1. Introduction

The Government of the People’s Republic of Bangladesh has entered into Loan Agreement with the Asian Development Bank (ADB) Loan 2756-BAN (SF) and Japan International Cooperation Agency (JICA) Loan BD-P66 for implementation of Khulna Water Supply Project. The Khulna Water Supply and Sewerage Authority (KWASA), under the Local Government Division of Ministry of Local Government, Rural Development and Cooperatives, is the implementing Agency of the project. Though the project is being financed by 02 (two) Development Partners of the Government of Bangladesh (GoB), such as ADB and JICA, Still the Land Acquisition and Resettlement part of the entire project is the responsibility of ADB.

The Project will develop a sustainable water supply system in Khulna City. Khulna relies entirely on groundwater and the project will introduce surface water as the main water source to avoid excessive groundwater abstraction. There are total estimated budget for replacement value of land is BDT and resettlement assistance and grant (other than land replacement value) is BDT e,0.In total [96,26,50,000 + 2,62,75,000] BDT=BDT 98,89,25,000 out of which BDT 93,99,01,000(95.04% of the total) has been paid.

The project requires 77.0609 acre land of which 2.521 acre in Bagerhat district and 74.5399

acre in Khulna district for construction of Water Intake Point, Impounding Reservoir, Surface Water Treatment Plant, Distribution Reservoir, Overhead Tank and Bottle Water Plant involving replacement of land only) to have compensation under resettlement plan of the project of which 127 persons (86.99% of the total) have been paid compensation amounting 27,03,18,547.2 (84.02% of the total targeted amount BDT 32,17,13,280.04 for top up of land paid by KWASA).

On the other hand, payment for the resettlement benefits against non- titled and titled holders there are approximately total of 401 EP’s (considering resettlement benefit except land) with estimated budget of BDT 2,62,75,000 to have compensation under resettlement plan of the project of which 395 persons (98.50% of the total) have been paid compensation amounting BDT 2,40,31,343.42 (91.46% of the total targeted amount).

1.1 Project Background

Khulna, the third largest city in Bangladesh, is located in the southwest area of the country and has a population of 1.5 million (2008). To cope with current insufficient water supply and increasing demand, the Khulna Water Supply and Sewerage Authority (KWASA) plans to improve the existing water supply system with assistance from the Japan International Cooperation Agency (JICA) and the Asian Development Bank (ADB). The Project proposes a surface water supply system sourced from the Mollarhat intake point on the bank of Modhumati River in Bagherhat District, approximately 58 kilometers (km) from the Khulna. The raw water from the Modhumati River will be stored into an impounding reservoir and transmitted to a surface water treatment plant (SWTP) at Samonto Sena with the purified water to be distributed to consumers through a system of smaller storage reservoirs, overhead tanks, and piped distribution networks.

1.2 Project Components

Physical infrastructure to be developed by the Project includes the following:

JICA Components-

(a) Water intake facility from the Madhumati River at Mollarhat;

(b) Raw water transmission pipe (1.4 meter dia) for a total of length of 33 kilometers (km);

(c) Surface Water Treatment Plant (SWTP) with capacity of 110 MLD at Samanto Sena; and

(d) Impounding reservoir with capacity 777438 Cum at Samanto Sena storing non-saline raw water taken during wet season when salinity concentration is less than 1000 milligrams per liter (mg/L) in the river; and

ADB Components-

(a) Clear water transmission pipe 1200mm for a total length of 33 km to distribution reservoirs

including Rupsha river crossing 450 M;

(b) Distribution Network (diameter 50 mm– 400 mm) for a total of length of approx.700 km to supply

water to the consumer end

(c) Seven distribution reservoirs for distribution to service zones in Khulna City and 10 Overhead

tanks for sufficient water pressure and also for some water reserve required for consumers

(d) KWASA headquarters office and 2 zonal offices

1.3. Land Acquisition Requirement

Physical implementation of improvement works under the Project has required 77.0609 acre land of which 2.521 acre in Bagerhat district and 74.5399 acre in Khulna district for construction of Water Intake Point, Impounding Reservoir, Surface Water Treatment Plant, Distribution Reservoir, Overhead Tank and Bottle Water Plant. The majority agricultural, but some used for homestead. This has caused involuntary resettlement impact on a total of 77.0609 with about 139 titled Aps and 401 non titled affected persons (APs). It should be noted that, although implementation of improvement Water Intake Point, Impounding Reservoir, Surface Water Treatment Plant, Distribution Reservoir, Overhead Tank and Bottle Water Plant includes large numbers of dispersed infrastructure in 13 places, requirement for acquisition of land has involved for construction of KWASA project locations in the following area are given in below:

