Delhi's ACB to reopen Rs 100-croretransport scamNEW DELHI

The Delhi government`s Anti Corruption Branch(ACB) has decided to relaunch the probe into thealleged Rs 100-crore transport scam that took placeunder the previous Sheila Dikshit government.

"The ACB has decided to reopen the CNG fitnessscam which had occurred during the government ofSheila Dikshit. The role of three senior bureaucrats isunder scanner," a government source told IANS.

In 2012, the ACB had launched a probe after it foundthat the Delhi government had incurred a loss of Rs 100crore in awarding the contract of operation and mainte-nance of inspection and certification of CNG vehicles.

"Due to some hiccups, not much progress was madeby the ACB. It also did not get the permission to ques-tion officials," the source said.

However, in January 2014, the CBI initiated a prelim-inary inquiry into the case and was assured all help bythe then Aam Aadmi Party government.

But after Arvind Kejriwal resigned as chief minister inFebruary 2014, "the case got stuck again", the sourcesaid.

The case will now be probed by the ACB again, hesaid.

Dust storms likely in Delhi, mercuryto settle below 40 degreesNEW DELHI

It was sunny morning with minimum temperature set-tling at 25.8 degree Celsius, two notches below normalfor this time of the season.

According to MeT department, humidity level record-ed till 8.30 am Saturday morning was 53 degree Celsius.

An official of the department said that no rain isexpected today, but dust storms may occur in someareas of the national capital.

"Maximum temperature is expected to settle at 39degree Celsius. There is no rain expected in next one ortwo days. Dust storm may occur in different parts of thecity today," the official also said.

The maximum temperature yesterday settled a notchbelow the season's average at 38.8 degrees Celsiuswhile the minimum temperature was recorded at 26degrees Celsius, two points below normal.

Teenage boy drowns in waterpark's poolNEW DELHI

A 17-year-old youth drowned in the pool of a waterpark here where he had gone on an outing with hisfriends yesterday, Delhi Police said.

The police said the body of the victim, Gagandeep,was recovered from the pool of Splash Water Park inAlipur area of outer Delhi.

A case of causing death by negligence has been regis-tered at Alipur police station on the complaint of thevictim's friend and the deceased's body has been hand-ed over to his family after conducting a post-mortem.

Gagandeep, a resident of Vishnu Garden, had gone tothe water park with five friends in the afternoon yester-day.

According to his friends, they had informed the pool'slifeguard that they were not good at swimming.

One of his friends Jaswinder told police that the poolwas crowded due to which nobody noticed Gagandeepdrowning and when they returned to the pool, no life-guard was on duty.

There was commotion and Gagandeep was taken outfrom the deep end of the pool, he said.

"No life-saving first-aid was provided in the waterpark," Jaswinder said.

The victim was then taken to a nearby hospital wherehe was declared brought dead by the doctors.

Two weeks ago, a 13-year-old boy drowned in theswimming pool of a government school in east Delhi'sShahdara. Two lifeguards were arrested in this case.

Delhi government cracks down onpolluting hotels

New Delhi: The Delhi government on Friday crackeddown on 77 hotels for violating pollution norms in thenational capital, sending closure notice to all of them.

"The Delhi Pollution Control Committee found that77 hotels were operating without license from munici-pal corporation and Delhi Police and Delhi PollutionControl Committee. They did not have pollution check-ing devices either," Delhi`s Environment Minister AsimAhmed Khan said.

The hotels were located in south Delhi`s Mahipalpurarea near Indira Gandhi International Airport.

"The government issued a closure notice to them," theminister said, adding that 27 hotels were sealed.

Khan said the government has also directed theauthorities to cut water and electricity connections ofthe 77 hotels.

The crackdown came after a direction from theNational Green Tribunal.

Women trained in self-defence canprotect themselves: BassiNEW DELHI

Delhi Police Commissioner B.S. Bassi has assertedthat a woman trained in self-defence can handle a situa-tion and protect herself whenever her safety is threat-ened.

"All I said was that women trained in self defence canhandle any situation where her safety is threatened. Theright of private defence extends to the causing of death,it's a provision in the Constitution," Bassi told mediahere.

According to reports, the Delhi Police has trainedover 50,000 women in self-defence so far, achievinghalf of its target set for the year.

tion in Delhi as an "ego tussle"and "brinkmanship", expelledAAP leader Yogendra YadavSaturday hit out Chief MinisterArvind Kejriwal for handling a"genuine" issue in a "veryimmature" manner.

Yadav, who floated a 'politi-cal movement' SwarajAbhiyan after he was oustedfrom AAP less than twomonths ago following a bitterpublic spat with top leader-ship, also said they have decid-ed not to form a political partyfor now.

He said they were not focus-ing on AAP which was just a"regional party" but his forumwas trying to "deepen alterna-tive politics" in the countryand it may "intervene" by sup-porting some candidates inBihar and other poll boundstates.

Yadav, whose outfit is rally-ing people who "feel cheated"by the developments in AAP,said the attitude adopted byKejriwal on the issue of pow-ers of Delhi Government willbe counterproductive.

"I feel that a very genuineissue is being raised in a veryimmature manner," Yadavsaid, without naming Kejriwal.

"Delhi should have a fullstatehood. An elected govern-ment of Delhi should be ableto appoint and transfer officerslike any other elected govern-ment. Unfortunately, ourConstitution and the law doesnot permit it right now.

