The “Bank” means both AmBank (M) Berhad 196901000166 (8515-D) (“AmBank”) and AmBank Islamic Berhad

199401009897 (295576-U) (“AmBank Islamic”). The Terms and Conditions herein are to be read together with the terms and conditions of the Bank’s relevant Credit Card/ Credit Card-i agreement(s) (including the Bank’s Visa/UnionPay Agreement) (collectively referred to as (“Cardholder Agreement”) or any other terms not specifically mentioned herein. Campaign

1. The “Campaign” means this “Apply, Activate & Get 30% Cashback” organized by the Bank in accordance with the Campaign’s Terms and Conditions as provided herein.

Campaign Period

2. The Campaign shall run from 1st October 2020 to 31st December 2020 (both dates inclusive) ("Campaign Period") or such other period as may be determined by the Bank with Prior Notice.

Eligibility

3. “Eligible Cardholder(s)” is defined as any individual including staffs whether permanent or contractual within the AmBank Group, who during the Campaign Period applies for any one of the following participating AmBank Credit Card/AmBank Islamic Credit Card-i as a Principal/Supplementary cardholder:

(a) AmBank Credit Card:, AmBank SIGNATURE Priority Banking Visa Infinite, AmBank Visa Infinite, AmBank Visa Signature Card, AmBank UnionPay Platinum Card, AmBank Visa Platinum Card, AmBank Visa Gold Card, AmBank CARZ Visa Card, AmBank TRUE Visa Card, AmBank BonusLink Visa Signature, AmBank BonusLink Visa Platinum, AmBank BonusLink Visa Gold and AmBank Cash Rebate Visa Platinum Card.

(b) AmBank Islamic Credit Card-i:, AmBank Islamic SIGNATURE Priority Banking Visa Infinite-i, , AmBank Islamic Visa Infinite Card-i, AmBank Islamic Visa Signature Card-i, AmBank Islamic Al-Taslif Visa Platinum Card-i, AmBank Islamic Al-Taslif Visa Gold Card-i, AmBank Islamic Visa CARZ Card-i (Collectively known as “Participating Islamic Credit Card(s)”)

4. The following persons are NOT eligible to participate in this Campaign:

(a) Existing AmBank Credit Card/AmBank Islamic Credit Card-i cardholder(s)

(b) Cardholder(s) who have cancelled their AmBank Credit Card/ AmBank Islamic Credit Card-i twelve (12) months prior to the Campaign Period and have reapplied for a new AmBank/ Ambank Islamic Credit Card-i during the Campaign Period.

(c) Cardholder(s) of AmBank Business Platinum card, AmBank M-Card, AmBank Cosway Card and any insurance cards issued by the Bank;

(d) Any newly approved AmBank Credit Card/AmBank Islamic Credit Card-i that has been suspended, cancelled or terminated during the Campaign Period;

(e) A cardholder who is in default of payment of sums due or suspected of committing any fraudulent, unlawful and illegal acts in relation to the cardholder’s Credit Card/Credit Card-i account, and/or any other facilities or services with the Bank; and

(f) Cardholder(s) who have participated or are participating in any other concurrent AmBank Credit Card/AmBank Islamic Credit Card-i sign-up/acquisition promotion via any other channels either organised by AmBank/ AmBank Islamic or any of the Bank’s authorised third parties.

5. An Eligible Cardholder(s) may apply for any of the Participating Conventional Credit Card or any Participating Islamic Credit Card-i or both in order to participate in this Campaign:

(a) via face-to-face/in person at any AmBank/AmBank Islamic branch or direct sales team or via calls through AmBank/AmBank Islamic telesales team; or

(b) via AmOnline by completing an electronic AmBank Credit Card/AmBank Islamic Credit Card-i application form and uploading the required supporting documents online.

Qualifying Criteria

6. The participants of this Campaign must fulfill the following criteria during the Campaign Period as provided below:-

(a) Apply for the principal and/ or supplemantary Participating Conventional Credit Card and/or Islamic Credit Card-i and;

(b) Activate the newly approved Participating Conventional or Islamic Credit Card/Credit Card-i and

(c)Use the Credit Card/ Credit Card-i on the Eligible Spend (according to Clause 8 below) within sixty (60) calendar days from the approval date.

