Continue to rely on the 'Norwich Pharmacal' principles, as opposed to introducing an alternative infringer identity disclosure mechanism that is not subject to scrutiny by the court

Dilemma: From copyright owners' point of view: more

protection, faster speed of response, etc. sought From OSPs point of view: an MOU does not provide

legal safe harbour, hence no incentive Users' rights: left out?
