Nutrition company Herbalifeacknowledged Thursday that ithad overstated its membershipfigures in an admission that couldfuel more scrutiny of the compa-ny’s business model.

The company said in a Securi-ties and Exchange Commissionfiling that it had misreported “ac-tive new member” figures.

Herbalife has faced multiplefederal investigations over itsbusiness practices and accusa-tions from hedge fund investorBill Ackman that the company isrunning an illegal pyramidscheme. Herbalife has deniedthose allegations and accusedAckman of stock manipulation.

The company blamed its mis-stated membership figures on“database scripting errors” and“quarterly aggregation issues.”Herbalife stock (HLF) fell 7.4% inafternoon trading to $52.20.

The drop came after investorslast week drove shares skywardafter Herbalife said it was negoti-ating a resolution to the FederalTrade Commission’s probe.

The company said worldwidenew active members rose 3.2% inQ4 2015, compared with a yearearlier, not 16.7% as it reportedlast week. It said U.S. active newmembers rose 30.7% during thesame period, not the 71% it previ-ously stated.

Altogether, Herbalife corrected28 dierent statements tied tothe new active member figures.

“The company did not discoverthese errors earlier because it hadlimited visibility into the likelyrate of change in this metric uponits first use,” the company said ina statement.

“The company has taken cor-rective action regarding theseissues.”

With the spread of discountairlines across the country, somefliers have come to expect airfaredeals. But those may have beenhard to come by last year at ahandful of airports that had thehighest ticket prices in the U.S.

“When you have less competi-tion, fewer seats and strong de-mand from a region, you have theability to raise fares,” says ScottMiller, spokesman for HarrisburgInternational Airport in Pennsyl-vania, where the average domes-tic fare was $480.32 in the thirdquarter of 2015. That’s the secondhighest among the nation’s top100 airports. “To the consumer,it’s frustrating because they havea facility they want to use, but noteverybody can aord the highfare, and they’re forced to drivehours to fly.”

Only Dane County RegionalAirport in Madison, Wis., toppedHarrisburg, with an average do-mestic fare of $511.58. And whilethe others among the top five alsotended to be smaller airports —Knoxville’s McGhee Tyson andFresno Yosemite InternationalAirport in California — there’salso a big airport on the list: New-ark Liberty.

“Newark’s high fares can be ex-plained in part by it being a for-tress hub for United,” said travelindustry analyst Henry Harte-veldt. United carried 68.4% of theairport’s passengers last year. “Asa result, budget airlines such asFrontier and Spirit, which tend to

oer lower fares, have a very lim-ited presence.”

Newark also has numerouslong-haul flights, which tend tobe pricier. And airports like New-ark that have a high proportion ofbusiness travelers often showhigher average fares. That’s be-cause business fliers typically paymore for last-minute bookings, orfor seats in the premium cabins.

But another key factor behindsome airports’ lofty fares is air-lines having the upper hand whenit comes to pricing. In Madison, for instance, Delta controls 52%of the market share, says DaneCounty Regional airport spokes-man Brent McHenry, making iteasier for the carrier to boostfares because of a lack of compe-tition. And across the industry, airlines have fine-tuned the bal-ance between the number ofseats they oer and passenger de-mand, enabling them to chargemore.

Knoxville’s McGhee-Tyson Air-port is constantly on the searchfor new service in order to bringfares down, says airport spokes-woman Becky Huckaby. In May,low-cost carrier Allegiant will addtwo new routes to Baltimore andLas Vegas.

“We are always actively tryingto recruit new service from in-cumbent carriers as well as newairlines to create competition, which has a positive impact onlowering airfares,” says Huckaby, adding that the airport is current-ly served by Allegiant, American,Delta and United and it has sea-sonal flights from Frontier.

Harrisburg International, which mirrors Knoxville in serv-ing a significant number of busi-ness travelers, saw 1.2 millionpassengers last year, and Millersays it could handle 2 million fli-

ers based on population anddemand.

However, Frontier pulled upstakes in Harrisburg last year,

shifting service to Philadelphia,Miller says. Several other airlines— Allegiant, Delta, American,United and Air Canada — remain, but they have “shrunk capacity tothe point ... they can set fares atthis level, and business travelerswill pay for the convenience ofusing Harrisburg vs. driving,”though many fliers “not able to(pay) the premium, or who don’twant to, are forced to drive hours, and they do.”

The loss of passengers to Balti-more and Philadelphia aects thefortunes of both the Harrisburgairport and the broader commu-nity, Miller says.

There are other factors that in-fluence ticket prices.

For instance, “Madison has ahigh percentage of business trav-elers,” McHenry says. “In com-parison to leisure travelers, theybook tickets very last-minute,routinely purchase first-classfares, as well as fully refundabletickets, which can inaccuratelyinflate the average ticket price” ascalculated by the Bureau ofTransportation Statistics.

The tax portion of a ticket hasalso risen, McHenry says. Cur-rently 21% of a $300 ticket is tax-es, according to the trade groupAirlines for America. Still, overall, the average domestic ticket pricein the third quarter of last yearwas $372, the lowest since 2010.

“Air travel remains one of thebest consumer bargains outthere, as evidenced by the in-crease in the number of peopleflying,” says Melanie Hinton, spokeswoman for Airlines forAmerica.

“The strength of demand, aswell as the cost of serving a spe-cific airport, and competition iswhat ultimately drives trac andfares.”

MEL EVANS, AP

Passengers leave Newark Liberty Airport in June. Budget airlines, which oer lower fares, tend to have a smaller presence atNewark because the airport is a “fortress hub” for United Airlines, travel industry analyst Henry Harteveldt says.

