Northeast Community School District Board Meeting Minutes July 18, 2018 Board President Richard Krogmann called the regular meeting to order at 5:00 P.M.. Present were Directors Mary Smith, Shawn Rathje, Jeni Grantz, Board Secretary Marx and Superintendent Gray. Andy Friedrichsen arrived at 5:08 P.M. Leigh McEwen and Jennifer Huling were present. Also, Media representative, Nick Joos, The Observer, was present. During public forum, secondary teachers, Marci Rickords and Rachel Pasker, spoke about the new Tier III Reading course that is an action item on the agenda. They have been working together developing the class with Rachel Pasker teaching it. Also during public forum, Jenna Stevens, spoke about an upcoming opportunity for the Current Ag Concerns students to attend the Iowa State Fair, conduct interviews and broadcast results for KCLN. The overnight stay for the students is an action item on the agenda. Moved by Jeni Grantz, Mary Smith to approve the consent agenda which included approving bills outstanding, recapitulation/finance summary, minutes from June 20th, and the following open enrollments:

2018-2019 Open Enrollment IN 6 Students from Clinton CSD 2 Students from Camanche CSD 2 Students from Easton Valley CSD

Motion carried 5-0.

Information and Discussion Items—

Superintendent Gray said that admission tickets for varsity football games will be $5 for adults and students starting this year. It used to be $4 for students. He has received 2 bids for removing and replacing the perimeter fence along Hwy 136. The lowest bid is $24,000. Unless the board objected, he hoped to get the process started. He gave a report on the National Principals Conference that administrators attended last week. The speakers and presentations for very worthwhile. Area principals will be meeting in August to discuss their ideas and suggestions on the North Regional Center for CTE. Beckwith Roofing is on the 2nd phase of roof replacement at the Middle/High School building. Northeast Teacher, Joel Frost, was award as this year’s Southeast District Star FFA Advisor at the Iowa Association of Agricultural Educators Conference.

Principal McEwen stated she also thought the conference last week was great and was thankful she had the opportunity to attend. She is ready for the year to start and ready for kids to be here.

Jennifer Huling gave a report to the board on the things going on at the Middle/School building.

Recommendation to approve the resignation of Ann Claussen as School Bus Driver at the end of the 2017-2018 school year. Recommendation to approve the appointment of Octavio Cruz for the position of Assistant Middle School Football Coach. His salary will be $1,851.89 which is 7% of the Schedule B base of $26,455.58. Recommendation to approve the appointment of Shelly Mahmens as Elementary Teacher for the 2018-2019 school year. Her salary will be $55,689.33 based upon BA+24 Step 28 of the 2018-2019 Salary Schedule. Recommendation to approve the appointment of Jacob Schaefer as HS Student Council Advisor. His salary will be $793.67. This is 3% of the Schedule B base of $26,455.58. Recommendation to approve the appointment of Kori Cudney as Associate. Her salary will be $10.95 per hour, Step 6 of the 2018-2019 Associate Salary Schedule. She will work 7 hours per day, Monday through Friday. Recommendation to approve the appointment of Eileen Petersen as Associate. Her salary will be $10.19, Step 1 of the 2018-2019 Associate Salary Schedule. She will work 4.5 hours per day, 2 days per week. Recommendation to approve the appointment of Jennifer Huling as Interim Middle/High School Principal for the 2018-19 school year. Her salary will be $88,000.00

Motion carried 5-0.

Moved by Shawn Rathje, Jeni Grantz to approve the Overnight Trip for CAC Students to

Des Moines, IA on August 13th. Motion carried 5-0.

Moved by Andy Friedrichsen, Mary Smith to approve the MBAEA Partnership School

August 16, 2018

Personnel Report

Recommendation to approve the resignation of Angela Rickertsen as Special Education Associate effective immediately.

Recommendation to approve the resignation of Judi Henningsen as Special Education Associate effective immediately.

Recommendation to approve the appointment of Rachel Pasker as Senior Class Sponsor starting the 2018-19 school year. Her salary will be $529.11 based upon 2% of the Schedule B base of $26,455.58.

