We are indebted to Len Levy, director of salesfor Rank Records of America, for this week's edi-torial comment.

In a release issued this week Mr. Levy says,among other pertinent things, that "The trade pub-lications are now more necessary than ever inintroducing new talent."

The question of new talent and Section 317 hasbeen one of the self-induced nightmares amongsome elements of the popular music business.Obviously, the trade publications, which in theirtotality are read by the entire market, are the idealoutlet for showcasing the stars of tomorrow.

This, of course, is only one reason for the im-portance of the trade publication today. Transcend-ing its significance as a medium for displaying newtalent is its cardinal function .of serving as a mediumfor responsibility for the trade. By which we meanthat the buyer of music in the pop field does nothave to enter the market under the usual stipula-tion of caveat emptor: For the buyer need notbeware if the information is sound, the statisticsaccurate, and the charts a true guide to honestprogramming.

For ourselves, we would never confess to "slop-piness" in the compiling of these vital-vital to theindustry, that is-statistics.

The ideal situation would be-and should be-that the responsible trade publications reflect whatis happening to such an incontestible degree thatthe program director and the disc jockey will becompelled-and gladly- to rely for their hit pick-ing on what the trades have objectively determined.

It sounds like a New Deal. But such a new dealis needed today especially-and hopefully-if thecards are not stacked.

Disc Exec PraisesValue of Trade MagsII "Trade publications are now more nec-essary than ever in introducing new talentto the music industry," said Len Levy, di.irector of sales for Rank Records in a letterto his distributors.

Levy indicated that while trade paperswere always considered an important meansof introducing new artists, the FCC's actionon Section 317, "has made this type ofpress exploitation imperative." This is thtfirst such statement by a major disk execu-tive.

"In light of the present radio situation,'"Levy stated, "we all know how difficult ithas become to gain a showcase for new tal-ent." He recommended that "the combina-tion of trade paper advertising with pub-licity ballyhoo will create advance intereston the part of the radio station when therecord of an unknown is presented to them."

ARMADA, NAB Discuss'317' Policyim ARMADA and the NAB have jointlyagreed that donations of records to broad-casters does not constitute "consideration,"according to ARMADA president EwartAbner Jr. Both groups are preparing com-ments on Section 317 of the Federal Comeinunications Act, to be filed with the FCC!before May 2. They will present separatebriefs.

Abner said that free records do not con-stitute consideration since "the broadcasteris not obligated to play them." "ARMADA'sview" he said, "is that free records aremerely samples, nothing more." Section 317prohibits the airing of any matter for "con-sideration" without an announcement bythe station.

Also announcing their policies towardsSection 317 recently were the AmericanBroadcasting Company and the NationalBroadcasting Company. ABC also felt thatsince there was no compulsion on thebroadcasters' part to play free records, theycould not be considered payment or "valu-able consideration." NBC asked that Section317 be reinterpreted so that the rule foridentifying free rccords be separated fromthe matter of actual payola in broadcasting.

F "Slipshod" Experts Testify

Before House CommitteeWASHINGTON, D. C.-As this edition

went to press disc jockey Dick Clark wasunder fire from congressional investigatorswho implied that he gave payola to otherDJ's. The charge was made by Robert W.Lishman, counsel for the House SpecialSub -committee on Legislative Oversight ashe questioned Thomas Noonan, research di-rector of Billboard.

He asked Noonan, if Billboard, in calcu-lating its ratings "takes into account thefact that Clark or his companies pay payolato numerous disc jockies all over the coun-try?" There was no clearcut answer.

Noonan was called to the stand to ex-plain information given to the committeeby Bernard Goldstein, of Computech, anelectronic processing firm, retained by Clarkto study his record activities between Au-gust, 1957 and November, 1959.

Goldstein told the sub -committee that therecords played on Clark's show had "animpact of 0111,, 2.336 per cent."

Under the sub -committee's prodding,Goldstein admitted that he did not knowwhat this meant. He said that the informa-tion had been given to him by Noonan.Noonan was located in the hearing roomand called to the stand.

Under questioning, Noonan admittedthat he had come up with the figure "insuch a slipshod fashion that I can't explainhow I arrived at it."

Goldstein had also testified that Clarkhad financial interest in only one out ofevery four records he played on his "Ameri-can Bandstand" show during 1957-59. Mostof the sub -committee dismissed the 300pounds of statistical data that Goldstein hadhauled into the hearing room as in someinstances utterly "valueless."

Rep. John Moss (D -Calif.) observed thatthe survey failed to include songs ownedby Clark's employer, the ABC network, orthose in which Clark's associates held aninterest.

Goldstein's figures which showed thatClark held an interest in only 4,230 of the15,662 records played during the last twoyears, were also questioned by CongressmanMoss. He charged that Goldstein had in-cluded the Clark theme song in his study,which was played 1,322 times. "Since Clarkhad no interest in this tune," Moss said, itsinclusion tended to reduce the percentageof songs in which he did have an interest."

RIAA Report Mirrors

Record Industry GrowthManufacturers' sales for last year totaled

almost $225 million according to a reportjust released by the Record Industry Asso-ciation of America. This is an increase ofapproximately 25 million dollars over 1958.If all records were sold at list price, thetotal retail value would amount to $472,500,000.

The report, a comprehensive survey ofthe record industry for 1959, also indicated:the coming of age of stereophonic sound;the growth of medium size labels; and theincrease of album sales in relation to salesof singles.

Stereophonic records made their marklast year by accounting for 20 per cent ofall 12 -inch long-playing discs sold. Theirpopularity was not as great as expected be-cause of the slow distribution of new stereo-phonic phonographs, according to the re-port.

A long range trend shows that since1952, companies grossing between 2% and10 million dollars have jumped from 3 to7; 3 labels grossing from $750,000 to $2%million have appeared where there werenone in 1952; and there are five more disk-eries now grossing up to $750,000 thanthere were eight years ago.

The report also noted that 88 differentlabels were represented among the top fiftysellers of 1959. Approximately one-third ofthese were issued by seven major labels.

20th FoxAppoints BovaIN Basil Bova was named national promo-tion manager for 20th -Fox Records, it wasannounced by Henry Onorati, the label'spresident. Bova, a ranking Boston promo-tions man, recently handled Al Martino'ssuccessful New England tour.

Jazztet Bows on ArgoArt Farmer's Jazztet makes its debut re-

cording today (May 2) on the Argo label.Called "Meet the Jazztet," it features tenorsaxman Benny Colson, trombonist CurtisFuller, pianist McCoy Tyner, bassist Ad-dison Farmer and drummer Lex Humph-ries, with Farmer on Trumpet.
