I - Home Investment Partnerships Program Overview

A. Introduction

The HOME Investment Partnerships Program (HOME) is authorized under the HOME Investment Partnerships Act - Title II of the Cranston-Gonzalez National Affordable Housing Act (42 U.S.C. 12701 et seq.). Program regulations may be found at 24 CFR Part 92. The HOME program final rule is available electronically and complete information about the HOME program and its requirements can be found by visiting the HOME program website at: http://www.hud.gov/offices/cpd/affordablehousing/programs/home/index.cfm

The HOME program provides federal funds for the development and rehabilitation of affordable rental and ownership housing for low-income households. The program gives local governments the flexibility to fund a wide range of affordable housing activities through housing partnerships with private industry and non‐profit organizations. The intent of the HOME program is to:

• Provide decent, affordable housing to lower-income households;• Expand the capacity of nonprofit housing providers;• Strengthen the ability of state and local governments to provide housing; and• Leverage private-sector participation.

Each year, the Ventura County Entitlement Area receives an allocation of funds for the HOME which is funded and regulated at the federal level by the U.S. Department of Housing and Urban Development (HUD). The amount of funds received depends on the appropriations set aside each year by Congress in the Federal budget and the number and demographics of the other participating jurisdictions throughout the country. Applications for the County of Ventura HOME Program funding must benefit residents of one, some or all of the following County Entitlement Area Communities: the cities of Fillmore, Moorpark, Ojai, Port Hueneme, Santa Paula, and the unincorporated area of the County of Ventura. Applications benefitting residents outside of these areas are eligible but may receive a lower priority for funding than projects serving the County Entitlement Area Communities.

The County anticipates approximately $467,415 in HOME funds available during the 2017-18 program year. The total approximate amount of HOME funds available under this application is $502,499 which includes $35,084 in Program Income received during FY16-17.

The federal HOME program is a complex grant program that has a variety of requirements that must be taken into consideration before applying for funding. This application requests detailed information on the proposed project. To be considered for HOME grant funding, agencies must adhere to all application requirements, submit a complete application and demonstrate HOME eligibility and the capacity to meet all HOME required obligations. B. Eligible Applicants

Cities within the HOME entitlement area (Fillmore, Moorpark, Ojai, Port Hueneme, Santa Paula and the unincorporated County of Ventura); current county-certified nonprofit Community Housing Development Organizations (CHDOs); other non-profit developers, housing authorities, limited partnerships, and for-profit developers proposing HOME-eligible activities are eligible Applicants and are encouraged to submit applications for the HOME Investment Partnerships Program grant funding.

The word Applicant as used in this application and all Attachments includes both the Applicant and all future owners/developers of HOME funded projects.

Individual persons are not eligible to apply for HOME funding; however, individuals may be eligible for assistance from programs that receive HOME funds such as housing rehabilitation or rental assistance programs.

C. Eligible Beneficiaries of HOME Funds

The HOME program is designed to provide affordable housing to low- and very low-income families and individuals. Therefore, the program has rules about targeting program resources and establishes beneficiary eligibility. In general, the incomes of households receiving HUD assistance must not exceed 80 percent of the area median.

The eligibility of households for HOME assistance varies with the nature of the funded activity. HOME income limits are published each year by HUD – See Attachment A. HUD Income Targeting regulations can be found at 24 CFR 92.216-217.

D. Eligible Uses of HOME Funds

Rental Housing : Affordable rental housing may be acquired and/or rehabilitated or newly constructed.

Homebuyer Activities : HOME funds may finance the acquisition and/or rehabilitation or new construction of homes.

Tenant Based Rental Assistance (TBRA): Financial assistance for rent, security deposits and, under certain conditions, utility deposits for eligible beneficiaries.

Homeowner Rehabilitation : Assistance to homeowners with the repair, rehabilitation or reconstruction of their homes.

