Defamation on the internet

What is defamation?•  Defamation, in general, is the act of making not true statements about something which damages his/her reputation.

• People are often confused about this. Libel is simply defamation in a written form. So, defamatory comments on websites and in emails are examples of Internet libel. However, slander is defamation in a verbal form, for example, an audio recording.

forms of defamation• Defamatory material can take many forms including novels, poems, cartoons, paintings and songs. More recently things that have been said on the Internet have also been considered to be defamation. It does not matter what form you use to state or spread defamatory comments, it is against the law.

The elements that must be proved to establish defamation are:

1. False publication;2. False statement of a fact.

• Yes. Truth is an absolute defense to a defamation claim. But keep in mind that the truth may be difficult and expensive to prove.

Criminal defamation• Many nations have criminal penalties for defamation in some situations and different conditions to clear out if an offense has happened. Defamation in the Internet also hurts people and criminals must be punished.

Personal Opinions• It should be noted that personal opinion on any topic can be posted on blogs, websites, and other sources but sometimes it hurts people. For example, when somebody posts your photos on Facebook you are not satisfied and you feel hurt.

A Large problem• Once a defamatory statement is published on the Internet, the damage is already done. Even content that is later removed may be found by diligent searchers. But, on the bright side, proving publication is easy, and if you must prove harm to reputation, that may be done simply by saving and printing any negative comments left by people who read the defamatory story.

• False statements can reach hundreds of people at once when they are published online. It is important that a remedy would exist for those who suffer online defamation. A defamatory statement on a blog may be read by a large number of people, and then shared via email or sites like Facebook, increasing the damage.

• If you have defamed someone over the internet, it is not too late to do something about it. Firstly, you should remove the material immediately. If the person you have defamed made a written complaint that you have defamed them, you can offer to help and improve the situation in 28 days.

• Sometimes you might find that you become involved in defaming someone without any meaning. For example, if someone sends you a defamatory email about someone else and you forward it to other people. In that case, even if you were not the original author, you may still be responsible. Also, be aware that because emails can be shared so easily, there might be more people getting the email than intended.

• Generally, anyone who repeats someone else's statements is just as responsible for their defamatory content as the original speaker.

• Yes. Many insurance companies are now offering media liability insurance policies designed to cover online libel claims. However, the costs depend on how big the forum is. In addition, the insurer will conduct a review of the publisher, and may insist on certain standards and qualifications.