Garfa, Mollahat, Bagerhat Tilok & Pathorghata (Samonto- sena area), Rupsha, Khulna Labanchora, Khulna Notun Rasta (Pabla), Khulna

Charerhat, Khulna Baniakhamar, Khulna

Deana, Khulna Mirerdanga, Khulna Rayer Mohal, Khulna Choto Boyra Khulna Notun Bazar (Bongo bay) Khulna Boyra Housing, Khulna

KDA Jalil Sharoni, Khulna

1.4 Land Acquisition Strategy of the Project

The strategy adopted in each stage of KWASA activities from design till implementation has been to reduce the requirement of land acquisition and thereby minimize the involuntary resettlement impacts. During preparation of detail designs of the proposed infrastructures for different subprojects, decisions were made in consultation with local communities and reflecting inputs from public consultation and disclosure in site selection.

Physical or economic displacement due to development project, if unmitigated can give rise to severe economic, social and environmental risks; production systems are dismantled; people face impoverishment when their productive assets or income sources are lost; social and cultural attachment with neighbors are diminished or lost. ADB therefore, seeks to avoid involuntary resettlement wherever possible; minimize involuntary resettlement by exploring project and design alternatives; enhance or restore the livelihoods of all displaced persons in real terms relative to pre- project levels; and improve the standards of living of the affected poor and other vulnerable groups. Taking the ADB requirements and harmonizing with the Law of the country, resettlement plan was prepared and implementation of resettlement plan is of high priority. The people living or having asset in the project area will be affected due to implementation of the project. Though the positive impact of the project is expected to be enormous, yet the people who had been enlisted in the as project affected persons will be affected losing their homesteads, agriculture land, trade/business, sources of income etc. As a policy of involuntary resettlement the affected people will be given compensation for their lost land, damaged crops, structures, trees etc. But to protect them from dipping below the livelihood level they were on, they would be awarded with additional grants under the title resettlement benefit by Khulna Water Supply Project (KWSP). Due importance was given to reduce land acquisition and resettlement impacts by:

* locating components on government-owned land and/or within existing right of way (ROW);

* avoiding, where possible, locations that will result in destruction/disturbance to historical and cultural places/values;

* avoiding tree-cutting where possible; and

* ensuring all planning and design interventions and decisions are made in consultation with local communities and reflecting inputs from public consultation and disclosure for site selection.

1.5 Monitoring Reports on Involuntary Resettlement

A series of monitoring reports on Involuntary Resettlement have been produced during the course of project implementation. As shown in below Table. These include several semi-annual monitoring reports discussing the land acquisition and resettlement impacts of the Project.

2. Require land for Project implementation The Project will develop a sustainable water supply system in Khulna City. Khulna relies

entirely on groundwater and the project will introduce surface water as the main water source to avoid excessive groundwater abstraction. During implementation period project require 77.0609 acre land in 13 location of project area. 2.521 acre in Bagerhat district and 74.5399 acre in Khulna district for construction of Water Intake Point, Impounding Reservoir, Surface Water Treatment Plant, Distribution Reservoir, Overhead Tank and Bottle Water Plant. No need of land acquisition for establishing water transmission and distribution pipe lines.

For acquisition of land has caused involuntary resettlement (IR) impact prompting the need for preparation of individual Resettlement Plan (RP) for this subprojects. The Government therefore has prepared an individual RPs, for each these subprojects, in line with the legal procedure for land acquisition in Bangladesh and in conformity with the ADB’s safeguard requirements on involuntary resettlement, adhering to the principles and procedures outlined in the Resettlement Framework (RF).

