WARNINGDo not place your BT Freestyle 4100base in the bathroom or otherhumid areas.

Handset rangeThe handset reception range fromthe base is up to 300m outdoorsand up to 50m indoors.

Signal strengthThe symbol on your handsetscreen indicates when you are inrange. When you are out of range,it flashes and the screen displaysOUT OF RANGE and there is a beep.

IMPORTANTDo not connect the telephone lineuntil at least one of the handsets isfully charged.

The base station must be pluggedinto the mains power at all times.

Which socket?

Location

You need to place your BT Freestyle 4100 base stationclose enough to a mains power and telephone socket sothat the cables will reach.

Make sure it is at least 1 metre away from otherelectrical appliances to avoid interference.

Your BT Freestyle 4100 works by sending radio signalsbetween the handset and base. The strength of thesignal depends on where you site the base. Putting it ashigh as possible ensures the best signal.

Setting up

1. Plug the power adaptors into the base and any chargersthat come with your product.

2. Plug the telephone line cord into the base.

(ILLUSTRATION)

Do not connect the other end to the wall socket yet.

3. Plug the power adaptors into the mains wall socket andswitch the power on. The green POWER/IN USE light onthe base comes on.

4. Install 2 X NiMH AAA batteries supplied into eachhandset. Then slide the battery compartment cover intoplace.

Getting started

Talk/Standby timeUnder ideal conditions, thehandset batteries should giveabout 12 hours talk time or 120hours standby on a single charge.(The base must remain pluggedinto the mains at all times).

Please note that new NiMHbatteries do not reach full capacityuntil they have been run down andrecharged a few times.

Battery low warningWhen the handset battery symbolis empty and flashing, you willneed to recharge the handsetbattery before using it.

Battery performanceTo keep your batteries in the bestcondition, leave the handset offthe base for a few hours at a time(after the initial 16 hour charge).

Running the batteries right downat least once a week will help themlast as long as possible.

The charge capacity ofrechargeable batteries will reducewith time as they wear out, givingthe handset less talk/standby time.Eventually they will need to bereplaced. New batteries areavailable from the BT FreestyleHelpline on 0870 240 3962.

After charging your handset for thefirst time, subsequent chargingtime is about 6-8 hours a day.Batteries and handset may becomewarm during charging. This isnormal.

5. Charge the handsets for at least 16 hours by placing thehandset on the base. The red CHARGING light comeson. The handsets are pre-registered to the base.

If you have purchased either the BT Freestyle Twin, Trio or Quad products the additional handsets will come pre-registered to the base.

6. After 16 hours charging, plug the telephone line cordinto the wall socket.

Lets you scroll through menuoptions.

During a call, adjusts the earpieceand handsfree volume, page 18.

In range signalSteady when handset is in range of the base.Flashes when out of range of the base or notregistered to the base.

Alarm setIndicates that the alarm has been set.

Handsfree onIndicates that handsfree is being used.

Call in progressIndicates a call is in progress.

Ringer offIndicates that the ringer is switched off.

Keypad lockedIndicates when the keylock is on.

You have missed new calls*Displayed when you have unanswered calls inthe Calls list (appears in the third line of thedisplay instead of the date and time).

Navigating the menus…

Your BT Freestyle 4100 handsets have a menu systemwhich is easy to use. In most cases, each menu leads to a list of options. Have a look at the menu map on thefollowing page.

When the handset is switched on and in standby, pressMENU to open the main menu and use the button toscroll to the menu option you want. Press OK to openthe list of options.

… and selecting menu options

Once the menu list you want is open, use the buttonto scroll through the options then press OK to select theoption you want.

For example to change the handset ringer volume:

1. Press MENU to open the main menu then to displayHANDSET SETTINGS. Press OK then to displayRINGER VOLUME.

2. Press OK. The volume options are displayed and thecurrent selection is heard. Press to scroll through theoptions and each setting is played. Press SAVE toconfirm the option you want. Display shows SAVED andreturns to standby.

As you get deeper into the menuyou will find that multiple optionsare shown in the handset display.The highlighted option will beselected when you press OK.

Go back one level

You can go back to the previous menu level by pressing BACK.

