Occupational Health and Safety Act, 1983

Without limiting the generality of the provisions of clause 7.1 of

the Agreement, the Contractor's attention is drawn to the

provisions of the Construction Regulations, 2007 issued in

terms of the Occupational Health and Safety Act, 1993. The

Contractor is to enter into an agreement with the Employer

shall prepare a documented Health and Safety specification for

the works (refer to part C5 for a copy of the specification) and

to ensure that the has made provision for the cost of health and

afety measures prescribed during the execution of the Works

This clause shall be amended as follows:

14.1 The security required shall be as described in the bid

document and shall be in the form of cash, a certified cheque or

bank guarantee from a banking institution registered in terms of

the Banks Act 1990 (Act No 94 of 1990) or from an insurer

registered in terms of the Insurance Act 1943 (Act No 27 of

1943)

14.2 Such selected security shall be provided within fourteen

(14) calendar days of written acceptance of the contractor's

tender.

14.3 For second highest scoring bidder security shall be provided

notification of the contractor's tender.

14.2 No Clause

14.3 The Employer's entitlement to recover expense and loss

in terms of 33.0 shall take precedence over the reducing of the

surety or proportions thereof

14.4.1 A fixed construction guarantee to the value of 10% of the

contract amount shall be applicable

14.5 The parties shall expressly agree that neither the

Employer nor the Contractor shall be entitled to cede the rights

to the surety to any third party and the Employer shall apply the

security strictly according to the provisions of this agreement

(14) calendar days of written acceptance of the contractor's

tender

guarantee if, in the opinion of the employer, the guarantor is

not accredited

31.17 Retention Fund

31.17.1 The Employer shall withhold from the Contractor

retention of 10% up to a maximum amount of 5% of the contract amount

of all payments made before the issuing of the certificate of

practical completion. No interest is to be paid to the Contractor

on the retention. The retention fund shall be held by the

Employer as a guarantee to the Employer for the completion

of the contract.

31.17.2 Fifty percent (50%) of the retention fund shall be

released to the Contractor on the issuing of the certificate of

practical completion, and the remainder on the issuing of final

completion on certificate and acceptance of the final account..

OCCUPATIONAL HEALTH AND SAFEY ACT - SECTION

The tenderers attention is drawn to the fact that the

Occupational Health and Safety Act (Act 85 of 1993) is in force.

Copies of the Act are available from the Government Printing

Works, 149 Bosman Street, Pretoria, (Private Bag X85,

Pretoria, 0001, Tel No. (012) 334-4500).

Tenderers are expected to be fully acquainted with the

requirements of the Act

A pro-forma "Agreement in terms of the Occupational Health

and Safety Act - Pat C 1.4" is included in these bid documents.

Tenderers are advised to study this pro-forma in order to make

responsibilities of the Act and the Municipality.

COMMUNITY EMPLOYMENT AND SMME

INVOLVEMENT

The building related projects of the EMM shall be labour

intensive and shall promote community employment in the

execution of the contract resulting form their tender.

Furthermore, it shall contribute to the development of SME's

(Small and Medium Enterprises) especially from previously

disadvantaged communities

 A minimum of 30% of the contract value must be  utilised in payment of at least one or more of

the following:

(a)               Emerging sub-contractors

(b)               Emerging suppliers

(c)               Local labour

(d)               Or similar local content as approved by the employer.

Local Labour

It is an explicit condition of this contract that only persons

normally resident in the locality of the works (Local Labour) may

be employed on the contract. Provided however, that should

adequate and appropriate labour not be available within the

locality, other labour may be employed, subject to the approval

of the Representative/Agent and satisfactory proof being

provided that every reasonable endeavour has been made, to

employ labour from the immediate locality. The contractors

shall identify the local community leaders, with the purpose of

negotiation with them, regarding utilisation of local labour in

the construction process. In this regard, the Contractor shall

furthermore give preference, where possible, to the

employment of women, youth and disabled

Protection of existing services

The contractor must make allowance against the relevant items for the following: (a) Necessary

care to be taken when excavating near existing services in or across the path of excavations (b)

Protection and maintaining such service in operation by means of temporary supports or shoring

as necessary (c) Delays and disruption of the progress of the work due to the existence of the

service (d) Repairs necessitated by damage caused by the contractor

Controlling and re-routing of traffic

The contractor must make allowance next to the relevant item for the following: (a) Temporary

road traffic signs required for controling traffic (b) Construction and maintenance of bypass/es

and associated facilities where and when required (c) Warning lights, flagmen, barricades

CONCRETE, FORMWORK AND REINFORCEMENT

Lightweight concrete

Lightweight concrete shall have a density of 600kg/m3 for the top 50mm and 400kg/m3 for the

remaining thickness. The minimum thickness at outlets, channels, etc shall be 50mm

Cost of tests

The costs of making, storing and testing of concrete test cubes as required under Clause 7

"Tests" of SABS 1200 G shall include the cost of providing cube moulds necessary for the

purpose, for testing costs and for submitting reports on the tests to the Architect. The testing

shall be undertaken by an independent firm or institution nominated by the Contractor to the

approval of the Architect (Test cubes are measured separately)

Formwork

Description of formwork shall be deemed to include use and waste only (except where described

as "left in" or "permanent"), for fitting together in the required forms, wedging, plumbing and

fixing to true angles and surfaces as necessary to ensure easy release during stripping and for

reconditioning as necessary before re-use

The vertical strutting shall be carried down to such construction as is sufficiently strong to afford

the required support without damage and shall remain in position until the newly constructed

work is able to support itself.

