October 30: Save the Date for TREB’s Annual Meeting
TREB’s 2018 Annual Meeting, which is set for Tuesday, October 30 at the Toronto Congress Centre, is fast approaching. With an exciting lineup of new content that’ll keep you up to date on the latest developments shaping our industry
and Association, this year’s meeting is expected to build on the success of 2017’s Annual Meeting, which saw a record 1,200 Members in attendance.
Taking place from 10:00 a.m. to 12:00 p.m., this year’s meeting will feature a two keynote address presentations from CIBC Deputy Chief Econmist Benjamin Tal and Leader of the Conservative Party of Canada Andrew Scheer.
You’ll also want to attend to hear the latest TREB and industry updates, take in a 150+ exhibitor trade show, be inspired
by an awards presentation to some outstanding Members, and take advantage of a chance to network with your fellow Members.

President’s Message: Update on Tribunal Order
Dear Members,
I have been hearing from so many of you regarding the recent decision by the Supreme Court of Canada to not grant leave for appeal of the June 3, 2016 Competition Tribunal Order. Many of you are asking what this means for Members and how you can stay compliant.
Below is a short video, and I also want to provide an update to you on the steps TREB is taking to ensure you are informed and fully compliant with the Order. I want to ensure you that we will keep you informed every step of the way as this matter unfolds.
In issuing information to its Members and to consumers, TREB is working to ensure it is providing clarity on the complexities of the June 3, 2016 Competition Tribunal Order and its implications, including some of the more controversial points such as the use and distribution of pending sold (i.e., the sold price prior to closing) data.
Members and consumers hold varying beliefs about what the Order means, and TREB is taking measured and responsible steps to ensure that any information we provide on this complex issue is accurate.
RECO has issued a response (read it here) on the Order as well, and has provided additional clarity in what the decision means for both Members and consumers.
TREB is working to stay within the limits of the law and the Tribunal’s Order during the transition period and is prepared to pursue legal action against those who do not operate within those limits.

Best Practices: Sign By-Laws – What You Need to Know
Street sign advertising is one of the most effective ways to generate attention for an open house and get people in the door to view a property for sale. However, as outlined in numerous notices from TREB to its Members in the past, the consistent disregard of municipal sign by-laws by Members has led some municipalities to consider banning open house signs altogether.
Before you use street signs to advertise an open house or property, you must familiarize yourself with your ongoing
obligations to comply with the applicable sign by-laws in your municipality to:
• Help ensure municipalities continue to allow Members to use open house signs;
• Avoid enforcement measures, such as the imposition of fines, from municipalities; and
• Prevent potential action from TREB’s Arbitration and Professional Standards Steering Committee.

Easily Take Action to Make REALTOR® Issues an Election Priority
TREB is working to ensure that key REALTOR® issues are priorities for GTA election candidates and the voting public during the current municipal election campaign. Municipal elections will be held across Ontario on October 22, 2018.
We have launched UnlockMyHousingOptions.ca to help you, your clients, and the general public raise key real estate issues with municipal election candidates across Toronto and the GTA. Click here to go to the site where you can quickly and easily send an email to the municipal election councillor and mayoral candidates in your ward or municipality.
The site does all the work for you, including looking up your candidates and their contact information, and customizing an
email message for you.

Key Deposits in Rental Agreements: What You Need to Know
With more Members becoming involved in residential lease and rental agreement activities, TREB has been asked to provide information related to deposits, specifically key deposits.
In a nutshell, key deposits are legal and permissible, but only if:
• the deposit is refundable, and
• the amount of the deposit is not more than the expected cost of replacing the key(s) if they are not returned to the landlord.
The landlord must give the deposit back when the tenant turns in their key(s) at the end of their tenancy.
Although Section 134 (1) of the Residential Tenancies Act classifies any deposit other than last month’s rent as an illegal charge, the phrase “Unless otherwise prescribed” allows for exemptions recorded in another piece of legislation: Subsection 17(3) of the Ontario Regulation 516/06 which allows certain charges to be exempt from Section 134 of the Act, including key deposits.
For additional answers related to deposits in general, please refer to the FAQ section of the Landlord and Tenant Board website.
TREB cannot provide legal advice, so we encourage our Members to familiarize themselves with these pieces of legislation and speak to their Broker of Record.

If you're currently subscribed to Authentisign® through WEBForms®, or have an OREA TransactionDesk® account, enter the email address you used for that account when you signed into Instanet® & Authentisign® from Stratus for the first time (see screen capture, on the left).
If you can't remember which email address you used for your original Authentisign® account, you can enter it later by following these steps:
1. Click Instanet-Authentisign in Stratus.
2. Click Setup (gears icon) on the left side menu of the dashboard.
3. Click Preferences in the Setup Options menu.
4. Enter your email address. Make sure that it is the same email address associated with your previous Authentisign® account.
Once you have finished updating this account with that email address, please contact Lone Wolf at 1-800-668-8768 so that Instanet® & Authentisign® support representatives can put a request in to merge the two accounts together.