"The transition from wherewe are and where we should behas to be made with lot ofpatience, negotiations andtact," he told PTI.

"Unfortunately, what wehave witnessed is confronta-tion, ego tussle, brinkmanship.I fear that this way of handling

this kind of genuine issue willbe counterproductive," he said.

Asked whether he has anyregrets over his ouster, Yadavsaid that, "It would be silly tosay that I have no regrets, Itwould be stupid to say that Iloved being dragged out and itwould be foolish to spend restof my life just regretting that."

Yadav claimed lakhs of peo-ple "who entered politics forthe first time in their life feelcheated, dejected" and throughSwaraj movement efforts areto bring them together andgive them hope once again of

alternative politics in the coun-try.

Elaborating on the role of theplatform floated by him andanother expelled AAP leaderPrashant Bhushan, Yadav said"Swaraj Abhiyan is an attemptto deepen alternative politicsin the country but for us poli-tics does not mean fightingelections and elections are notmerely a way to somehowform the government".

"As of now we are not apolitical party so obviouslythere is no question of contest-ing Bihar elections as SwarajAbhiyan."

Yadav said, "At the sametime because we are a politicalmovement we are committedto intervening in the democrat-ic process.

"The manner in which wecan intervene would be by wayof creating an alternative agen-da, by way of creating publicawareness, by way of oppos-ing tainted candidates or byway of exposing unfair prac-tices in elections."

He said, "In some exception-al cases we may on an experi-mental basis support somepeople's candidates who maynot be affiliated with any polit-ical party."

Slamming Jung, Kejriwal in an

interview to an English news chan-nel had said he does not give timeeven to Deputy Chief MinisterManish Sisodia or other Delhiministers for a meeting or take hiscalls. "But if the 'chowkidar'(watchman) of (BJP President)Amit Shah calls him (LG), he willcrawl and go," he said.

Alleging that the "LG house hasbecome another BJP headquarter",Kejriwal had also said, "He (LG) isacting like a poll agent of BJP."

Though there was no statementfrom LG's office, Jung made thebrief remark, "May god forgivehim for he knows not what hesays".

Delhi ACB reopens 2002 CNGfitness scam case: Sources

NEW DELHIIn a significant move, Delhi

government's Anti-CorruptionBranch (ACB) has"reopened" the alleged 2002CNG fitness scam of Rs 100crore in which three top offi-cials of Sheila Dikshit gov-ernment were under scanner.

"The ACB is reopening the2002 CNG Fitness Scam inwhich top three babus, whohad worked under SheilaDikshit government, areunder scanner," top govern-ment sources said.

They said that ACB hadregistered a case in 2012 intothe alleged 2002 CNG Fitnessscam which runs into Rs 100crore.

"During the AAP's previous49-day stint, Arvind Kejriwalhad said that all documentswould be provided to CBI

after the probe agency soughtsome documents pertaining tothe scam.

"But, the case probe gotstuck as Kejriwal governmentresigned," they said, addingthat as elected government isnow in place in the capital,ACB would probe the matterthoroughly.

The sources claimed thatthe probe was stalled due toinability to get permission toquestion the officials.

The Aam Aadmi Party had,in December last year, rakedup the issue of the CNG fit-ness scam of 2002 andattacked the "continuingsilence" of the central govern-ment and Delhi Lt GovernorNajeeb Jung on the allegedindictment of top bureaucratsin the city government byCBI.

(unlawful compulsorylabour), 201 (destructionof evidence)/ 202, volun-tarily causing hurt by dan-gerous weapons or meansand criminal intimidationof the IPC.

Jagriti, however, wasdischarged for the allegedoffence of attempt to mur-der and under sections 325(punishment for voluntari-ly causing grievous hurt),377 (unnatural offences)and 370 (buying or dis-posing of any person as aslave) of IPC.

The court had orderedframing of charges againstDhananjay for the offenceof destruction of evidenceonly.

Apart from other provi-sions, he was also dis-charged of the allegedoffences of voluntarilycausing grievous hurt bydangerous weapons ormeans, buying or dispos-ing of any person as aslave and unlawful com-pulsory labour.

The couple were arrest-ed on November 5, 2013

in connection with thedeath of their 35-year-oldmaid Rakhi Bhadra, a res-ident of West Bengal.

Delhi Police'sVigilance Unit has so farregistered 36 cases underthe Prevention ofCorruption Act against 74police personnel whichinclude two Inspectors, 6Sub-Inspectors, 6 AssistantSub-Inspectors, 22 HeadConstables and 38Constables, police saidtoday. In addition to this,10 POCA cases have alsobeen registered in localpolice stations in Delhi (in2014 and up to June 31 this

year) against 10 police per-sonnel - five Sub-Inspectors, one AssistantSub-Inspector, two HeadConstables and twoConstables. "Apart fromregistering POC Act casesand taking up investiga-tion, strict departmentalaction was taken againstthe defaulting personnel.In all, 69 officers havebeen placed under suspen-sion and 8 were dismissedon corruption charges. Modi government will go if itdoesn't build Ram temple: VHP

says that the Narendra Modi govern-ment doesn`t have the mandate toaddress its core issues, the VishwaHindu Parishad (VHP), a constituentof the Sangh Parivar, disagrees.

The VHP has said that the hugemandate with which the Modi gov-ernment came to power was not onlyfor development but also to delver onits core issues, including building agrand Ram temple at Ayodhya.