Total estimated budget for replacement value of land is BDT 96,26,50,000 and resettlement

assistance and grant (other than land replacement value) is BDT2,62,75,000.In total [96,26,50,000 + 2,62,75,000] BDT=BDT 98,89,25,000 out of which BDT 93,99,01,000(94.57% of the total) has been paid. 93,51,83,936.90 Table 1 Summary of Land Acquisition Status

2.1 Information about affected people

Payment of resettlement benefits for the titled (146) EPs is going on and a total of 401

non-titled EPs were identified from Bagherhat and Khulna; so far a total of. Tk BDT

2,40,31,343.42 paid among the 395 Non-titled EPs of Bagerhat and Khulna districts. Moreover,

125 TEPs out of about 146 were paid amounting Tk. 91,11,52,593.50 in Bagerhat and Khulna

districts for the land acquisition purpose. Payment details are shown in below table:

2.2 Resettlement Budget and Financing Plan

The Indicative land acquisition and resettlement cost estimate for the Project includes eligible compensation, resettlement assistance as outlined in the Entitlement Matrix, and support cost for Resettlement Plan. Government financing will provide funds to support all land acquisition and compensation for lost assets, while ADB financing will cover other assistance costs (livelihood and income rehabilitation, shifting assistance, training, etc.) including implementation support of the Resettlement Plan. The total land acquisition and resettlement cost for the Project is BDT 1,062,313,338.00 or USD 13,787,324.31. All additional payment (top-up) and resettlement benefits will be paid to the Entitled Persons (EPs) directly by KWSP.

The indicative cost items are outlined below:

Benefits.

The updated draft Resettlement Plan is based on census of raw and clear water pipe line and land acquisition areas including DC’s survey and records of the total land owners. The entitlements for these displaced persons have been worked out in line with the actual impacts assessed based on land records data, DC’s survey and census data. Deputy Commissioner is preparing individual Land Acquisition estimate for every proposed site. In addition to that a separate Resettlement Budget (estimate) will be prepared as per approved entitlement matrix, JVAT’s data and PVAC’s pricing. The indicative budget for land acquisition and resettlement costs under the project to be financed by the Government and ADB. Government financing will cover land, other assets and contingency. ADB will cover other assistance, grant, allowances and RP implementation cost etc.

2.3 Physical infrastructure to be developed by the Project includes the

following:

JICA Components

(a) Water intake facility from the Madhumati River at Mollarhat;

(b) Raw water transmission pipe (diameter 1,350 millimeters [mm]) for a total of length of 33 kilometers (km);

(c) Surface Water Treatment Plant (SWTP) at Samanto Sena; and

(d) Impounding reservoir at Samanto Sena storing non-saline raw water taken during wet season when salinity concentration is less than 1000 milligrams per litre (mg/L) in the river.

A total of 66.08 acres of private land will be acquired with an estimate of 103 households with legal title identified comprising a total of 448 economically displaced persons (EDP) as follows: (i) the intake point at Mollarhat requires 2.521 acres of private agricultural land belonging to 30 households (130 EDPs); and (ii) the impounding reservoir and SWTP site at Samanto Sena requires 63.56 acres of private agricultural land with some seasonal fish/shrimp ponds belonging to 73 households (318 EDPs) with legal title identified. There will be eight agricultural tenants and five agricultural workers affected

ADB Components

(a) Distribution reservoirs (5) for distribution to five service zones in Khulna City;

(b) Overhead tanks (11) for sufficient water pressure and also for some water

reserve required for consumers. The overhead tanks are filled with clear

water pumping from distribution reservoir;

(c) Distribution pipes (diameter 50 mm–400 mm) for a total of length of 700 km

will be constructed to supply water to the consumer end;

(d) Clear water transmission pipe (diameter 300 mm–1100 mm) for a total length

of 25 km to distribution reservoirs; and

(e) KWASA headquarters office and 3 zonal offices

A total of 7.02 acres of land will be acquired for 11 overhead tank and 5 underground reservoirs and a zonal Khulna Water Supply and Sewerage Authority (KWASA) office building. There will be 7 households (42 EDPs) with legal title. One household will lose agricultural income from the loss of farming activities and two households will lose fishing livelihood. There will be one commercial structure affected and one lease of public land (for sand storage) affected by the Project.

2.4 Project Safeguard Procedure

1. ADB’s safeguard requirements apply to all administered components of Khulna Water Supply Project regardless of the source of financing.

