A regular session of Troy City Council was held Monday, August 17, 2015, at 7:00 p.m. in Council Chambers.
Members Present: Clark, Heath, Kendall, Phillips, Schweser, Snee, Tremblay and Twiss. Upon motion of Mr. Clark, seconded by Mrs. Snee, Mrs. Oda was excused from this meeting by unanimous roll call vote.

INVOCATION: The meeting began with an invocation given by Mrs. Snee, followed by the Pledge of Allegiance.
PROCLAMATION: Mayor Beamish provided a proclamation that the City would recognize September as Feed Ohio Month, and that the recognition is also State-wide. Mayor Beamish presented the proclamation to Bishop David Katwyk (representing Feed Ohio) and Mr. Richard Steineman (representing a local food pantry and soup kitchen).
PUBLIC HEARING: At 7:04p.m., Mrs. Baker declared open a public hearing on 0-26-2015, the issuance of revenue bonds by the Dayton-Montgomery County Port Authority for a project to be known as StoryPoint of Troy, located on Towne Park Drive. Mr. Kip Wahlers, of Ice Miller LLP, bond counsel to the Port Authority and for the project, commented that the City will have no financial responsibility associated with the bonds or the project, and that the community where the project is located must consent to the bonds. There were no other comments in this regard, and at 7:07p.m., Mrs. Baker declared this public hearing closed .
MINUTES: The Clerk gave a summary of the minutes of the August 3, 2015, meeting of Troy City Council. There were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mrs. Snee, to approve these minutes. Motion passed by unanimous roll call vote.
COMMITTEE REPORTS: Finance Committee: Mr. Kendall, Chairman, reported that Committee recommends legislation be prepared authorizing the execution of an agreement by the City of Troy in connection with the issuance of revenue bonds by the Dayton-Montgomery County Port Authority regarding the StoryPoint Project. The StoryPoint Project on Towne Park Drive is seeking to fund the project construction through the issuance of revenue bonds by the Port Authority. In that the project will be located within the City of Troy, IRS Regulations require the City to hold a public hearing and to approve a contract related to the bonds issued by the Port Authority for the project. The bonds are not issued by the City, and the City has no responsibility for the financial viability of the project. So that the bonds may be issued without delay and the project proceeds, Committee supports emergency legislation. Report signed by Schweser, Tremblay and Kendall.

Streets & Sidewalks Committee: Mr. Phillips, Chairman, reported as follows: 1. Committee recommends legislation be prepared authorizing the Director of Public Service and Safety to
enter into LPA Federal Local-Let Project Agreement with the Ohio Department of Transportation for the Troy Recreational Trail project. This project is for State FY 2020 to include resurfacing of Miami Shores Golf Course to the Market Street Bridge, Intersection of Surrey Road with Trade Square, north to Lytle Road, and Adams Street Bridge to North Ridge Avenue. City will contract for the project and receive reimbursement of 80%, or up to $249,040.
2. Committee recommends the ODOT preliminary consent legislation be approved related to the ODOT resurfacing of N. Market Street from Water Street to Staunton Road during State FY 2020, with the City paying 20% of the project cost.

COMMENTS OF THE MAYOR: Mayor Beamish commented: -The Air Force Band of Flight Concert will be held on the Public Square on August 23 at 7:00 p.m. -The first THS football game of the season will be held Thursday, August 27.
COMMENTS OF THE PRESIDENT OF COUNCIL: Mrs. Baker thanked those who attended the August 16 Mayors Concert.
COMMENTS OF MEMBERS OF COUNCIL: -Mr. Heath thanked those who attended the August 15 Festival of Nations event, and also thanked the City employees and volunteers who helped prepare for the event. -Mr. Phillips commented that he received a letter from the resident at 1361 Essex Court that recycling bins were being taken or not handled correctly. Mr. Phillips commented that he has not personally noticed that and usually bins get blown around due to wind. Mr. Titterington stated that the contractor would be reminded regarding handling of bins. -Mr. Clark congratulated Officer Richardson on his retirement. He commented that he also heard good comments about a police officer on foot patrol at the Farmers Market.
AUDIENCE COMMENTS: -Josh Havener, President of the IAFF Local 1638, commented that he did not believe Council received correct information from the Director of Public Service and Safety related to the IAFF rejecting a Memorandum of Understanding (MOU) proposed by the City. Mr. Havener stated that 20 of the 34 members were present at the meeting, which is a majority of the members, 12 copies of the MOU were provided for the members to review, no other motion was offered at the meeting regarding handling the MOU, and with no one voting "nay" on a motion to reject the MOU, that was considered a unanimous vote. He also commented that the attorney for the IAFF had advised the union not to sign the MOU. Mr. Havener also suggested Council look at a report Novak had prepared for Clearcreek as the analysis was very different than in the report provided for the Troy Fire Department, and the department would still like to move forward with a full time option.

Regarding the proposed location of a new water tower to be within Carriage Crossing Park, there were the following comments: -Katie Deland, 2831 Parkwood Drive, presented a petition by persons opposed to locating a water tower in Carriage Crossing Park. Mrs. Deland further commented: the concern is from an environmental and engineering view as well as recreational; the media may have indicated the plans were further along than they are; there are a number of questions including is this location based on being cheaper, the height of the tower, is this the best topography for a tower, what other land owners were contacted and prices negotiated, will the tower actually serve the Stonebridge subdivision and where is there information on that, and what green space would be used to offset that taken for a tower as the entire park is now used for recreation. -Charles Adams, 2911 Parkwood Drive, commented that he feels there has been excellent conversation on both sides, the residents of the area were caught by surprise regarding the tower location, the residents understand there will be a meeting to discuss concerns but no notice has been received, and the feeling is that the tower will be forced on the neighborhood with not as much input from the neighbors as they would like. -Deborah Billheimer, 2824 Parkwood Drive, commented that she is a resident and a realtor, the land where the park is located is low and floods now, she is concerned that a tower with a cement base will cause a lot of flooding and devalue the properties. Mr. Titterington commented that staff will be meeting with the neighbors on September 2, the consulting engineer for the project will be present and will have the technical calculations, and staff will do their best to explain where we are at and how things work. Being asked if the meeting would be broadcast, Mr. Titterington said it would be determined if that could be done.

This Committee met on September 1 to review the certifications forwarded for acceptance by the Miami County Budget Commission for the rates of tax to be levied on the general duplicates for 2015 for collection in 2016. The certifications are to be based on the City's tax budget, which Council approved earlier this year. The certifications are provided geographically by school districts.
RECOMMENDATION: (To be read at Council Meeting) It is the recommendation of this Committee that legislation be prepared accepting the tax levies for the City of Troy as certified by the Miami County Budget Commission. We also support emergency legislation to meet the October 1 date by which acceptance of the certifications are to be returned to the County.

