TERMS AND CONDITIONS

1. DANSA MANIA is a reality dance competition (the “Competition”) organised by Mediacorp Pte Ltd (the

“Organiser”).

2. The Competition is open to dance group of all genres whose members are Singapore citizens and Singapore permanent residents. Contestants entering the Competition must be of a minimum age of 13 years old and maximum age 40 years old as of 28th October 2018.

3. The following persons are not eligible to enter the Competition:

a. Current permanent full time or part time employees of any one of the Mediacorp group of companies; and/or the immediate families of such staff.

b. Individuals working for any of the Mediacorp group of companies on contract (not being full time or part time employment); and/or the immediate families of such staff.

c. Undischarged bankrupts, persons currently under police investigation or are involved in any legal entanglements, and persons under probation with curfew imposed.

4. At least one member of the group MUST be able to speak Malay. As this competition will be broadcast on

SURIA all interviews with the group will be done in the Malay language.

5. The number of members in a group is minimum 3 and maximum 10.

6. Any change of members in the group will be reviewed on a case by case basis and is subject to the prior approval of the Organiser.

7. Registration is FREE. 8. Each group must complete the official application form and submit the same in person at the audition

venue. 9. All materials sent including photos and videos will be retained by the Organiser and will become property

of the Organiser. The contestants shall assign the copyright to the application videos submitted to the Organiser and the contestants shall, where necessary at the Organiser’s request, sign such further documents and do everything necessary to effect such assignment.

10. The Organiser has the right at any time to require proof of identity and/or eligibility. Failure to provide such

proof within a reasonable time shall, at the discretion of the Organiser, result in disqualification from the Competition. All personal details and information requested by and supplied to the Organiser by each contestant and/or group must be truthful, accurate and in no way misleading. The Organiser reserves the right to disqualify any contestant and/or group from the Competition or auditioning process in its sole discretion, should the contestant and/or group at any stage supply untruthful, inaccurate or misleading personal details and/or information.

11. It is a condition of entry and participation in the Competition that each group and its members: a. Confirms and undertakes that they shall not drop out of any stage of the Competition. b. In the event that the Organiser deems it necessary to re-record any part of the Competition, the group

in question agrees to such re-recording. c. Participate in any promotional and/or publicity activities as may be required by the Organiser including

without limitation, photo shoots, interviews, press conferences which does not interfere with the production schedules.

12. The Organiser reserves the right to disqualify any contestant and/or group in the event of any failure to

attend rehearsals and/or recordings on time or if any contestant / team drops out of the Competition.

13. The Organiser reserves the right to bar any contestant and/or group from appearing in the Competition on the grounds of undesirable conduct and/or appearance. All contestants are advised to be suitably dressed and made-up.

14. It is a condition of entry and participation in the Competition that the contestant has not entered into any

contractual, commercial, sponsorship or other arrangement in respect of his / her name, likeness, image or biography which might be in breach of these terms and conditions or otherwise conflict with the Competition or prevent the contestant from participating in the Competition or the broadcast, promotion, exploitation or sponsorship thereof. Each contestant is also required to refrain from wearing any clothing items bearing designer or sports logos or bearing the name or likeness of a celebrity, living or dead, during any part of the Competition.

15. The Organiser reserves the right to publish/use any photographs and videos taken of the contestants during

the Competition and to use the name and likeness of any contestant, including friends, family, supporters, teachers or any other individual accompanying the group (the “accompanying persons”), for the publicity of the Competition. The contestants shall procure the accompanying persons, at the Organiser’s request, to sign any documents and do everything necessary to ensure that the Organiser shall have the unfettered rights to use such photographs and/or videos.

16. Each contestant consents and agrees to the Organiser recording his/her actions and voice at all stages of the Competition, at all locations and settings, including any live audition(s), whether such recording be audio, audio-visual or in the form of photographs and further acknowledges that the Organiser has the right to edit, telecast or choose not to telecast any such recording. All copyrights or other rights to such recorded footages of the respective contestant shall be vested in the Organiser and each such contestant agrees to assign present, contingent and future rights to his/her recorded footage(s) at any stage of the Competition to the Organiser absolutely. All contestants agree to complete any formalities or sign any documents necessary to perfect this assignment.

17. By taking part in the Competition, the contestants each and all irrevocably give all consents and waivers

necessary for the Organiser to record and use their footage(s) in any manner, for any purpose (commercial or otherwise) and in any part of the world as the Organiser deems fit. The contestants agree that the Organiser and any of the MediaCorp group of companies may use any recording made by the Organiser, including but not limited to, audio recordings, visual recordings, and photographs, for the promotions and publicity of the Competition.

18. The Organiser may freely assign any of its rights or transfer any of its rights and obligations hereunder to a

related company within the Mediacorp group of companies.

19. Each contestant expressly waives any and all rights, which he/she may have, either in law, in equity or otherwise, which or claim to have as a result of any alleged infringements of the contestant’s “moral rights of authors”.

20. All contestants shall be responsible to make any necessary arrangements with his/her employer and family

in anticipation of their expected absence from work and home.

21. All contestants shall be responsible for their own transportation; food and drinks or lodging required by them during or in connection with the Competition and no reimbursement may be sought from the Organiser.

