ABSTRACT:
Objectives
Exchange of a Best Practice Model (practiced in Germany, Netherlands and United
Kingdom) for incorporating mediation into the tight 6-week time frame (Brussels
IIa/Recast) of international child abduction proceedings in Spain, Italy and Poland.
Plugging a gap by providing a means to assist in the recognition, enforcement of
mediated “package” agreements (parental responsibility, maintenance and other
matters) in child abduction,parental responsibility, relocation cases between EU
Member States in general and specifically in Germany, Spain, Italy and Poland by
developing best practice tools.

4 research reports; development of an EU, 4 country specific best practice tools, case
scenarios, evaluation.

ABSTRACT:
Objectives:
entrust a team of inspectors from national judicial inspection services with the task of
studying the conditions under which the European instruments of judicial cooperation
in civil matters are implemented by the national courts and with the task of proposing
any possible improvements;
develop tools for evaluating these instruments for these inspection services,

Evaluation of the implementation of several instruments of judicial cooperation in civil
matters by national courts.
Type and number of persons benefiting from the project:
the European institutions, in particular those in charge of the European Judicial Network
in Civil and Commercial Matters (EJN) and EU Justice Scoreboard, the central
authorities of each Member State responsible for implementing the European judicial
mutual assistance instruments, the national judicial inspection services, the judges,
prosecutors, the judicial staff, the lawyers, bailiffs and notaries in charge of the cross-
border mutual assistance procedures, European citizens subject to measures in the field of
civil judicial cooperation.

Expected results:
provide to the national and European institutions additional information on the
implementation of instruments of judicial cooperation in civil matters;
identify and promote national good practices for a strengthened cooperation and a
better exchange of information between competent national authorities;
analyse any difficulties in the implementation of the aforementioned instruments and
propose improvements in order to increase the capacity of national practitioners to
address issues related to judicial cooperation in civil matters;
develop a common methodology for evaluating the implementation of the said
instruments.

ABSTRACT:
Objectives
The project’s main objective is to shed light (also through the collection of relevant data)
on the terms whereby the relationship between Regulation No 1215/2012 (Brussels Ia)
and other EU law instruments is to be handled, with a view to investigating the impact
that the above mentioned issue produces upon the effective application of the EU law
acquis on judicial cooperation in civil matters and with specific regard to the effective
enforcement of judgments, in light of the collected case-law, consistently with the
priority of the call.

Expected results

in civil matters through the identification of possible solutions to mitigate the main
criticalities examined.

ABSTRACT:
Objectives
The project aims to cover the existing information gap on enforcement procedures,
requirements, competence, costs and timing in the 28 EU Member States (29
enforcement systems). Specifically: collect accurate information on enforcement
legislation, procedures, expenses and professionals across EU enforcement systems;
compile, present and compare this information in a user-friendly and accessible way;
make this information accessible online through the EU Enforcement Atlas and integrate
it with the EU judicial atlas.
Activities
Data collection and analysis, quality control and compilation of this information in a
uniform, accessible and user friendly format;
Making information on enforcement available and accessible; integrating it with the
European Judicial Atlas; launching the EU Enforcement Atlas and disseminating
results to all stakeholders. This will be achieved through: accessible enforcement e-
manuals, user-friendly EU Enforcement Atlas website, regular information updates.
Dissemination and awareness activities, through a launch event of Enforcement Atlas
combined with a European roundtable on the future of enforcement of claims and an
information campaign through internet, social media and national chambers, targeting
judicial officers, lawyers, notaries and stakeholders across the EU.

Final beneficiairies: children who become the victim of an international child
abduction (1320 cases reported to 116000 holtines in 2016, app 130 000 international
couples file for divorce each year in the EU);
Direct beneficiairies: legal professionals (judges, lawyers, Central Authorities,
mediators, guardians at litem, police,… involved in cases of international child
abduction in Europe).
Expected results
The development of specific tools that can help to improve the situation of children in
cases of international child abduction;
Create good practices to provide better and more child-friendly information to
children in all stages of the international child abduction;
Create good practices to inform children on a return decision and inform and involve
them in the practical organisation of the enforcement of the decision;
Create good practices to provide age-appropriate and child-friendly good practices to
provide assist children upon return and after return, so that their reintegration can be
organised smoothly;
The exchange of good practices and the creation of collaborations between
professional stakeholders in the member states to improve the daily lives of children
in cases of international child abduction and their wellbeing upon enforcement of
return decisions.

ABSTRACT:
The project aims at increasing cross-border cooperation between EU Member States
using in particular two Framework Decisions (FDs) - 2002/584/JHA on the European
arrest warrant and the surrender procedures between Member States and 2008/909/JHA
on the application of the principle of mutual recognition to judgments in criminal matters
imposing custodial sentences or measures involving deprivation of liberty for the purpose
of their enforcement in the European Union.
Objectives:
Transfer knowledge between EU MS legal practitioners responsible for extradition,
and to jointly explore best practice in and sustainable development of cross-border
cooperation in the application of the European Arrest Warrant, whilst respecting the
protection of fundamental rights.
Analysis of partners’ prison and legal protection systems, with findings providing a
baseline for the development of standards which lead to a standardized procedure for
the provision of information by the issuing member state according to each individual
case, contextualized in referral to international standards.

elements from participating practitioners

Creation of an an effective toolkit for EU MS legal practitioners to get an in-depth

Realising of a comparative study on the evolution of the main “rewarding measures”
in the selected Member States.
Creation of one or more European models of rewarding measures for a future vertical
harmonisation.
Verification of the operational limits of Article 16 of Directive (EU) 2017/541
(mitigating circumstances for repentant terrorists) and production of guidelines for its
implementation.

rewarding measure;
Feasibility study on the possibility to harmonise the rewarding measures for
terrorists;