The Hindu outfit also reminded thegovernment to be ready to "face theconsequences" -- like the previousNDA government led by Atal BihariVajpayee -- if it did not deliver on thecore issues.

"The mandate which the BJP got inlast general election was not merelyfor development. People expect thatthey will address the core issues too,"VHP spokesperson and national sec-retary Surendra Jain told IANS.

"Despite several comments on theissue by senior BJP leaders, our hopeis still alive. We expect that this gov-ernment will fulfill its commitment toconstruct a Ram temple at Ayodhya,"he added.

"The Prime Minister iscommitted, we have nodoubt it will come. Now, itis stuck because somebodyis trying to play aroundwith the definition whichwe had worked out aftercareful thought. It wasvery simple, only twoparameters were to betaken into account, rankand total service,"Lieutenant General(retired) Kadyan said.

"If you inject anythingelse which will be neitherfair nor will it be easy toimplement. So, we aregoing to sit with the peoplewho have worked it out.Let us see how it isresolved. I have great con-fidence that we will be ableto resolve it," he added.

The Indian Ex-Servicemen Movement(IESM), a leading associa-

tion of retired military per-sonnel, has said that theywould agitate and call for ahunger strike, if theirdemands for one-rank,one-pension are not met.

Officials of the IESMannounced their plans tolaunch an agitation after ameeting with UnionDefence Minister ManoharParrikar to discuss theOROP issue ended incon-clusively.

Major General (retired)Satbir Singh, who is thevice-chairman of IESM,said that their meeting withthe Defence Minister wasinconclusive. He said theywill hold a rally at theJantar Mantar from June14 and will begin thehunger strike from June15.

"The Chief of Army staffhad told us to meet theDefence Minister beforeholding a meeting. We, themembers of Indian Ex-ser-vicemen movement (IESM), met the DefenceMinister. He told us thatthe ministry is working onit (OROP). We will meethim again, once it is final-

ized and the date is givento us, we will inform therest," Major General(retired) Singh said.

"If it does not happen,then we will begin an agi-tation from June 14, wewill hold a rally at JantarMantar. We will begin ahunger strike from 15thonwards," he added.

The NDA Government atthe Centre has drawn flakfrom various political par-ties, especially from theCongress, over the delay inimplementing the OROPscheme.

Prime Minister NarendraModi, while addressing thenation in his eighth editionof the 'Mann Ki Baat' pro-gramme, had assured ex-servicemen that his gov-ernment would soonresolve the OROP issue.

The OROP scheme hasbeen a long-standingdemand of ex-servicemen'sassociations and relates topayment of uniform pen-sion to defence forces per-sonnel retiring in the samerank with the same lengthof service, irrespective oftheir date of retirement.

Operation Bluestaranniversary: Fiveinjured in clashinside Golden TempleAMRITSAR

Five youths were injuredin a clash inside GoldenTemple here on Saturdaywhen people had gatheredthere to mark the 31stanniversary of OperationBluestar. According topolice, the incident tookplace as members of theSGPC's Task Force resortedto lathicharge on a group of22 Sikh youths who wereraising pro-Khalistan slo-gans on the periphery of thetemple near Akal Takht.

Five of the protestingyouths were injured in theaction with two of them sus-taining head injuries.

Deputy Commissioner ofPolice Parmpal Singh saidthat trouble started as thegroup of 22 people raisedpro-Khalistan slogans andwere joined in it by someSikh youths who had cometo the temple.

That prompted the SGPCTask Force members to dis-perse them and the slogan-chanting youths were forcedto move outside GoldenTemple, where all 22 ofthem were taken into pre-ventive custody by police.

The National Human RightsCommission (NHRC) is the pre-mier body that investigates abuses

and violations of human rights in India.Set up in 1993, the NHRC has wide-ranging powers to investigate, recom-mend prosecutions, and award compen-sations for human rights violations.High-profile cases investigated by theCommission include encounter killingsby the police and other acts of violenceby the state. In 2002, the Commissionunder former Chief Justice J.S. Verma,was the first official body to visit Gujaratafter the riots; it moved the SupremeCourt to transfer cases outside the Stateto secure a fair trial.

The NHRC, set up under the Protectionof Human Rights Act, 1993, consists ofnine members. Four are ex-officeappointments — serving Chairpersons ofthe National Commissions forMinorities, Scheduled Castes, ScheduledTribes and Women. Two are persons whohave done work in the area of humanrights. And three are from the judiciary:a sitting or retired judge of the SupremeCourt; a Chief Justice of a High Court;and, the most important of all, a formerChief Justice of India (CJI) who headsthe Commission.

Needing an icon of independenceThat the head has to be a former CJI is

for good reason. Commonly, humanrights violations are committed by, orwith the connivance of, or allowed to beperpetrated by high-level political lead-ers, the police or other officers. The pub-lic needs to have unquestionable confi-dence that these cases will be investigat-ed without a tinge of favour, by the mostindependent persons available. TheCommission’s public face and guidingforce is the Chairperson. Hence, theinsistence on a former CJI as theChairperson of the Commission. Even apuisne judge of the Supreme Court is notto be considered for the post; nothingless than a person who has occupied thehighest rank in the judiciary will do. Ifthere is an icon of independence in thecountry who has received no favour fromthe government and is fearless abouttackling the powers that be, surely it isthe CJI. So proceeds the Act.