Recommendation to approve the appointment of Matthew Bolahan as Contest Speech Director starting the 2018-19 school year. His salary will be $4,123.78 based upon 14% of the Schedule B base of $26,455.58 and longevity pay.

Recommendation to approve the appointment of Emily Buech as Special Education Teacher starting the 2018-19 school year. Her salary will be $33,500 - BA Step 1 on the 2018-2019 Salary Schedule and increased to the state minimum.

Recommendation to approve the appointment of Mindy Lehmkuhl as Special Education Associate starting the 2018-19 school year. Her salary will be $10.19 per hour, Step 1 of the 2018-19 Associate Salary Schedule.

Recommendation to approve the appointment of Allyse Trenkamp as Special Education Associate starting the 2018-19 school year. Her salary will be $10.19 per hour, Step 1 of the 2018-19 Associate Salary Schedule. She will work 4.5 hours per day, 2 days per week.

Recommendation to increase the hours of Eileen Petersen, Special Education Associate, from 4.5 hours per day, 2 days per week to 7 hours per day, 5 days per week for the 2018-19 school year.

AGREEMENT TO PROVIDE DRIVER EDUCATION SERVICES

This Agreement made and entered into this 14th day of September, 2018 by and between Mississippi Bend Area Education Agency, ("AEA") and XXX Community School District ("School District" or "District"). AEA agrees to provide, exclusively, Driver Education Services ("Driver Education Program" or "Program") for the School District based on the following provisions:

1. Term of Agreement. This Agreement shall be effective as of the first day of 2019 summer school, and shall continue for a period of one (1) year, expiring on the last day of the fourth quarter of the 2019-2020 school year. In the event that the beginning or end date specified herein is different from that contemplated by either party, the dates may be changed as agreed upon by both parties, in writing, and consistent with Section 12 of this Agreement. Unless terminated as provided herein, this Agreement shall renew from year to year hereafter. Either party may terminate this Agreement at anytime by giving notice of such termination to the other party. Unless otherwise agreed to by both parties as provided in Section 12 of this Agreement, such termination shall be effective as of the last day of the fourth quarter of the school year in which the notice is given.

2. Statutory Compliance. AEA agrees to conduct the Program in compliance with all applicable driver education requirements established and mandated pursuant to Iowa Code §§ 714.17-.23, Chapters 261B and 321.178.1 and Iowa Administrative Code §§ 26.1-.7.

3. Instructors. AEA agrees to provide a sufficient number of certified driver education instructors as required by Iowa Code §§ 26.1-.7 to accommodate the needs of all District students enrolled in the Driver Education Program. AEA shall notify the School District of the Program instructors' names and school assignments five days prior to the first day of Program session. AEA shall pay for all instructors and all expenses associated with such instructors reasonably necessary to staff the Program.

3.1 Program Manager. AEA agrees to appoint a Program Manager to oversee this Agreement and facilitate the day-to-day administrative duties of the Program.

3.2 Benefits. AEA reserves the right to provide additional benefits as it sees fit to maintain the fitness and moral of its instructors.

3.3 Instructor Evaluation. School District may provide input regarding AEA's instructors who are on supplemental contracts.

4. Equipment, Facilities, and Textbooks. School District shall make available to AEA suitable classrooms and facilities reasonably required by AEA to conduct the Driver Education Program which will include, but not be limited to, access to a working audio/video medium, student and teacher desks, and chalk or dry-erase boards.

4.1 Classroom Supplies and Materials. School District agrees to provide AEA limited use of copy machines. AEA will provide and pay for all secretarial support, classroom supplies, and duplication of classroom materials.

4.2 Program Vehicles. AEA agrees to provide driver training vehicles necessary for Program administration and shall be responsible for the maintenance, gasoline, and upkeep of the vehicles and provide for the dual brake installation on all vehicles. The vehicles will be equipped with the following items:

(a) Instructor dual brake(b) Inside rear-view mirror(c) Instructor's eye check mirror(d) Required driver education signage(e) Outside rear-view mirrors mounted on each side of the vehicle

4.3 Storage. School District shall provide a secure on-site storage area for AEA vehicles throughout the term of the Program.

4.4 Accommodation of Disabilities. School District shall provide all the cost related accommodations for students with special needs, including special equipment and required installation or modifications on a case-by-case basis.