This Committee met on September 1, 2015, to review the certifications forwarded for acceptance by the Miami County Budget Commission for the rates of tax to be levied on the general duplicates for 2015 for collection in 2016. The meeting was also attended by members of the City staff.
The acceptance of the tax levies is an annual requirement. The certifications are to be based on the City's tax budget, which Council approved earlier this year. The County Budget Commission certifications were received by the City on August 31. Acceptance of the levies is to be returned to the County by October 1. Certifications are provided geographically by school districts. As a portion of the City is within the Miami East School District, there are certifications for both the Troy City School District and the Miami East Local School District. As a part of Troy's boundary is within Staunton Township, there are certifications reflecting both school districts for the small Staunton Township area.
RECOMMENDATION: It is the recommendation of this Committee that legislation be prepared accepting the tax levies for the City of Troy as certified by the Miami County Budget Commission. We also support emergency legislation to meet the October 1 date by which acceptance of the certifications are to be returned to the County.

SUMMARY REPORT: (To be read at Council meeting) On August 24, 2015, all members of Council met as a Committee of the Whole to review the proposed Hobart Arena Renovation and Expansion Project and to consider authorizing bidding of the project. The meeting was chaired by Council President Baker.
Council authorized the design of the project at the end of last year. During the meeting we reviewed the history of the Hobart Arena, what was suggested by the Feasibility Study, and the current design for the renovation and expansion of the 65+ year old building. Due to additional capital improvement repairs noted through the design process and adding a new south lobby entrance with ticketing and office areas to the design, based on the final design, the project estimate has increased from the $6,480,000 budgeted amount to a requested authorization of $7,350,000. Other elements of the project are discussed in the detailed portion of the report, including items that will be bid as alternates and may need to be considered at a later date.
RECOMMENDATION: (To be read at Council meeting) It is the recommendation of Council as a Committee of the Whole that the Hobart Arena Renovation and Expansion Project should go forward based on the design reviewed. We recommend that legislation be prepared to authorize the Director of Public Service and Safety to advertise for bids and enter into a contract for the Hobart Arena Renovation and Expansion Project at a cost not to exceed $7,350,000. On August 24, 2015, all members of Council met as a Committee of the Whole to review the proposed Hobart Arena Renovation and Expansion Project and to consider authorizing bidding of the project. The meeting was chaired by Council President Baker. This meeting was also attended by Mayor Beamish, the City Auditor, the Director of Public Service and Safety, two representatives of the Troy Recreation Board, a representative of the architect, members of the City staff, and citizens.
The Hobart Arena is a 65+ year old structure. It has been under City operation for a little over 45 of those years. Architectural and engineering firms have advised that facilities of this type usually have no more than a 35 year life span before being demolished and re-built. At the end of 2014, Council authorized the design of the Hobart Arena Renovation and Expansion Project. This project was included in the 2015 Capital Improvement Fund budget in the amount of $6,480,000. Funding for the project is from bond proceeds for the Riverfront Development Project.
Staff and the architect reviewed the current layout of the Hobart Arena, what was discussed following the completion of the feasibility study, and the proposed design recommended by the Recreation Board for bidding. It was discussed that the goals of the project are to:
• Improve traffic flow for patrons, staff and the event; • Clear the existing corridor area to allow more space for patrons; • Add a second lobby/ticketing/small office area at the south end, which will allow altering the existing lobby area to
also be handicapped accessible; • Stage concession areas throughout the building/increase points of sale (by adding to exterior walls to avoid
queuing in the corridors); • Increase restrooms to meet current codes and have them located throughout the building;

• Consolidate "back of the house" operations and consolidate maintenance operations, include a multi-purpose room in this area as a potential additional revenue source with it located out of the public corridor, and include an improved kitchen area to serve all concession areas and the multi-purpose room; and
• Establish an area for the Zamboni and other equipment in the back of house maintenance area. The design has been done in a way that a walkway/access will be available to a second sheet of ice if it is established in the future.
It was commented that: o Some of the displays now housed in the Arena, such as the Hall of Fame display, will be relocated and nicely
displayed, but may not have quite as much space allowed. o Impact on existing parking would be a loss of no more than six spaces, but some drive/access areas may be
eliminated or altered. o A patron "drop off' area is still being discussed with the architect. o The plans do not provide for a dock for the use of the vehicles of entertainment acts. o Ticketing would be available on the first floor and staffed during most open hours without patrons coming to the
staff offices, which offices will remain on the second floor. o Some box office/ticketing areas will be on the building exterior and under cover. o The new multi-purpose room will be located about 60' from Adams Street, 5' from existing sidewalk. o Landscaping will be included in the bid. Depending on the bid results, it may not be included in the final contract
and options such as handling the landscaping "in house" may need to be considered. The landscaping/irrigation estimate is $40,000. There will probably be the loss of eight trees, three of which should be replaced.
o Based on the proposed renovation plan, if a second sheet of ice structure is added in the future, the location is the space currently occupied by the Park Maintenance/Office Building.
o The proposed expansion will increase the 51 ,000 square foot Hobart Arena footprint by 26,000 square feet. It will not provide for additional seating for events. Replacement of temporary floor seating is not part of this project.
o The construction period is estimated at 10-12 months. Some Arena activities could be disrupted, but construction will be coordinated as much as possible to not impact scheduled events.
o It is felt that the improvements will assist is scheduling more events of the genre for which the Hobart Arena has become a popular venue.
o While staffing additions have not been determined, the Recreation Director commented that it is already difficult to cover open hours and increasing building utilization will only add to that concern.
Through the design phase of the project, the cost estimate has increased to $7,350,000. The increases are primarily attributed to a $250,000 higher estimate for capital improvement repairs and including the addition of the new south entrance in the expansion.
It was also discussed that several items will be included as alternates to the bid. Two of these are significant and it was discussed that if they cannot be included in a contract award, they will then be requested projects in the Hobart Arena 5-year Capital Improvement Plan (CIP) for funding. Those two items are Phase Ill (final phase) of the boiler system replacement (steam piping of the heating system throughout the building and new piping to convert to a hot water system) and replacing the existing catwalk system.
RECOMMENDATION: It is the recommendation of Council as a Committee of the Whole that the Hobart Arena Renovation and Expansion Project should go forward based on the design reviewed. We recommend that legislation be prepared to authorize the Director of Public Service and Safety to advertise for bids and enter into a contract for the Hobart Arena Renovation and Expansion Project at a cost not to exceed $7,350,000.

SUBJECT: ODOT CONSENT (PRELIMINARY) LEGISLATION WITHIN THE CITY RIGHT-OF-WAY: ON SR 202 AND ALONG SR 718
SUMMARY REPORT: (to be read at Council meeting) This Committee met on August 31 to consider the consent legislation provided by the Ohio Department of Transportation (ODOT) for two resurfacing projects within the City's right-of -way in the future. One project is on SR 202 at the intersection of SR 55. The other is along SR 718 at the intersection of Wilson Road and east of the 1-75 overpass. The projects are at no cost to the City.
RECOMMENDATION: (to be read at Council meeting) It is the recommendation of this Committee that Council approves the preliminary consent legislation associated with the paving work on SR 202 and the consent legislation associated with the paving work along SR 718. Following the ODOT format, we support emergency legislation.