Justice P. Sathasivam held the office ofthe CJI from July 2013 to April 2014.Shortly thereafter, the government

offered him the position of Governor ofKerala. He accepted, setting off a chorusof criticism. One former CJI, when askedfor his reaction, enigmatically andcrisply commented that “standards dif-fer”. Lawyers and retired judges pointedout that the office of the CJI was beingdevalued. Its holder was part of a consti-tutional triumvirate of power along withthe President and the Prime Minister,they argued, and therefore acceptingGovernorship meant going to an officenot only several rungs lower, but morecrucially one which was given entirely aspatronage and largesse by the executive.It was also feared that once a precedentwas set, and by no less than a CJI, itwould not be long before judges on theverge of retirement would have thevision of a comfortable gubernatorialposition hazing their eyes while decidingsensitive cases against the government.

Very few voices defended the appoint-ment. One of those was that of JusticeSathasivam himself. He argued that hewas accepting just another constitutionalpost, an untenable argument when theConstitution enumerates many postsbarely comparable to the eminence of theCJI. He is also reported to have said thatthese standards would not apply to aretired CJI, a defence which poses some

difficulty.Indeed, it needs to be remembered that

judges, especially of the Supreme Court,will inevitably handle cases of contro-versy involving the government andpolitical personages. Justice Sathasivamhimself has handled cases involvingprominent politicians such as Amit Shah,where the accused received relief.Accepting appointment from govern-ments of which such petitioners are apart will invite scrutiny of these casesand give rise to questions. This post factoscrutiny and linkage is one of the mainreasons why judges have stayed awayfrom accepting appointments that aredecided purely by politicians. Even theeminent Justice M.C. Chagla receivedstrong condemnation from leaders of theBar for accepting the posts of UnionMinister and Ambassador. Over theyears, Raj Bhavans have, with distin-guished exceptions, become havens forpoliticians being eased out, or rewardingcivil servants for services rendered.Justice Sathasivam was appointed duringthe season when Governors of severalStates were being given marching orderstelephonically by the Home Secretary.That a just-retired CJI broke precedenceand judicial ranks to join this less thanaugust group was an action that was

widely seen as diminishing the image ofthe head of the judiciary, with no coun-tervailing public interest.

An inappropriate appointmentThe concern that arises now is that

Governor Sathasivam is in the runningfor appointment as Chairperson of theNHRC. His name is mentioned as one ofthe likely appointees, and it is said thathe has given his consent. This would bean inappropriate appointment, goingagainst the grain of the primary qualifi-cation for heading the body, namely,independence from the government andthe perceived ability to take hard actionsagainst those in power.

This is an institutional qualification; itis no defence to say that a person whoenjoys a sinecure from the governmentwill revert to absolute independencewhen appointed to head the NHRC. It istrue that the statutory qualification forChairperson does not specify that thecandidate should not have held previousoffice at the hands of the government,but the framers of the Act would not haveenvisaged, even in their wildest dreams,that there would be a case of a ChiefJustice becoming a Governor and thenlooking to become Chairperson of theNHRC.

Viewed from another angle, it is theproximal position that matters — heought not to be treated as a former CJI,but as a Governor of a State, and hencenot qualified to be Chairperson of theNHRC. It appears that a petition wasfiled in the Supreme Court raising thesegrounds, but it was withdrawn on theground that the objection was beingplaced before the government. Perhapsjudicial determination will have to fol-low if executive consideration is inade-quate.

The position of the head of the NHRCis a crucial one for protecting human anddemocratic rights. These rights and theCommission are primordial for all citi-zens, especially for those who fall foul ofthe powerful in government. Theappointment to this office must not betainted in any way. Justice Sathasivamcommitted one mistake in accepting gov-ernorship and lowering the office of theCJI. One hopes that another such mistakewill not be committed.

The destruction of the April 25earthquake provided Nepalicitizens with a respite from the

presence of the topmost politicalparty leaders in their lives. Havinghogged the news for more than adecade through an incestuous cabalthat bypassed parliamentary practice,the leaders did not have the credibil-ity to come forward to lead the res-cue and relief effort.

But it did not take a month beforethey were up to their old tricks — thedust from the earthquake had noteven settled when the power brokersraised a political sandstorm that hadthe ability to derail reconstruction.On the basis of personal career cal-culations, with no introspection as tonaked past practice, they started anexercise to bring down the coalitiongovernment led by Sushil Koirala.

It was a clear case of opportunismrather than using the earthquaketragedy as opportunity to “build backbetter”. The most desperate in tryingto turn the calamity to personaladvantage were the Maoists, PushpaKamal Dahal and BaburamBhattarai, both of whom went intooverdrive. By contrast, the leaders ofthe Madhesi Morcha opposition,with longer investment in democrat-ic politics, were circumspect.

Mr. Dahal is hounded by fears ofinternational jurisdiction on humanrights and money laundering, andalso feels he must have a hand inreconstruction expenditure. This iswhy he wants to join governmentrather than serve as effective opposi-tion during a critical period. Mr.Bhattarai, finding his own ambitionschecked at every step by Mr. Dahal,with amazing hubris presents him-self as candidate for tsar of thenational reconstruction effort.

Democratic dangerThe sluggish performance of the

Koirala government in the aftermathof the earthquake is lost on no one.The Prime Minister has not been ableto lead from the front with spark andvision, nor generate collective own-ership within his cabinet even at thistime of crisis.