NEW YORK As more banking ac-tivities move online, JPMorganChase & Co. is shedding its pin-striped suits and stodgy oces ina bid to win over coders and engi-neers.

JPMorgan, the nation’s largestbank by assets, opened a digitalhub in Manhattan’s HudsonYards neighborhood in Decemberto house 700 tech workers. Un-like its more traditional Park Ave-nue headquarters, the digitalteam is allowed to wear jeans, ride around the oce on scootersand play Foosball and Xbox atwork.

If that sounds a lot like tech gi-ant Google, it’s because it is. Exec-utives with the digital teamtalked to executives at Google,Amazon and other tech compa-nies about how to best design thespace to spur innovation, saidJames Young, the chief informa-tion ocer for the bank’s digitalunit.

What they came up with wasthree football fields of open-floorspace that is designed to encour-age casual meetings and brain-storming sessions.

“There are more seats awayfrom desks than at desks,” Youngsaid. “We don’t want peoplespending their day looking atemail,” he said.

For Mario Pedernera, a pro-gram manager, the new space hasgiven way to “democracy with alowercase ‘d.’ ” It encouragesworkers “fresh out of college” toshare ideas with the team’s topexecutives at open-space meet-ings, he said.

The move highlights the em-phasis the bank is putting on on-line and mobile banking, inclu-ding plans later this year forChase Pay, a digital payment sys-tem that will compete with ApplePay, Android Pay and SamsungPay.

Like its Silicon Valley competi-tors, Chase Pay will let people usetheir phones to pay for things instores and restaurants.

Thursday, Chase launched aredesign of its retail banking web-site, chase.com, as part of its on-going eort to service andencourage the move away frombank branches.

LOS ANGELES She’s on Vine, In-stagram, Snapchat and Twitter. But the social app of choice forclassically-trained pop singerEmm is Flipagram.

“I just passed 100,000 fans” onFlipagram, which marries smart-phone videos and photos withpopular music. “Yeah!”

Some 40 million folks monthly(from around 10 million a yearago) visit the Instagram-meets-YouTube free app to repackagetheir smartphone photos andvideos with popular music, every-thing from the latest Justin Bieb-er hit to a classic from FrankSinatra. Photo/video sharinggrowth rate of 300% year-over-year has lured in big investors

such as Sequoia Capital andKleiner Perkins.

Five billion photosand videos are sharedmonthly on the app —a rate that’s gettingcloser to the 8 billionvideos viewed every

day each on both Snap-chat and Facebook. Some of the Los Ange-

les-based start-ups enthusi-asts are emerging artists such asEmm, who use it to showcasetheir music to new fans. Shefound a manager and club datesjust by posting videos with hermusic to the app.

Others just want to share theirphotos in a form that’s dierentfrom an Instagram collage. The 3-year-old company, co-founded byserial entrepreneur Farhad Mo-hit, is oering a visual-first cul-ture a new way to share theirproducts: music.

“People, especially youngerMillennials, take so many pic-tures during the day,” he says.“They speak and communicatedaily with pictures.”

Beyond up-and-coming talent,big-name celebrities such asBeyonce, Justin Timberlake,Channing Tatum and Madonnahave discovered the app and haveposted their own photo/videomusic slideshows.

And the app has blue-chip fi-nancing behind it: $70 millionfrom Sequoia Capital, KleinerPerkins Caufield and Byers, andIndex Ventures, in the latest fi-nancing round, announced in2015. The company won’t com-ment on valuation, but Tech-Crunch recently estimated it atmore than $300 million.

“There’s a reason celebritieshave found it (Flipagram),” Mi-chael Moritz, the chairman of Se-quoia, told USA TODAY. “Itanswers a need for them that

they can’t get on Instagram, Face-book or Snapchat, a way to weavein stills and videos simply withmusic.” Moritz is a longtime in-vestor in such companies as Goo-gle, Yahoo and PayPal. He serveson the Flipagram board of direc-tors with Kleiner Perkins partnerJohn Doerr.

While the app is free, Flipa-gram brings in money by sellingthe right to remove the Flipa-gram watermark for $1.99 a pop.

The company’s main focus ison user growth. But it’s compet-ing in a crowded arena.

There are dozens of apps tomake music videos from photosand videos (like musical.ly andVidify) and apps to either collector share photos. Facebook’s “Mo-ments” app bunches Camera Rollphotos and videos together, for

instance. And Facebook’s Insta-gram is the No. 1 photo-sharingapp, with 400 million monthlyusers and 40 billion photosshared to date.

Flipagram distinguishes itselfin two ways: length of social videoand its music library.

Similar social products aremuch shorter: Vine’s are only 6seconds long and Instagramvideos 15 seconds, but Flipagramlets folks go as long as 60 seconds.

And Facebook, Instagram andVine don’t have tools to mergepictures and videos with licensedmusic like Flipagram does.

That’s a key part of Flipagram’srecent success, Mohit says.

Two years after Mohit, 47,started Flipagram, he made dealswith the major record labels to al-low usage of current and librarysongs to be featured legally in Fli-pagram videos. It took 14 monthsto conclude the deals.

Flipagram had oered songsnippets via iTunes, but “weweren’t licensed for it,” Mohitsays. “That put a huge liabilityover the company. It was like abig sword over our head.”

Having the music and story-telling tools is Flipagram’s big dif-ferentiator, Mohit says.

Pulling photos and videos fromyour smartphone into a storywith a beginning, middle and end— and music — “is an overwhelm-ing thing,” he says. “It’s like thefirst time I tried Instagram. I feltlike I was an artist when I put afilter on the photo.”

Before Flipagram, Mohit, anIranian born immigrant whocame to the U.S. as a small child, started two business rating on-line sites, Shopzilla and Bizrate, which he sold to Scripps Howardfor $525 million.