This Committee met on August 31, 2015, to consider the preliminary consent legislation provided by the Ohio Department of Transportation (ODOT) for two separate projects to be scheduled in the future. The meeting was also attended by Mayor Beamish, Council President Baker, Council Members Clark, Schweser, Snee and Tremblay, the City Auditor, the Director of Public Service and Safety, and members of the City staff.
Consent is requested for the following two projects, with the work performed at no cost to the City:
• Paving work on SR 202 within the City of Troy's right-of-way, specifically at the intersection of SR 55. ODOT plans this work in State FY 2017.
• Paving work along SR 718 within the City of Troy's right-of-way, specifically at the intersection of Wilson Road and east of the 1-75 overpass. ODOT plans this work in State FY 2018.
Closer to the time period when these projects would be bid, the City will be asked to consider the final legislation.
RECOMMENDATION: It is the recommendation of this Committee that Council approves the preliminary consent legislation associated with the paving work on SR 202 and the consent legislation associated with the paving work along SR 718. Following the ODOT format, we support emergency legislation.

SUBJECT: ADAMS STREET IMPROVEMENT PROJECT PHASE 2 ADDITIONAL COSTS OVER AUTHORIZATION
SUMMARY REPORT: (To be read at Council meeting) This Committee met on August 24, 2015, to review costs exceeding the authorization associated with the Adams Street Improvement Project Phase 2.
Council authorized the Phase 2 contract at a cost not to exceed $555,000. Funding from the project was from the permissive tax balance of the Adams Street Bridge project. At the end of 2015, the contract had been encumbered in the amount of $550,000. Additional costs were incurred to finish the project, including costs associated with completing the bike path work to MCD specifications. Council is asked to increase the project authorization from $555,000 to $576,695.41. Much of the additional cost can be funded from the remaining permissive tax balance.
RECOMMENDATION: (To be read at Council meeting) It is the recommendation of this Committee that legislation be prepared to:
• Increase the authorization for the Adams Street Improvement Project Phase 2 and a contract with the L. J. DeWeese Co., Inc. for such project to the amount not to exceed $576,695.41, and authorizing the Director of Public Service and Safety to execute documents associated with the increased authorization.
• As this additional expenditure was not part of the 2015 appropriation, including it in a Reappropriation Ordinance.
In that the work has been done, we support emergency legislation so that payment can be made to the contractor.

This Committee met on August 24, 2015, to review costs exceeding the authorization for the Adams Street Improvement Project Phase 2. This meeting was also attended by Mayor Beamish, Council Members Tremblay, Schweser, Oda and Clark, the City Auditor, the Director of Public Service and Safety, members of the City staff, and a citizen.
In June of 2014, Council authorized the bidding of the Adams Street Improvement Project Phase 2 at a cost not to exceed $555,000. A contract was awarded to the L. J. DeWeese Co., Inc. in the amount of $454,978.20. From the contingency dollars between the base contract and the Council authorization, change orders have been authorized to encumber the project up to the amount of $550,000, $5,000 less than the authorization.
Towards the end of the construction, the contractor and staff encountered unplanned modifications that were required to complete the project. Much of that was associated with repairs to and completion of the bike path in accordance with the specifications of the Miami Conservancy District (MCD). The path is located within the MCD property. To comply with those specifications, including the requirement of significant additional fill material, approximately $56,000 in unplanned costs had to be added to the contract allocation associated with the bike path portion. In that the bike path ramp work was already underway when the additional costs became known, it was not an option for the City to cancel performance of that work. Based on the work performed, and as confirmed by staff, the additional obligation to the contractor is $26,694.41 over the remaining unencumbered balance for this project. That would increase the project authorization from $555,000 to $576,695.41, as $5,000 is still available (but not encumbered) from the initial authorization.

We were advised that there is a balance of $13,830 from the Adams Street Bridge Project permissive tax revenue to fund part of the additional cost, with the balance available from the fund balance of the Capital Improvement Fund.
It is the recommendation of this Committee that legislation be prepared: • Increasing the authorization for the Adams Street Improvement Project Phase 2 and a contract with the L.

PURCHASE OF PROPERTIES FOR PUBLIC PURPOSE

On August 31 there was a meeting of Council as a Committee of the Whole, with Council Members Clark, Heath, Phillips, Schweser, Snee, Tremblay and Twiss attending. The meeting was chaired by Council President Baker. Following an executive session, the Committee returned to regular session and approved the following separate mot ions by unanimous roll call votes:
That the Committee of the Whole recommends that the Director of Public Service and Safety be authorized to purchase three properties on South Mulberry Street (9 S. Mulberry Street, 15 S. Mulberry Street, and 24 S. Mulberry Street) at a total cost not to exceed $230,000.
That the Committee of the Whole recommends that the Director of Public Service and Safety be authorized to investigate alternate sites in relation to the extra high service water tower construction and that the City consider the potential purchase of real property.
RECOMMENDATION: (To be read at Council meeting) It is the recommendation of Council as a Committee of the Whole that legislation be prepared to carry out the above approved motions. In that both items are related to the purchase of properties, we recommend that the legislation be presented as emergency measures so the purchases are not delayed.

On August 31, 2015, Council Members Clark, Heath, Phillips, Schweser, Snee, Tremblay and Twiss met as a Committee of the Whole to consider the purchase of property for a public purpose. The meeting was chaired by Council President Baker. This meeting was also attended by Mayor Beamish, the City Auditor, the Director of Law, the Director of Public Service and Safety, and members of the City staff.
A motion was made that the Committee retire into executive session to consider the purchase or sale of property for public purpose. The motion was seconded and approved by a unanimous roll call vote. The Committee of the Whole retired into executive session at 6:03 p.m. The Committee of the Whole returned from executive session at 6:55 p.m. following a motion, second, and roll call vote to do so.
A motion was made by Mrs. Snee as follows: "I move that the Committee of the Whole recommends that the Director of Public Service and Safety be authorized to purchase three properties on South Mulberry Street (9 S. CHENEY ANNEXATION
SUMMARY REPORT: (To be read at Council meeting)

This Committee met on August 24 to consider the annexation of 1.243 acres in Concord Township to the City of Troy. This land is owned by S. Howard Cheney and is off Peters Road. The County approved the annexation on May 19. Based on the schedule prescribed by State Law, Council now makes a final determination on whether to accept the annexation. If the land is annexed to the City, it would retain the current Miami County single family residential zoning and would have to be rezoned to a City zoning before it could be developed. No indication has been provided by the owner as to a proposed future use for the land or a time frame for development.
RECOMMENDATION: (To be read at Council meeting) It is the recommendation of this Committee that legislation be prepared accepting the annexation of 1.243 acres in Concord Township, known as the Cheney Annexation.

This Committee met on August 24, 2015, to consider the annexation of 1.243 acres in Staunton Township, known as the Cheney Annexation. The meeting was also attended by Mayor Beamish, Council Members Oda, Clark and Tremblay, the Director of Public Service and Safety, and members of the City staff.
Council previously enacted legislation regarding this annexation, filed on behalf of S. Howard Cheney who is the owner of 1 OOo/o of the property proposed to be annexed. The parcel is located off Peters Road and is contiguous to the City of Troy. The annexation was approved by the County on May 19 and then returned to the City. There is a 120 day period, the first 60 days of which there is no action on the annexation. Between the 61 st and 120th day, the final determination is made by Council. We were also advised that if the land is annexed to the City, the current Miami County single family residential zoning continues until such time as a City zoning category would be approved. Thus, if the land is annexed to the City, it would have to be rezoned to a City zoning before it could be developed. No indication has been provided by the owner as to a proposed future use for the land or a time frame for development. Any future utility extensions would be at the cost of the developer.
RECOMMENDATION: It is the recommendation of this Committee that legislation be prepared accepting the annexation of 1 .243 acres in Concord Township, known as the Cheney Annexation.

