As The Washington Post noted recently, “Presidential records belong to history because they help provide insight into the decisions made by a president and his administration. More important, because they are the byproducts of work done on behalf of the nation, those records belong to the people of the United States.” 1 This lawsuit is all about protecting those records and ensuring that the American public will have future access to them. Plaintiff CREW is seeking a temporary restraining order in the face of the White House defendants’ repeated refusal to provide assurances that the only remaining copies of a large body of deleted email records are being preserved as both the Federal Records Act (“FRA”) and the Presidential Records Act (“PRA”) require.