Exit menu

If you want to exit a menu or the phone book, pressBACK. If you want to go straight to the standby screenpress the button.

Press the MENU button to access menus or the DIRbutton to open the directory.

Scroll to display menu options. Then press OK to select.

Dialling numbers quickly

Numbers can be dialled direct from the Directory (page24), the Calls list (page 32) or the redial list (page 20)

Call timer

Your handset automatically times the duration of everycall. The time is shown during the call and for a fewseconds after the call has ended.

Auto-answer

When you receive a call, you can answer it by lifting thehandset off the base station or charger, this is calledauto answer. Also, you can end calls by replacing thehandset on the base or charger. When you switch autoanswer off, all calls must be answered by pressing and ended by pressing .

Backlit buttons & display

When you press any button or receive a call/message,the keypad and display light up. If no button is pressedfor 10 seconds, the lights are switched off.

You can disable the backlight if youwish, see page 52.

Switch handset on/off

1. Press and hold to switch handset off.

2. Press and release to switch it on.

Make an external call

1. Press , listen for the dial tone then dial the number.

Preparatory dialling

1. Enter the number first. If you make a mistake pressCLEAR to delete. Press to dial.

End a call

1. Press or place the handset back on the base.

Receiving callsWhen the telephone rings the display may show thenumber or name of the calling party.

Or show External Call if Caller Display is not subscribed to.

Or Handset X calling if it is an internal call where X is thenumber of the handset calling.

The handset icon will also flash.

1. Press to answer the call, or if the handset is on thebase or charger, simply lift it up to speak.

If you have subscribed to a Caller Display Service yourcaller’s number (and name if stored in the Directory) willbe shown. See page 31 for more information.

Handsfree

Handsfree lets you talk to your caller without holding the handset. It also enables other people in the room tolisten to both sides of your conversation.

Switch to handsfree before a call.

1. Press . Display shows press again. Displayshows and you can hear the dial tone over thehandset speaker.

2. Press to switch handsfree off.

Switch to handsfree during a call.

1. Press . To switch handsfree off, press again.

Earpiece and handsfree volume

You can adjust the earpiece and the handsfreeloudspeaker volume. There are 5 levels to choose from.

Using the phone

Earpiece and handsfree volume areindependent of each other butinstructions for adjusting are thesame for both.

During a call:

1. Use the button to select volume 1-5. The currentsetting is shown. When you end the call the setting willremain at the last selected level.

Secrecy

During a call, you can talk to someone nearby withoutyour caller hearing you.

1. During the call press SECRECY. Display flashes Secrecyon. Your caller cannot hear you.

2. Press OFF to return to your caller.

RedialYou can redial up to 20 of the last numbers called. If youhave stored a name in the Directory to go with thenumber, the name will be displayed instead, see page 24.

Redial the last number

1. Press to open the Redial list. The last number dialledis highlighted. Press to dial the number.

If the number is already in thedirectory the SAVE option will notbe shown.

Redial a number from the list

1. Press to open the Redial list, the last number calledis highlighted. Press or to scroll through the list.When the number you want is highlighted, press

Empty

If there are no numbers in the Redial list, the display showsRedial List Empty.

Copy a number from the redial list

You can copy a number from the redial list into thedirectory. The redial list holds up to 20 of your mostrecently dialled numbers.

1. Press to open the redial list. Scroll or to thenumber you want and press OPTION.

2. Scroll to highlight SAVE NUMBER. Press OK.

3. Display shows ENTER NAME. Use the keypad to enter aname (see page 23 for entering text) and press SAVE.Display shows EDIT NUMBER. If necessary, use the keypad to change the number, thenpress SAVE to confirm.

Pressing will stop that handset only.

Deleting a redial entry

1. Press to open the redial list. Scroll to the entry youwant. Press OPTION. DELETE ENTRY is highlighted.Press OK.

Delete entire redial list

1. Press to open the redial list. Press OPTION. DELETEENTRY is highlighted. Press to highlight DELETE ALL.Press OK. Press DELETE to confirm or SAVE to cancel.

Paging

You can alert handset users that they are wanted orlocate a missing handset by paging the handsets,(paging calls cannot be answered by a handset).

1. Press on the base. The handsets ring. Displayshows PAGING CALL. Press again to stop thehandsets ringing or press on the handset.

