NORMATIVITY

◦ President Juan Manuel Santos sanctioned Law 1787 of 2016, approved by the Congress of the Republic, which allows safe and informed access to the medical and scientific use of Cannabis and its derivatives in the national territory.

Licenses for import, export, manufacture, acquisition, storage, transportation,marketiong, production, processing and distribution of products derived fromthe cannabis plant.

License:Authorization given by the control authorities through an administrative act, tocarry out the activities related to the management of seeds for planting, thecultivation of cannabis plants, and the transformation of cannabis for theproduction of psychoactive derivatives and not psychoactive, for medical andscientific purposes.

LICENSES

CURRENT LEGISLATION:

Article 7°. The follow-up to the granting or compliance with the license granted by the Ministry of Health andSocial Protection and the Sub directorate for Control of Chemical and Narcotic Substances of the Ministry of Justiceand Law will have to components:

1. Administrative component: Technical and legal monitoring of the parameters required for the granting oflicenses or of which the granting of license was granted. This component is a charge of the Ministry of Health andSocial Protection and the Sub directorate of Control and Inspection of Chemical and Narcotic Substances of theMinistry of Justice and Law, as appropriate, with the support of the Colombian Agricultural Institute (ACI).

2. Operational component: This refers to the exercise of monitoring and evaluation activities required to verify thetechnical and legal parameters mentioned in the administrative component. This component will be in charge ofMinistry of Health and Social Protection and the Sub directorate for the Control and Inspection of Chemical andNarcotic Substances of the Ministry of Justice and Law, as appropriate, with the support of the National DefenseMinistry when it’s required, though the Military Forces or the National Police and the Colombian Institute ofAgriculture and Livestock (ACI), or the one that acts as part of their respective competencies.

TYPES OF LICENSES1. Cannabis derivative manufacturing license: For the processing of cannabis for medical and scientificpurpose, which may include the manufacture, acquisition, import, export, storage, transportation,marketing and distribution of psychoactive and non-psychoactive cannabis derivatives.

2. Seed use license: Seed management, which may include the acquisition of any title, import, storage,marketing, distribution, possession and final disposal, as well as its export and use for medical purposes andscientists.

3. License for the cultivation of psychoactive cannabis plants: For the cultivation of psychoactive cannabisplants, which may include the sowing, acquisition and production of seeds, storage, marketing, distributionand final disposal, as well as export and use for medical purposes and scientists.

4. Non-psychoactive cannabis plant cultivation license: To advance the growing activities of cannabis plantswhose percentage of THC is less than 1% in dry weight, which may include planting, acquiring andproducing seeds; Storage, marketing, distribution and final disposal of plants, as well as export and use formedical and scientific purposes.
