This Agreement is made this __________ day of ______________ between ____________________________________________

______________________ Of ____________________________________________________________________________ (‘the Owner’) and HFR Performance Horses (‘the partners’: Murray & Philippa Holm), 40 Juniper Road, Smythesdale VIC 3351.

Whereby the Partners agree to agist the Owner’s stallion or stallions identified below (‘the Stallion’) at the property ‘HFR Performance Horses – 40 Juniper Road, Smythesdale VIC 3351’, on the conditions set out below.

1. The Owner agrees to pay all the Agistment and other charges as detailed below, which will be rendered and payable monthly. More than 60 day overdue accounts, with no payment will be passed to a debt collector or to VCAT for further collection.

2. The Stallion is agisted at the Owner’s risk at all times. It is the Owner’s responsibility to insure the Stallion against all risks while they are at HFR Performance Horses property, or being transported to and from the property. The Partners shall not be responsible for any disease, accident, illness or injury howsoever caused or arising to the Stallion whilst on HFR Performance Horse property, or being transported to and from the property.

3. The Partners agree to notify the Owner immediately the Partners become aware that the Stallion suffers, or has been in contact with any significant or notifiable sickness, disease or injury. Veterinary service for the Stallion may be provided at the Partners in consultation with the Owners’ or Partners’ Veterinarian. The Owner will pay all veterinary and other charges incurred while at HFR Performance Horses’ property.

4. The Owner gives the Partners a lien over the Stallion for payment of Agistment fees and all other charges and expenses, which the Owner must pay under this agreement. This means that the Owner may not remove the Stallion from HFR Performance Horses’ property while any part of this agreement is not fulfilled.

5. The Partners may sell the Stallion at public auction or by private sale, to recover any monies unpaid for 90 days after the Partner has sent the account. (Please contact HFR Performance Horses if there are problems with the account, paying or anything else prior to getting to this stage. HFR Performance Horses are advocates of communication!)

6. The Owner irrevocably appoints the Partners as the Owner’s power of attorney with power to sell the Stallion and to sign all transfers and other documents and do everything necessary to effect and complete the sale and to receive the purchase price and credit it towards the costs of sale and all monies owning.

7. Services offered to the Owner for their Stallion agistment fees are as follows:

a. Handling during serving a mare, while collecting, daily care.

b. Collecting semen for on Farm Artificial Insemination for mares that are sent to HFR Performance Horses as provided by the Owner at the direction of the Owner.

c. Semen extending preparing for shipping.

d. Daily feed of Hay (pasture and oaten hay), fresh water

e. General care – rugging, trimming of feet.

f. Exercise of the Stallion is on an as arranged/negotiated basis and may not be included in the monthly costs.

10. Stallion agistment and service fee per calendar month - $450. (approximately $15 per day in a 30 day month – included

services are outlined in paragraph 7).

11. Worming - $11.50 per tube

12. Semen shipping – on an as quoted basis (usually around $60 with Toll priority).

13. Mare Agistment - $65 per week (The Owner’s mares are only charged at the cost of $30 per week approximately $4.30

per day).

14. Pregnancy Scanning - $55 per scan.

15. Transport of mares to Veterinary Clinic for scans - $15

16. HFR Performance Horses recommends that Stallions undergo analysing of semen for chilling and shipping before being offered by this medium to public stud.

17. HFR Performance Horses recommends that Stallions have a health check by a Veterinarian prior to the start of each breeding season.

18. HFR Performance Horses recommends that Mares have a pre-breeding scan to ensure that they are healthy and ready for the up coming breeding season.

19. HFR Performance Horses recommends that Mares have an overall health check performed by a Veterinarian prior to each breeding season.

Fees and Charges

8. Costs not included in monthly rate are as follows:

a. Worming

b. Veterinary expenses arising from injury, illness or after discussion with the Owner.

c. Semen shipping charges (these will be quoted to the Owner before semen is shipped)

d. Visiting mare costs (not your own). Visiting mares are charged at $65 per week agistment, which includes

hay, handling, teasing and inseminating on farm – however will not cover any Protaglandins or Oxytocin

injections if necessary, Veterinary costs, pregnancy scanning. HFR Performance Horses has a mare

agistment contract for any visiting mares.

e. Grain feeds – if the Stallion requires grain feeding, then this must be provided.

9. Agistment rates are charged at a full calendar month or part there of if request to depart is made prior to 21 days into

the month. Fees are noted below in Paragraph 10.

Recommendations and Further Information for Owners 20. HFR Performance Horses recommends that Owners have breeding contracts with each of their booked clients, outlining

Live Foal Guarantee, costs etc.

21. HFR Performance Horses will only accept an outside mare to the Stallion at written (email) consent from the Owner,

outlining brands, markings, mare details and your client’s details as applicable.

22. HFR Performance Horses is not responsible for filling out and mailing stallion returns, however we will provide the Owner

with a list of first and last date of service.

23. The stallion form as found in Appendix A of this contract must be completed and returned prior to the Stallion arriving for

the breeding season.

24. HFR Performance Horses will not enter into any dispute between the Stallion Owner and their clients, all fees must be

paid prior to either Stallion or Mares are removed from the property, not exceptions.