5. Program Administration and Support. AEA agrees to provide the Program which will meet all requirements of Iowa Code 321.178. The course will be available to all students living within the School District who are at least fourteen (14) years of age, and who meet the necessary prerequisites established by the Iowa Code and AEA.

5.1 Administrative Duties. AEA, with cooperation from the School District, will be responsible for the following administrative duties:

(a) Providing registration materials and scheduling students(b) Record keeping(c) Issuing final grade reports (to school district)(d) Issuing Course Completion Certificates(e) Collecting Fees

5.2 Length and Time Requirements. AEA agrees to provide a Driver Education Program that is 30 hours of classroom and 6 hours of lab (driving) time. The Program length and time requirements will meet or exceed the standards under Iowa Code § 321.178 and Iowa Administrative Code § 26.

5.3 After School Programs. AEA will schedule after school programs as needed. Classroom sessions will meet for three (3) hours on two (2) to four (4) nights each week depending on Program length. AEA will schedule driving as needed based upon student and teacher availability.

5.4 Summer Programs. AEA will schedule summer programs over a three (3) to six (6) week period of time. Classroom sessions will meet for two (2) to three (3) hours on three (3) to five (5) mornings per week depending on Program length. AEA will schedule driving as needed based upon student need and teacher availability.

5.5 Program Flexibility. AEA agrees to offer Program that is flexible to help accommodate all students' needs within the District but reserves the right to schedule classes and instructors to make the most efficient use of available resources and which AEA reasonably determines is consistent with good business practice.

6. Discipline and Supervision. School District agrees that student supervision is the responsibility of AEA and its instructors for the duration of the students' enrollment in the Program, but only during the times the student is actively participating in either the classroom session or lab session of the Program. School District shall be responsible for student supervision at all other times.

6.1 Policies and Procedures. AEA and its agents agree to follow and require all student participants in the Program to comply with School District's policies and procedures. AEA reserves the right to develop and enforce rules that specifically apply to the Program and notify School District and students of said rules. AEA agrees to notify School District of any violation by a student of either the School District or AEA's policies or procedures and will cooperate with School District to insure all parties involved receive due process.

6.2 Discipline Policy. AEA reserves the right to adopt disciplinary policies and procedures to facilitate efficient and fair learning opportunities for all students. All students are subject to discipline, up to and including dismissal from the program.

7. Insurance. AEA agrees to provide School District with a certificate of insurance at the time it enters this Agreement and prior to commencing any work under this Agreement. AEA agrees to list School District as an additional insured on such insurance policy. AEA will provide updated certificates of insurance each year.

7.1 Coverage Limits. AEA agrees to obtain and keep coverage during the terms of this Agreement from an insurance company licensed to do business in the State of Iowa. The insurance policy referenced herein shall provide, at a minimum, the following coverage:

(a) Comprehensive General Liability Insurance with a minimum limit of

1. $1,000,000 per occurrence for bodily injury;2. $1,000,000 per occurrence for property damage; or3. $1,000,000 per occurrence combined single limit

(b) Automobile Liability Insurance with minimum limits of

1. $1,000,000 per person;2. $1,000,000 per occurrence for bodily injury;3. $1,000,000 per occurrence for property damage; or4. $1,000,000 per occurrence combined single limits

(c) Umbrella/Excess Liability Coverage with a minimum of a $1,000,000 limit per occurrence.

(d) AEA shall be responsible for insuring its property with property and casualty insurance as reference herein.

7.2 Workers Compensation. AEA agrees to provide Workers Compensation Insurance for all instructors as required by state law.

7.3 Indemnification. AEA agrees to protect, defend, indemnify, and hold School District harmless from and against all suits, claims, and demands by any Program participant, their heirs, or assigns, based upon alleged damage, including death, to person or property which may occur by or on account of any negligent act or omission on the part of AEA or any of AEA's agents or employees in fulfillment of their obligations under the terms of this Agreement.

