NOTIFICATION FOR THE PROPOSED DECOMMISSIONING OF 4 FUEL TANKS AT CRAMMIX BRICKS, BRAKENFELL (ERF ST214). SEC PROJECT NUMBER: 014032 DEA&DP REFERENCE NUMBER: NOT YET OBTAINED FROM DEA&DP Dear Mr Cloete, Sillito Environmental Consulting (SEC) has been appointed by Chevron South Africa (Pty) Ltd to undertake an application for an Environmental Authorisation to decommission 4 fuel tanks at Crammix Bricks, Brakenfell. The total fuel capacity to be decommissioned is 203m3. The proposed activity triggers an activity listed in terms of the Environmental Impact Assessment Regulations published in 2010 in terms of the National Environmental Management Act (Act No. 107 of 1998) as amended. The activity in question is listed as follows: Government Notice R544 Activity 27 (v)

The decommissioning of existing facilities or infrastructure for: (v) storage, or storage and handling, of dangerous goods of more than 80 cubic metres

As such, a Basic Assessment process is required to apply for authorisation of the proposed decommissioning. As the registered landowner, you will be included in the database of the affected parties and so will be given the opportunity to review and comment on the assessment reports produced for this application process. Public participation is anticipated to commence in approximately one month’s time. When the time comes for SEC to conduct a site visit on your property to assess the potential impacts, please would you indicate whether we may liase with Chevron or whether you would prefer that SEC liases directly with you as the landowner of the site. SEC has been appointed by Chevron South Africa (Pty) Ltd as the independent Environmental Assessment Practitioner to apply for an Environmental Authorization for this project in terms of the National Environmental Management Act, Act No. 107 of 1998 (“NEMA”), as amended. The Application will be made to the Western Cape Department of Environmental Affairs and Development Planning (DEA&DP). The applicant, Chevron South Africa (Pty) Ltd, proposes to decommission 4 fuel storage tanks located at Crammix Bricks, Brakenfell. The tanks to be decommissioned are listed as follows:

2 x 83m3 aboveground fuel storage tanks (Heavy Fuel Oil) 1 x 23m3 aboveground fuel storage tank (Heavy Fuel Oil) 1 x 14m3 underground fuel storage tank (Diesel)

The total fuel capacity to be decommissioned is 203m3. The tanks decommissioning comprises the following activity, which is listed in terms of Government Notice No. 544 of 2010, which is promulgated in terms of the NEMA: Activity No. 27 (v): The decommissioning of existing facilities or infrastructure for – (v) storage, or storage and handling, of dangerous goods of more than 80 cubic metres. The application process for Environmental Authorisation requires that a Basic Assessment process is undertaken as defined in the NEMA EIA Regulations contained in Government Notice No. 543 of 2010. Public consultation is a component of the Basic Assessment process. As such, you are hereby notified of the public participation process and of the availability of the Draft Basic Assessment Report for your review and comment.

fuel storage tanks (Heavy Fuel Oil); 1 x 23m3 aboveground fuel storage tank (Heavy Fuel Oil); 1 x 14m3 underground fuel storage tank (Diesel). The total fuel capacity to be decommissioned is 203m3.

The tanks decommissioning comprises the following activity, which is listed in terms of Government Notice No. 544 of 2010, which is promulgated in terms of the NEMA:

Activity No. 27 (v): The decommissioning of existing facilities or infrastructure for

(v) storage, or storage and handling, of dangerous goods of more than 80 cubic metres.

The application process for Environmental Authorisation requires that a Basic Assessment process is undertaken as defined in the NEMA EIA Regulations contained in Government Notice No. 543 of

2010.

Local government clinics in Ca-pe Town can’t keep up with thedemand for a new birth control

device.The device reduces a woman’s vi-

sit to the clinic for birth control toonce every three years, as opposedto every two or three months.

Implanon, a hormone releasingimplant, was introduced nationwi-de by national health minister DrAaron Motsoaledi in April this year,and has met with an overwhelmingresponse in the Western Cape, saysprovincial health departmentspokesperson Jo-Anne Otto.

The implant is a flexible plasticrod about the size of a matchstickwhich is inserted into the upperarm. Through the slow release ofprogesterone, it prevents womenfrom becoming pregnant.