This Committee met on August 24, 2015, to consider recommending that bidding be authorized for the fa~ade improvements at 121 Public Square, which project is funded by a CDBG grant. For FY 2014, Council approved CDBG Funding for fa~ade improvements to the Family Abuse Shelter property at 121 Public Square, particularly to replace the commercial storefront of the building. The project has been designed. The estimated cost of the project is $65,000. $60,000 was budgeted for the fa~ade improvements, and CDBG funds were also budgeted for the design of the work. The design was actually funded by the building owner. With the savings in the funding of the design, the project can be authorized in the amount of $65,000. These CDBG Funds must be expended prior to the end of this year.
RECOMMENDATION: It is the recommendation of this Committee that legislation be prepared authorizing the Director of Public Service and Safety advertise for bids and enter into a contract for fa~ade improvements to 121 Public Square at a cost not to exceed $65,000.

The right-of-way dedication is part of a replat that has been approved by the City Engineer that will combine lots into a single building lot; however, the dedication of right-of-way is a matter that can only be accepted by Council action.

SUBJECT: Public Defender Agreement- 2016
On an annual basis the Law Director prepares legislation for the renewal of the Public Defender Agreement. This agreement covers services for representing indigent defendants under ordinance violations. The Constitution requires that indigent defendants who face the prospect of jail be afforded legal representation. By entering into this agreement, the City satisfies its Constitutional obligation to provide such representation.
The agreement for 2016 will be on Council's agenda. The 2016 cost will be $20,341.13, which is the same amount since 2009. The history of this agreement is:

CONTRACT FOR COUNTY PUBLIC DEFENDER SERVICES TO MUNICIPAL CORPORATIONS
AGREEMENT
THIS AGREEMENT entered into between the Miami County Public Defender Commission hereinafter called the "Commission" and the City of Troy, Ohio, hereinafter called the "City''.
WHEREAS, the City recognizes its responsibilities under the Jaws of the State of Ohio and of the United States of America to provide legal counsel to indigent persons charged with loss of libci1y offense in its Municipal Court, and
WHEREAS, the city in furtherance of the execution of its legal responsibilities. desires that the legal services of the Commission be delivered to the City's indigent citizens and others so situated;
NOW THEREFORE, the parties do mutually agree to bind themselves as follows:
I. Scope of Work.
The Commission shall in a satisfactory and proper manner under the terms and conditions contained herein. perform the following services:
Provide legal counsel to indigent persons charged with loss of liberty offenses under, by or through, the Codified Ordinances of the City of Troy, Ohio. The within representation shall include such cases filed in the Miami County Municipal Court, and/or Miami County Common Pleas Court, and Miami County Juvenile Court.
2. Compensation.
The City shall pay to the Commission a sum not to exceed Twenty Thousand Three Hundred Forty One Dollars and Thi11een Cents ($20,341 .13) which shall constitute full and complete payment for all the Commissions services during the term of this contract. Said sum shall be paid in the following manner: One Third of this contract, to wit, Six Thousand Seven Hundred Eighty Dollars and Thirty Seven Cents ($6,780.37) shall be paid at the beginning of the term of this contract; thereafter Commission shall be paid the balance in two equal payments of one third of the contract price, the first of said payments at the expiration of the first four ( 4) months of the term of this contract in the amount of Six Thousand Seven Hundred Eighty Dollars and Thirty Eight Cents ($6,780.38), and the second at the expiration of the first eight (8) months of the term of this contract in the same amount of Six Thousand Seven Hundred Eighty Dollars and Thirty Eight Cents ($6,780.38).
9. Indigent Eligibility Standards.
In determining the indigent status of all individuals receiving representation pursuant to this agreement, all applicable standards of indigency and other rules and standards established by the Ohio Public Defender Commission and the Ohio Public Defender will be followed.

Payment by the municipality, whether by contractual amount or a fee schedule, does not exceed the fee schedule in effect and adopted by the county commissioners of the said herein county wherein the municipal corporation is located .

3. Term of Service.

5. Termination.
If the Commission shall fail to fulfill in a reasonable timely and proper manner its obligations under this Agreement, or if the Commission shall substantially violate any of the covenants, agreements or stipulations of this Agreement, the City shall thereupon have the right to terminate t his Agreement by giving written notice to the Commission of such termination and specif'ying an effective date thereof at least sixty (60) days before the effective date of said tennination. Termination by the City shall not constitute a waiver of any other right or remedy it may have at law or in equity for breach of this Agreement by the Commission.
6. Amendments .
All Amendments to this Agreement agreed upon by the parties shall he in writing and made a part of this Agreement.
7. Anti-Discrimination.
There shall be no discrimination against any employee who is employed in the work covered by this Agreement or against any application for such employment because of race. color. religion, sex or national origin. This provision shall apply to hut not be limited to. employment, upgrading, demotion or transfer, recruitment or recruitment advertising. lay-off or termination, raises of pay or other forms of compensation, and selection for training including apprenticeship. The Commission shall insert a similar provision in any sub-contract for services covered by this Agreement.
8. Conflicts.
Commission covenants that it presently has no interest and shall not acquire any interest direct or indirect, which would conflict in any manner with the performance of services required under this Agreement. No members of: nor delegates to, the Congress of the United States of America, and no resident Commissioner shall share in any part hereof or any benefits to arise herefrom .

The CITY also understands that right-of-way costs include eligible utility costs. WHEREAS, Council previously approved Resolution No. R-26-2014, authorizing
the Adams Street Improvement Project Phase 2 at a cost not to exceed Five Hundred
Fifty-five Thousand and no/100 Dollars ($555,000.00); and
WHEREAS, during the course of the project construction there were unplanned
modifications that resulted in the final cost of the project exceeding the authorization,
including requirements associated with repairs to and the completion of the bike path
that required the use of significantly higher quantities of fill materials; and
WHEREAS, the project is complete and additional funds are now due the
contractor.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Troy, as

SECTION 1: That the authorization for the Adams Street Improvement Project
Phase 2 is hereby increased by Twenty-one Thousand, Six Hundred Ninety-five Dollars
and 41/100 ($21,695.41 ) for a total authorization for such project not to exceed Five

On July 22, 2015, the Troy Planning Commission considered the rezoning of lnlot 6517, parcel D08-057880, from M-2, Light Industrial District, to OC-1, Office-Commercial District. This lot consists of 0.48 acres, located at the intersection of S. Crawford Street and E. West Street. The address of the parcel is 614 S. Crawford Street. The owner of the property is The owner of the property is Tammy & Brent LLC (Robert Cole). The applicant is Michael E. Lyons . The Troy Planning Commission has recommended that this rezoning be approved.
The Commission had received a report of City staff, which was reviewed as part of the meeting discussion. That report indicates that the intended use of the property is that it be renovated to house a fitness training center in the unoccupied (west portion) part of the building. The east side of the building will continue to be used at a welding repair company.
The Planning Commission determined not to hold a public hearing on this rezoning application.
By unanimous vote, the Troy Planning Commission recommends to Troy City Council that the requested rezoning be approved for lnlot 6517, parcel 008-057880, from M-2, Light Industrial District, to OC-1, Office-Commercial District, based on the findings of staff that:
o The area has similar "buffer'' zoning to the south of the proposed zoning classification; o The parcel meets the bulk requirements for an OC-1 zoned property and fits the proposed use well; o The proposed rezoning is consistent with the intent and purposes of the City of Troy Zoning Code; and o The rezoning would create a more effective buffer to the residential zones adjacent to this location .
This request is forwarded herewith to Council for consideration.