E. CHDOs – Community Housing Development Organizations

As defined by the Department of Housing and Urban Development, CHDOs (Community Housing Development Organizations) are special types of nonprofit housing developers that are accountable to the low-income communities they serve. Congress and HUD have recognized the role that CHDOs play in housing development by setting aside a minimum of 15% of each jurisdiction's annual HOME allocation for qualified CHDOs. HUD regulations on CHDOs may be found at 24 CFR 92.300-303.

The purpose of CHDO set-aside funds is (1) to promote partnerships between States, units of general local government and nonprofit organizations, and (2) to expand nonprofit organizations’ capacity to develop and manage decent and affordable housing.

Eligible CHDO Activities:

Acquisition and/or rehabilitation of rental housing

New construction of rental housing

Acquisition and/or rehabilitation of homebuyer properties

New construction of homebuyer properties

Direct financial assistance to purchasers of HOME-assisted housing sponsored or developed by the CHDO with HOME funds

F. HOME Program Requirements

HOME Program requirements are extensive and the Applicant must certify that the agency has the capacity to comply with all applicable requirements. Attachment “E” includes a summary of some of the requirements as well as links to program regulations and resources.

Applicants are strongly encouraged to review this information in detail and confer with consultants and legal counsel, as appropriate, to ensure that the Applicant and project are able to comply with all HOME Program requirements.

II – HOME Application Instructions

A. General Application Guidelines

To be considered for funding, projects/programs must be HOME eligible and meet all HUD and County requirements. Complete all sections of this application and answer all sections unless otherwise noted.

All applicants intending to apply are required to submit a mandatory Letter of Intent no later than 4:00 p.m. on December 2, 2016. The letter of intent should include the project name, the Applicant name, a project description, the estimated total development/program cost, the approximate amount of the HOME funding requested and proposed number of HOME-assisted units. The Letter of Intent may be e-mailed (preferred) or mailed to Tracy McAulay using the contact information provided in Section II (D).

Full applications are due no later than 4:00 p.m. on January 6, 2017. Complete application packages will contain all of the following:

One (1) complete paper copy of the following documents:o Originally signed copy of the HOME FY 2017-18 Application, including the applicable Section

IV (select one: Rental Projects, Homebuyer Activities, Tenant Based Rental Assistance or Homeowner Rehabilitation).

o Note that a paper copy of each of the Exhibits (as described in Section VI (A) of this application) is not required.

Incomplete and/or inaccurate information provided in any section of this application (including exhibits) may disqualify the application for funding. E-mailed applications will not be accepted. All pdfs included in the electronic submission should be searchable whenever possible.

A separate application form must be completed for each proposed project. Complete the application form and all supporting documentation thoroughly. If the application is

incomplete or inconsistent, the application may be disqualified. Handwritten applications will not be accepted. Do not alter or delete any portion of the application form (expanding comment boxes for additional text

is permitted) except where designated. “Tailor made” applications will not be accepted.

B. Important Dates

The following is a list of important dates and deadlines.

November 2, 2016 – 1st HUD Funding Public Hearing @ 3:00 p.m. – MANDATORY December 2, 2016 – Letter of Intent to apply due by 4:00 p.m. January 6, 2017 – All HOME Applications due by 4:00 p.m. March 20, 2017 – County notifies applicants of funding recommendations and posts recommendations

on CEO Community Development website. March 27, 2017 – 2nd HUD Funding Public Hearing @ 9:00 a.m. County of Ventura Administration

Building, Lower Plaza Assembly Room – MANDATORY. o Review of funding recommendations for all projects: HOME, CDBG and ESG (if available).

Staff will receive feedback from applicants and the public regarding funding recommendations. Modifications to funding recommendations may be made as appropriate to address significant concerns about final funding recommendations.

May 9, 2017 – Final HUD Funding Public Hearing for Annual Plan at Board of Supervisors meeting.