7. AmBank/AmBank Islamic reserves the right to approve or reject any applications and/or to request for any further supporting documents. For the avoidance of doubt, AmBank/AmBank Islamic has the discretion to determine whether the supporting documents are sufficient for the purpose of processing the application submitted to AmBank/AmBank Islamic.

8. Subject to the Terms and Conditions herein, the Eligible Cardholder(s) whose application has been submitted

during the Campaign Period and successfully approved by the Bank on or before 31st December 2020 will be

entitled to the cashback as set out in the table below provided the Eligible Cardholder(s) fulfils all the qualifying

criteria stated in Clause 6:-

9. For the purpose of this Campaign, “Eligible Spend” means all retail transactions (including online transactions) for the purchase of any goods or services (local and international) with the use of any newly approved Participating Conventional/ Islamic Credit Card-i applied during the Campaign Period and may, at the Bank’s discretion, include e-wallets transactions or transactions carried out with e-commerce merchants using the approved Participating conventional Credit Card/ Islamic Credit Card-i as below: -

For the avoidance of doubt, the calculation of any international purchases of goods or services will be calculated

according to the prevailing foreign exchange rate quoted at the Bank’s counter on the date the transaction is recorded in the Bank’s system.

10. The following transactions are excluded from the Eligible Spend:

(a) Easy Payment Plan (EPP), Balance Transfer (BT), QuickCash (QC) and Cash Advance; and/or

(b) quasi-cash transactions – (eg: betting and/or gaming transactions); and/or (c) any form of refund; and/or (d) any disputed, unauthorised or fraudulent retail transaction; and/or (e) interest/management fee payments, late payment charges, charges for cash withdrawals, card

services tax and any other form of service/miscellaneous fees. 11. All Eligible Spend must be within the Campaign Period. The date of the Eligile Spend transacted via the

Participating Conventional Credit Card/ Islamic Credit Card-i will be calculated by adding a grace period of five (5)

calendar days from the end of the Campaign Period. The Bank is not responsible in any manner whatsoever for any late posting of the spending amount to the Eligible Cardholder’s account caused by either the merchants and/or e-wallet service providers and/or third parties.

Cashback Entitlement

12. Upon satisfying the Qualifying Criteria and Eligible Spend in Clause 6 and 8 respectively, the Eligible Cardholder(s) will be entitled to receive the cashback amount as stipulated in Clause 8. For the avoidance of doubt, the following scenarios shall apply: -

(a) If an Eligible Cardholder applies for a principal Participating Conventional and/or Principal Islamic Credit Card-i and meets the Qualifying criteria in Tier 1 under Welcome Offer (A) but does not meet the Qualifying criteria in Tier 2 under Welcome Offer(A), the Eligible Cardholder(s) will be entitled to receive only one (1) Cashback in Tier 1 under Welcome Offer (A)

(b) If an Eligible Cardholder applies for a principal Participating Conventional Credit Card and an Islamic Credit Card-i and the principal Participating Conventional Credit Card/ Islamic Credit Card-i meet both Tier 1 and Tier 2 Qualifying criteria under Welcome Offer (A), the Eligible Cardholder(s) will be entitled to receive only one (1) Cashback under Tier 1 and one (1) Cashback under Tier 2 for Welcome Offer (A) For example under Tier 2, the Eligible Cardholder(s) applies for principal AmBank Platinum card and principal AmBank Islamic Platinum card-i and both cards meet the spending requirement of RM500 respectively i.e. RM1,000 in total spend, the Eligible Cardholder(s) is entitled for cashback of Ringgit Malaysia Two Hundred (RM200) i.e. 20% cashback based on the total cumulative spend for both cards, however as the cashback is capped at RM150 per cardholder, the Eligible Cardholder will only receive a maximum cashback of RM150.