BACKGROUND:
Michael E. Lyons, buyer and applicant agent for Robert K. Cole, has applied for Planning Commission to consider the rezoning of 614 South Crawford Street (Parcel D08-057880, Inlot 6517). Currently, the property is zoned M-2, Light Industrial District, and the applicant requests that the zoning of the parcel be rezoned to OC- 1, Office Commercial District.
The property consists of .48 acres located on the SW comer of the intersection of South Crawford Street and East West Street. The surrounding zoning districts include R-5 Single-Family Residential, R-6 Two-Family Residential, R-7 Multi-Family Residential, OR-1 Office Residential and M-2 Light Industrial Districts. A map depicting the surrounding zoning districts has been attached to this report
DISCUSSION:
The applicant has cited the reason for the proposed rezoning is to provide the opportunity to purchase and renovate the building to house a fitness training center into the unoccupied portion of the building. Currently, the building is home to American Made Fabricators, a welding repair company, who operates out of the east portion of the building. The west portion of the building is vacant and used for miscellaneous storage. The west portion of the building will house the fitness training center.
This area of the city is dominated by a mix of residential districts abutting industrial districts. The mix of these uses stem from the distant past when industrial zoning districts were established along the railroads because they were the prime source of transportation of goods and services. As the railroads were being reduced in services, the industrial zoning districts of this area remained. It is the intention of the zoning code to eliminate incompatible land uses by providing a buffer district between them.
The Zoning Code describes the OC-1 Office-Commercial district as "designed to accommodate a mixture of office and commercial uses consisting of groupings of professional, research, executive, administrative, accounting, clerical, stenographic and similar uses." This district is designed and intended to act as a buffer as a transitional area between nonresidential and residential uses .
The OC-1 district limits commercial uses that are envisioned to prevent disruption to the surrounding existing residential neighborhoods and the rezoning will protect the
surrounding residences from the more intensive uses that are currently allowed in theM-2 zoning district. Attached to this report are the permitted uses as described by the OC-1 zoning district and the M-2 zoning district.
It is staffs opinion that adjoining properties will benefit from the positive impact of the proposed rezoning. The proposed OC-1 district permits the greatest flexibility to the reuse of the property while complementing the existing commercial uses and protecting the surrounding residential zoning districts.
The Comprehensive Plan's Future Land Use (Figure 14-4) shows the surrounding area to be predominately residential with light industrial districts mainly to the east. The Comprehensive Plan also depicts the goal of the reuse of vacant or underutilized commercial and industrial structures in the core of the city.
In reviewing a rezoning proposal, Section 1139.07 outlines the criteria on which to base decisions:
(A) Whether the change in classification would be consistent with the intent and purpose of this Zoning Code.
The proposed rezoning is consistent with the Zoning Code, specifically with sections 1131.02( e), and (r). These sections dictate the intent and purpose of the Zoning Code. Theses sections are listed below:
~ 1131. 02( e) "To separate incompatible land uses and to cluster compatible and mutually supportive land uses".
~ 1131.02(r) "To direct particular land uses to the parcels of land best suited for them ... "
The rezoning is consistent with the above listed intentions of the Zoning Code.
(B) Whether the proposed amendment is made necessary because of changed or changing conditions in the area affected, and, if so) the nature of such changed or changing conditions.
The application was not submitted based upon any changing conditions in the area.
(C) Whether the uses that would be permitted on the property if it were reclassified would be compatible with the uses permitted on other property in the immediate vicinity.
The use is compatible with the existing parcels of land located around the proposed rezomng area.
(D) Whether adequate utility) sewer) and water facilities, and all other needed public services exist or can be provided to serve the uses that would be permitted on a property if it were reclassified.
All utilities are provided.
(E) The amount of vacant land that currently has the same zoning classification as is proposed for the subject property, particularly in the vicinity of the subject property, and any special circumstances, in any, that make a substantial part of such vacant land unavailable for development.
There is no vacant land in the vicinity of this proposed rezoning with OC-1 zoning.
(F) Whether the proposed amendment would correct an error in the application of this Zoning Code as applied to the subject property.

PUBLIC HEARING:
Due to the straight forward nature of the rezoning request and the fact that City Council is required to hold a public hearing if the request proceeds on, staff does not feel that a public hearing before the Planning Commission is warranted.
RECOMMENDATION:
Staff is recommending that the Planning Commission recommend approval of the rezoning from M-2, Light Industrial District to OC-1, Office Commercial District, based on the following:

A meeting of the Troy Planning Commission was held Wednesday, July 22, 2015, at 3:30 p.m. in Council
Chambers, second floor, City Hall, with Chairman Alan Kappers presiding. Also present were members - Titterington,
Beamish, Force, Mahan, and McGarry; Planning Staff- S Brandon & D Puckett; Planning Manager- T Davis.
The minutes of the June 24, 2015 meeting were approved.
HISTORIC DISTRICT APPLICATION, 114 S. MULBERRY STREET, INSTALLATION OF WALL SIGN
READING·· B.l.E.S.S., LLC.; OWNERS: ARC VENTURES, LLC- CHUCK STERN; APPLICANT- ROBERT
BASSINGER. A report of staff noted: the wall sign has already been installed, it is the re-facing of an existing
single-faced wall sign; property was built in 1911; sign allowance is 22.5 square feet of wall signage sign is less
than allowed at 4.16 square feet; written permission of the property owner was provided; colors are as installed and
shown in the photo attached to the application; and staff recommends approval based on:
• The sign is appropriate in scale to the building with which it is associated; and • The sign is appropriate in design to the architectural style or period of the building with which it is
associated; and • The colors selected for the sign are compatible with the building with which it is associated; and • The sign is located so as to reasonably minimize adverse aesthetic effects on the architectural design of the
building with which it is associated.
A motion was made by Mr. McGarry, seconded by Mrs. Mahan, to approve the wall sign application for
114 S. Mulberry Street as submitted and installed, with the with the specific colors as installed and shown on the
photo attached to the application, and based on the findings of staff that:
• The sign is appropriate in scale to the building with which it is associated;
• The sign is appropriate in design to the architectural style or period of the building with which it is
associated;
• The colors selected for the sign are compatible with the building with which it is associated; and
• The sign is located so as to reasonably minimize adverse aesthetic effects on the architectural design of the
building with which it is associated.

