What Makes a Lemon?

Your vehicle is under warranty andthe problem persists after at least twofailed attempts by an appropriate

manufacturer repair shop. 

Your vehicle has been deemed unsafe. The attemptsto fix your consistent problem have damaged your

vehicle, or caused its value to go down.  

You have been without your vehicle formore than 30 days because of repairs. 

These issues arose within 18 months or 18,000 miles of yourpurchase. 

A "lemon" is a car, truck, RV, motorcycle or any othertype of vehicle which has persistent problems. Your

vehicle is considered a lemon when these issues havenot been corrected after you have tried multiple times to

have them fixed by a repair facility.

Lemon Law

Your vehicle should live up toits warranty. If it doesn't, thenyou have the right to repairsat the expense of themanufacturer or dealer.These repairs must be donewithin a reasonabledistance of your location.

As a consumer, your rights are protected under the CaliforniaLemon Law (and many others) that entitles you to propertreatment and compensation afterpurchasing a lemon. 

If the problem can't be fixed afterseveral repairs, then you maybe entitled to a full refund orvehicle replacement. Themanufacturer must not only covercosts of your lemon, but the costof towing, renting a car andattorney's fees.

Song-Beverly ConsumerProtection Act This law gives consumers who buy or lease a brand

new car the right to protection and guarantees. 

If you've made several efforts to fix a damaged

consumer product, then the manufacturer of the new

vehicle will need to give you your money back or

replace it. 

This act also applies to RV living areas.

California Consumer LegalRemedies Act California lemon law gives additional rights to

consumers on top of the federal requirements by the

Federal Trade Commission (FDC). If the seller or

manufacturer of the vehicle withheld information or

lied about the vehicle's condition, you have the right

to compensation. Especially if the vehicle

was originally returned because it was a lemon.

MAGNUSON-MOSS ACTThe Magnuson­Moss Act is the "Federal LemonLaw" bill. This maintains that the company orseller who supplies the warranty must go intointricate detail of the warranty's terms. Thiswarranty must be in compliance with the FDC. 

FDC rules pertain to consumers who havepurchased a product which costs more than $15. 

This act is often referred to as "The Lemon Law."It relates to new vehicles and damage to the baseframework or structure. Under this law, the dealeror manufacturer would need to repair or replacethe problem area. If they cannot replace it, theymay have to refund you. 

What do I do If It's aWarranty Issue?The company must fix the problem at nocost and in a timely manner.

The warranty issuer can't shorten orlengthen the time of the vehicle's warranty. Any exceptions or limitations to thewarranty must be plainly detailed.

If the company has tried and failed to fixthe vehicle several times, they mustrefund or replace it.

If any part of the vehicle malfunctions or isfound to be defective, then the companymust comply with their stated warranty.