You can lock the keypad so that you don’t dial numbersaccidentally while carrying the handset around.

1. Press and hold . Display confirms KEYPAD LOCKEDand then reverts to the standby screen and displays .

2. To unlock the keypad, press UNLOCK, then press whilst Press # To Unlock Keys is shown in the display.

While the keypad is locked you can still answer incomingcalls and make 999 or 112 calls to the emergencyservice. But you cannot call other numbers or use themenus.

Internal calls

You can call the other handsets registered to your BT Freestyle 4100 base.

1. Press , The other handset numbers are displayed.Press to highlight the handset number you want, thenpress OK.

2. To end the call, press .

When the phone is in standby:

Delete entries

You can delete individual entries or the entire directory.

1. Press DIR. Scroll or to highlight the entry youwant, then press OPTION. Scroll to DELETE ENTRYor DELETE ALL and press OK.

2. Display asks you to confirm. Press DELETE to confirm orSAVE to cancel.

Copying directory entries

Save time adding entries by copying from one handset to another. So you only have to enter names andnumbers once!

While copying entries between two handsets you can still make external calls on any other BT Freestyle 4100handset registered to your base.

When the whole directory is copied, it will overwrite anyexisting entries on the other handset.

If the directory on the handset you are copying tobecomes full, the receiving handset displays DIRECTORYFULL. The sending handset displays COPY DIRECTORYENTRY FAILED for 2 seconds.

Copy an entry to another handset

Set groups

You can create ringing groups by selecting entries fromyour directory. For example if you create a group forfamily members and assign a ringer melody to thatgroup when one of that family group calls you will beable to identify which group from the ringer melody.

You can create up to 3 groups.

1. Press DIR. Scroll or to highlight the entry youwant to store in a group. Press OPTION.

2. Scroll to SET CALL GROUP and press OK. Scroll to highlight the group you want. Press OK. The display shows ADDED TO GROUP X.Select NO GROUP to remove a name from a group.

Name and set melody for a group

You can rename a group and change the melody.

31Caller DisplayCaller information not available

With some incoming calls, the telephone number of thecaller is not available and cannot therefore be displayed.

In this case your BT Freestyle 4100 provides you withsome explanatory information:

UNAVAILABLE – The number is unavailable.

WITHHELD – The caller has withheld their number.

RINGBACK – Ringback call.

OPERATOR – The call has been made via the operator.

PAYPHONE – The caller is ringing from a payphone.

INTERNATIONAL – International call.

Using Caller Display

If you subscribe to a Caller Display service, you can seeyour caller’s number (provided it is not withheld) on yourhandset display before you answer the call.

When a call is received your caller’s telephone numberwill be stored in a Calls list. The Calls list holds up to 40calls. When the Calls list is full, the oldest call will bereplaced by a new call, but the latest call will always beat the top of the list. If a caller rings again their numberwill move to the top of the list.

IMPORTANTTo use Caller Display you must firstsubscribe to your network provider’sCaller Display service. A quarterlyfee is payable.

SMS text messaging serviceWelcome to the SMS Text Messaging Service on your BT Freestyle 4100 product. The SMS Service is beingprovided by Bizzyline (Direct) Ltd. Terms and Conditionsof this service are supplied at the end of this guide onpage 75.

We recommend that you read these before you send yourfirst SMS text message. By sending your first SMS textmessage you are agreeing to these Terms and Conditions.

Your BT Freestyle 4100 can send and receive messagesto any mobile phone (national and international) andcompatible landline telephones.

Each SMS text message sent is charged at 12 pence forthe initial connection and then at local call rate thereafter(typical total cost per message sent is 12 pence includingVAT). One SMS message is sent on each connection.

You will not be charged to receive SMS messages.

Your BT Freestyle 4100 lets you send and receive SMStext messages of up to 160 characters.

SMS textingSMS stands for Short MessagingService.

You will not be able to receive textmessages until you have first senta message. The first sent messageregisters you with the text service.

IMPORTANTYou must subscribe to yourNetwork Provider’s Caller DisplayService so that you can use SMStext messaging. A quarterly feemay be payable, please contactyour network provider for moredetails.