Although new to South Africa, Im-planon has been used in many Euro-pean countries for a number of ye-ars and, according to the provincialhealth department, is a preferredform of birth control for many wo-men. “In the Cape Winelands area,over 2000 women have elected to ha-ve the Implanon inserted,” said Ot-to.

In explaining the lapse in timesince the roll-out in April to the offi-cial announcement last week, Ottosays: “This incredible response ex-ceeded availability of the device andit was decided to wait until logisti-cal issues were resolved before ad-vertising the availability again.”

How it worksDue to a local anaesthetic admis-

tered before the implant in inserted,the small operation is virtuallypainless. The whole process, inclu-ding counselling and paperwork, ta-kes about 30 minutes to complete.The implant is safe for use by wo-men of all ages and can be insertedstraight after delivery, allowing themother to decide when she is readyto have another baby.

“Implanon offers protection forup to three years and can be easilyremoved should the woman decideto have a baby before that. Normalfertility returns within a few weeksof removal of the device,” said Otto.

Every city clinic and maternityunit has a trained nurse “so no wo-man needs to find herself in the diffi-cult position of an unplanned preg-nancy,” said provincial health mi-nister Theuns Botha last week.

According to the official Impla-non website, it contains no estrogenandprevents pregnancyby stoppingthe release of an egg from the ova-ries. It also changes the consistencyof the mucous in the cervix, preven-ting the sperm from reaching the

egg.According to the website, clinical

studies indicate a woman’s chancesof getting pregnant are less than onefor every 100 women who use Impla-non for one year.

advantages and disadvantages. 2.2 If the proposed development might lead to rezoning of the site

than approval from Heritage Western Cape (“HWC”) will be required for the proposed development. In terms of the Standard Operating Procedure (“SOP”) between the Department and HWC, which came into effect on 1st July 2014, should Section 38 (1) of the national Heritage Resources Act, 1999 (Act no. 25 of 1999) (“NHRA”) be triggered, a Notice of Intent to Develop (“NID”) must be submitted to HWC. Furthermore a copy of the NID must simultaneously be submitted to this Department. If the Environmental Assessment Practitioner (“EAP”)/Heritage Practitioner is of the opinion that the development/activity will not change the character of the site, a request for confirmation of the applicability of Section 38 (1) (c) of the NHRA must be submitted to HWC.

2.3 The recommendations and mitigation measures stipulated in the Specialist Studies and by the EAP must be incorporated into the Final BAR and Environmental Management Programme.

2.4 The Final BAR must be made available for a 21 day commenting period. Only once the commenting period has been closed can the Final BAR be submitted to the Department for consideration with proof that registered I&AP’s were provided with an opportunity to comment. The comments and responses report must be updated to include and address additional comments received from registered I&AP’s and Organs of State.

2.5 The declarations from the applicant, EAP and independent specialists submitted with the Final BAR must be originals.

2.6 Since the development will require the decommissioning of fuel tanks, the EAP is required to obtain comment from the Department’s Directorate: Pollution Management.

2.7 All applicable listed activities should be included in the application. Failure to do so will invalidate the application.

2.8 The proposed development may not commence prior to an

2.2 SEC confirmed that as a result of the site being scheduled for rezoning in the future, Crammix Bricks has been shut down and as such the decommissioning is necessary as the tanks are no longer required. As such, SEC confirmed that the heritage legislation is not triggered.

2.3 SEC confirmed that all recommendations and mitigation measures of the EAP as well as Specialists and Organs of State will be incorporated into the Final BAR and Environmental Management Plan prior to submission.

2.4 SEC Confirmed that all comments received during the Draft BAR 40 day public comment period would be incorporated into the Final BAR and the Final BAR will be sent out for a further 21 day period for a second round of public comment

2.5 SEC confirmed that the Final BAR will then be submitted to the Department with all original signatures, a fully updated Comments and Responses Report, a Registered stakeholder table and proof of all phases of public participation.