But comparative perspective isneeded to gauge the Nepal govern-ment’s response, considering that theearth shook in the most difficult anddensely populated mountain terrainin the world. The government wasnot as devastatingly inept as project-ed in the immediate aftermath —infrastructure and services remainedin place and the authorities retainedcontrol over the miscellaneous inter-national rescue force.

There is now a mood to change thegovernment in order to prepare forthe reconstruction effort, and there isa pre-existing agreement that NepaliCongress President Koirala willmake way for the Communist Partyof Nepal (Unified Marxist–Leninist)Chairman, K.P. Oli, around the timeof promulgation of the new constitu-tion. What is new is the demand for a‘national government’ to include theMaoists and the Madhesi Morcha.

The most natural evolution is forMr. Koirala to make way for Mr. Oliin an orderly fashion, and for the rul-ing coalition to appoint a nationalreconstruction body with profession-al appointments from outside thepolitical realm. The Congress andthe UML must avoid an unbecomingfirefight at a time when there are stillbodies to be recovered from underdestroyed houses and landslide rub-ble. A political tug-of-war wouldserve only to deflect the need to planreconstruction, including preparingfor an international pledging confer-ence, scheduled for June 25.

Says sociologist ChaitanyaMishra: “Political bargaining at thistime would divert attention andutterly fail to recognise the humansignificance of the disaster and theneed for recovery. It would prioritisepolitical power over public service.”

The shift of the tectonic platescould not have been more inoppor-tune. The Nepali state, severelyweakened by a decade of conflictand another decade of confusion andintervention by foreign forces, fromnext door and from afar, was limpingtowards normalisation following theelections of November 2013. InMarch-April this year, the constitu-

tional negotiations seemed to bemoving towards resolution, with theMaoists on the back foot after thefailure of an announced three-daynational bandh.

That was when the earthquakestruck, and it took no more than acouple of weeks of quiet before thepolitical opportunists were castingabout. But the hard-won Nepalidemocracy cannot be upturned by anearthquake, nor can geopoliticalshifts be dictated by geological stra-ta.

The overwhelming show of nation-al and international military hard-ware and khaki prowess followingthe disaster sent an exaggerated mes-sage to the public that the civilianauthority was weak in contrast.

Indeed, for a whole month, Nepalwas a staging ground for a dozenmilitary rescue contingents, includ-ing India with the largest force andthe United States and China. Nepal’sexperience indicates a need forenhancing civilian capacity for dis-aster response in each of the coun-tries of South Asia.

National constitution, local bodiesBut the most pressing question for

now is whether there is a need to gobeyond reconfiguring the Congress-UML coalition, to expand it toinclude the Maoists and the MadhesiMorcha. Under any other circum-stance this would be a travesty with-in democracy, but given the nature ofNepal’s transitional polity, theanswer would be — yes, if the

Congress and UML can leverage theinvitation to national governmentinto obtaining agreement on promul-gation of the constitution and hold-ing of local government elections.

National reconstruction is impossi-ble to contemplate without the stabil-ity that would come with a constitu-tion. Neither can it happen withoutelected officials in the village, dis-trict and municipality councils,which is the only way to ensure equi-ty and accountability in the recon-struction planning and expenditure.The UML and the Congress havenearly two-thirds majority in thehouse, and given that they are ideo-logically divergent and under normalcircumstances would be in opposi-tion to each other, this is already a“national government”. It can beexpanded further only if, gatheringcourage from the suffering visited onthe citizens, the ruling coalitioninsists that the constitution be adopt-ed by due process, including two-thirds majority vote if required, and adate is set for local elections in earlyautumn.

If the long-standing deadlock overdemarcation of federal provincescannot be resolved, the republic mustbe declared “federal” in the constitu-tion, with the details to be workedout by an empowered commission.

International contributionThe worldwide response to the

Nepal disaster has been heart-warm-ing, but has been concentrated on thehigh-profile rescue and relief phase.International attention is alreadytapering off, long before the recon-struction phase has begun, with theNational Planning Commission stillengaged in preparing the PostDisaster Needs Assessment (PDNA).

The Congress and UML must workto give new energy to government,taking the Maoists and the MadhesiMorcha on board only as required,and prepare for the pledging confer-ence. The target of $6-7 billion willnot be easy to achieve, as past expe-rience with disasters elsewhere in thedeveloping world has shown.

First of all, the ruling coalitionmust be able to broadcast the mes-

sage of unity and common purpose,and prove its ability to plan andspend with competence and trans-parency. India, whose response to theearthquake was immediate and gen-erous, can help in the reconstructionprocess by ensuring a substantialcontribution to get the ball rolling.Prime Minister Narendra Modi hadactually proposed hosting the pledg-ing conference in New Delhi, and hisvisit to Kathmandu for the purposewould have positive impact both interms of publicity and volume ofcontributions overall.

Social justiceNepal’s geography seems designed

for natural disasters, from cloud-bursts and floods to landslides, heat-waves, frigid spells, droughts, glacialoutburst floods and earthquakes. Thecountry has to learn to cope andrespond, and one of the “gifts” of theApril earthquake was the sponta-neous rise of young professionals inthe rescue effort, who now constitutea new category to engage in nationalreconstruction. All the responders,from the young professionals to gov-ernment officials and internationalsupporters, must not lose sightthroughout the rebuilding phase thatit was the poor that were dispropor-tionately hit by the quake — it wasthe houses made using mud mortarthat collapsed. Therefore, the entirereconstruction effort must beanchored on social justice, whichrequires watch-dogging of the partybosses used to feudal era patronagepolitics and rule-by-syndicate.

