RESOLUTION - Authorizing the Director of the Board of Chosen Freeholders of the County of Hunterdon to sign and accept a County Comprehensive Alcoholism and Drug Abuse Contract #21-532-ADA-0, in the amount of $221,545.00, with a County Match of $28,699.00 for the period of January 1, 2021 through December 31, 2021.

2. RESOLUTION - Authorizing the Freeholder Director and Clerk of the Board of

Chosen Freeholders to sign and accept, on behalf of the County, a Supplemental Agreement, for the period of March 1, 2020 through July 31, 2021, Federal funds allocated through FTA Section 5311 CARES ACT, in the amount not to exceed $1,084,616.00

3. RESOLUTION - Authorizing the Director of the Board of Chosen Freeholders to

execute Contract Modification #1 and Contract Modification #2 with the Department of Military and Veterans Affairs to extend the original grant term through December 31, 2020 and increase the total grant amount by $7,500.00, from the original amount of $15,000.00 to $22,500.00.

4. RESOLUTION - Authorizing the Hunterdon County Health Department to accept a

Radon Awareness Program Grant, from the New Jersey Department of Environmental Protection, in the amount of $2,000.00 for the period of July 1, 2020 through June 30, 2021.

1. RESOLUTION - Authorizing the Freeholder Director to sign on behalf of the County, a Professional Services Agreement with Malick & Scherer, P.C. for a NJDEP permit modification and extension for the Prescott Bridge, in an amount not to exceed $61,696.82.

2. RESOLUTION - Approving Requisition #R0-05256 with Direct Flooring, in an

amount not to exceed $64,851.85 for flooring upgrades.

3. RESOLUTION - Approving Requisition #R0-05257 with Direct Flooring, in an amount not to exceed $69,225.98, for flooring replacement at the Justice Complex.

1. RESOLUTION - Expressing the support of the Hunterdon County Board of Chosen Freeholders for revisions to the Main Street Flemington Redevelopment known as Courthouse Square.

1. RESOLUTION - Authorizing final approval of the proposed acquisition of a development easement on the property owned by Susan Thomas, located on Rainbow Hill Rd, Flemington, NJ; and designated as Block 21, Lot 13 in East Amwell Township, County of Hunterdon, State of New Jersey, totaling approximately 33.9 acres and appropriating $71,190 through a Municipal Planning Incentive Grant.

2. RESOLUTION - Authorizing final approval of the proposed acquisition of a

development easement on the property owned by Jason and Ashley Onuschak, located at 452 Cherryville Road, Pittstown, NJ; and designated as Block 30, Lot 13 in the Township of Franklin, County of Hunterdon, State of New Jersey, totaling approximately 20.6 acres, and appropriating $8,668.80 through a Municipal Planning Incentive Grant.

Road Repairer 2 in the Hunterdon County Department of Public Works, Division of Roads.

5. RESOLUTION - Authorizing the regular appointment of Eric Hammerstone as a

6. RESOLUTION - Authorizing the Freeholder Director to execute, on behalf of the

County of Hunterdon, a contract with Martin and Cathleen DeSapio for a development easement identified as Block 6, Lot 11 on the Tax Map of the Township of Kingwood for approximately 48.4 gross acres.

7. RESOLUTION - Authorizing the Freeholder Director and Freeholder Clerk to sign

on behalf of the County, the 2020 agreement with Millersville University of Pennsylvania for assistance in performing surveillance in connection with the County’s Black Fly Control Program

Chosen Freeholders of the County of Hunterdon, to execute a Discharge of Mortgage on Block 13, Lot 10 in the Township of East Amwell.

12. RESOLUTION - Approving a temporary/interim retroactive salary adjustment for

25. RESOLUTION - Authorizing the Freeholder Director to sign a Section 5311 Federal

and October 25. 2. RESOLUTION - Approving a request from the High Bridge Emergency Squad

to host a coin toss in front of the High Bridge Station / Station 3 at 95 W. Main Street in the Borough of High Bridge, on Saturday October 17, 2020 from 9:00 AM to 1:00 PM, with a rain date of October 18, 2020.