2.6 SEC confirmed that the 40 day public participation period comes to an end on 1st September 2014. Comments had been received from the DEA&DP, Stellenbosch Municipality and one I&AP. all potential dust generating activities that may arise as a result of the proposed decommissioning activities as well as all mitigation measures that can be implemented at the site to reduce/ negate any potential dust impacts and nuisances has been compiled SEC confirmed that whilst the DMP historically implemented at the site has ceased due to the factory closing in December 2013, minor dust issues (associated with machinery dismantling etc.) that occur at Crammix bricks continue to be managed if an when appropriate by Crammix Bricks.

1.2 SEC confirmed that the DMP will be included in the Final BAR. A hard copy of the Final BAR including the DMP will be couriered to the City of Cape Town prior to the commencement of the next round of public participation.

Environmental Health The Environmental Health Department has no objection to the above mentioned application providing that: 2.1 The tanks and associated equipment (line pipes, etc.) be

dismantled and removed without causing any soil or groundwater contamination. All residual product resulting from storage of diesel fuel must also be removed from site.

2.2 Steps to be taken to avoid any health nuisance, including vapours and noise, as defined by the City of Cape Town, Environmental health By Law P.N. 13333 of 2003.

2.3 Decommissioning and dismantling of fuel tanks, including draining or reserves diesel fuel, must be done in such a way that it does not negatively impact any person or the surrounding community. That being said, workers handling/cleaning the fuel tanks must wear personal protective equipment.

2.4 To prevent any Health or Fire hazards, it must be ensured that all tanks are free of fuel vapours. This must be monitored throughout the dismantling process.

2.5 Written proof must be submitted that the tanks and associated equipment were indeed removed from site and disposed of satisfactorily.

2.6 The following legislation that pertains to Environmental Health must be complied with and included in the Final BAR: (a) Western Cape Noise Control Regulations, P.N. 200 of 2013

as promulgated under the Environmental Conservation Act, 1989.

(b) City of Cape Town Environmental Health By-Law P.N. 13333 of 2003.

(c) City of Cape Town Air Quality Management By-Law P.G. 6772 of 2010.

Environmental and Heritage Resources Branch 3.1 Section B7 of the BAR must be corrected to include the Braken

Nature Reserve within 500m to the north west of the larger Crammix site. Although SANBI Biodiversity GIS defines this area as being transformed due to the mining and development activities in the area, relatively good patches of fynbos vegetation remain on and abutting the larger Crammix site and are listed in the City of Cape Town’s Biodiversity Network. These remnants however, shouldn’t be affected by the decommissioning activities as the activities will be undertaken in already disturbed/mined areas, on the southern section of the Crammix site.

3.2 A copy of the site closure audit report must be submitted to this office for record purposes.

3.3 Potable water must not be used for dust suppression; water can be used from the Crammix quarry water bodies for this purpose.

3.4 Working hours must be specified in the Environmental Management Plan (“EMP”) to avoid confusion

3.5 It must be clarified who the “reasonable professional” who will be present when tank removal is in process referred to in Section 5.1 (b) and 5.5 (b).

3.6 The traffic speed limits for the site must be specified in Section 5.10 (d).

3.1 SEC confirmed that Section B7 of the Final BAR will be revised to include reference to the Braken Nature Reserve 500metres to the North West of the larger Crammix Bricks site.

3.2 SEC confirmed on behalf of Chevron that following the decommissioning and correct disposal of the tanks and associated equipment located at Crammix Bricks, a copy of the site closure audit report will be submitted to the City of Cape Town for record purposes.

3.3 SEC confirmed that the DMP compiled for the decommissioning activities includes the requirement to utilise quarry water bodies for dust suppression purposes.

3.4 SEC confirmed that the EMP will be revised to include specific working hours on site. SEC confirmed that working hours on site will be between 08h00 and 17h00 on Monday to Friday only and no work will occur on weekends.

3.5 SEC confirmed that Section 5.1 (b) and 5.5 (b) of the EMP will be revised to identify the site assessment/ risk assessment practitioner as the “responsible professional” who will be present when the tank removal is in process.

3.6 SEC confirmed that the Final BAR and EMP will be revised to indicate the traffic speed limits for the site as 60km/hr on Crammix Road and 10km/hr within Crammix Bricks itself.