2. According to ADB’s Operational Manual Section F1/OP (20 January 2010), the involuntary resettlement impacts of an ADB-supported project are considered significant if 200 or more persons will experience major impacts, which are defined as (i) being physically

displaced from housing, or (ii) losing 10% or more of their productive assets (income generating). The JICA safeguard policy does not have a similar threshold for defining significant impacts for categorizing social safeguards.

3. The total number of landowner households affected by the Project is based on actual data obtained from revenue records collected. Of these 110 households, a sample census survey was conducted (40% sample size). The estimated numbers of EDPs is based on the average household size derived from the sample survey. The following data from the sample survey were scaled up to arrive at overall estimated project impacts: (i) average household size (to estimate the total numbers of EDPs); (ii) monthly incomes (to estimate the number of households below the poverty line); (iii) extent of impacts including total loss of land and percent loss of productive land holdings (to estimate the number of households with major impacts which is defined as greater than 10% loss); and (iv) vulnerability (to identify vulnerable households, including women-headed households, physically handicapped-headed households, and households below the poverty line).

4. Non-titled holders comprise agricultural tenants, workers, and one leaseholder of land.

5. Vulnerable households are defined as (i) female-headed households, (ii) physically handicapped-headed

6. Households and (iii) those below the below poverty line (Note: the national poverty line is considered Tk9,000. This figure is to be updated in 2011 as part of the national census. During resettlement plan implementation, the revised poverty line may be considered in determining vulnerable persons).

7. This includes other landholdings outside the affected land parcel.

8. To assess the potential temporary impacts on businesses, hawkers and vendors, along the distribution networks and the transmission mains, structured transect surveys of sample representative stretches were carried out. A total of 18 locations representing various land use types in the network were taken up for sampling. A total of 530 commercial establishments, including hawkers and encroachments were surveyed. These shops and potential impacts will be further verified once the detailed designs are complete and the alignments for the networks and transmission mains are finalized.

9. The full closure of roads is not anticipated under the project and customer access is expected to be maintained. However, these potential impacts to customer access will be determined during detailed design.

10. Attempts were made to survey all households however some were unwilling to cooperate with the survey team as they chose to wait until the formal government notice was published to provide relevant information. These households will be surveyed at the time of the detailed measurement survey taken during project implementation and incorporated into the updated and final resettlement plans.

11. The information contained in the draft resettlement plan is tentative until the census of affected persons has been completed. Soon after the completion of detailed engineering designs, the borrower/client will finalize the resettlement plan by completing the census and inventories of loss of assets. At this stage, changes to the resettlement plan take the form of revising the number of displaced persons, the extent of land acquired, the resettlement budget, and the time table for implementing the resettlement plan. The

Entitlement Matrix of the resettlement plan may be updated at this stage to reflect the relevant changes but the standards set in the original Entitlement Matrix cannot be lowered when the resettlement plan is revised and finalized. (ADB Safeguards Policy Statement. Safeguards Requirements 2. 2009).

12. The cut-off date for title holders is based according to the formal notification (Section 3), and for non-titleholders the date of the census survey after the detailed design. Those who encroach into the project area after the cut-off date will not be entitled to compensation or any other assistance. The PMU will take video and photo documentation to ensure entitled persons on the cut-off date. For this project, the detailed measurement survey taken soon after official Section 3 notifications.

13. The Independent external monitor is defined as someone who is outside the day-to-day activities of the Project, and could include for e.g., professor, representative of nongovernmental organization (NGO) etc. The independent monitor will document the observations of the negotiation process and submit these directly to the ADB Project Officer.

14. The application to MOL includes a detailed statement specifying whether the land mentioned in the application is needed for public or private purpose, the area of the land, sketch-map, and purpose for which it could be used.

15. The Project will directly pay the training institutes for the number of persons enrolled for training.

16. This allowance will pay for training fees and short term courses to be paid directly to the institute.

17. Rates for cost estimation are detailed in Appendix 9.

18. Although ADB requires semiannual reporting, the Resettlement Plan monitoring reports will be included with the overall project quarterly reports, allowing ADB and JICA to closely monitor impacts given the scale of the land acquisition, resettlement, and low capacity of the Executing Agency. One monitoring report will record progress for both JICA and ADB components.

