D. REGULAR AGENDA ITEMS THAT MAY REQUIRE ITPC ACTION

1. Proposed Final FY 2020 OCARTS Area Unified Planning Work Program (UPWP) Jennifer Sebesta said last month the list of tasks was presented to the committee and this month the proposed final FY 2020 OCARTS Area UPWP, which also includes the accomplishments of 2019 and FY 2020 budget, is being brought to the committee for approval. She said the budget is higher this year than in the past because additional items were included: transportation modeling work for the 2045 Plan, an ITS Plan update, an air quality nonattainment study, and an update to the Commuter Corridor Study for the Regional Transportation Authority (RTA). The proposed FY 2020 budget also includes RTA local funding for the first time. There being no discussion, Councilmember John Brown moved to approve the proposed Final FY 2020 OCARTS Area Unified Planning Work Program and authorize staff to proceed with executing related contracts and agreements, subject to availability of funds. Councilmember Todd Stone seconded the motion. The motion carried.

2. Public Hearing and Action on Request for Amendment to the FFY 2019 Transit Element of the FFY 2018-2021 OCARTS Area TIP by COTPA Hayden Harrison said COTPA has submitted a request for an amendment to the FFY 2019 Transit Element of the FFY 2018-2021 OCARTS Area TIP. She

highlighted the information as detailed in the agenda memorandum. Larry Hopper said Suzanne Wickenkamp was in attendance to answer any questions the committee might have. There was no discussion. Chairman Matt Dukes opened the public hearing. There being no response from the public, the public hearing was closed. Commissioner Wilson Lyles moved to amend the FFY 2018-2021 OCARTS Area TIP by replacing the COTPA FFY 2019 Transit Element with the attached program of projects and submit the same to the Oklahoma Department of Transportation (ODOT) for amendment of the Statewide Transportation Improvement Program (STIP). Larry Hopper seconded the motion. The motion carried.

3. Preliminary FFY 2020-2023 Oklahoma City Area Regional Transportation Study (OCARTS) Transportation Improvement Program Hayden Harrison said the preliminary FFY 2020-2023 OCARTS TIP has been available for public review and comment the past 30 days. She said ACOG received no comments. She said the Intermodal Transportation Technical Committee (ITTC) recommended that the ITPC approve the Preliminary FFY 2020-2023 OCARTS TIP document for final consideration in June 2019. There being no discussion, Councilmember John Brown moved to approve the Preliminary FFY 2020-2023 OCARTS TIP document for final consideration in June 2019. Councilmember Todd Stone seconded the motion. The motion carried.

4. Request for Comments/Recommendations for the ITTC Criteria Subcommittee to Consider at the Summer 2019 STBG-UZA Scoring Criteria Revision Meetings Hayden Harrison highlighted the information as detailed in the agenda. When referring to the survey where comments and recommendations for the STBG-UZA Criteria could be submitted, several members stated they had not received it. Mr. Sweeney said the survey would be sent again to both the ITTC and ITPC members. Mr. Sharp said the desire is to receive feedback by June 7. He said two meetings have been scheduled for the STBG-UZA Criteria Subcommittee, with the option of additional meetings if necessary. The goal is to have updated criteria by September since the next Call for Projects opens November 1. Isaac Akem asked for a brief summary of the issues with the new Criteria. Mr. Sharp first noted that last summer as the new criteria was being finalized, the subcommittee came to two conclusions: transit projects would be limited to a ten percent cap and after the first round of project selection with the new criteria, it would be re-assessed to determine if anything needed to be changed going forward.

Mr. Sharp said the new criteria was a dramatic change from the previous set since it now aligned with federal guidelines and the long-range metropolitan transportation plan, whereas the old criteria did not. He said every year, small adjustments are made, but with this new criteria, it was deemed necessary to have a subcommittee meeting to resolve issues that arose. Mr. Sweeney asked what was in the new criteria that was the centerpiece to most of the trepidations. Mr. Sharp said with the new criteria, all projects now had the ability to score 100 points. In the past, certain project types could only attain 20, 30, or 60 points maximum. The subcommittee tried to make the criteria more equitable so that each type of project that could be brought forward would have the possibility of scoring 100 points. What occurred that spurred issues was one city spent time researching and testing the criteria and found a number of high scoring projects that they could put forward in a particular category (in this case, standalone bike/ped). The projects that city submitted were in areas where they could get the most points. To bring the criteria more to the center, the subcommittee will most likely address the scoring and limit it in some way (like they did with transit being limited to a ten percent cap). There being no further discussion, Councilmember Todd Stone made a motion to accept the recommendations of the subcommittee. Mayor Ray Poland seconded the motion. The motion carried. Mayor Lynne Miller commented that she appreciated the survey and appreciated the opportunity of the elected officials to attend the subcommittee meetings to hear what is going on. She thanked ACOG very much.

