ASK THE RABBIQuestion: If I am listening to a Daf Yomi podcast while walking my dog, am I allowed to continue listening as I clean up after my dog? - Ora Cohen RosenfeldQuestion: If you're walking your dog and listening to the daf and he poops, can you tell people that you cannot pick it up because its against Judaism!? - Eitan Skolnick (age 10)Answer: Ora and Eitan. Excellent question! While I noticed that the two of you asked the question in slightly different ways, the question of course pertains to something we learned on daf a few days ago. According to the gemara in Brachot one may not daven/learn/say shema in the presence of human excrement. One would have to actually walk at least 4 cubits away from where the smell ends. This would obviously mean that one has to be careful about saying shema or davening while changing a diaper. In the ancient world, these questions were very important as there werent really dedicated bathrooms and people would be trying to say the shema in the right time but often times not able because they were in the presence of human or animal waste. The shulchan aruch (79:4) rules that if animal waste smells bad then it would have the same halacha as human waste. There is some discussion about whether one can be more lenient with regards to Torah study than for shema and tefilah. But it is certainly preferable to pause the podcast while you are cleaning up after your dog. Once the waste is in the plastic bag (even if it is a clear plastic bag) then the gemara says that if it is covered, you may daven or learn. Thank you Ora and Eitan for the question! I love when halachic questions come out of learning daf!
