18-546 TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN LADIES AND GENTLEMEN: BE IT RESOLVED, by this Board of County Commissioners of Genesee County, Michigan (“this Board”), as follows:

1. This Board proposes that Genesee County, through this Board, will levy in 2018 the following millage rates for the following purposes: General Operating 5.4961 Emergency Medical Services 0.4837 Parks and Recreation 0.7485 Senior Citizen Services 0.6986 Uninsured Health Services Delivery System 0.9980 Veterans 0.0998 Animal Control 0.1996 MSU Extension 0.0399 Arts Education & Cultural Enrichment 0.9600 Total Millage Proposed to Be Levied 9.7242

2. This Board will hold a public hearing for the purpose of receiving testimony regarding the above proposed millage rates at 9:00 a.m. on Monday, September 24, 2018, in the Willard P. Harris Auditorium, Genesee County Administration Building, Third Floor, 1101 Beach Street, Flint, Michigan, such hearing to be part of the meeting of this Board already scheduled for that time, date, and location.

3. This Board adopts the statements made in the NOTICE OF PUBLIC

HEARING ON INCREASING PROPERTY TAXES (the “Notice”), which Notice is attached to this Resolution and incorporated herein by reference.

4. The County Clerk/Register (“the Clerk”) is directed to obtain on behalf of the

County publication of the Notice no later than Sunday, September 16, 2018, in The Flint Journal (the “Journal”), the Journal being hereby found by this Board to be a newspaper of general circulation within the County.

5. The Clerk is further directed to obtain publication of the Notice in the Journal

in accordance with the DIRECTIONS FOR PUBLICATION OF THE NOTICE OF PUBLIC HEARING ON INCREASING PROPERTY TAXES, which Directions are attached to the attached Notice and are incorporated herein by reference.

6. The Clerk is further directed to send the Notice to all newspapers circulated

within the County, and to do so prior to the public hearing date of Monday, September 24, 2018.

7. This Board’s Coordinator is directed to provide any notices of the above

provided for public hearing, additional to the notices above directed to be provided by the Clerk, as may be required by the Open Meetings Act, MCL 15.261 et seq.

DIRECTIONS FOR PUBLICATION OF THE NOTICE OF PUBLIC HEARING ON INCREASING PROPERTY TAXES

The Notice is to be published in The Flint Journal on or before September 16, 2018. It is to be published as a display advertisement, in other than the legal notices or classified advertisement portions of the newspaper. The Notice is to be not less than 4 inches wide and no less than 8 inches in vertical measurement, although as near to 8 inches in vertical measurement as reasonably practical from a layout standpoint. The two-line headline is to be in not less than 18-point type. The remaining text is to be in not less than 12-point type.

Notice of Public Hearing on Increasing Property Taxes

The Genesee County Board of County Commissioners of Genesee County, Michigan

will hold a public hearing on a proposed increase of 1.3603 mills in the operating tax millage

rate to be levied in 2018.

The hearing will be held on Monday, September 24, 2018, at 9:00 a.m. at the

Genesee County Administration Building – Harris Auditorium, 1101 Beach Street, Flint,

Michigan 48502. The date and location of the meeting to take action on the proposed

additional millage will be announced at this public meeting.

If adopted, the proposed additional millage will increase operating revenues from ad

valorem property taxes 16.26% over such revenues generated by levies permitted without

holding a hearing. If the proposed additional millage rate is not approved the operating

revenue will decrease by 0.93% over the preceding year’s operating revenue.

The taxing unit publishing this notice, and identified below, has complete authority to

establish the number of mills to be levied from within its authorized millage rate.

TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN LADIES AND GENTLEMEN: WHEREAS, the Soo Locks are a vital economic contributor, not just for

Michigan, but for the entire U.S. economy. Currently, there are only two locks that are being

utilized for shipping, which are the Poe and the MacArther. The 49-year-old Poe Lock is in

need of repair and the MacArther Lock’s size is not suitable for modern freighters to pass

through; and

WHEREAS, closing the Poe Lock would cause a negative economic impact of

$160 million within a 30-day span; and

WHEREAS, a shutdown of the Locks would result in the halt of the North

American automotive production within a matter of weeks; and

WHEREAS, the Soo Locks (out of 196 locks) are ranked number one in their

significance to the economy and save approximately $3.5 billion in transportation costs each

year; and

WHEREAS, having the Locks closed for even six months would result in 11

million jobs being lost; and

WHEREAS, the locks are a critical pathway for shipping natural resources

such as iron ore and agricultural products critical to the economic vitality of the Upper

Peninsula of Michigan, which are exported nationally and internationally; and

WHEREAS, building a new lock, in addition to the Poe Lock, would allow for

more efficient and redundant transportation opportunities.

NOW, THEREFORE, BE IT RESOLVED, that this Board of County

Commissioners of Genesee County, Michigan, supports the development and the funding

of the twinning of the Poe Lock as soon as possible.