C. Application Evaluation Criteria

Projects will be reviewed first for threshold eligibility and then ranked based upon the extent to which they meet the priority criteria set forth below. Once the ranking is complete, the top scoring application(s) will be recommended by County staff to the Board of Supervisors for approval. Projects approved by the board will receive a preliminary reservation of HOME funds. Note that HOME funding cannot be firmly committed to a project or program until all of the benchmarks set forth in 24 CFR 92.2 under the definition of “Commitment” are met.

All information submitted as part of this application package will be used to determine the eligibility and priority of each application. It is strongly recommended that applicants carefully review and evaluate all information submitted in this application for accuracy and internal consistency.

Applications will be evaluated for threshold eligibility based on the completeness of the information provided in the application, the extent to which the proposed project meets the goals and priorities set forth in the Ventura County 2015-19 Regional Consolidated Plan, the project’s financial feasibility (developmental and operational viability for the full HOME affordability period), the extent to which the application demonstrates that the project meets all HOME Program and County requirements, and the capacity of the Applicant.

Once threshold eligibility has been determined, projects will be evaluated, prioritized and ranked based on the following factors:

Extent to which the project provides housing for persons experiencing homelessness. Within this priority, projects proposing to provide supportive services designed to assist persons transitioning from homelessness to maintain their housing will receive additional priority.

Extent to which the project provides the largest number of new (or preserved) deed restricted low-income units (note that units do not need to be HOME-assisted to count as restricted low-income units).

Extent to which the project provides the largest number of new units for those at the lowest income levels (e.g. targeted more deeply than 50% & 60% AMI).

Project Readiness, as demonstrated by: o Status of the site control (if applicable);o The status of the development team; o Status of architectural plans; o Compliance with the General Plan and Zoning; and o The percentage of other funding either committed to the project at application or available on a

non-competitive basis. Past Performance, as determined by the County based on previous performance with County grants and

by the Applicant’s grant experience with other federal funds. Extent to which HOME funds are leveraged with other financing. Projects sponsored by a CHDO will receive priority in order to meet HUD’s 15% CHDO allocation

requirement.

V - Preliminary Environmental Review

VENTURA COUNTY HOME PARTICIPATING JURISDICTIONHOME INVESTMENT PARTNERSHIP PROGRAM (HOME)

Project Proposal for Program Year 2017-18

All HOME Projects (with the exception of Down Payment Assistance and TBRA programs) must complete the Preliminary Environmental Review for compliance with the

National Environmental Protection Act (NEPA).

All projects that receive HOME funding must receive National Environmental Protection Act (NEPA) clearance. NEPA is federal environmental protection legislation that is similar, yet often more restrictive than, the California Environmental Quality Act (CEQA). Applicants should be aware that no HUD money may be used to fund projects that cannot receive NEPA clearance.

The required NEPA Environmental Review (ER) must be completed prior to the execution of the HOME Agreement. If the ER is not completed within the specified timeframe, the HOME funding award will be withdrawn.

Projects receiving HOME funds that comprise a component of a larger project, such as site acquisition or predevelopment/design costs for a housing development, shall complete the ER process required for the completed larger project. For example, if a HOME-assisted project is a new construction project, but the HOME funds are used only for the acquisition of vacant land for the project, the environmental review must be based on new construction of housing, as well as the acquisition of the land. As applicable, the project also must receive local environmental clearance in accordance with the requirements of the California Environmental Quality Act (CEQA).

The ER process is the responsibility of the Applicant and must be completed by a qualified contractor; however, the County, as the Responsible Entity, will provide oversight, mentoring and must ultimately agree with the final ER before it is submitted to HUD. When the environmental clearance work for NEPA is defined as categorically excluded not subject to §58.5 or exempt, the ER may be performed by Applicant staff (in lieu of a consultant).

The applicant must pay for the cost of all work related to the ER, including the costs of hiring consultants to prepare the ER and any costs related to project mitigation determined as necessary during the review. The cost of all NEPA-required work may be reimbursed with HOME funding if it is included in the proposed project budget. Prior to Project Completion, the applicant must provide the County with documentation verifying that all mitigation measures were undertaken and completed as described in the ER.