(c) If an Eligible Cardholder applies for a principal Participating Conventional Credit Card and an Islamic Credit Card-i and the principal Participating Conventional Credit Card applied is the AmBank Cash Rebate Visa Platinum card and the Participating Islamic Credit Card-I meet both Tier 1 and Tier 2 qualifying criteria under Welcome Offer (A), the Eligible Cardholder will be entitled to receive only one (1) Cashback under Tier 1 and one (1) Cashback under Tier 3 for Welcome Offer (A) For example under Tier 3, the Eligible Cardholder applies for principal AmBank Cash Rebate Visa Platinum card and principal AmBank Islamic Visa Signature card and both cards meet the spending requirement of RM500 respectively i.e RM1,000 in total spend, the Eligible Cardholder is entitled for cashback of Ringgit Malaysia Three Hundred (RM300) i.e. 30% cashback based on total cumulative spend for both cards, however, as the cashback is capped at RM180 per cardholder, the Eligible Cardholder will only receive a maximum cashback of RM180 .

(d) For Supplementary Cardholder(s) to be eligible for Welcome Offer (B), each Supplementary Cardholder(s) must spend using their supplementary Participating Conventional Credit Card/ Islamic Credit Card-i to be entitled for the Cashback in Tier 1 and Tier 2 under Welcome Offer (B). The Cashback will be credited to the respective Supplementary Cardholder(s) account and the Cashback is limited to a maximum of three (3) Supplementary Cardholder(s) for each principal Cardholder.

(e) Under Welcome Offer (C), existing principal AmBank Credit Card cardholders may apply for another principal AmBank UnionPay Platinum Card or AmBank BonusLink Visa Card to be eligible for the AmBonus Points or BonusLink Points reward respectively provided the Cardholder activate and spend any amount on the card within sixty (60) calendar days from the approval date.

Welcome Offcer - Balance Transfer Mechanism

13. The minimum amount for the balance transfer shall be Ringgit Malaysia One Thousand (RM1,000) and maximum amount shall not exceed Ringgit Malaysia Thirty Thousand (RM30,000) per Eligible Cardholder who apply for Balance Transfer from credit card/ credit card-i or charge card from other banks (“Balance Transfer Amount”). Approval is subject to the Cardholder’s available credit limit.

14. The instalment tenure of the Balance Transfer shall be six (6) months or such other period as specified by the Bank from time to time with twenty-one (21) calendar days’ prior notice. Each instalment amount will be proportionately computed and billed accordingly to the Cardholder’s Card Account on the billing date of each month and over the instalment tenure and/or until the full settlement of the instalments. E.g. for approved Balance Transfer amount of RM1,000, upfront fees of 1.99% will be RM19.90 and the monthly instalment is computed as follows: (RM1,000/6 months) + RM19.90 = First month RM186.57, subsequent month RM166.67 for five (5) months.

15. The Bank shall be entitled to debit Ringgit Malaysia One Hundred (RM100.00) from the Eligible Cardholder’s account for any early settlement of the amount ahead of the instalment tenure. (except TRUE by AmBank Visa Card, AmBank BonusLink Visa Card and AmBank M-Card). All outstanding instalments on principal with its respective interest/management fee for the entire tenure shall immediately become due and payable in the event of any early settlementFor the avoidance of doubt, any cancellation of the Credit Card/Credit Card-ishall be regarded as an early settlement under the Campaign and the Bank shall similarly be entitled to debit the amount of Ringgit Malaysia One Hundred (RM100.00) from the Eligible Cardholder’s account and the Bank shall have the right to claim and be paid with all outstanding instalments on principal for the entire tenure, due to the aforesaid reason.

16. The Eligible Cardholder ‘s will be deemed to have defaulted on the monthly instalment payment of the Balance Transfer amount if the Eligible Cardholder’s does not make the full Specified Minimum Payment or full Minimum Monthly Payment, on or before the payment due date as specified in the Cardholder’s statement of account. In the event of three (3) or more consecutive instalment default payment events, all monies due and owing under the Balance Transfer account, comprising of total outstanding Balance Transfer monthly instalment and the total unbilled principal of the Balance Transfer monthly instalment, together with the applicable finance charges/ management fees, and the balance of all other monies due and owing under the Balance Transfer shall immediately become due and payable by the Eligible Cardholder’s.