18-548 TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN LADIES AND GENTLEMEN: BE IT RESOLVED, that this Board of County Commissioners of Genesee

County, Michigan, authorizes retaining expert appraisal witnesses related to the Michigan

Tax Tribunal property tax appeal involving the property located at 607 East 2nd Avenue,

Flint, Michigan 48502, at a cost not to exceed $10,000.00.

18-549 TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN LADIES AND GENTLEMEN: WHEREAS, the Director of Human Resources and Labor Relations has

negotiated a proposed Tentative Collective Bargaining Agreement with the AFSCME Local

496.01 bargaining unit, the changed or additional provisions of said Agreement to be placed

on file with the official records of the July 30, 2018, meeting of the Governmental Operations

Committee of this Board.

NOW, THEREFORE, BE IT RESOLVED, by this Board of County

Commissioners of Genesee County, Michigan, that the aforesaid Tentative Collective

Bargaining Agreement as negotiated by the Director of Human Resources and Labor

Relations is hereby approved and ratified, and the Director of Human Resources and Labor

Relations is authorized and directed to sign the Collective Bargaining Agreement document

for and on behalf of Genesee County, Michigan, and to deliver a copy of the Agreement,

when signed by all parties thereto, to the County Clerk/Register, who is hereby directed to

place a copy of the fully signed Agreement on file with the official proceedings of this Board.

18-653 RESOLUTION PLEDGING FULL FAITH AND CREDIT OF THE COUNTY OF GENESEE

FOR THE #0138 LUM & EXTENSION, BRANCH #1 DRAIN DRAINAGE DISTRICT DRAINAGE DISTRICT BONDS, SERIES 2018

TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN

LADmS AND GENTLEMEN:

At a regular meeting of the Board of Commissioners of the County of Genesee, Michigan, held on August 27, 2018.

The following resolution was offered by mid supported by

WHEREAS, pursuant to the Drain Code, Act 40, Public Acts of Michigan, 1956, as amended (the "Drain Code"), proceedings are being undertaken by the Genesee County Drain Commissioner (the "Drain Commissioner'') for the construction and financing of improvements to the county drain in the drainage district designated as the #0138 Lum & Extension, Branch #1 Drain Drainage District (the "Drainage District"), said improvements having been determined to be necessary for the public health; and

WHEREAS, pursuant to said proceedings, a special assessment roll has been or will be prepared and duly confirmed by the Drain Commissioner prior to the issuance of the Bonds described below to pay for the construction and financing of the improvements; and

WHEREAS, the special assessments on said special assessment roll are payable in fifteen (15) annual installments by the Township of Gaines, the Charter Township of Mundy, the County of Genesee (the "County'') and benefitted lands in said Drainage District, according to apportionments duly determined by the Drain Commissioner acting pursuant to Section 262 of the Drain Code, with interest thereon at such rate as sha1l be calculated to be sufficient to pay interest on the Bonds described below; and

WHEREAS, pursuant to the authorization provided in the Drain Code, the Drain Commissioner, by order, will authorize and provide for the issuance of bonds of the Drainage District to be designated DRAINAGE DISTRICT BONDS, SERIES 2018 (LIMITED TAX GENERAL OBLIGATION) (the "Bonds"); and

WHEREAS, the Bonds will be issued in the aggregate principal amount of not to exceed Seven Hundred Twenty-Five Thousand Dollars ($725,000), and will be issued in anticipation of, and the principal of and interest on the Bonds will be payable from, collections of ssid special assessments; and

WHEREAS, Section 276 of the Drain Code IIIIthorizes the Board of Commissioners of the County, by resolution adopted by a majority vote of its total membership, to pledge the full faith and credit of the County for the prompt payment of the principal of and interest on the Bonds; and

WHEREAS, the Board of Commisaioners has determined that it is in the best interest of the County that the Bonds be secured by a pledge of the full faith and credit of the County, as authorized by Section 276 of the Drain Code, in order to enhance the marketability of the Bonds and to obtain a lower and more favorable interest cost.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF GENESEE, MICIDGAN:

1. Public Purpose; Full Faith and Credit Pledge of County. The Board of Commissioners of the County does hereby determine that the improvements to the Drainage District to be financed with the proceeds of the Bonds are necessary for the protection of the public health, safety and welfare of the County and its residents. Pursuant to the authorization provided in the Drain Code, the Board of Commissioners of the County does hereby irrevocably pledge the full faith and credit of the County for the prompt payment of the principal of and interest on the Bonds when due; provided. however. that the aggregate principal amount of the Bonds to be issued by the Drainage District shall not exceed $725,000. Pursuant to said pledge, in the event that the collection of special assessments on the special assessment roll is insufficient to pay the principal of or interest on the Bonds when due, the amount unpaid shall be promptly advanced from County funds as a first budget obligation, and the County Treasurer is directed to immediately make such advancement to the extent necessary.

2. Reimbursement of Advance from Special Assessment Roll. In the event that, pursuant to said pledge of its full faith and credit, the County shall be required to advance out of County funds all or any part of said installments of principal and interest on the Bonds, it shall be the duty of the County Treasurer, for and on behalf of the County, to take all actions and proceedings and pursue all remedies permitted or authorized by law for the reimbursement of such sums so paid, including, without limitation, the reassessment by the Drain Commissioner of the Drainage District as provided in Section 276 of the Drain Code.

