GENERAL SCOPE OF WORK:

Design & Fabrication of LPG storage Tank

Supply of LPG tanks, piping & equipment as per below

CLIENTS SCOPE:

All related civil and electrical work.

Covered space, as required, to be provided for storage of material delivered at site

for mechanical work. Also living quarter cum office at site or at a nearby place for

our site engineer and other staff.

Uninterrupted power and water supply as required for completion of job at free of

cost.

All necessary and other statutory approvals / permissions / licenses from

local bodies/government shall be arranged by you at your cost.

Crane for fabrication, installation and commissioning and all other related work to

be provided by you free of cost as and when required by us.

Customs duty, stamp duty , port clearance , local transportation from Apapa port to

site and all other related work in Nigeria .

TERMS & CONDITIONS:

Taxes & Duties: Extra as and if applicable in customer’s country.

1. CHESS-T GROUP GAS TANKS Scope of Work & Supply:

Engineering: - We will carry out Mechanical Design Calculations and prepare

the Fabrication Drawings and will get it reviewed from TPIA.

Preparation of all Procedures such as WPS/PQR/SR/RT/HT etc. and QAP and

get it reviewed from TPIA.

Local transportation from our works in India to Mumbai port

Shipping from Mumbai port India to Apapa port supplying of tanks & related

material, equipment’s etc.

2. Your Scope of Work and Supply:

To furnish us all design parameters. Vessel considered above is of general

parameters, there may be some minor changes after getting the confirmation

for the required parameters.

All for Nigeria ties and charges for Import of all tank as well as all equipments at

Apapa port including customs clearance, customs duty, customs bond,

Stamp duty, port clearance and handling charges and all other applicable

duties or taxes or levies etc as may be required in Apapa port & the charges for

the same to be paid by you at your cost and expenses.

Inland handling and Transportation (From and at Apapa port and up to site)

of all materials (Pre- fabricated material, raw material, Construction material,

Machineries etc) including custom clearance and all taxes and duties for the same

.The expenses for above in your country to be borne by you to your account.

All local approvals and approval for the entire project from, DPR , Soncap,

Energy departments, Ministries and all other government and private







organizations.

All Civil work and electrical is in your scope.

All necessary cranes and equipments for assembly and installation will be in your

scope.

All electrical work up to LPG yard including transformer , panels , cables , MCCB

etc will be in your scope

All fire fighting work, fire fighting pumps, jockey pumps, fire fighting pipe line,

water storage tank etc will be in your scope and you are required to provide

us pressurised water till the inlet of sprinkler system inside LPG yard at the

pressure of 5 to 7 bar.

Installation, testing & commissioning of complete project

3. Payment Terms:-

40% to be paid by you as advance along with the confirmed order against advance

bond valid till the date of bill of lading for supply of materials to Apapa Port 60% on

readiness of the Tanks, Pipe, Flanges, Studs, Nuts, Gaskets, Pump, Compressor and

other material as per scope of supply mention etc against our proforma invoice prior

to dispatch

4. Supply Time:- Brief Stage-wise Completion will be as under:

- Engineering - ½ Month

- Major Plate Procurement - ½ Month

- Fabrication & Testing of tank - 2 Month’s

- Shipment of Tank & other equipment - 1 Month

- Total - 4 -5 Months

Please note that the above is on general/normal working condition and it may vary







as per the prevailing conditions. The completion time will alter if there is any change

in design , layout ,non-receipt of clearance from your side due to any government

approvals/ for Nigeria ties, non-completion of civil work in time as required by us for

various site activities , Power interruption/cut off , Any local interference / problems,

accident , Natural calamities, Political issues, Civil war or any other reasons beyond

our control.

5. Validity of Offer: - 30 Days, thereafter it will be after confirmation in writing.

6. Documentation:

We shall supply the following information regarding the materials used in

fabrication of the tank for your reference and records:

a. Chemical composition.

b. Physical and mechanical strength / properties.

c. Material check test reports

d. All stage inspection reports for L seam, C seam and DP tests.

e. All NDT reports for PT , UT , RT

f. Hydro test reports .

g. The final Third Party’s Inspection Report for tanks.

7. Warrantee / Guarantee: The above Facility will be guaranteed for a period of

12 months from the date of commissioning or 18 months from the date of supply of

material whichever is earlier against any defect in Raw materials and Workmanship.

In case of any defect is observed during the guarantee period, we undertake to

rectify/ replace the defective part free of cost without any obligation.

8. Taxes and duties: The above price is the basic price to be received by CHESS-T

GROUP GAS TANKS

from customer. All Taxes and Duties in NIGERIA like Direct Tax, Indirect tax,

Corporate Tax,







Withholding tax , VAT, Stamp Duty, Custom’s Bond charges, Custom Duty, and / or

any other tax levied or demanded or recovered from CHESS-T GROUP GAS TANKS

by any authority/ authorities in NIGERIA are to the account of the customer .

9. Bank Charges: All Bank charges in NIGERIA are to the account of the customer.

All Bank charges outside NIGERIA are to the account of CHESS-T GROUP GAS TANKS

except for LC confirmation charges which will be to the account of the customer both

inside and outside Shipping.

10. Deductions: The above price is the basic price to be received by CHESS-T

GROUP GAS TANKS from the customer. No deduction or retention of any kind from

the above value shall be made on any account. If any deductions is to be made as

required by any Local Laws, the same to be borne solely by the customer.

11. Insurance: Transit insurance charges for all materials from NIGERIA port to

site to the account of the customer.

12. Confidential information: Specifications, drawings, data, software and other

Information transmitted by seller to buyer are the property of seller or its

supplier. Information marked proprietary or confidential are trade secrets and shall

only be disclosed in confidence on a need to know basis on the condition that it is not

to be reproduced, copied, reverse engineered or used for any other purpose than the

purpose for which it is provided and shall not be disclosed to third parties without

prior written permission from seller. The provision of this section shall not apply to

that part of information which

1) Is or becomes generally available to the public through no fault of buyer

2) Already in possession of buyer prior to disclosure hereunder

3) Hereafter received from a third party who did not receive the same from seller

or under an obligation of confidence or

4) Required by law or governmental agency to be disclosed provided that the

buyer notifies seller of the disclosure requirements and assist seller in objecting to







limiting to such disclosure.

13. Delivery and Documentation: All delivery or shipping dates are approximate

and are best on seller’s prompt receipt of all necessary information from the buyer

to properly process the order. In the event the buyer delays or fails to provide any

information for seller, seller shall be entitled to a sufficient extension of time to

overcome such delay or failure and to an adjustment in the price. The risk of loss

thereto shall transfer to buyer as follows:

a) For sale in which the end destination of the goods is within the country of

manufacture, upon the delivery freight carrier;

b) For sale in which, end destination of the goods is outside the country of the

manufacture, immediately after the goods have passed beyond the territorial limits of

the country of manufacture.

14. In case material is not lifted within delivery period specified in the P.O., then

inventory carrying cost @ 21% per annum shall be charged.

15. Force Majeure: The delivery schedule shall be suitably extended if the following

Force

Majeure conditions affect the seller.

- Acts of GOD.

- Fires, Epidemics, Floods, Riots, Wars.

- Sabotage, Strikes, Lock-outs.

- Any Act of Government Bodies / Institutions / Law Enforcing Agencies.

- Any situation beyond the reasonable control of seller