17. Subject to prior notice to the Eligible Cardholder, the Bank shall be entitled to exercise it’s discretion to terminate the Credit Card/Credit Card-i facility made available to the Eligible Cardholder, whereupon all outstanding monthly instalments with the respective interest rate/management fee shall immediately become due and payable upon the Bank’s demand of the same by notice in writing to the Eligible Cardholder. All such outstanding Balance Transfer amount will be shown in the monthly statement and the Eligible Cardholder shall pay the same in accordance to the provisions of these terms and conditions and the Cardholder Agreement in default of which, the Bank shall be entitled to exercise its rights herein and under the Cardholder Agreement.

18. The Bank may defer, suspend or reject any application under this Campaign (i) if the outstanding balance or amount requested exceeds the Eligible Cardholder’s credit limit, or (ii) the outstanding balance or amount requested does not meet the prescribed minimum transfer or requested amount, or (iii) if the Eligible Cardholder’s account has insufficient available balance, or such other reasons by the Bank at its discretion. Where the Eligible Cardholder’s application is successful, payment to the Credit Card/Credit Card-i accounts with the other Credit Card/Credit Card-i issuers/financial institutions will be made in the manner provided herein.

19. The signature of the Eligible Cardholder on the application form or consent obtained via phone call will be deemed conclusive proof of the Eligible Cardholder’s instruction to the Bank to directly settle and pay the outstanding balance of the Credit Card/Credit Card-i or charge card owing to the other card issuers/financial institutions, on behalf of the Eligible Cardholder.

20. The total Balance Transfer amount of principal and interests/management fees shall be reserved from the total credit limit of the Eligible Cardholder and shall not be made available for usage. A corresponding amount of the instalment paid by the Cardholder will be progressively restored on monthly basis into the Eligible Cardholder’s credit limit subject to application of payment.

21. Payments made by the Eligible Cardholder to the Credit Card/Credit Card-i account will be used to pay off any card service tax followed by Cash Advance, QuickCash, Monthly Instalments and any revolving balance that attract the highest finance charges/management fee first.

22. The following events shall be applicable in this Campaign:

(a) Outstanding balance of the Credit Card/Credit Card-i or charge card transferred from other card issuers’ credit or charge card issued in Malaysia only.

(b) Payment to the respective card issuer/financial institution(s) shall be effected by the Bank upon approval of the Campaign application. The amount payable is as approved by the Bank and as per transcribed on the application form or obtained via phone call.

(c) Payment of the Balance Transfer Amount will be made to the respective card issuer/financial institution via direct credit to respective card issuer’s/financial institution’s account via InterBank GIRO.

(d) Notwithstanding the terms and conditions herein, the Eligible Cardholder shall continue and remain liable to the card issuers/financial institutions for the facilities enjoyed by the Eligible Cardholder in accordance to the terms governing the same.

(e) The Bank in implementing the Campaign shall not be liable to the Eligible Cardholder for any interest or finance charges/management fee imposed by the other card issuers/financial institutions caused by a delay or failure on the part of the Bank in paying the outstanding balance owed by the Eligible Cardholder, notwithstanding the Bank’s approval of the Eligible Cardholder’s balance transfer application, to the other card issuers/financial institutions concerned.

(f) The Bank has the right to approve and transfer the whole or part of the amount applied. The Bank is not obliged to assign any reason to the Eligible Cardholder in respect of its decision.

Welcome Offer – QuickCash Mechanism

23. A minimum amount of Ringgit Malaysia One Thousand Only (RM1,000) and maximum amount shall not exceed 50% or 70% of Cardholder’s existing credit limit based on credit card/ credit card-i type (“QuickCash Amount”). Approval is subject to the Cardholder’s available credit limit and risk grade.

Hence, the total amount of principal and interest/management fees is computed as follows: [RM7,000 + (RM7,000 x 3.88% x 1 year)] = RM7,271.60. Cardholder may have remaining credit limit available of RM2,728.40 or less.

24. A special interest rate/ management fee of 3.88% flat per annum will be charged to the Cardholder’s account

based on the amount approved.

E.g. for approved QuickCash amount of Ringgit Malaysia Twenty Thousand (RM20,000), the monthly instalment is computed as follows: [RM20,000 + (RM20,000 x 3.88% x 1 year)] / 12 months = RM1,731.33 per month.