8. Costs and Fees. AEA shall establish the registration fees for the School District. AEA will determine said fees by a cost analysis completed by the AEA based on total expenses to run the Program. If the revenue exceeds the expenses for the current Agreement term, AEA will set aside the excess and use it to offset rising costs for the next Agreement term and/or pay for unexpected costs incurred by AEA to run the Program. Each new Agreement term, AEA will revise student fees to reflect rising costs, the addition or deletion of schools, and any surplus or deficit from the preceding Agreement term.

8.1 Collecting Fees. AEA shall collect student fees except for the student fees waived according to status or Department of Education Regulations for students who qualify for free or reduced lunch. AEA shall collect fees or invoice School District at the end of each session.

8.2 Reimbursement of Qualified Fees. School District agrees to reimburse AEA for tuition payments for those students who qualify for free or reduced lunch either in the full amount or in partial amount to equal the full tuition payment when matched with the student partial payment.

8.3 Tuition Fee. In exchange for Program services provided by AEA under this Agreement, AEA will charge a fee of $370.00 per student, or a reduced or waived fee for students who qualify for free or reduced lunch.

8.4 Non-payment. AEA reserves the right to withhold Certificate of Completion for the Program until AEA has collected the entire tuition fee.

8.5 Renegotiating Fees. School District and AEA mutually agree to renegotiate the fee as provided for in Section 12.2 of this Agreement, if necessary, if driver education requirements as stated in Iowa Code §§ 714.17-.23 and/or Iowa Administrative Code §§ 26.1-.27 are modified or amended by legislative act or administrative rule making process during the effective term of this Agreement.

8.6 Program Failure. A student is not entitled to a refund in the event the student fails the Program. AEA requires full tuition to retake the class.

9. Out-of-State Certificates. AEA agrees to provide eligible students who are enrolled at the District with out-of-state compliance certificates free of charge and pursuant to Iowa law. Eligible students include those currently enrolled at the District, dual enrolled as a student receiving competent private instruction, and transfer students who have enrolled with the District.

10. Lost Certificates. The cost of certifying and providing certificates for makeup sessions or lost certificates shall be assessed to each individual student and shall not be billed or assessed to the District.

11. Governing Law. This Agreement shall be interpreted and enforced in accordance with the laws of the state of Iowa.

12. Amendments. No amendment to this Agreement shall be valid unless made in writing and executed on behalf of the party against whom enforcement is sought.

13. Enforceability. In the event a court finds any restriction, condition, or provision invalid, the invalidity of any restriction, condition, or other provision of this Agreement or any part of the same shall not impair or affect, in any way, the validity or enforceability of the rest of this Agreement.

14. Entirety Clause. This Agreement contains the entire understanding and agreement between AEA and School District with respect to the subject matter herein and supersedes any prior representations, understandings, or agreements, written or oral.

15. Successors and Assigns. Except as otherwise provided in this Agreement, every covenant, term, and provision of this Agreement shall be binding upon and inure to the benefit of the parties and their respective successors and assigns.

Contract for Driver Education with the Northeast Community School District

The Triple ‘R’ Driving School LLC will provide Driver Education for the

Northeast Community School District on the following basis:

1. Sessions will be offered in the spring, summer, and fall with the possibility of winter based on

demand. Dates and times will be arranged and approved with the Northeast School District

administration.

2. The collection of the Driver Education fee will be the responsibility of Triple ‘R’ Driving School.

The Northeast School District will notify Triple ‘R’ Driving School of those students enrolled that

are eligible for free or reduced tuition. Arrangements will be made to reimburse Triple ‘R’

Driving School for those students on free and reduced tuition (Triple ‘R’ will send an invoice at

the completion of the course).

3. In administering this course, Triple ‘R’ Driving School will meet or exceed all state requirements

for Driver Education. This includes a minimum of 30 hours of classroom instruction and a

minimum of six hours behind-the-wheel training (and all other stipulations as set forth by the State

of Iowa Department of Education).

4. All grading, tracking and student progress will be the responsibility of Triple ‘R’ Driving School.

Issuance of certificates of completion at the conclusion of the course will be the responsibility of

Triple ‘R’ Driving School.

5. Triple ‘R’ Driving School will provide flexibility in scheduling to ensure all needs of the students

are met.