\RUPERT. A report of staff noted: zoning is B-3 Central Business District; this is the former location of Del Cid Dish
Satellites; building was constructed between 1900 and 1910 and is on the National Register of Historic Places;
rendition of signs provided to Commission; colors are Logo Digital Print and will be Village Green SW2237, Zicron
SW2129, Riverboat SW2308 and Yellow Corn SW2348; allowed signage area is 24 square feet of combined
signage and as the proposed signage is 14.25 square feet, it is below the maximum allowed; and staff recommends
approval based on:
• The signs are appropriate in scale to the building with which it is associated; and • The signs are appropriate in design to the architectural style or period of the building with which it is
associated; and • The colors selected for the signs are compatible with the building with which it is associated; and • The signs are located so as to reasonably minimize adverse aesthetic effects on the architectural design of
the building with which it is associated .

The property owner did not provide written permission for the signs, but did sign the application .
A motion was made by Mr. Force, seconded by Mrs. Mahan, to approve the application for two window
signs for 8 N. Market Street, as submitted with the specific colors of Logo Digital Print and will be Village Green
SW2237, Zicron SW2129, Riverboat SW2308 and Yellow Corn SW2348; and based on the findings of staff that:

MOTION PASSED, UNANIMOUS VOTE
REZONING, INLOT 6517, PARCEL D08-057880, FROM M-2, LIGHT INDUSTRIAL DISTRICT, TO OC-1,
OFFICE-COMMERCIAL DISTRICT, 614 S. CRAWFORD STREET: OWNER OF THE PROPERTY IS TAMMY &
BRENT LLC (BOB COLE); APPLICANT IS MICHAEL E. LYONS. Staff provided a report, noting: property
consists of .48 acres located on the SW corner of the intersection of South Crawford Street and East West Street;
surrounding zoning districts include R-5 Single-Family Residential, R-6 Two-Family Residential, R-7 Multi-Family
Residential, OR-1 Office Residential and M-2 Light Industrial Districts; applicant plans to purchase and renovate the
building to house a fitness training center into the unoccupied portion of the bu ilding; currently, the building is home
to American Made Fabricators, a welding repair company, who operates out of the east portion of the building; the
west portion of the building, currently vacant and used for miscellaneous storage, will house the fitness training
center. The report of staff:
"This area of the city is dominated by a mix of residential districts abutting industrial districts. The mix of these uses stem from the distant past when industrial zoning districts were established along the railroads because they were the prime source of transportation of goods and services. As the railroads were being reduced in services, the industrial zoning districts of this area remained. It is the intention of the zoning code to eliminate incompatible land uses by providing a buffer district between them.
The Zoning Code describes the OC-1 Office-Commercial district as "designed to accommodate a mixture of office and commercial uses consisting of groupings of professional, research, executive, administrative, accounting, clerical, stenographic and similar uses." This district is designed and intended to act as a buffer as a transitional area between nonresidential and residential uses.
The OC-1 district limits commercial uses that are envisioned to prevent disruption to the surrounding existing residential neighborhoods and the rezoning will protect the surrounding residences from the more intensive uses that are currently allowed in the M-2 zoning district. Attached to this report are the permitted uses as described by the OC-1 zoning district and the M-2 zoning district.
It is staffs opinion that adjoining properties will benefit from the positive impact of the proposed rezoning. The proposed OC-1 district permits the greatest flexibility to the reuse of the property while complementing the existing commercial uses and protecting the surrounding residential zoning districts.
The Comprehensive Plan's Future Land Use (Figure 14-4) shows the surrounding area to be predominately residential with light industrial districts mainly to the east. The Comprehensive Plan also depicts the goal of the reuse of vacant or underutilized commercial and industrial structures in the core of the city.
In reviewing a rezoning proposal, Section 11 39.07 outlines the criteria on which to base decisions:
(A) Whether the change in classification would be consistent with the intent and purpose of this Zoning Code.
The proposed rezoning is consistent with the Zoning Code, specifically with sections 1131.02(e), and (r). These sections dictate the intent and purpose of the Zoning Code. Theses sections are listed below:
);> 1131 .02(e) "To separate incompatible land uses and to cluster compatible and mutually supportive land uses". );> 1131 .02(r) "To direct particular land uses to the parcels of land best suited for them ... "
The rezoning is consistent with the above listed intentions of the Zoning Code.

(B) Whether the proposed amendment is made necessary because of changed or changing conditions in the area affected, and, if so, the nature of such changed or changing conditions.
The application was not submitted based upon any changing conditions in the area.
(C) Whether the uses that would be permitted on the property if it were reclassified would be compatible with the uses permitted on other property in the immediate vicinity.

PUBLIC HEARING: Due to the straight forward nature of the rezoning request and the fact that City Council is required to hold a public hearing if the request proceeds on, staff does not feel that a public hearing before the Planning Commission is warranted.
RECOMMENDATION: Staff is recommending that the Planning Commission recommend approval of the rezoning from M-2, Light Industrial District to OC-1, Office Commercial District, based on the following:
o The area has similar "buffer" zoning to the south of the proposed zoning classification; and o The parcel meets the bulk requirements for an OC-1 zoned property and fits the proposed use well; and o The proposed rezoning is consistent with the intent and purposes of the City of Troy Zoning Code; and o The rezoning would create a more effective buffer to the residential zones adjacent to this location."
The owner was present. Mr. Force asked about the welding shop continuing to exist. Mr. Davis said it
would operate as a legal non-conforming use, with the two businesses in one building. Mr. Cole said the operator
of the welding shop is aware that the welding operation will be considered legal non-conforming.

ORDINANCE TO ACCEPT THE APPLICATION FOR THE ANNEXATION OF CERTAIN TERRITORY CONTAINING 1.243 ACRES. MORE OR LESS. IN CONCORD TOWNSHIP. IN THE CITY OF TROY. OHIO
WHEREAS, a petition for the annexation of certain property in Concord Township was
duly filed by the owners of the below-described property, and
WHEREAS, Council has previously adopted legislation regarding municipal services,
buffering requirements with this parcel, and consent, and
WHEREAS, the said petition was duly considered by the Board of County
Commissioners of Miami County, Ohio, on May 19, 2015; and
WHEREAS, the Board of County Commissioners of Miami County, Ohio has approved
the annexation of said territory to the City of Troy, as hereinafter described, and

petition was approved for annexation to the City of Troy by the Board of County Commissioners
of Miami County, Ohio on May 19, 2015, be and the same as hereby accepted. Said territory is
described in Exhibit A, attached hereto and made a part hereof. The certified transcript of the
proceedings for annexation with an accurate map of said territory, together with the petition for

