The attached captioned DCEO Trade Act Documents and the additional grantee certifications are not susceptible to legal review of the terms, as the agreements contain no obligatory terms and conditions for review.
Rather, the documents are a request for additional Trade Grant Funds. This matter is appropriately reviewed by audit if necessary. Given that the application and certifications refer to practices that are beyond the knowledge of the Civil Division of the State's Attorney's Office, we suggest review with the submitting staff member is appropriate.

AUTHORIZING AGREEMENTS FOR WORKFORCE INVESTMENT ACT AND TRADE ADJUSTMENT ACT FUNDING FOR PROGRAM YEAR 2014
WHEREAS, Kane County administers Federal funding provided by the Illinois Department of Commerce and Economic Opportunity for a three-county area, including Kane, DeKalb, and Kendall Counties; and
WHEREAS, said funding supports training and job readiness services for adults, dislocated workers, and youth; and
WHEREAS, the county has been notified that it will receive a formula allocation under the Workforce Investment Act for Program Year 2014 in the amount of $5,777,074 and that it can expect allocations of Trade Adjustment Act funds to serve impacted workers during the year; and
WHEREAS, the local Workforce Investment Board has authorized several subrecipient organizations to provide services to adults and dislocated workers in DeKalb County, and youth throughout the three-county area.
NOW, THEREFORE, BE IT RESOLVED that the Chairman of the Kane County Board is authorized to accept Workforce Investment Act and Trade Adjustment Act funds awarded during Program Year 2014 and to sign grant agreements, certifications and other documents required by the Illinois Department of Commerce and Economic Opportunity to accept said awards.
BE IT FURTHER RESOLVED that the Chairman of the Kane County Board is authorized to sign agreements with the subrecipient organizations named below for the activities and up to the amounts specified for Program Year 2014.

By law, the Chief Elected Official in a local workforce area is fmancially responsible for the use of WIA funds. In a multiple CEO area where one CEO serves as the grant recipient, the other CEOs are not absolved from the misuse of WIA funds. Likewise, in areas where the CEO (in a single CEO area) or the CEOs (in a multiple CEO area) designate a grant subrecipient, the CEO/CEOs* remain fmancially liable for any misuse of WIA funds. All CEOs will be held jointly and severally responsible for the repayment of any misspent funds.
*This refers to the CEO's political unit, not the CEO personally