3. RESOLUTION - Approving a request from the High Bridge Fire Department to

PROCLAMATION

2020-35 Fire Prevention Week 2020

WHEREAS, the County of Hunterdon is committed to ensuring the safety and security of allthose living in and visiting Hunterdon County; and

WHEREAS, fire is a serious public safety concern both locally and nationally, and homes arethe locations where people are at greatest risk from fire; and

WHEREAS, home fires killed more than 2,630 people in the United States in 2017, accordingto the National Fire Protection Association® (NFPA®), and fire departments in the UnitedStates responded to 357,000 home fires; and

WHEREAS, cooking is the leading cause of home fires in the United States where firedepartments responded to more than 173,200 annually between 2013 and 2017; and

WHEREAS, two of every five home fires start in the kitchen with 31% of these fires resultingfrom unattended cooking; and

WHEREAS, more than half of reported non-fatal home cooking fire injuries occurred when thevictims tried to fight the fire themselves; and

WHEREAS, children under five face a higher risk of non-fire burns associated with cookingthan being burned in a cooking fire

WHEREAS, Hunterdon County’s residents should stay in the kitchen when frying food on thestovetop, keep a three-foot kid-free zone around cooking areas and keep anything that cancatch fire away from stove tops; and

WHEREAS, residents who have planned and practiced a home fire escape plan are moreprepared and will therefore be more likely to survive a fire; and

WHEREAS, working smoke alarms cut the risk of dying in reported home fires in half; and

WHEREAS, Hunterdon County first responders are dedicated to reducing the occurrence ofhome fires and home fire injuries through prevention and protection education; and

WHEREAS, Hunterdon County’s residents are responsive to public education measures andare able to take personal steps to increase their safety from fire, especially in their homes; and

WHEREAS, the 2020 Fire Prevention Week theme, “Serve Up Fire Safety in the Kitchen”effectively serves to remind us to stay alert and use caution when cooking to reduce the risk ofkitchen fires.

THEREFORE, the Hunterdon County Board of Chosen Freeholders do hereby proclaimOctober 4-10, 2020, as Fire Prevention Week throughout this state, and urge all residents ofHunterdon County by checking their kitchens for fire hazards and using safe cooking practicesduring Fire Prevention Week 2020, and to support the many public safety activities and effortsof Hunterdon County’s fire and emergency services.

WHEREAS, Hunterdon County selects a dairy princess each year since 1965; and

WHEREAS, Rebecca Phillips, of West Amwell Township, is a senior at South Hunterdon Regional HighSchool; and

WHEREAS, Rebecca Phillips has been a member of the Mount Airy Dairy 4-h Club for eight years and iscurrently the president; and

WHEREAS, Rebecca Phillips has breed and shown her own Holstein cattle where they are kept atSpring Run Dairy in Alexandria Township; and

WHEREAS, Rebecca Phillips has served as a Hunterdon County Dairy Ambassador for eight years, andis a member of the South Hunterdon Regional FFA Chapter as a reporter, is on the varsity field hockey,basketball, softball teams, and participates in the Key Club and Peer Leaders Program; and

WHEREAS, the County of Hunterdon was awarded a n Operating Assistance grant for federalfunds allocated through FTA Section 5311, in the amount not to exceed $356,972.00 with NewJersey Transit allocating $178,486.00 and a County match of $178,486.00, for operating theHunterdon County Consolidated Transportation system, for the period of January 1, 2020through December 31, 2020; and

WHEREAS, on May 5, 2020 the Hunterdon County Board of Chosen Freeholders authorizedan application with NJ TRANSIT, who as the Designated Recipient will apply to the U.S.Department of Transportation, requesting aid in the financing of administration, capital and/oroperating assistance projects pursuant to Section 5311 CARES ACT of the Federal TransitAct, and