We are providing the following for your information:
• Major Project Update: o Sidewalk Program 8 - work has restarted with the remainder of the
sidewalk marked for replacement. Quantities are being finalized in order to send letters to the property owners receiving new sidewalks through the City's contractor.
o Adams Street Phase 2 - bike path ramp construction has been installed and paving is complete. Adams Street has been overlaid and restriped. Site work is complete.
o Sewer Lining Project - Miller Pipeline has completed the relining in Southview and northeast of the river. Miller Pipeline is about 3
/4 complete with lining of manholes in conjunction with the sanitary sewer lining.
o ODOT Paving- resurfacing of North Market Street from Water Street to Staunton Road. Staff is reviewing Stage 3 documents. Project will begin construction in June 2016. The bridge will remain open but traffic will be modified with half of the bridge closed at a time.
o Curbside Recycling Program for FY 2015-2017 was awarded to Rumpke of Ohio, Inc. With this new new contract, the containers will be changed from bins to 65 gallon containers (with lids) on wheels. Rumpke will be using new vehicles that allow the driver to use an automated system to manipulate the equipment to empty the container without exiting the vehicle. Rumpke has ordered new fuel efficient and environmentally friendly Compressed Natural Gas (CNG) vehicles to use in Troy. However, due to the availability of these vehicles, Rumpke has advised the City that the vehicles are currently not expected to be available prior to early October. In the meantime, the contractor and the City will be developing educational materials regarding the new curbside collection procedures. As previously commented, there are a number of alleys where the recycling collection will need to be changed to street collection to accommodate the new collection vehicles. The educational materials will include information related to this change, as well as addressing the new containers. Samples of the new containers can be viewed in City Hall near the Billing and Collections Office, the entry area of the Engineering and Planning Office, and the Central Service and Maintenance Facility.

o McKaig Road Improvement Phase 2 - effective June 15, McKaig Avenue was closed to through traffic from Monroe Street to Madison Street for the construction of the McKaig Road Improvement Project Phase 2. This area will be closed until mid-November, 2015. Access for residents in the construction area is being maintained. Sanitary sewer laterals are being recorded for condition and location prior to other utility installation. Contractor has completed storm sewer replacement along Madison. The Facilities Encroachment Agreement to permit CSX to bore under the railroad crossing has been executed. The water main has been replaced between Grant Street and Monroe Street. Work to reconnect the residents will take place in the coming weeks.
o Marina Building - marina interior work continues with extensive electrical work. The HV AC ductwork is being placed in previously unused areas of the building. Two roof top HVAC units now being installed. Insulation and drywall work continue throughout the building. Ceiling grinds are now beginning to be placed in some of the rooms. A new front entry will begin to appear as the foundation work for this feature has begun. The construction of a dumpster area is also beginning on the south side of the building.
o Treasure Island Park - concrete work continues around the developing lighthouse plaza. The amphitheater and shelter house foundations are underway. The second step in the foundation process is the placement of re-bar, which is moving forward for both of the features. The bike path on the island is now being excavated and graveled with asphalt to be placed later. Earthwork continues throughout the site. The underground electrical work for the facilities and outdoor lighting is moving forward.
• As a reminder, City offices will be closed in observance of the Labor Day Holiday on September 7. Residential trash and recycling will be picked up on September 7. There will be no delay in these collections. The Dye Mill Road facility will also be open on September 7. The Troy City Council Meeting will be on Tuesday, September 8.
• Effective September 11, Captain Chris Anderson of the Troy Police Department will retire. Captain Anderson began his career with the City of Troy on September 10, 1984.
• The final two summer concerts by the Troy Civic Band on Prouty Plaza will take place on Monday, September 7 and Sunday, September 13 at 7:00p.m.
• Just a reminder, Trick or Treat night will be on Thursday, October 29, 2015, from 6-8 pm.

Operations Items of Interest September 4, 2015
Street - Including Solid Waste - Jerry Mullins, Foreman • Collected and transported 260 tons of residential trash since the last report of
260 tons. • Sign shop has completed its painting operations at night and is back on day
shift. • Asphalted 6 water services and 6 areas marked for repair including seam repair
on South Dorset Road from West Main Street to McKaig Avenue. • Dura-patched 27 areas marked for repair including several areas in Riversie
Cemetery. • Collected T-bags and brush. Several letters were sent out for non-compliant
brush piles. We continue to remind citizens that brush must be bundled or placed in T-bags in order for it to be collected by the City. We also are reminding citizens that the Dye Mill Road Facility is open, and we offer that facility in lieu of placing brush at the curb. We are also experiencing a large number of yard waste bags that are not City of Troy bags. Water Treatment Plant- Jeff Monee • For the month of August 2015, the WTP pumped a total of 115.044 million
gallons (MG) to our distribution system and customers in West Milton and parts of Miami County ( avg. 3. 711 M G /day). Total precipitation recorded at the WTP for Aug. was 2.72". Respective totals for August in previous years were:

• A total of 10, 103,343 gallons were pumped to the Extra High Service pressure zone in northwest Troy by the EHS Booster Station for August 1-31, for an average daily consumption in that zone of 0.3368 MG.
• An EnerNOC demand response performance audit was conducted on August 25. Participation in this program by the WTP yielded $5,561.24 in capacity payments to the City of Troy during the past 12 months.
• Operations Technician Jason Tron successfully completed his OEPA Bacteriological certification on August 23 and is now fully certified for all bacteria testing duties in the main plant lab.
• Contractor has resumed removal of lime residuals from the east sludge lagoon. City of Dayton officials agreed to the removal of an additional 1,500 dry tons to meet the maximum amount required under the Lime Agreement. Over 600 additional tons have been removed, and work should be completed within the next week.
• WTP maintenance staff has completed the pressure washing of Train 2 clarifiers. These clarifiers will have minor coating touch-up done in the next few weeks before being placed in service in October.
• New WTP Operator Mark Myers is continuing his training on plant systems and procedures. Mark will be working alongside shift operators for the next several weeks before assuming his position as the third shift operator.
Wastewater Treatment Plant - Tim Snider • Completed 2016 expense budget and entered it in Fin-Q. • Vendor completed annual infrared testing. • Vendor completed Arc Flash Survey update. • Final clarifiers #3 and #5 have been taken off line and cleaned. They are now
ready for the painting contractor to prep and paint. • Equalization basin # 1 has been cleaned and is ready for the contractor to
perform concrete repair inside the basin. • Contractors have been on site to install the water proof membrane on the tunnel
top and the acid proof membrane at the UV area. • Pressure transducer has been installed at the Staunton Road Storm Water Pump
Station. Programmable Logic Computer (PLC) programming is scheduled to be completed soon.
• Maintenance staff completed an oil change in the drive units at Madison Street Storm Water Pump Station. They also completed other annual maintenance requirements at this Pump Station.
• Annual inspection and maintenance continues on the primary clarifiers. The north clarifier is complete; we are still waiting for repair parts for the south primary. We should receive and install these within the next few weeks.
• The 350 Kva generator was taken to Madison Street storm water station for the annual testing of the generator and the transfer switch. This was also used as a training exercise for our newer employees.
• Maintenance staff replaced the battery and faulty battery charger on the generator at the Race Drive Storm Water Pump Station.
• Average Daily Effluent Flow for July was 6.61 MGD. • Average Daily Effluent Total Suspended Solids for July was 7.52 MG/L with
93. 5°/o removal efficiency. • Average Daily Effluent C-BOD5 for July 7.33 MG /L with 95.0°/o removal
efficiency.