Nepal could come out of this asexemplary in its response to megadisaster, but this will not happen forthe wishing, and without politicalstability deriving from a new consti-tution and participatory local democ-racy. The alternative is continuingpolitical disarray even as the mon-soon approaches, to rain down on alandscape weakened by the tremorsand aftershocks of April.

At a time when the Right to Fair Compensation andTransparency in Land Acquisition, Rehabilitationand Resettlement (Second Amendment) Bill, 2015

is being examined by a joint committee of Parliament, thepromulgation — for a third time — of an Ordinance showsscant regard on the part of the Narendra Modi governmentfor democratic norms. Despite public expressions to thecontrary by even Mr. Modi, the BJP-led NDA governmentappears disinclined to concede any ground to theOpposition on its key demands to restore clauses relatingto consent and social impact assessment that were integralto the 2013 Act.

Not surprisingly, therefore, Opposition MPs on the jointcommittee are planning to disassociate themselves fromit. Sitaram Yechury, CPI(M) general secretary and a

member of the committee, has described the re-promulga-tion of the Ordinance as “absolutely untenable constitu-tionally in a democracy”. Even as the ruling dispensationshows no sign of relenting, murmurs of unhappiness havecome from within the BJP itself, especially from MPs whorepresent rural constituencies. In fact, at the first meetingof the joint committee some BJP members, worried aboutthe political fallout of the proposed changes, expressedtheir concern. Even the BJP’s NDA allies, the ShiromaniAkali Dal and the Shiv Sena, have raised questions aboutthe wisdom of persisting with such an unpopular move.

Evidently, the Modi government misread the signs: foreven senior officials who see merit in the proposedchanges (as they feel it would simplify land acquisitionand put infrastructure projects on the fast track) say thegovernment should have engaged the Opposition in a dis-cussion before bringing the Bill forward. It should havealso, they add, conducted a countrywide exercise of opin-ion-making before attempting to initiate changes. Now, theOpposition, led by the Congress, has had sufficient time torun its campaign against the government-sponsoredchanges. Reports from the ground suggest that a substan-tial swathe of the population believes the government draftgoes against the interests of the rural poor and is anti-farmer.

Unfortunately for the government, all this has coincid-ed with unseasonal rain that has damaged crops, and a hikein fertilizer prices. Yet, the minimum support price forcrops has not been increased commensurately. Takentogether, the message is that this is indeed a suit boot kisarkar — in Congress vice-president Rahul Gandhi’sshorthand — that does not care for the agricultural class; itjust wants a land law that would favour the corporate rich.The ruling dispensation’s plan to call a joint session afterthe current Land Bill is defeated in the Rajya Sabha, fliesin the face of pragmatic politics, as it would just give theOpposition even more ammunition. The only explanationis that its numbers in the Lok Sabha have blinded the gov-ernment to the predominant national mood.

There is now a mood to change the governmentin order to prepare for the reconstruction effort,and there is a pre-existing agreement that NepaliCongress President Koirala will make way for the

Communist Party of Nepal (UnifiedMarxist–Leninist) Chairman, K.P. Oli, around the

time of promulgation of the new constitution.What is new is the demand for a ‘national government’ to include the Maoists and the

Madhesi Morcha.The most natural evolution is for Mr. Koirala to

make way for Mr. Oli in an orderly fashion, andfor the ruling coalition to appoint a national

reconstruction body with professional appoint-ments from outside the political realm. The

Congress and the UML must avoid an unbecomingfirefight at a time when there are still bodies to berecovered from under destroyed houses and land-

slide rubble. A political tug-of-war would serveonly to deflect the need to plan reconstruction,

including preparing for an international pledgingconference, scheduled for June 25.

According to a joint census conductedby both the countries, there are 111Bangladeshi enclaves in India that hous-es 37,369 people while 14,215 peoplehave been residing at 55 Indian enclavesin Bangladesh.

The agreement with Bangladesh willmean exchange of a series of enclaves.

Assam alone will have to hand over250 acres.

Manipur attack:Rajnath Singh has directed that no mili-tant involved in the attack should beallowed to go scot free and strongest pos-sible action should be taken against allthose involved in the ambush.

The security forces have intensified amassive combing operation at Chandeldistrict in Manipur to track down the mil-itants involved in the ambush on theArmy convoy.

The central government has taken seri-ous note of the incident and directed thatall installations of the security forces inManipur and Nagaland be put on highalert to foil any attempt by the militantsto strike again.

Army officials said the militants usedrocket-propelled grenades and detonatedan IED to attack the Army convoybesides firing indiscriminately withsophisticated weapons.

In the case, probed by Bank Securitiesand Fraud Cell of CBI, it was alleged thatSinh had floated fake companies andforged invoices showing purchase ofinfrastructure and properties for the chan-nel.

The bank ultimately released Rs 67crore on his accounts. However, he didnot repay the bank after which CanaraBank declared the loan as a NonPerforming Asset and wrote to CBI.

In April, six parties with socialist rootshad announced that they were merging toform a national party headed bySamajwadi Party chief Mulayam SinghYadav. They were all once part of theJanata Dal, which disintegrated almosttwo decades ago.