25. The QuickCash amount shall be treated as a cash advance. In the event the monthly principal instalment

amount and the monthly interest/management fee instalment amount is not paid in full on the payment due date, the Cardholder will be liable for a finance/management fee charge at the rate of 1.5% per month calculated on a daily rest basis on the outstanding principal balances. If payment received does not settle the current balance in full, any unpaid QuickCash monthly instalment/ (principal amount) will be subject to the finance/management fee charge, calculated from the posting date in the statement of account until full payment is received and credited

26. The Bank shall be entitled to debit Ringgit Malaysia One Hundred Only (RM100) from the Cardholder’s account

for any early settlement of the amount ahead of the instalment tenure (not applicable to TRUE by AmBank VISA Card, AmBank BonusLink VISA Card and AmBank M-Card). All outstanding instalments with its respective interest / management fee for the entire tenure shall immediately become due and payable in any early settlement. For the avoidance of doubt, any cancellation of the Card shall be regarded as an early settlement under the Programme and the Bank shall similarly be entitled to debit the amount of Ringgit Malaysia One Hundred Only (RM100) from the Cardholder’s account and shall have the right to claim and be paid with all outstanding instalments with its respective interest/management fee for the entire tenure, due to the aforesaid reason.

27. The Campaign facility made available to the Cardholder shall be terminated:- (a) immediately if an Event of Default (as defined under the Cardholder Agreement) has occurred; or

(b) at the Bank’s discretion, upon the Bank providing at least twenty one (21) calendar days prior notice, to terminate the Campaign facility made available to the Cardholder

Upon termination, all outstanding monthly instalments with the respective interest rate/management fee shall immediately become due and payable upon the Bank’s demand of the same by notice in writing to the Cardholder. All such outstanding QuickCash amount will be shown in the monthly statement and the Cardholder shall pay the same in accordance to the provisions of these terms and conditions and the Cardholder Agreement in default of which, the Bank shall be entitled to exercise its rights herein and under the Cardholder Agreement.

28. In the case of QuickCash:

(a) It is not applicable for cash withdrawal at ATMs using Cardholder’s Credit Card/ Credit Card-i. (b)Amount approved will only be disbursed into the Cardholder’s personal banking account maintained in Malaysia.

29. The Bank may defer, suspend or reject any application for the Campaign in the event of but not limited to:- (a) the outstanding balance or amount requested exceeds the Cardholder’s credit limit; (b) the outstanding balance or amount requested does not meet the minimum prescribed transfer or requested

amount; (c) if the Cardholder’s account has insufficient available balance; or (d) where the Bank gives prior notice with reasons as deemed reasonable by the Bank

Cashback Fufillment

30. The cashback will be issued to the qualified Eligible Cardholder(s)’ principal and /or supplementary credit card/

credit card- i of application within eight (8) to ten (10) weeks after meeting the Qualifying Criteria within sixty

(60) calendar days from the approval date as outlined in the table below:

31. The Bank shall notify the Eligible Cardholder(s) via SMS/telephone/electronic mailer/mailer based on their contact details maintained in the Bank’s system. Notwithstanding the foregoing, the Bank reserves the right to use any other medium or method, including the Bank’s website at www.ambank.com.my for the purpose of announcing the Eligible Cardholder(s) who are qualified for the cashback.

32. The cashback can only be issued to the Eigible Cardholder(s)’ principal and /or supplementary credit card/ credit card- i approved during the application and the cashback is not exchangeable by the Eligible Cardholder(s) for other gift, credit or any other kind of products and is not transferable to any third parties.

33. At the time of receipt of the cashback according to Clause 12, all Participating Convenntional Credit Card or Islamic Credit Card-i account(s) of the Eligible Cardholder(s) must be activated and in good standing during the Campaign Period in order to be eligible for the cashback upon meeting the all the qualifying criteria stated in Clause 6.

34. The Bank will not entertain any request from any Eligible Cardholder(s) or any other person to credit the cashback to any third party.