3. Income Restoration and Rehabilitation Project authority provides all type of entitlements for compensation, relocation, and income restoration for displaced persons. The displaced persons cultivating their land for crops or fish/shrimp will be given sufficient advanced notice to harvest (60 days); and if harvest in that time is not possible, they will be compensated for the loss of the standing crops and/or fish/shrimp harvest and fruit bearing trees at their current market value. Additional assistance for those landowners experiencing major impacts defined as losing greater than 10% of their productive landholdings is also provided. The Project management Unit (PMU) will provide assistance to those farmers/fishermen and laborers who require assistance in either re- establishing livelihood or require compensation during periods of disturbance.

Short and medium term income restoration and livelihood assistance includes the following:

(i) PMU to assist displaced persons in identifying new agricultural lands for purchase or lease to continue agricultural livelihood;

(ii) Cash compensation equivalent to the value of harvest (crops and/or fish) for

one season to those agricultural landowners losing greater than 10% of total productive (income generating) landholdings;

(iii) Shifting allowance for households based on actual cost of moving/unloading;

(iv) PMU to help link displaced persons to vocational institutes wherein the PMU will pay14 for a 3-month training course to those seeking skill development, including alternative cropping methods or other new skills of their preference (assumed at Tk4,000/person/household);15

(v) PMU to help link displaced persons to employment opportunities through referrals or assistance in seeking jobs (e.g., local job postings, etc.). The PMU will also identify the required skills for the construction activities under the Project prior to the commencement of the construction and link them to project employment wherever possible;

(vi) In addition to the above entitlements, vulnerable groups will receive additional allowance equivalent to three months income at minimum wages, for restoring or enhancing their livelihood, as well as preference in project related works; and

(vii) For linear works, temporary loss of income to shops and businesses due to disturbance caused by construction will be compensated for those located in areas subject to full street closure based on actual income (verifiable through incomes of similar businesses) or minimum wage rates (whichever is higher) for the entire period of disruption (typically 15-21 days).

To improve livelihood condition project authority gives financial assistance for the poor community. Till now project authority were identified 401 non-titled EPs from Bagherhat and Khulna; so far a total of. Tk BDT 2,40,31,343.42 paid among the 395 Non-titled EPs of Bagerhat and Khulna districts. Moreover, 112 TEPs out of about 139 were paid amounting Tk. 91,11,52,593.50 in Bagerhat and Khulna districts. Below table shoe the features of affected community

4. Grievance Redress Mechanism

A grievance redress mechanism (GRM) has been established to receive, evaluate and facilitate the resolution of affected persons concerns, complaints, and grievances about compensation and resettlement issues at the project level. Project authority established complain box in different place of project area. To aware people authority conduct consultation meeting, FGD and distribute leaflet. Till date one formal complaint submits in ADB office and this complains solve. The Government has formed a Grievance Redress Committee (GRC) by the following members:

In the consultation meetings, extensive discussions with the stakeholders were held. The overall outcome of the consultation meetings provided mixed opinions towards project implementation. The participants showed their concerns regarding impact on land, crop, trees, fruits and homestead due to the land acquisitions. However, due to the long-term benefits of the project, they agreed to the acquisition of their land. Also, the Cash Compensation by Law (CCL) method of acquisition and guarantee of hassle-free speedy payment of compensation further encouraged them. During feasibility period two consultation meeting and three FGD conduct in project different area. Total 183 people attend in two consultation and 21 participants in three FGD. These meetings were held at five different locations of the two districts on different dates commencing from 12–21 August 2010. These meetings were attended by different cross sections of the affected population. These public consultation meetings with land owners, local elite and general members of the public were also attended on occasions by the Mayor of Khulna, Assistant Deputy Commissioner (Revenue) Bagerhat, Managing Director, KWASA, ADC (Land Acquisition) Khulna and the officials of the project team and KWASA including elected representatives, local leaders, women groups, representatives of professional groups like businessmen, farmers, teachers, religious leaders, and public representatives as well as members and chairman of the Union and Upazila Councils and the consultant

To ensure transparency in planning and active involvement of displaced persons and other stakeholders, project information will be disseminated through disclosure of resettlement planning documents. A resettlement information leaflet containing information on compensation, entitlement, and resettlement management adopted for the Project will be made available in local language (Bangla) and will be distributed to displaced persons. The KWASA through its PMU will keep displaced persons informed about impacts, compensation and assistance proposed for them; and facilitate grievance redressal.