When you are using SMS textmessaging you must not withholdyour telephone number or theservice will not allow you toconnect. BT have prefixed theService Centre 1 number with‘1470’, this will release yourtelephone number only to the SMSProvider, even if you normally haveyour number withheld.

4. When sending a message the display briefly showsTRANSFERRING SMS before returning to standby.

If there is a problem, the display shows MESSAGE FAILEDand the message is stored in the outbox. Press CLEAR toreturn to the standby display or press READ to open themessage and send again.

Your BT Freestyle 4100’s outbox is like a redial list. It holds a copy of the last 5 messages sent. If yourmessage did not get through, a copy is stored in theoutbox so you can send it later. The newest messagesreplace the oldest messages in the outbox.

When the outbox is full the newest messages replace theoldest messages in the outbox.

Saved messages are stored in the Drafts folder

If you want to save a message to complete and/or sendlater you can store it in the drafts folder. Your BTFreestyle 4100’s drafts folder can store up to 5 messages.

Predictive text

Your BT Freestyle 4100 gives you the option of usingpredictive text. It utilizes LETTER predictive text which‘guesses’ what the next letter is most likely to be andinserts it.

Switch predictive text on or off

When writing a text, press and hold to switchpredictive text between on and off. When predictive textis switched on, the icon is shown in the display.

Using predictive text

When writing the text, press the button to produce theletter you want e.g. if you want an ‘a’ press , an ‘a’appears in the handset display. If the letter shown is not the letter you want e.g. you wanted a ‘c’, then youcan display all the options under the button bypressing the .

When the letter you want is displayed, press the buttonfor the next letter, the most likely letter under thatbutton will be displayed. Again, if it isn’t the right letteryou can change it by pressing .

Just use the Reply option as you would for a messagefrom another fixed line phone (see Reading SMS texts,below).

When you receive a new text message, the display showsNEW SMS MESSAGE. To read it later, press CLEAR. Thedisplay returns to standby and shows instead of thedate and time.

Received messages are stored in the Inbox

Your BT Freestyle 4100’s inbox can store up to 40received text messages. The oldest message is listed as01. 40 would be the most recent message. The inbox isin the base not the handset.

To send a text message from a mobile to your BT Freestyle 4100

1. Write your message in the normal way, but include thenumber of the phone you are sending to in the message.The number must be enclosed in #’s. A typical messagewould be: “Hi there, I’ll see you at the match onSaturday #01234567891#. If the person you are sendingto uses a sub address then you should add the 1 digitsub address to the end of the telephone number, e.g.#012345678915# (where 5 is the subaddress).

2. Select Send and, when asked for the number to send to,enter 07786201010 (Vodaphone Big Number). All textmessages from all mobiles to fixed line phones must besent to this number, they are then re-directed automaticallyto the number you have included in the message.

If you send a lot of text messages to fixed line phonesyou may want to store the Vodaphone Big Number(07786201010) in your mobile’s directory.

Replying to a message received on a mobile fromyour BT Freestyle 4100

You can use the Reply option, usually found on mostmobile phones, BUT if the text of the received messageis automatically deleted when you use this option youwill need to include the destination number in your reply,enclosed within #’s exactly as it was in the receivedmessage. For example, if the message you received was“Hi there, I’ll see you at the match on Saturday#012345678915#”, and this text doesn’t appear in thereply, your reply would be “OK, I’ll be behind the goal atthe river end #012345678915#”.

If the reply option deletes the original text you may findit more convenient to use the ‘Forward’ or ‘Edit’message option.

Date and time

If you subscribe to your network’s Caller Display service,the date and time are set automatically on all handsetswhen your BT Freestyle 4100 receives its first call. If newhandsets are then registered to the base, they will alsoreceive the current date or time.

If the mains power to the base is cut, the date and timeare lost and will need to be reset.

The date and time can also be set manually using ahandset.

Set date and time using a handset

1. Press MENU. Scroll to TIME AND DATE SETTINGS andpress OK. Display shows SET DATE & TIME. Press OK.

2. Use the keypad to enter the date, e.g. = 3rd June. Press SAVE.

3. Enter the time e.g. = 3.30pm. Press SAVE.

The new time will not appear on the other handsets untilthey go on line or a call is received.

