Thank you for the opportunity to share my concerns and submit questions regarding Discovery Coeur
d’Alene LLC’s (dba Arrow Point Marina) application to a commercial dock extension on the north side
adding 36 more slips and permitting an existing closed-off swim area on Lake Coeur d’Alene.

My name is Jody Bieze and I live at 19521 S Highway 97. By way of background, my family has owned
and lived at this location for over sixty-years.

As you would expect, the size and number of boats on Lake Coeur d’Alene exponentially increased.
Whereas, ski boats in the 80s where designed to create the smallest, flattest wake possible. The later
part of the 90s and beginning of 2000, specialty wakeboard boats were designed to create the largest
wake possible.
Boat wake energy is event-dependent and influenced by several factors including boat’s length, water
depth, and boat speed. Wake energy is most destructive when it does not have the opportunity to
dissipate over distance. Although boat wakes create periodic disturbances, in compassion to
wind/weather waves, boat wakes can create a significant impact to docks along the shoreline due longer
wave periods and greater wave height. Even small recreational boats within 500ft of a shoreline are
capable of producing wakes that can cause impact particularly during frequent exposure to boat wakes.
This is of particular impact to the docks between Arrow Point Marina and the Panhandle Yacht Club.

As discussed w/ Matt Baine on 12 November 2019, my personal experience with Discovery Coeur
d’Alene LLC [over the past fourteen years] has been unpleasant and more times than I would prefer
extremely painful. Their demonstrated lack of regard is a matter of record. However, my meeting with
Matt Baine was cordial and I thanked him for being kind. Mr. Baine shared with me that being a good
neighbor and service excellence are of paramount importance to Gozzer Ranch Golf and Lake Club,
regardless if one is a member.

During the spring, Gozzer’s shuttle service boats take to the water increasing the number of shuttle trips
throughout the summer months. Additionally, wake boats run back and forth between Arrow Point
Marina and Neachen Bay. The wake waves created, especially by larger boats, shuttle boats, and wake
boats, are significant rolling waves that crash over the top of private-owned docks. Despite posted wake
zones, boat-wake waves travel outside of no wake zones, carrying a large amount of energy with them,
which creates a continuous pounding of waves to the docks along the shoreline between Arrow Point
Marina and the Yacht Club.

Natural waves including storm waves generated by weather fronts require open water to form,
however, boat-wake waves come from any direction where the boat is operating. Heavy trafficked
waters can be covered in boat-wake waves traveling in all directions throughout the day. Because of its
concentration of energy all moving in one direction, boat-wake waves carry more energy with it then a
wind wave of the same height. This makes frequent boat wake impact potentially more damaging then
storm waves.

Concerns

skies.

What facility features are available to the public?
Kootenai County has 21 public marine facilities owned and managed by Kootenai
County that include a description of facility features and parking options. Facilities
only accessible by water include facility features, such as boat docks, picnic tables,
and restrooms.
How will the maximum size of Arrow Point Marina be determined? Who will determine
when the marina has reached its “maximum” size?

The Encroachment Permit Number L-95-S-3997E Dated 27 February 2006, granted Discovery
CDA Investors, LLC dba Arrow Point Marina to install and maintain a commercial marina
extending 470 feet waterward OHWM consisting of a total of 146 slips. How was the initial
number of slips determined?
The document dated 27 February 2006 indicated a marine pump-out facility. (Please reference
section 21 of the agreement.) Where is the marine pump-out facility? Is it available to the
public?
The Grill property description (previously known as Eddie’s) included in the application packet, is
no longer opened to the public. Is the property description relevant to the marina extension
request?

The Use of Leased Premises defines commercial marina as 146 slips. Were all the slips at the
time of application (2006) public? As referenced in section F (page 3 of 15) of the lease
provisions indicates a change in operations and convert of some moorage to private use must
keep 50% of moorage available for use by the general public. Is the term general public defined
to mean people who live or own property in Kootenai County? Is the current number of slips
available to the public 73?
Section 7. Lessee’s Compliance with Applicable Laws and Rules (page 5 of 15) subsection B. No
Waste or Nuisance, “The Lessee shall not do anything or allow any action, which will create a
nuisance or a danger to persons or property.” Is the No Waste or Nuisance referring to Idaho
Code 55-101 NUISANCE DEFINED. Anything which is injurious to health or morals, or is indecent,
or offensive to the senses, or an obstruction to the free use of property, so as to interfere with
the comfortable enjoyment of life or property, or unlawfully obstructs the free passage or use,
in the customary manner, of any navigable lake, or river, stream, canal, or basin, or any public

park, square, street, or highway, is a nuisance. Who holds Discovery Coeur d’Alene Investors,
LLC accountable to comply with this requirement?

Kootenai County Community Development indicated the slip extension request by Discovery
Coeur d’Alene Investors, LLC will require additional parking stalls. In speaking with the planner,
Discovery Coeur d’Alene Investors, LLC stated additional slips will be used by residents and
therefore parking will not be needed. Gozzer Ranch Golf and Lake Club is a private club. How is
“general public” defined? Who will hold Discovery Coeur d’Alene Investors, LLC accountable to
comply with this compliance requirement?
Discovery Coeur d’Alene Investors, LLC proposed additional parking at the top of hill along
Highway 97. Is consideration given for the distance a person will have to walk to get to their
boat slip? Where will the individual store their trailer? Where will the individual launch their
boat?
A request has been made to permit the swimming area. Will the swimming area being extended
as well? If so, will the docks be moved further out?