Comments received from the Directorate: Pollution Management include the following: Introduction: Clarification of the discrepancy in the tank volumes specified in the Draft BAR is required. A1 Chevron must confirm the future zoning considered for the site. A2 Chevron is not aware of any known or reported spills and/or leaks from the tanks; A3 Tests have been conducted on the tanks. The report on the test results has not been submitted with the DBAR. A4: A baseline Environmental Conditions Assessment (ECA) was conducted in 2013 whilst the site was still operational but production levels were scaled down. The results and the correspondence provided to SEC indicate that the site is not

In an email dated 30th September 2014 SEC responded to the comments raised by the Directorate: Pollution Management, stating the following: Introduction: SEC confirmed that the total fuel storage capacity at the site is 203m3. In citing a total of “up to 300m3”, SEC intended to allow for the event that any discrepancy in tank volumes is discovered during site decommissioning; or possibly an undetected underground tank being discovered when an underground utilities clearance survey is undertaken just prior to tank decommissioning. SEC is satisfied that the decommissioning procedure and management measures recommended in the BAR and EMP will be adequate for a total capacity of up to 300m3, in the general fuel storage areas indicated on the site layout plans.

contaminated and as such does not require any remedial intervention work. A5: D:PM noted that the date of sampling in the ECA is 26th April 2014 and date of analysis is 10th May 2014. A detailed methodology of the sampling procedure and storage of samples from collection to analysis is required. A6: The DBAR refers to 2 x HFO ASTs with a capacity of 83m3 yet the ECA states the volumes of the HFO ASTs as 80m3. Clarification of the discrepancy is required. B1: Given that the ECA was conducted prior to the removal of the tanks, as well as D:PM’s concerns raised with regard to the time lapse between the sampling and analysis of the samples as indicated in the ECFR, a following-up contamination assessment is required to confirm the outcome of the baseline ECO conducted once the tanks have been removed. B2: Attention is drawn to the coming into effect of Part 8 (provisions 35041) and the promulgation of the “Norms and Standards for the remediation of contaminated land and soil quality”, of NEM: Waste Act No. 59 of 2008 (NEMWA). B3: Guidance in terms of the requirements of Part 8 of NEMWA will be provided once the outcomes of the follow-up contamination assessment have been communicated to the D:PM. B4: Should the outcome of the follow up contamination assessment indicate a substantial difference in comparison with the baseline assessment, the ECA cannot be accepted. Chevron will be required to ensure compliance with the provisions of Part 8 of NEMWA. B5: The report on the tests conducted on the tanks must be submitted to the D:PM. B6: It must be ensured that Crammix Brick complies with the commitments contained in the DBAR and EMP. B7: An Audit Report for comment by D:PM must be submitted once the decommissioning has been completed.

A1. The Spatial Planner for the District at the City of Cape Town, Mr Gerrit Fourie, confirmed in a telecom on 30th September 2014 that the site is currently zoned Agricultural in terms of the Cape Town zoning scheme which came into effect on March 2013. The site is however to be re-zoned for residential and commercial purposes. Council has received an application on the subject property which will consist primarily of residential units in various forms supported by a smaller commercial node. SEC confirmed that this information will be included in the Final BAR. A2 No response required. A3 As per D:PM’s telecom with Colleen McCreadie on 25th September 2014, the reference to the “tests” in the report refer to tests which will be undertaken whilst the tanks are being removed. They will inform the decommissioning process from the perspective of minimising health and safety and environmental risks. Draft Basic Assessment Report to proceed. If contamination occurs because of the removal of the storage

tanks and other infrastructure, or if contamination is found that was the result of leaks during the operation of the tanks, the Department must be notified immediately.

The tanks must be thoroughly emptied prior to dismantling to prevent any leaks that may enter the stormwater system.

All clean up and rehabilitation measures contained in the emergency response plan must be adhered to at all times.

If pollution of groundwater occurs, a remediation plan must be provided to the Department. This should include groundwater monitoring for a reasonable time after the cleanup operation had taken place.

The precautionary principle applies. If pollution does occur, every effort should be made to reduce the levels of contamination as far as possible.