Ringer melody

You can set your handset to different ringer melodies for External and Internal calls. Choose from 5 standardringer melodies and 6 polyphonic melodies.

Recall mode

Recall is used with some switchboard features and someBT Calling Features.

It is pre-set to Timed Break which is correct for directexchange lines and most switchboards. For someswitchboards you may need to select Earth (consult yourswitchboard supplier).

To change the recall type

You can register up to 5 handsets to your BT Freestyle4100 base.

If you have purchased a Twin, Trio or Quad thehandsets in these packs are already pre-registered tothe main base.

However if you purchase additional Freestyle 4100handsets separately you will need to register them to thebase first for them to work.

1. When you switch on a new Freestyle 4100 handset, the display shows REGISTER HANDSET? Press OK.Display shows SELECT BASE.

2. Press or to select the base number and pressOK. If the handset is new then choose Base 1, if it hasbeen registered to other bases choose the first numbernot marked with a *.

3. Enter the base PIN (original setting 0000) and press OK.

4. Press and hold the button on the base for around10 seconds. When the base beeps, release the button. The handset is automatically assigned the nextavailable handset number. The handset will beep whenregistration has taken place.

You can de-register any handset from a base using anyhandset registered to an in range base.

Replacing the handset batteries

After a time, you may find that the handset batteries are running out of charge morequickly. This is a standard sign of wear and the batteries will need replacing.

For spare AAA NiMH rechargeable batteries please contact the BT Freestyle Helpline0870 240 3962.

Slide off the battery compartment cover. Install the batteries as shown.

Slide the battery compartment cover back into place.

Do not immerse the batteries in water or throw them onto a fire, or dispose of them withordinary domestic refuse.

Never use non-rechargeable batteries. Only fit rechargeable Nickel Metal Hydride (NiMH)AAA. Using the wrong type of batteries will invalidate your guarantee and may damagethe phone.

It is recommended that if you have a pacemaker fitted you check with a medical expertbefore using this product.

Never dispose of batteries in a fire. There is a serious risk of explosion and/or the releaseof highly toxic chemicals.

Cleaning

Simply clean the handset and base with a damp (not wet) cloth, or an anti-static wipe.Never use household polish as this will damage the product. Never use a dry cloth as thismay cause a static shock.

Environmental

Do not expose to direct sunlight.

The product may heat up when the batteries are being recharged or during prolongedperiods of use. This is normal. However, we recommend that to avoid damage you do notplace the product on antique/veneered wood.

Do not submerge any part of your product in water and do not use it in damp or humidconditions, such as bathrooms.

Do not expose your product to fire, explosive or other hazardous conditions.

There is a slight chance your phone could be damaged by and electrical storm. Werecommend that you unplug the power and telephone line cord from the base for theduration of the storm.

A total REN of 4 is allowed. If the total REN of 4is exceeded, the telephone may not ring.

With different telephone types there is no guarantee of ringing, even when the REN isless than 4.

Only use the supplied mains power adaptors, item code 010091 for the base station and010093 for the charger.

Connecting to a switchboard

Switchboard compatibility

This product is intended for use within the UK for connection to the public telephonenetwork and compatible switchboards, which support tone dialling, timed break recall orearth recall. If in doubt please consult your service provider.

Switchboard external line access code

You may need to enter an access code (e.g. 9) in order to get an outside line. So that theswitchboard has time to pick up an outside line, you may also need to add a ‘pause’ afterthe access code.

Insert a ‘pause’ in a stored number

If you need to add a pause in the dialling sequence, follow the example given below:

GuaranteeYour Freestyle 4100 handset is guaranteed for a period of 12 months from the date ofpurchase.

Subject to the terms listed below, the guarantee will provide for the repair of, or at BT’s or its agent’s discretion the option to replace the Freestyle 4100, or any componentthereof, (other than batteries), which is identified as faulty or below standard, or as aresult of inferior workmanship of materials. Products over 28 days old from the date ofpurchase may be replaced with a refurbished or repaired product.

SMS Service ConditionsSMS service conditions for Bizzyline(Direct) Ltd., Issue 1, 5 July 2001

IMPORTANTYou must read the following Conditions before youregister for SMS Service, by registering you haveaccepted these conditions.