WHEREAS, Hunterdon County has been awarded a grant through FTA Section 5311 CARESACT in the amount not to exceed $1,084,606.00 with New Jersey Transit, no local matchrequired, for operating the Hunterdon County Consolidated Transportation system, for theperiod of March 1, 2020 through July 31, 2021; and

WHEREAS, in February of 2017, Hunterdon County Freeholders endorsed the Main Street Flemingtonredevelopment plan, known as the Courthouse Square Project; and

WHEREAS, the Borough of Flemington originally approved this redevelopment plan in December of2017; and

WHEREAS, since that time, the original approved plan has been substantially revised to take intoaccount public concern about the perseveration of historic structures and ongoing concerns aboutthe projects’ scale; and

WHEREAS, the Borough of Flemington approved this new revised redevelopment plan for theCourthouse Square Project in September of 2020; and

WHEREAS, the Hunterdon County Board of Chosen Freeholders continues to encourage responsibleredevelopment and investment in our downtown centers while retaining its rural character; and

WHEREAS, Hunterdon County demonstrated its commitment to targeted economic development bycreating an Economic Development Division and hiring its Director; and

WHEREAS, the revised Main Street Flemington redevelopment effort, known as the Courthouse SquareProject, addresses many economic development objectives and supports long term economic viability forHunterdon County.

NOW, THERFORE, BE IT RESOLVED, that the Board of Chosen Freeholders of the County ofHunterdon does hereby acknowledge that the revised Main Street Flemington redevelopment plan,known as the Courthouse Square Project, supports and promotes economic sustainability; and

WHEREAS, the County of Hunterdon may acquire a development easement in accordance with theState Agriculture Retention and Development Act, N.J.S.A. 4:1C 11 et. seq., the Municipal PlanningIncentive Grant Program, N.J.S.A. 4:1C 43.1, and the regulations thereunder; and

WHEREAS, on March 7, 2019, the Hunterdon County Agriculture Development Board (CADB) receivedan application for the proposed acquisition of a development easement on the approximately 36.4-acreproperty owned by Susan Thomas, located on Rainbow Hill Rd, Flemington, NJ; and designated asBlock 21, Lot 13 in East Amwell Township, County of Hunterdon, State of New Jersey; and

WHEREAS, on May 28, 2020, the State Agriculture development Committee (SADC) certified the fairmarket value (CMV) of the development easement pursuant to N.J.A.C. 2:76-7.14 at $10,500.00 peracre on the Thomas Farm with one dwelling opportunity consisting of: zero Residential Dwelling SiteOpportunity (RDSO); zero existing dwellings in the Proposed Easement Area; zero severableexceptions; and one 2.5-acre non-severable exception limited to one future single-family residential unit;resulting in approximately 33.9 net acres; and

WHEREAS, on July 9, 2020, the landowner accepted the CMV of $10,500.00 per acre, conditioned uponall interested parties granting final approval for acquisition of a development easement; and providing fora commitment of funding pursuant to N.J.A.C. 2:76-17.16; and

WHEREAS, on September 10, 2020, the CADB passed a resolution recommending that the FreeholderBoard provide final authorization for the proposed acquisition of a development easement with anestimated cost sharing breakdown as follows (based on an estimated 33.9 acres), subject to:

a) The actual acreage to be covered by the development easement per the final survey whichconforms to the farmland preservation program requirements, andb) Any additional adjustments pursuant to State statute, rule, regulation, or policy;