The six parties are - the SamajwadiParty, the JD(U), Rashtriya Janata Dal,Janata Dal (Secular), the Indian NationalLok Dal and the Samajwadi Janata Party.

Govt will not... "The new Bill is currently before the

joint committee of Parliament. We wantthe bill to be passed. We are ready to havesuggestions. The government will con-sider the collective wisdom of the com-mittee, but we will not compromise onthe basic purpose of the Land AcquisitionAct," Naidu told reporters on the side-lines of an event here.

The joint panel will have to submit itsreport on the first day of the MonsoonSession on the bill which has alreadybeen passed by the Lower House.

Making a veiled attack on Congressvice president Rahul Gandhi on his 'suit-boot ki sarkar' remark, the Union urbandevelopment minister said, they shouldshow maturity and debate on largerissues of development.

"I have yet not understood the com-ments on PM's suit boot. The first primeminister (Pandit Nehru) used to wear suitboot and hat. One should be very carefulin making such comments and showmaturity. They should debate on largerissues of development and not make irre-sponsible statements," he said.

The minister further said it is necessaryto show the world that India is a maturedemocracy.

"We need to focus on brighter issues.Development should be the core issue forall including politicians. We are seeingwhat is happening around the globe.Everyone wants progress. We also needprogress," he said.

Woman raped ...Police Station, said the woman has filed

a complaint claiming that Subhash, a res-ident of Indra Colony here, raped her sev-eral times on the pretext of marriage.

According to the complaint, thewoman, originally a resident of BaliNagar, Palwal, had an estranged relation-ship with her husband and she had lefthome with her two children and startedliving separately at sector-62 inFaridabad.

After some days she met Subhash, thewoman claimed, adding that heexpressed his willingness to marry herand agreed to accept her children also.

In the meantime, the victim got preg-nant four times but she was aborted bysome medicines given by Subhash, whohad told her that he was a divorcee, thewoman claimed.

A few days back, she came to know thatSubhash is married and is father of threechildren, the woman said in her com-plaint, adding that then she decided tolodge a case.

A case was registered at Police StationBallabgarh in Faridabad under variousSections of IPC, Rajbala said, adding thatprobe was on in the matter.

China ship...victim of the tragedy, a three- year-old

girl, was among the hundreds more bod-ies retrieved from the murky waters afterdisaster response teams stabilised the

cruiser in an upright position, accordingto officials in the rescue headquarters inJianli, central China's Hubei Province.

So far 396 bodies have been recoveredfrom the four-storey cruise ship while atotal of 46 people are still missing.Authorities requested that river trafficand others along the river alert them ifthey noticed any floating bodies.

Only 14 survivors, including the cap-tain and chief engineer who swam to theshore, have been found after the ship car-rying 456 Chinese holiday-makers, most-ly elderly, sank within two minutes onMonday night.

Today, the body of the youngest victim,a three-year-old girl, was found on thefourth floor of the upturned ship, whichwas righted and hoisted out of water.

The ship was on an 11-day trip alongthe Yangtze when it overturned in Jianliin central China's Hubei Province.

Authorities have attributed the over-turning of the ship to sudden, severewinds, but have placed the captain andhis first engineer under police custodypending investigation.

Disaster teams yesterday put chainsaround the hull and used cranes to com-pletely righted the 2,200-tonne ship andthen gradually lift it out of the waters ofthe Yangtze after an overnight risky oper-ation, three days after the capsize.

Meanwhile, Jiang Zhao, legal represen-tative of Chongqing Dongfang ShippingCompany that owns the Eastern Star, latelast night apologised to all the victimsand their families and promised to coop-erate with any investigation, state-runnews agency Xinhua reported.

The 76.5-meter vessel had been in serv-ice for nearly 20 years and can carry up to534 people. It went through an annualmaintenance in late 2014, and was quali-fied to cruise until April 25, 2016,according to Jiang.

More than 3,400 soldiers and 1,700police together with 149 vessels and ahelicopter have taken part in the rescuemission.

Over 1,400 relatives today convergedon this town and paid tributes to theirdear ones at the shore.

Officials are taking DNA samples toestablish the identity of the bodies. Allcabins on the ship have now been ster-ilised to prevent any possible outbreak ofdisease.

In a sign of mourning, China's state andother major TV channels have suspendedsome entertainment programmes fromtoday.

Programmes or advertisements high-lighting celebrations will also be with-drawn for the next three days.

The Eastern Star disaster became thecountry's worst since the sinking of theSS Kiangya off Shanghai in 1948, whichis believed to have killed anywhere from2,750 to nearly 4,000 people.

"We met the defence minister. He saidthe plan is being worked on and we willimplement it. If they come out with adate, we will suspend the agitation, other-wise we will launch an agitation," chair-man of Ex-Servicemen Movement ofIndia Maj. Gen. Satbir Singh (Retd) saidon Saturday.

"We will launch the agitation at JantarMantar and will go on relay hunger strikefrom June 15," he said.

Asked if they got any assurance, theveteran said the minister told them theyare working out the details.

"He did not say when it will be imple-mented," Singh said.

Bangladesh shuts Islamic seminary,forbids banners for India tour

DHAKABangladesh authorities

have shut down an Islamicseminary next to a cricketstadium in Dhaka and for-bidden provocative bannersahead of the Indian team'supcoming tour of the coun-try, officials said Saturday.