1. INTERPRETATION

In this Contract:

“Authorised User” means anyone the Customerallows to use the Service.

“Bizzyline” means Bizzyline (Direct) Ltd. of WarfordHall, Merrymans Lane, Great Warford, AlderleyEdge, Cheshire. SK9 7TP. Registered in EnglandNo. 3308270.

“BT” means British Telecommunications plc of 81Newgate Street, London, EC1A 7AJ registered inEngland No. 1800000.

“Code of Conduct” means the guidelines regardingthe use of SMS issued by Bizzyline for the protectionof the Customer and other users of the Service.

“Contract” means, in order of precedence, theseConditions and Registration by sending the firstSMS message.

“Customer” means the person using the service.

“Helpdesk” means the helpdesk facility provided by BTto handle enquiries and administration for the Service.

“Service” means the SMS service and any otherrelated or ancillary services provided by Bizzyline inconjunction with BT.

“Software” means any software provided by BT toenable the Customer to access or use the Service.

2. DURATION

This Contract begins on the date that the Customerregisters for service by sending their first SMSmessage and will continue until terminated in accor-dance with this Contract.

3. PROVISION OF THE SERVICE

3.1 Bizzyline will provide the Customer with the Serviceon the terms of this Contract.

3.2 Bizzyline will use reasonable endeavours to providethe Service by any date agreed with the Customerbut all dates are estimates and Bizzyline has noliability for any failure to meet any date.

3.3 Bizzyline will provide the Service with the reasonableskill and care of a competent service provider.

3.4 It is technically impracticable to provide a fault freeService and Bizzyline does not undertake to do so.Bizzyline will however repair any reported faults assoon as it reasonably can.

3.5 Bizzyline cannot be held accountable for loss ofservice caused by faults, maintenance or otherissues on the mobile networks which are outside ofBizzyline’s direct control.

3.6 Occasionally Bizzyline may:

(a) change the technical specification of theService, provided that any change to the tech-nical specification does not materially affect theperformance of the Service;

(b) suspend the Service for operational reasons suchas repair, maintenance or improvement of the

Service or because of an emergency. Bizzylinewill restore the Service as soon as it reasonablycan after suspension; or

(c) give the Customer instructions which it believesare necessary for reasons of health, safety or thequality of any service provided by Bizzyline tothe Customer or any other customer.

3.7 Except for Software (if any) provided to theCustomer by Bizzyline as part of the Service, theCustomer is responsible for providing suitable software and telecommunications equipment andservices necessary to access and use the Service.This Contract does not include the provision oftelecommunications services necessary to connectto and use the Service.

3.8 The Customer is responsible for the acts and omis-sions of all Authorised Users in connection with theService and is liable for any failure by any AuthorisedUser to perform or observe the terms and conditionsof this Contract, including any instructions issuedunder paragraph 3.5.

3.9 The Customer acknowledges that he or she is awareof the Code of Conduct and that the Code ofConduct has been made available for the protectionand safety of the Customer and others using theService. The Customer agrees to ensure that anyAuthorised Users are aware of and familiar with theCode of Conduct.

4. SECURITY

4.1 The Customer is responsible for the security andproper use of all information used in connectionwith the Service and must take all necessary steps toensure that this is kept confidential, secure, usedproperly and not disclosed to unauthorised people.

4.2 The Customer must immediately inform Bizzyline ifthere is any reason to believe that information hasor is likely to become known to someone not autho-rised to use it or is being or is likely to be used in anunauthorised way.

4.3 Bizzyline reserves the right to suspend access to theService if at any time Bizzyline considers that thereis or is likely to be a breach of security.

4.4 Bizzyline reserves the right (at its sole discretion) torequire the Customer to change information used bythe Customer in connection with the Service.

4.5 The Customer must immediately inform Bizzyline ofany changes to the information the Customersupplied when registering for the Service.

5. USE OF THE SERVICE

5.1 The Service is provided solely for the Customer’s ownuse (including use by Authorised Users) and theCustomer will not sell or attempt to sell the Service(or any part or facility of it) to any third party.

5.2 The Service may be used by individuals who are atleast 18 years of age or by minors who have thepermission of a parent or responsible adult to usethe Service.