COVID-19 Municipal Grant Program WHEREAS, the ongoing COVID-19 public health emergency has shouldered municipal governments in Hunterdon County with unanticipated costs ranging from the acquisition of personal protective equipment (PPE), employee overtime costs, retrofitting of public spaces, and acquisition of cleaning materials; and WHEREAS, the Hunterdon County Board of Chosen Freeholders desires to provide funding to assist Hunterdon County municipalities in support of expenditures made in 2020 in response to the COVID-19 public health emergency; and WHEREAS, this program shall be known as the Hunterdon County COVID-19 Municipal Grant Program; and WHEREAS, the amount of funding for each municipal grant will be determined on the basis of .40 per capita population for each municipality with a minimum grant of $1000 and a maximum grant of $5000; and WHEREAS, the grant program shall cover the acquisition of PPE, reimbursement of health emergency overtime costs already incurred, purchase of protective infrastructure and equipment (new acquisitions and reimbursement of expenses already incurred), cleaning supplies and services, sanitizer, emergency management expenses, reimbursement of COVID-19 related overtime costs, and any other costs determined to be expended in response to the ongoing public health emergency; and WHEREAS, Hunterdon County municipalities shall submit their grant application for funding in accordance with the above standards by November 30, 2020; NOW THEREFORE, BE IT RESOLVED, that the Hunterdon County Board of Chosen Freeholders authorize the creation of the Hunterdon County COVID-19 Municipal Grant Program; and BE IT FURTHER RESOLVED, that the County Administrator, County CFO, County Counsel, Clerk of the Board, and Office of Emergency Management shall be tasked with implementing this program as outlined in this resolution.

2020-592 Pet Waste Disposal Resolution

BE IT RESOLVED: that all pet owners and keepers are required to immediately and properlydispose of their pet’s solid waste deposited on any property owned and operated byHunterdon County.

SECTION I. Definitions:

1. Immediate- shall mean that the pet solid waste is removed at once, without delay.2. Owner/Keeper- any person who shall possess, maintain, house or harbor any pet,

whether or not the owner of such pet.3. Person- any individual, corporation, company, partnership, firm association, or political

subdivision of this State subject to County jurisdiction.4. Pet- a domesticated animal (other than a disability assistance animal) kept for

amusement or companionship5. Pet solid waste- waste matter expelled from the bowels of the pet; excrement6. Proper disposal- placement in a designated waste receptible, or other suitable container,

and discarded in a refuse container which is regularly emptied; or disposal into a systemdesigned to convey domestic sewage for proper treatment and disposal

WHEREAS; Any owner or keeper who requires the use of a disability assistance animal shallbe exempt from the provisions of this section while such animal is being used for that purpose.

WHEREAS; The provisions of this resolution shall be enforceable by any local/state policeofficer, County Sheriff officer, or County Park Ranger.

WHEREAS; Any person(s) convicted by a court of competent jurisdiction of violating thisresolution shall be subject to a fine not to exceed $200.00.

WHEREAS; Each section, subsection, sentence, clause and phrase of this resolution isdeclared to be an independent section, subsection, sentence, clause and phrase, and thefinding or holding of any such portion or this resolution to be unconstitutional, void, orineffective for any cause, or reason, shall not affect any other portion of this resolution.

WHEREAS; This resolution shall be in full force and effect from and after its adoption and anypublication, as may be required by law.

WHEREAS, the Flood Mitigation Assistance Program is a competitive grant program that provides funding to states, local communities, federally-recognized tribes and territories. Funds can be used for projects that reduce or eliminate the risk of repetitive flood damage to buildings insured by the National Flood Insurance Program; and

WHEREAS, FEMA chooses recipients based on the applicant’s ranking of the project and the eligibility and cost-effectiveness of the project; and

NOW THEREFORE, BE IT RESOLVED, that the Hunterdon County Board of Chose Freeholders hereby authorizes the Office of Emergency Management to apply for Flood Mitigation Assistance to provide for the elevation of homes deemed as Severe Repetitive Loss properties by FEMA.