22. The Organiser shall not be liable to the contestants or to their legal representatives for any loss, damage or

injury to their person or property during or in connection with the Competition. 23. The stages of the Competition are as follows:

a. Audition b. 5 challenges rounds. c. Semi-Final d. Final

24. The Organiser reserves the right to cancel, drop, and restructure any part of the Competition for whatever reason, without incurring any liability to the groups and without having to provide any reasons.

25. All performances must not infringe the rights of (including but not limited to copyright, trademark, trade

secret or other rights), or defame or embarrass any person, firm or company. Each group and its members shall indemnify and keep the Organiser, its officers, agents and employees fully indemnified against any and all loss, damage, claims and costs (including costs on a full indemnity basis) suffered and/or incurred as a result of claims and costs (including cost on a full indemnity basis) suffered and/or incurred as a result of the group’s or its members’ breach of any of these terms and conditions.

26. The Organiser reserves the right to require the group to alter/change any dance choreography if it is found

by the Organiser, in its sole opinion to be inappropriate or if the choreography involved dangerous stunts that could cause accidents.

27. In particular, all performances must not infringe any music copyright used in the competition. Groups must

abide by the list of approved music, songs, artists provided by the Organiser and work only with the list given. Groups must not edit or insert any form of additional audio effects, music, or songs of their own or acquired from elsewhere apart from that approved and provided by the organizer.

28. The selection and number of judges shall be at the Organiser’s sole discretion. The decision of the judges is final and no inquiries or appeals, verbal or written, will be entertained.

29. The Organiser reserves the right to add, delete and/or alter the list of prizes offered for this Competition.

30. The finalists and winner of the competition may be required to endorse the publicity campaign for the

promotion of certain products/services such terms and conditions as may be determined by the Organiser. 31. The Organiser has the sole discretion to decide when or whether to broadcast part of all of the Competition,

postpone or change the timing of any such broadcast without incurring any liability to the contestants.

32. Contestants shall not disclose to family members, friends or any members of the public details of pre-recorded segments/programmes before transmission of programmes.

33. Contestants and/or groups shall not give, provide, grant and/or make any interviews, comments and/or

share/disclose any information (whether in written, audio and/or video form) relating to the Competition, themselves or other contestants to:

a. any press or other media without the prior written consent of the Organiser; or b. on any other platform or media, including but not limited to any social networking sites, for example,

Instagram, Facebook, Snapchat and Twitter.

34. Contestants and/or groups shall not at any time (whether during or after the Competition) make any personal appearance, give any interview or allow publication in any media (be it online, print, visual or audio) in any capacity in relation to the Competition, nor disclose any information or details whatsoever concerning the Competition, other finalists and contestants, prize winners, the Organiser or its related companies, officers, licensees and/or agents without the prior written consent and approval of the Organiser. Without prejudice to the generality of the foregoing, contestants shall not make any disparaging remarks or any comments about the Competition or the Organiser which may adversely affect the reputation of the Competition or the Organiser.

35. Any breach of these confidentiality provisions may cause the Organizer irreparable harm and the Organizer may not have any adequate remedy at law. As such, the contestant agrees that the Organizer shall be entitled to injunctive relief against the contestant without prejudice to other remedies that the Organizer may be entitled to as a result of such breach.

36. No contestant and/or group shall at any time during the Competition commercially exploit or aid the

commercial exploitation of his or her participation in the Competition in any way whatsoever.

37. While participating in the Competition, a contestant and/or group shall not, without the prior written consent of the Organizer enter into any agreement with or participate in any other programme produced by any person/company in the business of producing, transmitting or exhibiting programmes for or on television in Singapore or elsewhere.

38. Groups agree that their personal data may be used by the Organiser and its related companies (collectively

“Mediacorp”) to:

a. For Mediacorp or its designated representatives or business partners to provide goods and services to the contestants and matters ancillary thereto.

b. To verify and process payment when the contestants purchase goods and services from Mediacorp. c. For verification and record of the contestants’ personal particulars including comparing it with

information from other sources and using the information to communicate with the contestants. d. For research and analysis, including surveys and polls. e. For publicity and promotional purpose. f. To contact the contestants for future casting opportunities. g. To send the contestants notices, information, promotions and updates including marketing and

advertising materials in relation to Mediacorp’s goods and services and those of third party organizations selected by Mediacorp.

h. To comply with any request from any third party or any order of court or directive from authorities investigating any alleged offence or misconduct or for the purposes of taking legal action against the participants.

39. By participating in this Competition, each contestant consents to Mediacorp collecting, using, disclosing and/or processing his/her personal data for the purposes as described in the clauses above. The contestant further agrees that Mediacorp can transfer his/her personal data out of Singapore to Mediacorp’s third party service providers or agents for the purposes as described in the clause above. 40. All contestants must abide by the applicable terms and conditions as stated in English only. Only the English version of these terms and conditions shall prevail and apply to all the contestants: any translation thereof into other language(s) is for the convenience of the contestants only. Non-compliance with or breach of the applicable terms and conditions shall immediately disqualify the contestants from further participation in the Competition and any prizes won shall be forfeited.

41. These terms and conditions may from time to time be made or amended by the Organiser. All such rules shall be solely interpreted by the Organiser and the Organiser’s interpretation shall be final at all times.

42. These terms and conditions shall be governed by and construed in accordance with the laws of Singapore

and the contestants submit to the non-exclusive jurisdiction of the courts of Singapore.