5. 2019 National Bike Month Taylor Johnson said that the 2019 National Bike Month will be officially over on May 31. He then gave a presentation of some of the events that occurred in May, which can be viewed here: http://www.acogok.org/wp-content/uploads/2019/06/Bike-Month-and-BTW-Presentation-2019-Updated.pdf

6. 2018 Ozone Advance Update Input Eric Pollard said every year ACOG completes an Ozone Advance submission, which is ACOG’s opportunity to share with EPA Region 6 what the region is doing to reduce emissions that cause ozone. ACOG works closely with the Oklahoma Department of Environment Quality (ODEQ) to complete as comprehensive a list as possible of all emissions reductions actions that are being taken in the region. He thanked the cities of Mustang and Yukon for submitting new projects this year. He said if any of the entities have new projects that are not on the list, to please let him know. He said this takes on increased urgency as our region heads toward a likely violation of the EPA ozone standard this year. EPA will be looking more

closely at what we are doing as a region to reduce emissions, and this is our opportunity to share with them.

7. Transportation News and Update Report Census 2020 Geography ACOG staff is working with local entities on census tract and block group geographies for the 2020 Census. ACOG will be using the boundaries for future transportation planning and modeling. Local members will be using them for CDBG and other federal grants. Typically, ACOG staff prefers to keep the census tracts the same in order to allow for historic comparisons; however, if an area has grown dramatically, then a census tract may require splitting. FY 2020 UPWP and Budget ACOG staff has had discussions with FTA and FHWA regarding certain future projects listed in the UPWP and ACOG budget in order to determine different solutions for consultant selection. One of these projects is the air quality nonattainment study and the other is a transit/rail study for the RTA. State Transportation Innovation Committee ACOG hosted the quarterly State Transportation Innovation Committee meeting this month. This meeting gives state agencies and FHWA an opportunity to share new innovations. Mr. Sharp mentioned one of the projects is going to test a particular segment of Memorial Road where they will add rubber into the asphalt to see if it will bring more longevity and life to those particular roads. Tree Canopy Study ACOG, Oklahoma City Community Foundation, and Oklahoma Forestry Service staff met with the Davey Resource Group this month as they start their data collection on the species diversity and health of trees in Central Oklahoma. As mentioned, this study will assist with air quality modeling and planning, heat islands, and water runoff issues. Aerial Photography Last weekend, the City of El Reno experienced a deadly EF-3 tornado that hit a number of buildings, including a hotel and mobile home park. ACOG staff helped the City of El Reno access new aerial photography that was flown this spring so they could more clearly assess damage issues. He said our 9-1-1 department had provided funding for the project, which allowed ACOG to get a one-foot aerial photography for all of Canadian County. Driving Oklahoma ODOT Secretary Tim Gatz is continuing to have discussions on new technologies that may affect the transportation system in Oklahoma. Oklahoma Municipal League (OML)’s Jodi Lewis made some comments concerning SB 365 – that preempts authority of cities and counties to restrict autonomous vehicles. Secretary Gatz said that he would work with OML and local communities on this issue.

Oklahoma City West River Trail The Oklahoma City Community Foundation has finished planting 800 trees along a segment of the River Trail near Western Avenue. Surveys for Residential Building Permit Fees and Oil and Gas Permit Fees Mr. Sharp presented survey results from many of the region’s member entities for residential building permit fees and oil and gas permit fees. This information will allow members to review what each community is charging for those services. He thanked the entity staffs for helping ACOG with this update. Regional Transportation Authority ACOG staff was asked to speak with the League of Women Voters in Norman about the RTA. Summer Intern Each summer ACOG applies to the Local Technical Assistance Program at OSU for a summer intern. These interns are usually engineering or planning students from OSU and OU. ACOG is happy to have Ignacio Velasco Gil join us for the summer. The internship gives him a chance to learn what a COG does and by attending some of our meetings, he will get a better understanding of how regional cooperation works. The committee welcomed Mr. Velasco Gil. Councilmember Peter Hoffman referred back to the oil and gas permit fees and the issue of drilling within communities. He asked how the public sentiment is relative to five to ten years ago in allowing it to happen, regardless of how much money is raised. Mr. Sharp said ACOG has heard from communities in the southwest portion of the ACOG area recently, and it seems like the volume has increased dramatically and is causing some issues for those communities in maintaining roads and proximity of rigs to residential structures. Councilmember Mike Fullerton said generally the public does not like the increased drilling activity and it is a big battle. He said their city is caught between the oil industry and citizens; they need to come together as a community because the gas is there and if they do not come to an agreement, the legislature will push them into something the entities will not like. Mayor Mike McEachern said HB 2150 will take away the cities’ rights. Commissioner Wilson Lyles said the Oklahoma Corporation Commission administers permits and compliance for oil and gas drilling. Mayor McEachern said the rights of individuals is what is at stake here. The oil companies are moving to take control away from the local communities. Commissioner Lyles said the entities have to get the legislators on board to get the gross production tax back up to where it needs to be competitive with our surrounding states, but they refuse to do so because they are afraid the oil and gas companies will pull out. Councilmember Fullerton said he had an opportunity to speak at a hearing at the Capitol in August 2018, and proposed a 0.5 percent gross production