5.3 The Customer is solely responsible for evaluating anygoods (including software) or services offered by thirdparties via the Service. Bizzyline will not be a party toor in any way responsible for any transactionsbetween the Customer and third parties.

5.4 The Service must not be used by the Customer or anyAuthorised User in a way that does not comply with:

(a) the terms of any legislation or any licence appli-cable to the Customer or that is in any wayunlawful;

(b) any instructions given by Bizzyline under para-graph 3.5(c); or

(c) the Code of Conduct.

5.5 The Service must not be used by the Customer orany Authorised User:

(a) fraudulently, in connection with a criminaloffence, or otherwise unlawfully;

(b) to send, receive, upload, download, use or re-useany information or material which is offensive,abusive, indecent, defamatory, obscene ormenacing, or in breach of confidence, copyright,privacy or any other rights;

(c) to cause annoyance, inconvenience or needlessanxiety;

(d) to send or provide unsolicited advertising orpromotional material or to receive responses toany unsolicited advertising or promotional mate-rial sent or provided using the Service by anythird party; or

(e) other than in accordance with the acceptableuse policies of any connected networks.

5.6 If the Customer, an Authorised User or anyone else,with or without the Customer’s knowledge orapproval, uses the Service in contravention of para-graphs 5.1, 5.2, 5.3, 5.4 or 5.5. Bizzyline may treatthe contravention as a material breach of thisContract which cannot be remedied for thepurposes of paragraph 10.

5.7 The Customer must indemnify Bizzyline against anyclaims or legal proceedings which are brought orthreatened against Bizzyline by a third party because:

(a) the Service is used in breach of the provisions ofthis paragraph 5; or

(b) the Service is faulty or cannot be used by thatthird party.

Bizzyline will notify the Customer of any such claimsor proceedings and keep the Customer informed asto the progress of such claims or proceedings.

6. CONFIDENTIALITY

6.1 Bizzyline will keep in confidence any informationprovided to it by the Customer when registering forthe Service or otherwise under this Contract and willnot disclose that information to any person (otherthan its employees, contractors, or professionaladvisers, or the employees or contractors of aBizzyline Group Company who need to know theinformation) without the Customer’s consent.

6.2 This paragraph 6 will not apply to:

(a) any information which has been published otherthan through a breach of this Contract;

(b) information lawfully in the possession of therecipient before the disclosure under thisContract took place;

(c) information obtained from a third party who isfree to disclose it;

(d) information which a party is requested todisclose and if it did not could be required by lawto do so; or

(e) information which has been reduced by Bizzylineto anonymous, non-personal form before disclosure.

6.3 This paragraph 6 will remain in effect for 2 yearsafter the termination of this Contract.

7. LIMITATION OF LIABILITY

7.1 Bizzyline accepts unlimited liability for death orpersonal injury resulting from its negligence andparagraphs 7.2 and 7.3 do not apply to such liability.

7.2 Bizzyline is not liable to the Customer, either incontract, tort (including negligence) or otherwise fordirect or indirect loss of profits, business or antici-pated savings, nor for any indirect or consequentialloss or damage or for any destruction of data.

7.3 Bizzyline’s liability to the Customer in contract, tort(including negligence) or otherwise in relation to thisContract is limited to £1,000 for any one incident orseries of related incidents and to £2,000 for all inci-dents in any period of 12 months.

7.4 Bizzyline excludes all liability of any kind in respectof any material which can be accessed using theService and is not responsible in any way for anygoods (including software) or services provided bythird parties advertised, sold or otherwise madeavailable by means of the Service.

7.5 Bizzyline is not liable to the Customer either incontract, tort (including negligence) or otherwise forthe acts or omissions of other providers of telecom-munications or services or for faults in or failures oftheir equipment.

7.6 Each provision of this Contract, excluding or limitingliability, operates separately. If any part is held by acourt to be unreasonable or inapplicable, the otherparts shall continue to apply.

8. MATTERS BEYOND REASONABLE CONTROL

If Bizzyline is unable to perform any obligation underthis Contract because of a matter beyond its reason-able control such as lightning, flood, exceptionallysevere weather, fire, explosion, war, civil disorder,industrial disputes (whether or not involving itsemployees), or acts of local or central Government orother competent authorities, or events beyond thereasonable control of its suppliers, it will have noliability for that failure to perform.