35. The Eligible Cardholder(s) are responsible to ensure that their telephone number(s) and/or email address (es) and/or mailing address (es) provided are current and updated with the Bank. In the event of non-receipt of the cashback, the Eligible Cardholder(s) are required to contact the Bank before 31st May 2021 to inquire the status of the cashback or to make a claim. No request, inquiry or claims shall be entertained after 31st May 2021

36. The Bank reserves the right to substitute the cashback with another gift of the like or similar value at its discretion

with Prior Notice on the Bank’s website at www.ambank.com.my.

General Terms and Conditions

38. By participating in this Campaign, the Eligible Cardholder(s) are to be bound by the Campaign’s terms and

conditions, the decisions of the Bank and, any addition, variation or amendment made pursuant to Clause 24 from

time to time with Prior Notice.

39. The Bank shall not be responsible or liable for any failure by any Eligible Cardholder(s) to participate in the Campaign

at any time caused by any network, communication or system error, interruption and/or failure.

40. To the extent permitted by law, the Bank shall not be liable to the Eligible Cardholder(s) when any Force Majeure

event occurs. “Force Majeure” refers to any unforeseen events and/or circumstances not within the reasonable control of the Bank, which the Bank is unable to prevent, avoid or remove including natural disasters such as flood, typhoon, hurricane, storm, tempest, volcanic eruption, earthquake, landslide, landslip, subsidence or sinking of the soil or earth or acts of public unrest such as strikes, lock out, industrial disturbances, riots, wars, epidemic, pandemic each of which is beyond the control of the Bank or such other event, condition or circumstances of similar nature as may be classified as Force Majeure by the Bank from time to time.

41. The Bank’s decision on all matters relating to the Campaign is final and binding on all Eligible Cardholder(s). No

further correspondence or appeal will be entertained. 42. The Bank has the right to vary, amend, delete or add to any of the Terms and Conditions set out herein, in whole

or in any part from time to time including to vary the Campaign Period with Prior Notice before the changes take effect. For the avoidance of doubt, the cancellation, termination or suspension by the Bank of this Campaign will not entitle the Eligible Cardholder(s) to any claim or compensation against the Bank for any and all losses or damage suffered or incurred by the Eligible Cardholder(s) as a direct or indirect result of the act of cancellation, termination or suspension save where such losses or damages suffered are caused by the wilful defalt, fraud or gross negligence of the Bank.

43. Unless expressly stated otherwise, the Terms and Conditions herein set forth, including any amendment thereto, will prevail over and other provisions and/or representation contained in any other notices/promotion/advertising materials for this Campaign.

44. The Bank reserves the right to:

(a) disqualify any Eligible Cardholder(s) to participate in the Campaign when the Eligible Cardholder(s) has performed an “Eligible Spend”, in a manner or pattern which the Bank deems to be abnormal, irregular and/or is indicative of an attempt to obtain an unfair advantage over other Eligible Cardholder(s) with normal/regular spending patterns, and the Bank’s decision in this matter shall be final and conclusive on all Eligible Cardholder(s); and/or

(b) forfeit the cashback fufillment in the circumstance where there is reversal of Eligible Spend or cancellation of the Participating Conventional Credit Card/ Islamic Credit Card-i during the Campaign Period or non-adherence to the Terms and Conditions herein;

45. By participating in this Campaign, the Eligible Cardholder(s) give their consent to the Bank to disclose their information to any third-party vendor(s) appointed by the Bank for the purpose of executing and/or fulfilling the

Campaign’s mechanisom. The Eligible Cardholder(s) are advised to read and understand AmBank Group’s Privacy Notice, which is available on the Bank’s website (https://www.ambankgroup.com/eng/Pages/PrivacyNotice.aspx) and any of the AmBank/ AmBank Islamic branches.

46. The Bahasa Malaysia version of these Terms and Conditions are also available. In the event of any discrepancy or conflict in the interpretation of these Terms and Conditions, the English and Bahasa Malaysia versions of each of these Terms and Conditions shall be construed as the equivalent of each other, and each of the Terms and Conditions stipulated shall carry the same meaning.

47. All questions concerning the construction, validity, enforcement and interpretation of the Terms and Conditions stipulated herein shall be governed by, construed and enforced in accordance with the laws of Malaysia. The parties hereby submit to the exclusive jurisdiction of the courts of Malaysia for the purpose of any suit, action or other proceeding arising out of or based on the Terms and Conditions herein.