Good morning Bernadette,  Thank you for your comments (attached) on the Draft Basic Assessment Report for the proposed decommissioning of fuel tanks located at Crammix Bricks, Brakenfell.   As per point 2.1, SEC will make amendments as required to the BAR to ensure clear reference to the preferred alternative in the Final BAR in compliance with Regulation 28 (1)(c) and Regulation 28 (1) (j) of GN No.R543 of the NEMA EIA Regulations, 2010.   As per point 2.2, as a result of the site being scheduled for rezoning in the future, Crammix Bricks has been shut down and as such the decommissioning is necessary as the tanks are no longer required. As such, SEC confirms that the heritage legislation is not triggered.   As per point 2.3, all recommendations and mitigation measures of the EAP as well as specialists and Organs of State will be incorporated into the Final BAR and Environmental Management Plan prior to submission.   As per point 2.4, all comments received during the Draft BAR 40 day public comment period will be incorporated into the Final BAR and the Final BAR will be sent out for a further 21 day period for a second round of public comment.  As per point 2.4 and 2.5, The Final BAR will then be submitted to the Department with all original signatures, a fully updated Comments and Responses Report, a Registered stakeholder table and proof of all phases of public participation.  As per point 2.6, the 40 day public participation period comes to an end on 1st September 2014. At this stage comments have been received from the DEA&DP, Stellenbosch Municipality and one I&AP. The EAP will send out a reminder email to all Organs of State who have yet to comment (most specifically DEA&DP: Pollution Management) to comment by 1st September 2014.  I trust that this is in order. Should you have any further comments or queries, please do not hesitate to contact me.     Warmest regards,

Good afternoon Jahne,  SEC received the Directorate: Pollution Managements’ (D:PM) comment for the proposed decommissioning of fuel tanks at Crammix Bricks on 9th September 2014, thank you.  Please see SEC’s response to the Directorate’s comments and queries below, using your numbering system.   Introduction  The total fuel storage capacity at the site is 203m3. In citing a total of “up to 300m3”, SEC intended to allow for the event that any discrepancy in tank volumes is discovered during site decommissioning; or possibly an undetected underground tank being discovered when an underground utilities clearance survey is undertaken just prior to tank decommissioning: this has happened on past applications.   SEC is satisfied that the decommissioning procedure and management measures recommended in the BAR and EMP will be adequate for a total capacity of up to 300m3, in the general fuel storage areas indicated on the site layout plans.  A1. The Spatial Planner for the District at the City of Cape Town, Mr Gerrit Fourie, confirmed in a telecom on 30th September 2014 that the site is currently zoned Agricultural in terms of the Cape Town zoning scheme which came into effect on March 2013. The site is however to be re‐zoned for residential and commercial purposes. Council has received an application on the subject property which will consist primarily of residential units in various forms supported by a smaller commercial node. This information will be included in the Final BAR.  A2: No response required.  A3: As per D:PM’s telecom with Colleen McCreadie on 25th September 2014, (as attached),  the reference to the “tests” in the report refer to tests which will be undertaken whilst the tanks are being removed. They will inform the decommissioning process from the perspective of minimising health and safety and environmental risks. For example, testing the tank manholes for vapour prior to commencing with the decommissioning process. It is not necessarily the case that test results would be available or reported on. However, SEC confirms that any additional site assessment and soil and groundwater sampling required, will be undertaken when the tanks are removed and the reports submitted to DPM accordingly.  A4: No response required.  A5. SEC has requested the detailed methodology of the sampling procedure and storage of samples from the applicant and the specialists who undertook the site assessment. This has been attached for D:PM’s review and will be included in the Final BAR.   A6:  The applicant, Chevron, has confirmed that the tanks are 83m3 in capacity.

B1 and B5: In an email dated 26th September 2014, Chevron has confirmed that a follow up contamination assessment will be undertaken once the tanks have been removed, the results of which will be forwarded to the Directorate: Pollution Management.  B2, B3 and B4:Chevron acknowledges that all legislative requirements for remediation of any contamination that may be detected at the site once a further contamination assessment has been undertaken, will be adhered to.                                                                                                                                                          B6. The applicant, Chevron,  confirms that they will comply with all commitments contained in the Draft BAR and EMP.  B7: A post‐closure audit report, to be submitted to the DEA&DP Land Management and Pollution Management Directorates,  has been included as a condition in the EMP. Please refer to Section 6 of the EMP, which will be distributed with the Final BAR for comment in due course.  Thank you     Warmest regards,