WHEREAS, the Hunterdon County Housing Corporation is the mortgagee in a certain mortgage executed by Mildred Wolfe on October 31, 2006 and recorded on November 13, 2006 in Mortgage Book 3080, at Page 426 in the Office of the Hunterdon County Clerk. Said Mortgage was modified on April 30, 2007 and the Modification of Mortgage was recorded on July 16, 2007 in Book 3164, at Page 736. The mortgage was assigned to the County of Hunterdon, said Assignment of Mortgage being recorded on April 8, 2009 in Book 2026 at Page 753. The mortgage being a lien on the property in the amount of $37,864.00 on property known as Block 13, Lot 10 in the Township of East Amwell, Hunterdon County, State of New Jersey.

The mortgage has been paid in full and may be discharged or canceled of record.

5311 Grant Application Authorization

WHEREAS, the Secretary of Transportation is authorized to make grants for a general public transportation program of projects in other than urbanized areas under Section 5311 of the Federal Transit Act, as amended;

WHEREAS, the grant for financial assistance will impose certain obligations upon the Subrecipient, including the provision of the local share of the project costs in the program;

WHEREAS, it is required by the U.S. Department of Transportation in accordance with the provisions of Title VI of the Civil Rights Act of 1965, that in connection with the filing of an application for assistance under the Federal Transit Act, as amended, the Subrecipient gives an assurance that it will comply with Title VI and EEO requirements of the Civil Rights Act of 1964 and U.S. Department of Transportation requirements; and

WHEREAS, the Subrecipient is required to adhere to the requirements as specified in the U.S. Department of Transportation's Minority Business Enterprise (MBE) regulation set forth in 49 C.F.R. Part 23, Subpart D.

NOW, THEREFORE, BE IT RESOLVED:

1. That the Administrator is authorized to execute and file an application on behalf ofSubrecipient The County of Hunterdon, Department of Human Services, with NJTRANSIT who as the Designated Recipient will apply to the U.S. Department ofTransportation requesting aid in the financing of administration, capital and/or operatingassistance projects pursuant to Section 5311 of the Federal Transit Act, as amended.

2. That the Administrator is authorized to execute and file with such applications andassurance or any other document required by the U.S. Department of Transportationeffectuating the purposes of Title VI and EEO requirements of the Civil Rights Act of1964.

3. That the Administrator is authorized to set forth and execute affirmative minoritybusiness policies pursuant to 47 C.F.R. Part 23, Subpart D.

4. That the Administrator is authorized to furnish such additional information as the U.S.Department of Transportation may require in connection with the application.

Amended Agreement with GTM Executive Consulting Budget Account #T-03-56-2887-004, T-03-56-2893-000 & 0-01-20-0140-207 Contract Amendment #1

WHEREAS, the County of Hunterdon has a need for remote workforce readiness and continuity of services related to the COVID-19 public health emergency; and WHEREAS, the Emergency Contracts Statute (N.J.S.A.40A:11-6), permits the awarding of contracts when an emergency affecting the public health, safety or welfare requires the immediate delivery of goods or the performance of services; WHEREAS, County Counsel has verified that this meets the statute and regulations governing the award of said contracts; and WHEREAS, additional workforce readiness needs have presented themselves as a result of the ongoing COVID-19 public health emergency including support of remote work, business continuity, and risk mitigation; NOW, THEREFORE, BE IT RESOLVED, by the Hunterdon County Board of Chosen Freeholders as follows:

The Hunterdon County Board of Chosen Freeholders hereby accepts the terms as specified in a professional services agreement between The County of Hunterdon and GTM Executive Consulting, 930 Creamery Road, Upper Makefield, PA. This contract is awarded as a professional services agreement in accordance with N.J.S.A. 40A:11-6, of the Local Public Contracts Law. The County hereby accepts the fees for the basic services and specialized services described in the agreement, in an amount not to exceed $148,813.00 (850.36) hours at $175.00 per hour) using Acct. #T-03-56-2887-004, T-03-56-2893-000 & 0-01-20-0140-207. The Director and the Clerk of the Hunterdon County Board of Chosen Freeholders are hereby authorized to execute these agreements on behalf of the County. The Clerk is hereby authorized and directed to publish the Notice of Contract Awarded in the Hunterdon County Democrat.