9. TERMINATION OF THIS CONTRACT BYNOTICE

Either party may terminate this Contract on 14days’ notice to the other, without prejudice to anyrights that may have accrued before termination.Upon termination (for whatever reason), Bizzylinemay re-allocate any information associated with theterminated Service.

10. BREACHES OF THIS CONTRACT

10.1 Either party may terminate this Contract or theprovision of Service under it without notice if theother:

(a) commits a material breach of this Contract,which is capable of remedy, and fails to remedythe breach within a reasonable time of a writtennotice to do so;

(b) commits a material breach of this Contractwhich cannot be remedied; or

(c) is repeatedly in breach of this Contract.

10.2 If any of the events detailed in paragraph 11.1 occurbecause of the Customer or an Authorised User,

Bizzyline may suspend the Service without prejudiceto its right to terminate this Contract. At its solediscretion, Bizzyline reserves the right to suspend orterminate any Authorised User’s use of the Serviceas an alternative remedy to immediate suspensionor termination of the Contract.

This remedy is without prejudice to Bizzyline’s rightsubsequently to suspend or terminate the Contract.Bizzyline may refuse to restore Service which hasbeen suspended under this paragraph until it hasreceived assurances satisfactory to Bizzyline that thebreach has been remedied and will not be repeated.

10.3 Termination under this paragraph is without preju-dice to any rights that may have accrued beforetermination.

10.4 If either party delays in acting upon a breach of thisContract that delay will not be regarded as a waiverof that breach. If either party waives a breach of thisContract that waiver is limited to that particularbreach.

10.5 Upon termination (for whatever reason), Bizzylinemay re-allocate any information associated with theterminated Service.

11. CHANGES TO THIS CONTRACT

Bizzyline can change the Conditions of this Contractat any time on 14 days’ notice to the Customer.

12. ASSIGNMENT

Neither party may assign or transfer any of its rightsor obligations under this Contract, without thewritten consent of the other, except that Bizzylinemay assign its rights or obligations (or both) to aBizzyline Group Company without consent.

13. ENTIRE AGREEMENT

This Contract contains the whole agreementbetween the parties and supersedes all previouswritten or oral agreements relating to its subjectmatter.

14. NOTICES

Notices given under this Contract may be deliveredon-line, in writing or by SMS message; notices willbe deemed effective on the date of publication, orotherwise as notified to the Customer by Bizzyline.A notice from Bizzyline which is sent by SMS to theCustomer’s SMS mailbox will be deemed effective 3days after the date it is sent. A notice from theCustomer to Bizzyline will be deemed effective whenreceived by Bizzyline at the address on these Termsand Conditions.

15. DATA PROTECTION CONSENT

By accepting the terms and conditions of thisContract, the Customer grants Bizzyline and itsagents processing data on Bizzyline’s behalf,permission, in accordance with the Data ProtectionActs 1984 and 1998, to send the Customer unso-licited advertising and promotional materialpertaining to other Bizzyline products and servicesand to third-party products and services selected byBizzyline. The Customer may revoke permission toBizzyline and its agents to send the Customer unso-licited advertising and promotional materialpertaining either to other Bizzyline products andservices or to third party products and services, orboth, by writing to us at the address on these Termsand Conditions.

This Contract is governed by the law of England andWales.

CODE OF CONDUCT

How should I behave when I use the Bizzyline SMSService?

Here are a few guidelines for you to consider whenyou’re using SMS, which like any Service, can allowstrangers to meet and chat anonymously.

Remotely, people may not be who they say they are.

You could be putting yourself at risk if you arrangeto meet someone you’ve met through the SMSservice. If you do agree to meet someone, never goalone, always meet in a public place. Never go inthe other person’s car, and do tell a friend whereyou’re going and, just as importantly, when you’llbe back.

Don’t give out your name, address, or telephonenumber or ask anyone else for this information viaSMS.

Please don’t intimidate others on the SMS serviceby sending abusive, menacing or obscenemessages – you will be in breach of the Conditionsfor Bizzyline if you do.