3. Rescission. All resolutions and parts of reaolution insofar as they conflict with the provisions of this resolution be and the same hereby are reacinded.

Harris Auditorium, 3M floor of the Genesee County Administration Building, 1101 Beach Street, Flint, Michigan, the Board of Commissioners will consider a resolution relating to the issuance of bonds by the #0138 Lum & Extension, Branch #1 Drain Drainage District in the aggregate principal amount of not to exceed $725,000. If the bonds are issued, the bonds will contain a limited tax full faith and credit pledge of the County of Genesee, Michigan.

The bonds will be paid in the first instance from the collection of special assessments levied within the #0138 Lum & Extension, Branch #1 Drain Drainage District.

August 27, 2018, meeting of the Finance Committee of this Board).

BE IT FURTHER RESOLVED, that this Board finds that extenuating

circumstances exist supporting waiver of the hiring freeze, and directs the Director of Human

Resources to have the necessary personnel position number created, as necessary, for said

position and to commence the hiring process so that the position may be filled as soon as

practicable in accordance with County policy and any applicable collective bargaining

agreement.

BE IT RESOLVED, by this Board of County Commissioners of Genesee County,

Michigan (this "Board"), that the budget attached to this Resolution (the "Proposed Budgef') is

adopted as the proposed Genesee County Budget for the fiscal year commencing October 1 ,

2018, and ending September 30, 2()19 (the "Ensuing Fiscal Year").

BE IT FURTHER RESOLVED, that the Proposed Budget is Genesee County's

proposed general appropriations act for the Ensuing Fiscal Year, within the meaning of Act No.

2 of the Public Acts of 1968, as amended, MCl §141.421 et!§g., and consists of the following

components: 1) Proposed appropriations/expenditures, as itemized In the component at pages

IV through VI of the Proposed Budget, titled "Genesee County, Michigan - 201812019

Budget;" 2) a statement as to ad valorem taxes having a total of 9.7242 mills, levied and

A public hearing will be held on Monday, September 24,2018, at 9:00 a.m., or as soon thereafter as the order of business will penn It, In the Willard P. The property tax millage rate proposed to be levied to support the proposed budget will be a subject of this hearing.

The total ad valorem property tax millage to be levied in support of the proposed budget Is 9.7242 mills. This millage will be partially from the County's 2018 tax and partially from the County's 2019 tax. Further details regarding this millage are in the proposed budget.

Any citizen wishing to address the Board of County Commissioners on the proposed budget or on the proposed property tax millage rates will be given the opportunity to make oral or written comments at the time of the hearing and to ask questions regarding the proposed budget and the proposed millage rates.

A copy of the proposed budget will be available for public Inspection as of September 10, 2018, following its adoption on that day, In the Office of the Genesee County Clerk, Elections Division, located in the East Wing on the second floor of the Genesee County Court House, 900 South Saginaw Street, Flint, Michigan 48502. 18-559 TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN LADIES AND GENTLEMEN: BE IT RESOLVED, by this Board of County Commissioners of Genesee County,

Michigan (“Board”), that the request by the Office of Genesee County Sheriff (“Sheriff”) to

authorize entering into an agreement with the Genesee Intermediate School District (“GISD”),

whereby the Sheriff will provide seven deputies who are certified police officers to act as School

Resource Officers for GISD for the period commencing September 1, 2018, through August 31,

2018, the cost of said deputies being fully funded by GISD at no cost to the County, is approved

(a copy of the memorandum request dated September 4, 2018, to be placed on file with the

official records of the July 30, 2018, meeting of the Governmental Operations Committee of this

Board), and the Chairperson of this Board is authorized to execute the agreement on behalf of

Genesee County.

BE IT FURTHER RESOLVED, that this Board authorizes establishing, posting,

and filling two additional Police Deputy positions to be assigned to work under the GISD

contract, said new positions to be fully funded by GISD at no cost to the County.

circumstances exist supporting waiver of the hiring freeze, and directs the Director of Human

Resources to have the necessary personnel position number created, as necessary, for said

position and to commence the hiring process so that the position may be filled as soon as

practicable in accordance with County policy and any applicable collective bargaining

agreement.

County, Michigan, that the request by the Medical Examiner to authorize amending the EPIC

contract between Genesee County and Hurley Medical Center, said amendment being

necessary to allow the Medical Examiner’s Office to use scribes provided by Hurley Medical

Center to document autopsies in EPIC, the electronic medical software, for the period

commencing October 1, 2017, through September 30, 2018, at a total cost not to exceed

$30,000.00, is approved (a copy of the memorandum request dated August 27, 2018, and

supporting documents being on file with the official records of the August 27, 2018, meeting

of the Human Services Committee of this Board), and the Chairperson of this Board is

authorized to execute the amendment on behalf of Genesee County.
