End of the term of officeof a German Member of the European Parliament

At its sitting of 17 November 2003 Parliament took note of the appointment of:

Mrs Emilia Franziska MÛLLER (PPE-DE/DE)

to an office incompatible with the office of Member of the European Parliament and established that his seatwas vacant.

Pursuant to Rule 8(4), her membership of the European Parliament ended with effect from 6 November2003.

Statement by the Presidency on behalf of the European Unionon the parliamentary elections in Georgia

Brussels, 14 November 2003

The European Union is closely following the political situation in Georgia and attaches the utmostimportance to the stability of this country. The European Union therefore expresses its deep concern aboutdevelopments following the parliamentary elections in Georgia held on 2 November.

On the basis of the preliminary findings and conclusions of the International Election Observation Mission,the European Union regrets that the election process has fallen short of a number of OSCE commitments andother international standards. Reported irregularities and delays in the voting process on polling day and inthe subsequent counting and tabulation process seem to reflect a lack of political will and administrativecapacity for the conduct of free and transparent elections. It is evident that in some regions seriousirregularities, including ballot-stuffing, occurred and implausible turn-out data raises deep concerns aboutrespect for voters� and candidates� rights. The European Union regrets these developments which weaken thetrust of the Georgian people in the authorities and are in contrast to the evolution towards a democratic civilsociety.

The European Union calls on all parties in Georgia to show restraint in the present situation refrain fromviolence and intensify the search for a democratic solution.

The European Union encourages Georgia to pursue its path towards political stability and economicdevelopment and expresses its willingness to cooperate with the Georgian authorities, together with theOSCE, to help Georgia lay the basis for a better electoral framework in good time for the presidentialelections in 2005. The European Union urges the authorities to avoid in the future problems similar to thosefaced during the recent elections.

The European Union Special Representative will visit Georgia shortly.

The Acceding Countries Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland,the Slovak Republic and Slovenia align themselves with this statement.

The EU hopes that bilateral negotiations will be conducted in a spirit of good-neighbourly relations and withthe aim of finding a quick solution that preserves lasting regional stability.

The EU is of the opinion that, as a matter of principle, such issues ought to be settled through bilateralnegotiations, with due respect for territorial integrity, and without the pressure of unilateral measures.

Should agreement prove elusive, the EU, its Member States and the Acceding Countries consider that thematter could be referred to the International Court of Justice in The Hague.

P 135/03Declaration by the Presidency on behalf of the European Union concerningthe signing, on 16 November 2003 in Dar es Salaam, of the peace agreement

between the Transitional Government of Burundi and the Forces forthe Defence of Democracy movement

Brussels, 19 November 2003

The European Union welcomes the signing, this past Sunday 16 November in Dar es Salaam, of the peaceagreement between the Transitional Government of Burundi and the Forces for the Defence of Democracy(FDD) movement led by Mr Pierre Nkurunziza. After the conclusion of the Pretoria Protocol on Political,Defence and Security Power Sharing in Burundi on 8 October and the subsequent agreements of 2 Novemberbetween the Burundian government and the FDD, the European Union considers that a further stage on theroad to peace has been completed and urges the parties to implement the agreements as soon as possible.

At the same time the European Union regrets that fighting is still going on in several provinces of thecountry, and especially in rural Bujumbura. The EU once again calls on the National Liberation Forcesmovement led by Mr Agathon Rwasa to abandon the military option, which appears to be as increasinglyfutile as it is deadly, aggravating the enormous suffering already visited upon the population. As in itsdeclaration of 14 October, the European Union also calls on the Burundian government to keep the dooropen for negotiations.

The European Union thanks the organisations and countries which made the signing possible: RegionalInitiative, Presidency of the African Union, South Africa, contributors to the African Mission in Burundi. Itreiterates its support for the African Mission in Burundi. The Union also affirms its commitment tosupporting the reconstruction of the country at this crucial stage in its history and emphasises the importanceof the donors' round table which will be held in Brussels on 14 and 15 January 2004.

The European Union strongly condemns the heinous acts of terrorism that today have struck the UKConsulate-General and HSBC's offices in Istanbul, bringing death and suffering to hundreds. The EuropeanUnion sends its sincerest condolences to the relatives and friends of the victims and to the Turkish people.

There can be no justification for such atrocious acts. The European Union offers its full support to Turkey, aclose partner, at this difficult time. Today's events demonstrate once again the need for the InternationalCommunity to work together to combat terrorism in all its forms.

on the current situation in ZimbabweBrussels, 28 November 2003

The European Union wishes to express its continued concern about the climate of tension in Zimbabwe,which is being aggravated by pressure on the judiciary and the intimidation of and violence against theZimbabwean people who are unable to enjoy their fundamental rights.

In this context the European Union strongly deplores:

- the recurrent interference with the right to vote and the right of candidates to register and campaign freelyin elections;

- the arrests of National Constitutional Assembly protestors during a peaceful demonstration on 22ndOctober and the fact that their lawyer was physically barred from meeting with them. The same lawyerhad been brutally attacked previously by the police when seeking their assistance;

- the violent interruption of a peaceful demonstration on 18th November and the subsequent arrest andtemporary detention of the Zimbabwe Congress of Trade Union leaders as well as members of severalcivil society organisations and journalists.

