    We look orward to seeing and visiting personally with you at

    the American Bar Associations Forum on the Entertainment and

    Sports Industries annual meeting Thursday, Friday and Saturday,

    October 13-15, 2011. Our meeting will be held at the GrandHyatt New York. This years program includes topics on ethics,

    music, sports, videogaming, licensing and merchandising, lm/

    TV, literary publishing, theater and perorming arts, and litigation.

    Our programs will explore how the entertainment and sports

    industries are reacting to the transormed economic climate in

    which these industries operate. We will present three plenary

    sessions (or all attendees), which ocus on general industry

    issues.

    The Governing Committee has assembled an outstanding

    group o nationally noted industry and legal experts. Practicing

    attorneys, business people and corporate executives who

    represent and lead the entertainment, arts and sport industries,

    will attend the conerence. Bring your laptops, as the materialswill be readily accessible on the Forum website or on

    CD-ROM only.

    PLENARY I:Bankruptcy/Collections Enforcement

    of RightsBankruptcy lings, and the eects thereo, have

    become commonplace occurrences in the practice

    o many sports and entertainment lawyers.

    Numerous issues arise: What contracts, such as

    license agreements, will be rejected, which will be

    assumed; what are the procedures or rejection and

    assumption o contracts, what issues exist, and what

    are the pitalls/issues that arise regarding protection

    o copyrighted works and trademarks in the contexto the administration o a bankruptcy estate, what

    procedural or substantive issues are there in

    attempting to extract or administer copyrighted

    works and trademarks in a bankruptcy estate,

    etc. This panel will present an experienced array

    o practitioners who will discuss these and other

    issues that arise when bankruptcy lings occur in

    the sports and entertainment context. The panel will

    discuss not only the procedural and substantive legal

    issues that come up, but also present the practical

    issues that apply in making deals where there is a

    bankruptcy overlay to consider.

    licensing o the perorming rights o copyright

    owners o musical compositions and sound

    recordings will be the primary revenue drivers in the

    uture, including revenues that can now be derived

    rom neighboring rights. In a controversial move,

    at least one major music publisher has announced

    that it will be administering its perorming rights

    licensing directly in the digital arena, rather than

    through a PRO. This panel will discuss how ASCAP,

    BMI, SESAC, and SoundExchange license songs,

    scores and sound recordings in the digital world,

    how rate courts, litigation, voluntary agreements

    and Copyright Royalty Boards shape what the ees

    are as well as what is actually licensable, how the

    online world has aected the traditional worlds o

    perormance licensing and what the uture holds or

    these two primary rights o Perormance. The panelwill also explore when a transmitting organization

    may transmit programming without obtaining

    reproduction rights rom the copyright owners or