tax increase to go to the county if drilled within the county or a 0.45 percent tax to the city if drilled within the city. This increase would be used to repair road damages. Mayor McEachern said there is a concerted effort by the current state administration to tell cities how to raise their tax, pitting local governments against the Oklahoma Corporation Commission. The water is of concern and residents are selling water off their property. Councilmember Fullerton said every horizontal well equals about 40 vertical wells. Councilmember Hoffman asked if they are concerned about the 4 million gallons they use per well to drill. Mark Sweeney said based on what he thinks he is hearing around the table – he already knows what one of the top priorities is legislative-wise for 2020. Even though it was on the radar screen this time, maybe going forward into the fall, there needs to be continual conversation about how to strategize as this is a common problem among every entity. He said there are some other things to bring to the table for legislative issues, but maybe the process should be started a little earlier than last year to try to come up with some strategies that will work going forward. He said there is no guarantee of success, but if we do not come together to work together, we will not get anywhere. Chairman Dukes agreed that the entities need to come together on this issue.

MID-YEAR STATUS REPORT ON THE OBLIGATION OF FFY 2019 SURFACE TRANSPORTATION BLOCK GRANT URBANIZED AREA (STBG-UZA) FUNDS AND PENDING PROJECTS DATE: JUNE 27, 2019 FROM: HAYDEN HARRISON Projects Coordinator II Transportation & Planning Services INFORMATION: The attached three tables reflect the Surface Transportation Block Grant Urbanized Area (STBG-UZA) funds obligated during the first half of FFY 2019 (Oct. 1, 2018 - Mar. 31, 2019) and the funds anticipated to be obligated by the end of the federal fiscal year (Sept. 30, 2019).

The FFY 2019 STBG-UZA funds for the OCARTS Transportation Management Area are $26,117,981.18. This is based on the region’s FFY 2019 STBG-UZA obligation authority ($17,958,502.50) plus the remainder not spent by the region through September 30, 2018 ($8,159,478.68).

Table 1 lists all transactions affecting the region’s STBG-UZA funds during the first half of FFY 2019, as provided by the ODOT Finance Division. The column entitled "Change in Federal Funds" reflects cost overruns and underruns associated with STBG-UZA projects previously awarded, as well as the estimated federal share for FFY 2019 projects authorized by the Federal Highway Administration prior to bid letting.

Table 2 takes the estimated balance of FFY 2019 funds from Table 1 ($26,117,981.18), and reflects the estimated change in funds that will occur if all unauthorized projects included in the FFY 2019 element of the TIP are authorized by September 30, 2019.

Table 3 combines the information provided in Tables 1 and 2 by reflecting obligated funds and funds anticipated for obligation, by each local government, through the end of the federal fiscal year.

As a reminder, in order to secure FFY 2020 funding authorization, all of the following requirements must be met by July 1, 2020:

• The project must receive final right-of-way clearance from ODOT (which can only occur after federal environmental clearance),

• The sponsoring entity must submit final plans to ODOT, • The sponsoring entity must submit an updated cost estimate to ODOT (prepared by

the project engineer), and • The physical movement of utilities should be complete or underway.