6. All teachers and instructors will be certified Iowa secondary teachers (with the proper state

certification in drivers education) and the responsibility of Triple ‘R’ Driving School. Triple ‘R’

currently subcontracts with three retired/current school administrators and 11 fully certified Iowa

secondary teachers, all of whom possess a vast knowledge of Iowa communities and roads. Triple

‘R’ represents that all services will be rendered using sound, professional practices and in a

competent and professional manner.

7. Triple ‘R’ Driving School will comply with all rules and regulations established by the Iowa

Department of Education and Iowa Department of Transportation.

8. Background checks will be conducted in accordance to Northeast School District standards for all

personnel providing Driver Education instruction. In the event that the district determines an

instructor unsuitable, Triple ‘R’ will promptly replace that instructor with an alternative instructor.

9. Triple ‘R’ Driving School will provide books (Drive Right; 9th Edition) for instructional purposes

and supply all necessary curriculum.

10. All automobiles, gas, and maintenance will be the responsibility of Triple ‘R’ Driving School

(unless otherwise arranged). Automobiles used in conjunction with Driver Education will be

equipped with instructor’s dual brake, required and appropriate driver education signage, and

outside rear-view mirrors on each side of the vehicle. Vehicles currently used for Driver

Education include Toyota Corollas and a Chevy Cruzes.

11. Triple ‘R’ Driving School will be responsible for implementing accommodations for students with

special needs. Triple ‘R’ Driving School will work with the Northeast School District to

determine what accommodations may be necessary.

12. Insurance will be provided by Triple ‘R’ Driving School. Triple ‘R’ Driving School will obtain

and keep in force during the terms of this agreement insurance coverage as described:

- Comprehensive General Liability Insurance with minimum limits of $1,000,000 per

Occurrence for Bodily Injury and $1,000,000 per Occurrence for Property Damage

- Automobile Liability Insurance with minimum limits of $1,000,000 per person,

$1,000,000 per Occurrence for Bodily Injury, and $1,000,000 per Occurrence for

Property Damage.

- Business Insurance with minimum $1,000,000 limit per Occurrence.

- Umbrella/Excess Liability Coverage with minimum of $1,000,000 limit per

Occurrence.

13. The Northeast School District agrees to provide a classroom and access to other necessary and

reasonable classroom equipment (i.e. television, DVD/VCR, overhead, etc.) and facilities

(bathroom, drinking fountain, copy machine, etc.). Triple ‘R’ Driving School will keep facilities

reasonably clean and be responsible for any damage caused to the facilities as a result of Driver

Education.

14. The Northeast School District agrees to not directly hire instructors and independent contractors to

teach Driver Education, and agrees they are under a non-compete agreement with Triple ‘R’

Driving School.

15. The cost of the course for the school year 2018-19 will be $355.00. The cost of the course for

those eligible for free or reduced tuition will be $355.00. Future rates beyond the 2018-19 school

year will be determined in consideration of materials such as automobiles, gas, and insurance,

however Triple ‘R’ agrees to not raise the rate more than $5.00 per year. Triple ‘R’ Driving

School reserves the right to lower the cost if they deem necessary, but agrees not to surpass the

rates currently stated. Fees for those not eligible for free or reduced tuition will be collected by

Triple ‘R’ Driving School, with $175 deposit due upon registration and the balance being due on

the first day of class. Those eligible for reduced tuition will be charged a rate agreed upon by the

Northeast School District, with the deposit ($175) due upon registration and the balance due at the

first class. The remaining fee will be covered by the Northeast School District. The Northeast

School District will cover the entire fee of $355 should the student be eligible for free tuition.

16. Triple ‘R’ Driving School reserves the right to remove students from the course on the basis of

excessive absentees or disruptive behavior. Students dismissed from class for excessive absences

or behavior issues will not be issued a refund and will be required to pay full price to enroll in a

future session. Students who fail the course will not be issued a refund and will be required to pay

full price should they wish to retake the class.

17. The Northeast School District agrees to cooperate with Triple ‘R’ Driving School in regards to

communication with students (school announcements, flyers posted in school, etc.).

18. Ryan Rump and/or Craig Reuter will be the primary contact persons from Triple ‘R’ Driving

School to oversee the program and handle administrative duties/issues. They will act as a liaison

with the Northeast School District and discuss issues with the district as needed.