Maulana Abdus Shakoor,head of the RauzatunSaliheen Alim Madrassa,said he had received a letterfrom the authorities askinghim to keep the madrassaclosed during the one-offtest match from June 10-14.

"This is the first time wehave received a requestfrom the governmentadministration to keep thecomplex closed," MaulanaShakoor told AFP.

KOLKATAMohun Bagan coach Sanjay Sen,

who guided the team to its firstnational league title in 13 years,believes Indian football does notneed over-hyped and below-parforeign coaches as there is nodearth of talent in local managers.

"I am not against them (foreigncoaches). But tell me how manyforeign coaches have got thenational team and the clubs tro-phies? It always has been Indiancoaches.

"There's no point having below-par foreign managers, they have tobe quality ones to take Indian foot-ball forward. They have to be ofgood pedigree," Sen told IANS inan interview.

Sen also welcomed the IndianSuper League (ISL), saying it hashelped Indian players raise the levelof their game but said one has tohowever see if the tournamenthelped the footballers in the longrun.

Sen took over the reins of the125-year-old club last Decemberafter his predecessor SubhasBhowmick was sacked for not pos-sessing an Asian FootballConfederation (AFC) A licence forcoaching that has been mademandatory by the All India FootballFederation (AIFF) for coachesseeking to manage I-league teams.

Sen says during his five-monthstint, the fans started rallyingbehind the team after delivering

"Winning the I-League, yes, itdoes seem like a fairy tale now. ButI literally had to start from scratch.I don't think when the officials hadchosen me to lead Mohun Baganthey had thought I would be able todo it (win the trophy).

"So when I started out there werenot many people around, only theplayers, but then we started win-ning and slowly the number of offi-cials increased in practice sessionsand the matches. The supporters

also rallied behind the team," hesaid.

But the coach admitted to be in adaze after receiving overwhelmingadulation from fans and officialsafter winning the trophy.

"It is a feeling which I just can'tdescribe. The way people reactedwas astonishing. What love andadmiration! It is one of the biggestthings that has happened in mylife."

While cardio is great forthe heart, it's only half of yourworkout equation. For a balancedfitness programme, strength train-ing is essential. While buildingmuscle is especially beneficial forweight loss, it also slows the mus-cle loss that comes with age,increases bone density, reducesrisk of injury and strengthens con-nective tissues.

Here's how to work your wayaround weights:

Get a planThe first thing you need is a seri-

ous workout plan. Set up a sessionwith a personal trainer or join aworkout programme to learn howto train properly. Remember,showing up in the weight roomwithout having the faintest ideaabout your goals won't get youanywhere.

Word of caution: Don't pick upthe weights before a round ofwarm-up exercises.

Dumbbells or barbells?When faced with the choice

between barbells and dumbbells,you should consider the lifts you'redoing. It is recommended that youuse both in your workouts.

Dumbbells are recommended forshoulders and chest, whereas bar-bells should be used for squats ordeadlifts. As a rule, you'll want to

work with a lighter and a heavierset of dumbbells during yourworkouts. Heavy weights will helpbuild muscle mass, while lighterones will stabilise the muscle,which supports joints and tendons.

To figure out which size dumb-bells are best for you, there's a sim-ple test that will determine the sizeof the weights you'll be using forjust about any dumbbell exercise.

Women can start with a set oftwo 5 to 10-pound weights, andmen with a set of two 10- to 20-pound weights.

How to: Stand with a weight ineach hand, holding them near thehips, palms forward. Shouldersand elbows should be pinnedagainst the wall. Without movingupper arms, curl the weights upuntil dumbbells are shoulder level,then lower to starting position.

Aim for 14 to 22 repeats withshoulders flat against the wall,raising arms for a count of two andlowering them for a count of two.

If your muscles fail or you can'tmaintain form before reaching 14reps, pick a set of weights fivepounds lighter. If you can easily domore than 22 reps, pick a set fivepounds heavier. This determinesyour lighter set of weights. Add 10pounds, and that's how much youshould be lifting when reaching fora heavier set of weights.

Get form rightWhen you're lifting weights, it is

not only the number but also thetechnique that counts. Experts rec-ommend maintaining form foreffective muscle-building. If theweight gets squirrely, and you can'tfollow a smooth up-and-downmotion, drop weight, but get the

form right. Not only will it keepinjuries at bay but will also max-imise results.

Master the movesHere are four fundamental

movements to get you started:SquatStart with just your bodyweight,

or a barbell across the back of yourshoulder blades. Place your feetshoulderwidth apart, toes pointingeither straight ahead or slightlyout. If you're using a barbell, gripit wider than shoulder-width. Sitback into your heels, sending yourbutt and hips back and down,keeping knees over the toes, shoul-ders and chest tall. At the bottomof squat, press through heels andreturn to standing position. Thisworks your legs, thighs, hips andcore muscles.

Glute bridge chest pressFor alternating arm chest press

in a bridge, lie down on theground, knees bent, feet firmlyplanted on the ground, one dumb-bell in each hand. Push up throughyour heels and raise your lowerback and butt off the ground.Keeping the torso and upper legsaligned, push the dumbbells upabove the chest, perpendicular toyour body, arms shoulder-widthapart, the palms of hands facingaway from your face. Bending oneelbow, so that arm creates a 90degree angle, lower dumbbelldown to your chest, keeping theother arm raised. Push the dumb-bell back to starting position.Repeat with the other arm for onerep. This exercise works your pecsand chest muscles.