ATTACHMENT C-2 SUBJECT: SUMMER 2019 STBG-UZA SCORING CRITERIA REVISION MEETINGS DATE: JUNE 27, 2019 FROM: HAYDEN HARRISON Projects Coordinator II Transportation & Planning Services INFORMATION: At the April ITPC meeting, Mayor Lynne Miller of the City of Norman presented a motion to direct the STBG-UZA Criteria Subcommittee to reassess the STBG-UZA scoring criteria for future years and consider modifications to the project selection criteria for the STBG-UZA Program. When the ITTC Criteria Subcommittee revised the STBG-UZA scoring criteria in August 2018, it was understood that the subcommittee would reconvene to address any concerns that arose after the first Call for Projects was conducted. This will allow all members to provide feedback on the scoring criteria process. To ensure all comments, suggestions, and recommendations were received and documented, ACOG staff welcomed members of the ITTC and ITPC to provide feedback via an online survey: https://acogok.wufoo.com/forms/stbguza-criteria-update-survey/. This survey reviewed the Criteria and Process for Evaluation of Service Transportation Block Grant - Urbanized Area (STBG-UZA) Projects that was developed under the guidance of the ITTC Criteria Subcommittee in the summer of 2018, as well as the STBG-UZA Procedures. The results of the survey were discussed at the first STBG-UZA Criteria Subcommittee meeting held on Friday, June 14. Other comments, suggestions and recommendations were received and will be compiled into potential revisions to the STBG-UZA Scoring Criteria. These potential revisions will be presented at the next STBG-UZA Criteria Subcommittee meeting on Thursday, July 18, 2019. Additional meetings will be scheduled as needed. FROM: HAYDEN HARRISON Projects Coordinator II Transportation & Planning Services INFORMATION: The Central Oklahoma Transportation and Parking Authority (COTPA) has submitted a revised program of projects for the EMBARK bus system to amend the FFY 2019 Transit Element of the FFY 2018-2021 OCARTS Area Transportation Improvement Program (TIP). COTPA is requesting this amendment (see next page) to add the FTA 5337 State of Good Repair funds apportioned for FY 2016 and FY 2017. The FY 2016 funds will be used to help fund the Meridian Ave. Landing Project along the Oklahoma River, and the FY 2017 funds will be used to help fund improvements such as the Regatta Park Landing. These funds may be used for repair and reconditioning of Rivercruiser vessels. Further details about the request can be found in the attachments. This amendment will ensure consistency among the OCARTS TIP, the Statewide Transportation Improvement Program (STIP), and the grant awards. Upon approval, the attached program of projects will supersede and replace the FFY 2019 COTPA Transit Element (page 41) of the FFY 2018-2021 OCARTS Area TIP. The Intermodal Transportation Technical Committee (ITTC), at its June 13, 2019 meeting, recommended approval. ACTION REQUESTED: Motion to amend the FFY 2018-2021 OCARTS Area TIP by replacing the COTPA FFY 2019 Transit Element with the attached program of projects and submit the same to the Oklahoma Department of Transportation (ODOT) for amendment of the Statewide Transportation Improvement Program (STIP).

TIP Amendment Two, FTA Section 5337 Funds, May 2019 2019 TAM states seven SGR Measures, two (#7 and #8) of which apply to the Rivercruiser program. Performance Measures for FY2018 – FY2022 with FY2019 Performance Targets For COTPA’s fiscal year 2019 (July 2018 – June 2019) we submitted to the following Strategic Government Resources (SGR) targets: 1. N/A % of EMBARK vehicles that have met or exceeded their Useful Life Benchmark (ULB) Not applicable to this TIP Amendment regarding the Rivercruiser program. These are for rubber-tire vehicles that are >$50,000 in value and not used for revenue. COTPA does not have any non-revenue vehicles more than $50,000. 2. 0 % of EMBARK fixed-route heavy duty transit buses will have met or exceeded their Useful Life Benchmark (ULB) This bus-related measure is not applicable to this TIP Amendment regarding the Rivercruiser program. EMBARK uses 12 years ULB for all heavy-duty transit buses using the ULB for grants. 3. 0% of EMBARK paratransit buses will have met or exceeded their Useful Life Benchmark (ULB) Not applicable to this TIP Amendment regarding the Rivercruiser program. 4. 0% of EMBARK streetcar vehicles will have met or exceeded their Useful Life Benchmark (ULB) This is a streetcar-related measure, and so is not applicable to this TIP Amendment regarding the Rivercruiser program. 5. 0% of EMBARK track segments will have performance restrictions by class This streetcar-related measure is not applicable to this TIP Amendment regarding the Rivercruiser program. 6. 0% of EMBARK facilities will have a condition rating below 3.0 on the FTA Transit Economic Requirements Model (TERM) scale The EMBARK Ferryboat landings do not have a condition rating below 3.0 on the TERM scale, and yet can always benefit from improvement. The repairs and renovations to the Regatta Park and Meridian landings, for example, will help to ensure that conditions remain sufficiently high. 7. 0% of EMBARK ferryboat vessels will have a condition rating below 3.0 on the grading of condition for vessels based on values in the Published Marine Price Guide Book. The EMBARK Ferryboat vessels have a condition rating far below 3.0 (lower implies better quality). This TIP amendment can be used to refurbish, repair and recondition the ferryboat vessels to help keep them below 3.0, and these funds are not programmed this time to the ferryboat maintenance facility.

No written comments were received during the 30-day public comment period.
