Everything is great! I am just coming back from a seminar at Manitoba Start. It was about employee rights in Manitoba. What an eye-opener! I learned so much!
Well, for one thing, we learned about things like vacation pay and overtime pay.
Sounds interesting! What kinds of things did you learn?
Hmmmm…. It is good to know about things like that. Don’t employers have to pay us more if we work more than 40 hours a week?
Yes, in most cases. And we also learned about the right to take certain leaves.
Certain leaves? What is that all about?
Basically that employees have the right to take time off work, in some situations.

Oh yes, I heard that employees can take time off to attend a funeral for a family member, or to take care of a sick child, for example.
Right! There are also laws and rules in place for things like statutory holidays and termination of employment.
You got it!
I think that if we work on a stat holiday our employer has to pay us extra right? I think it’s called time-and-a half, or something like that?
You sure covered a lot of ground. I wish I could have attended that seminar with you!

Let’s learn about some of your rights as an employee in Manitoba

The following have been deemed to be rights by workplace safety and Health.
-You have the right to know about any hazards you may encounter in your workplace, and how to protect yourself from them.

-You should receive safety and health training and instruction before you begin work, and in the event your responsibilities at work change.

-You should always work under the guidance of a competent supervisor who can show you how to do your work safely.

-You have the right to participate in a workplace Safety and Health Committee if there are 20 or more employees in your workplace.

-You have the right to have a Worker Safety and Health Representative if there are between 5 and 19 employees in your workplace.

-You have the right to ask for additional information or voice a concern related to safety and health hazards to which you may be exposed.

-You have the right to refuse work that you believe is dangerous to your safety and health or to others.

-if you exercise a right or carry out a duty under the Workplace Safety and Health Act or Regulations, you cannot be disciplined or discriminated against.

Employment Standards also has a set of rules that apply to all employees in Manitoba.
Here are 3 examples of leave
1. Maternity leave- 17 weeks; If you are an employee expecting to give birth to a child
2. Family leave- 3 days; If you are an employee that needs to take care of a family member
3. Bereavement leave – 3 days; If you are an employee and need to deal with the death of a family member

2. Deductions; this is money an employer takes off an employees paycheck
In most cases employers can only deduct:
a. money that is required by a law
b. money that the employee agrees to pay for something that is a direct benefit to them.

3. General holidays; also known as statutory holidays or stat holidays.
These are days that the government has deemed to be holidays. Most employees either get the day off, or must be paid more if they work on one of these days.

The Retail Businesses Holiday Closing Act Determines the hours most retail businesses can be open on Sundays and holidays.

6. Termination of employment; Employment relationships can be ended by the employer or employee. Usually the requires the person ending the employment to give notice.

7. Vacations and vacation pay; Employees must receive at least 2 weeks of vacation per year for the first four years of employment, and at least 3 weeks of vacation after the fifth consecutive year.

For each week of vacation, employees are entitled to 2% of the wages earned in that year, meaning that, employers may put vacation pay on every cheque, or they may choose to pay out at the time of the vacation leave.

8. Minimum wage; The minimum wage is the lowest hourly wage any employee can receive.

At this time the minimum wage in Manitoba is $11.25 per hour

9. Young employees; Young persons working in Manitoba have all of the rights and responsibilities as adult employees.

Children 16 and under need a child employment permit before they can begin working.
Employees under 18 years old cannot work in certain industries.