Formwork to soffits of solid slabs, etc. shall be deemed to be slabs not exceeding 250mm thick

unless otherwise described

SUPPLEMENTARY PREAMBLES

"Polycop" polypropylene pipes

Polypropylene pipes 54mm diameter and under shall be seamless copper coloured class 16

pipes jointed with "Fast-fuse" heat welded thermoplastic or brass compression fittings as

designed for use with copper pipes as stated.Pipes shall be firmly fixed to walls etc with coloured

nylon snap-in pipe clips with provision for accommodating thermal movement and jointed and

fixed strictly in accordance with the manufacturer's instructions. All pipe diameters are nominal

external.

"Polylink" polypropylene pipes

Polypropylene pipes 63mm diameter and over shall be class 12 pipes jointed with cast iron

"Supraclamp" running joints. Fusion welded bends, once or twice mitred as necessary, and tees

shall be factory manufactured.

Fusion welded bends and tees shall include jointing to pipes with PVC rubber ring double Z joint

couplers. Branch tees shall include flanged and bolted joints to "Polycop" branch pipes in

addition and for brass compression male iron to copper straight couplers.

Reducers shall include jointing to pipes with PVC rubber ring double Z joint couplers and

reducers shall be of sufficient overall length to accommodate same. All pipes shall be jointed

and fixed strictly in accordance with the manufacturer's instructions. All pipe diameters are

nominal external.

uPVC pipes and fittings

Sewer and drainage pipes and fittings shall be jointed and sealed with butyl rubber rings. Soil,

waste and vent pipes and fittings shall be solvent weld jointed.

uPVC pressure pipes and fittings

Pipes for water supply shall be of the class stated. Pipes of 40mm diameter and smaller shall be

plain ended with solvent welded uPVC loose sockets and fittings. Pipes of 50mm diameter and

greater shall have sockets and spigots with push-in type integral rubber ring joints. Bends shall

be uPVC and all other fittings shall be cast iron, all with similar push-in type joints.

Copper pipes

Pipes shall be hard drawn and half-hard pipes of the class stated. Class 0 (thin walled hard

drawn) pipes shall not be bent. Class 1 (thin walled half-hard), class 2 (half-hard) and class 3

(heavy walled half-hard) pipes shall only be bent with benders with inner and outer formers.

Fittings to copper waste, vent and anti-syphon pipes, capillary solder fittings and compression

fittings shall be "Cobra Watertech" type. Capillary solder fittings shall comply with ISO 2016.

Only compression fittings shall be used in walls or in ground.

Reducing fittings

Where fittings have reducing ends or branches they are described as "reducing". In the case of

pipes with diameters not exceeding 60mm only the largest end or branch size is given. Should

the contractor wish to use other fittings and bushes or reducers he may do so on the

understanding that no claim in this regard will be entertained. In the case of pipes with

diameters exceeding 60mm all sizes are given and no claim for extra bushes, reducers, etc will

be entertained.

Fixing of pipes

Unless specifically otherwise stated, descriptions of pipes shall be deemed to include fixing and

chasing into walls etc, casting in, building in or suspending not exceeding 1m below suspension

level.

(heavy walled half-hard) pipes shall only be bent with benders with inner and outer formers.

Fittings to copper waste, vent and anti-syphon pipes, capillary solder fittings and compression

fittings shall be "Cobra Watertech" type. Capillary solder fittings shall comply with ISO 2016.

Only compression fittings shall be used in walls or in ground

Fixing of pipes

Unless specifically otherwise stated, descriptions of pipes shall be deemed to include fixing to

walls etc, casting in, building in or suspending not exceeding 1m below suspension level

Lead pipes and fittings

All soldered joints shall be wiped and brass unions shall be used for jointing lead to steel

Reducing fittings

Where fittings have reducing ends or branches they are described as "reducing". In the case of

pipes with diameters not exceeding 60mm only the largest end or branch size is given. Should

the contractor wish to use other fittings and bushes or reducers he may do so on the

understanding that no claim in this regard will be entertained. In the case of pipes with

diameters exceeding 60mm all sizes are given and no claim for extra bushes, reducers, etc will

be entertained

Wire gratings

Descriptions of gutter outlets etc shall be deemed to include wire balloon gratings

Septic tanks

Descriptions of septic tanks shall be deemed to include excavation, bedding and jointing,

concrete base slabs, jointing to drains and backfilling, compaction, etc all in accordance with the

manufacturer's instructions

Exposed concrete surfaces

Exposed surfaces of concrete stormwater channels, cover slabs, inspection eye marker slabs,

ELECTRICAL INSTALLATION

PROJECT AND GENERAL SPECIFICATIONS

The project and general specifications applicable to the electrical work are issued as separate

documents which form part of the tender documentation. No specific reference in the

descriptions in these bills of quantities is made to particular clauses in these specifications.

Tenderers are however to acquaint themselves fully and read the descriptions closely with the

applicable clauses in these specifications for the full intent and meaning of each description.

SUPPLEMENTARY PREAMBLES

The firm which is to carry out the electrical work shall be a firm of experienced specialists to be

employed as a domestic subcontractor to the main contractor.

The measurement of these quantities is based on the contract drawings and will not be subject

to adjustment except in compliance with an order in writing. The quantities for cables, conduit

and conductors are assessed in relation to indicated positions of distribution boards and outlets

etc. and are taken as final unless the contractor is in disagreement, to which end he will be

required to indicate on drawings the sizes and routes of all cables and conduits for each circuit

as built. Similarly the numbers and sizes of conductors in each conduit must be indicated. This

information must be verified by the representative/agent and passed on to the quantity surveyor

for adjustment if necessary. All payments for work done will be based on the original quantities

unless the quantities for the cables, conduits and conductors have been adjusted in terms of the

foregoing.

Prices for conduits shall include for fixing to all types of surfaces, in chases including chasing

and making good, casting in or building into brickwork etc.
