the Marco Polo programme, but believes it shouldbe bolstered with practical measures including:

� tighter inspections and more severe penalties in the event of labour law infringements;� public financing of modal transport infrastructure;� requiring operators to pledge to provide new ongoing services;� procedures for extending the Marco Polo programme up to 2010;� tasking a management committee to monitor actions;� provision for actions involving air and pipeline transport;� approval for projects located in a single Member State provided they have a beneficial impact on

international shipments;� a "European Guide" of multimodal platforms and their characteristics.

With a view to reducing road congestion and improving the environmental performance of the whole

European transport system, which are among the objectives of the Marco Polo programme, theCommittee emphasises the need for a global approach which would change certain economic practices,and for a sufficient increase in financial resources.

� Key points: The EESC believes that there remains much detail to be worked out in the Commission's proposals,

particularly regarding the precise operation of the new framework, consultation arrangements and thesetting and monitoring of targets.

More specifically, the EESC considers that:

� supplementary action to develop additional runway capacity and other landside infrastructure,minimising local environmental impacts, is essential if airspace capacity is to be optimised;

� the premise that safety precedes in ranking order, all other aspects of these proposals, should beenshrined into every element of them. To this end it is expected that standards will be establishedand continuously reviewed;

� the Community must make available adequate instruments for front-end R&D input to assure thecreation and retention of centres of excellence;

� the charging regime to airspace users must be transparent to ensure that the right incentives are givenfor matching investments to user demand;

� the European Regulator must ensure that the payments' regime recognises and rewards the investors�impact wherever it occurs in the chain.

The purpose of the Commission's proposal is to harmonise and simplify the consultative procedure(comitology).

The Committee highlights the importance of the proposal by the Commission as an important step towards acoordinated strategy for simplifying Community lawmaking and improving European governance.

The Committee proposes:

firstly, that the information procedure applied vis-à-vis the European Parliament be extended to theCommittee;

and secondly, that committees which assist the Commission, and on which representatives of civil society sit,be kept informed in accordance with their particular remit.