- the attempts to exert undue influence on the judiciary in favour of the government as in the case of theongoing legal proceedings concerning the banning of the Daily News.

The European Union calls on the Government of Zimbabwe to respect the constitutionally andinternationally guaranteed rights of the Zimbabwean people to freedom of expression, information,association, assembly and movement. It also calls on the government to desist from any further action whichcould affect the re-establishment of a national consensus on all aspects of governance, human rights andeconomic development and to invite the UN High Commissioner for human rights and the InternationalLabour Organisation to conduct a fact finding mission in Zimbabwe.

The European Union reiterates its commitment to continue providing substantial humanitarian assistance tothe Zimbabwean people. The European Union�s and its Members States� total response since the beginningof the crisis has amounted to 300 million euros. In this context the EU urges the Government of Zimbabweto create the conditions for the recovery of agricultural production.

The European Union urges the Government of Zimbabwe to engage in active and meaningful dialogue withother national stakeholders, in particular the main opposition party, on ways to solve the political andeconomic crisis.

following the presidential elections in MauritaniaBrussels, 26 November 2003

The European Union has followed closely the conduct of the electoral process and the announcement by theMauritanian Constitutional Council of the official results of the presidential elections held on 7 November2003.

The European Union is pleased that this ballot, won by President Taya whose re-election it welcomes, wasconducted in an atmosphere of calm, with the participation of six candidates. However, it is concerned tonote that one candidate was taken in for questioning the day before and again the day after the ballot, andthat he remains in detention along with some members of his entourage. The Union urges that the rules oflaw should be respected in relation to them.

The European Union calls on those in power and in opposition to resume dialogue in a spirit of openness andresponsibility, so as to ease tensions on the Mauritanian political scene.

Declaration by the Presidency on behalf of the European Unionon the situation in GeorgiaBrussels, 24 November 2003

The European Union notes with satisfaction the peaceful outcome to the political crisis in Georgia over thepast weekend. The European Union calls on all political actors to continue to show restraint, and to refrainfrom the use of force in the testing times ahead. Outstanding differences should be settled through dialogueand within the framework of the Constitution.

The European Union looks forward to working with new political leaders in Georgia to ensure that the willof the Georgian people may be freely expressed and translated into tangible political action. The EU SpecialRepresentative, Ambassador Heikki Talvitie, is meeting with all main actors in Tbilisi to discuss theimmediate way ahead for Georgia. The European Union renews its commitment to assisting Georgia inovercoming its difficulties.

The European Union attaches the highest importance to the sovereignty and territorial integrity of Georgia.It is important to maintain the unity of the Georgian people in its search for a better future. Positivedevelopments in Georgia may contribute to peace and stability in the whole of the South Caucasus.

The European Union pays tribute to the political courage of former President Shevardnadze, whosebehaviour has avoided bloodshed and division of the Georgian people. He has confirmed his statesmanship,and his long career will be remembered for his lasting service to international peace.

The European Union stands ready, together with others and taking account of the particular role of theOSCE, to assist Georgia in the preparation and conduct of the announced elections. It is imperative thatthese be adequately prepared, free and fair, so as to reflect the will of the people of Georgia.

Statement of the Presidency on behalf of the European Unionon initiatives by the Israeli and Palestinian civil societies

Brussels, 2 December 2003

The European Union welcomes initiatives from the Israeli and Palestinian civil societies aiming at promotingrapprochement, confidence building and the establishment of a lasting peace.

The Geneva initiative by Yossi Beilin and Yasser Abed Rabbo confirms the willingness whichexists within the two civil societies to achieve peaceful coexistence in two independent, viable andprosperous states, living side by side in security, to the benefit of all Israelis and Palestinians as well

as of all countries in the region. It is also helpful to increase the awareness of the public opinions ofboth sides on the need to identify the necessary efforts and reciprocal concessions in order toachieve a negotiated settlement of the conflict.

In this regard, the EU considers the document presented on 1st December in Geneva as a valuablecontribution by the civil society in support of the Quartet�s Roadmap which remains the basis for theimmediate resumption of the peace process as endorsed by the entire international community throughUNSC resolution 1515.

The EU reiterates its willingness to further assist in all efforts towards a peaceful solution to the conflict,while condemning violence and terrorism in all its forms.

Declaration by the Presidency on behalf of the European Unionon the latest developments in Côte d'Ivoire

Brussels, 9 December 2003

The EU welcomes the meeting held in Yamoussoukro on Thursday 4 December 2003 between the nationalarmed forces and those of the New Forces, under the chairmanship of the Head of State and SupremeCommander, with a view to resuming the vital and urgent process of assembling and disarming the opposingmilitary forces.

It applauds the statements made by President Gbagbo, clearly expressing his resolve to apply the MarcoussisAgreement in full.

It now trusts that the commitments made at that meeting will be scrupulously honoured.

The EU fully values and encourages these positive developments, which hold out a sign of hope for the swiftand full implementation of the Marcoussis Agreement. It strongly reiterates its call to the New Forces'ministers to resume their participation in the peace process and in government as soon as possible. In viewof the decisions just taken in Yamoussoukro, those ministers' continued absence would now beincomprehensible.

The EU also confirms its willingness to support the reunification and reconstruction of Côte d'Ivoire with allthe means at its disposal.