contract. Contract has been awarded to Layne lnliners and Miller Pipeline. We will be notifying property owners as
2014-04 Southview & NE River Sewer Relining necessary for this project. Layne lnliners has completed the lining and site restoration. Retainage has been 2014-05 SW Interceptor Relining released to Layne and the project closed out. Miller Pipeline has completed relining in Southview and NE of the
river. Miller Pipeline is about 3/4 complete with lining manholes.
2013-14 Adams Street Phase 2 Project is complete. Council will be considering legislation to increase authorization for unforseen additional expenses including those related to recreation path issues.
Contract was awarded to Double Jay Construction. Final restoration and punch list items are being performed. Site
2013-02 Piqua-Troy IT roy-Urbana Intersection distance issues to the north are being reviewed. Additional slope easement is being obtained on the northeast corner of the intersection. Soil has been removed from the site and the site will get final restoration in the next month. Sanitary sewer was cleaned of installation debris and retainage has been released to the contractor.
ODOT will fund a portion of this project. LJ DeWeese Co., Inc. was awarded the project and a preconstruction
MIA- Troy East Main Street Downtown meeting took place to kickoff the project. A letter to the residents was sent to all affected property owners and
2015-01 tenants. In August construction began on the south side of the street. Contractor has removed sidewalk, installed Streetscape (PID 93240)
electrical conduit, and reinstalled the sidewalk and curb. The brick will be installed in the next week. After the south sidewalk is complete, the contractor will begin removing the north sidewalk.
Council approved the recommendation to enter into an agreement with MSA Architects for the design of this project.
2014-16 Hobart Arena Renovation and Design development is progressing and bid alternates are being analyzed. The construction documents phase is
Expansion coming to a close with several review meetings in the next month. At the September 8 meeting of Council, legislation will be considered to athorize bidding this project.
Inside the marina interior work continues with extensive electrical work. The HVAC ductwork is being placed in previously unused areas of the building and two roof top units are now being installed. Insulation and drywall work

is awarded to Finfrock Construction Company. CSX has provided approval for the J&B stormwater crossing. 2014-07 McKaig Road Improvements Phase 2 McKaig Road will be closed until mid-November for street reconstruction. Sanitary sewer laterals are being
recorded for condition and location prior to other utility installation. CSX Facilities Encroachment Agreement for boring under the railroad crossing has been executed. The water main has been replaced between Grant and Monroe Streets and work to reconnect the residents will take place in the coming weeks.
2014-12 Extra High Service (EHS) Water Tower A public meeting was held for the residents of the Extra High Service area and future area that would be served by this tower. Following the meeting, a site will be confirmed and design will proceed for bidding late 2015/early 2016.
Council has authorized a contract with RA Consultants. Staff has submitted all requested information for
2014-03 Water Regionalization Study evaluation, Workshop #2 was held, and the project will continue. Staff and the consultant met with West Milton to discuss details of their existing water system. The City has began to estimate hours for operations and administration necessities for West Milton and Miami County infrastructure.
Council has authorized a contract with RA Consultants, LLC. The City executed the signed agreements. RA
2015-05 Sewer Regionalization Study Consultants' staff is working through analysis/assumption revisions due to meeting with Miami County and the City. Consultant has discussed CIP, O&M and debt costs associated with the City rates. The City has began to estimate hours for operations and administration necessities for Miami County infrastructure.
2015-03 Washington Road Waterline Staff entered into an agreement with Choice One Engineering Company for the design of a water loop along Washington Road from West Main Street to West Stanfield Road. Design has begun.
Access Engineering, LLC has been authorized to design a gravity sewer from the Nottingham Subdivision to Piqua-2015-04 Nottingham Subdivision Sewer Gravity Troy Road at Troy-Urbana Road. Design is progressing. Easement requests are being coordinated with the
property owners. Preliminary layout has been reviewed and the design continues.
Troy Recreational Trail Resurfacing Council approved the ODOT LPA Agreement including accepting ODOT funding and to begin to acquire bike path

according to federal regulations. Resurfacing is scheduled to occur SFY 2020 (calendar year July 2019). The project will be Local-Let (i.e. implemented by City Staff) and will be funded 80/20 ODOT/Troy.

Council authorized bidding for the Phase 8 sidewalks where the property owner did not take out a permit to do the
2014-21 Sidewalk Program 8 work. Project was awarded to I. F. Weber. Work has restarted with the remainder of the sidewalk marked for replacement. Quantities are being finalized in order to send letters to the property owners receiving new sidewalks through the City's contractor. Council authorized a paving program in the amount of $1,068,000. That amount includes paving of City streets and
2015-14 Paving Program other City properties. The contract was awarded to the only bidder, John R. Jurgensen Co. Grinding work is estimated to begin the week of September 14. ODOT -Let and funded project. Staff is reviewing the Stage 3 documents which are approximately 90 percent
MIA- 55- 11.83 Bridge Redecking design. Project will begin construction in June 2016. The bridge will remain open but traffic will be modified with half North Market Street (PID 96435) of the bridge closed at a time. Resurfacing of North Market Street from Water Street to Staunton Road will be
completed as part of the redecking project. Staff has started working with Miami Valley Lighting (MVL) and MVCC to determine the best way to convert the
MV Lighting Street Light Contract -City's Mercury Vapor (MV) street lights to High Pressure Sodium (HPS) street lights as required by law. As a trial, LED street lights have been installed on Plum Street, Short Street, Adams Street, and along Shaftsbury Road at
Street Light Conversion Adams Street. Street light additions and possible excess lighting are being monitored in conjunction with the Police Department.
Staff has been working with an outside contractor to make the Engineering electronic files organized in such a way

Sensus Analytics Controlled Launch Since Analytics has been released full scale, Sensus offered the City a free implementation and a Controlled Launch (i.e. beta test) for two (2) months allowing the City input prior to the full scale release. A Kick-off meeting is scheduled for the end of September.

Edgewater Section 8 is awaiting final course of asphalt. 2015-07 Halifax Section 1 underground utilities installation and the initial course of asphalt have been installed. 2007-25 Hawk's Nest Section 2 awaiting final course of asphalt.
2015-06 Nottingham Section 7 final course of asphalt will be completed in the next month . Section 8 construction has intermediate course complete and housing development will begin in the next month.
2003-35 Villages of Concord (formerly Oakmont) Section 5 is awaiting final punch list and final course of asphalt. Due to the lack of construction progress in recent years, the City is investigating the potential of completing the subdivision via special assessment process.

8-20-15 dp On 8-19 I noticed approximately 8 cars in the parking lot of this vehicle service center with sales prices and vehicle disclosures on the glass . I visited with the manager of this location and he said they were there for service and the numbers were being applied so the cars could go to a Piqua location. I also received a call from another source to check the facebook page for this business as he is advertising these cars for sale at his location here in Troy. I stopped in today with copies of the facebook page and spoke with the manager and Alan Prather (the owner). I explained what could and could not be done at this location. I told him that under no circumstance should there be any vehicles on this lot that appears to be for sale. He got angry and said "I'll just call my lawyer". He later called my cell and apologiized and said he would remove the stickers while they are on his lot and only sticker his cars for sale at the location in Piqua. He then asked about other dealers he has contracts with if they would have to remove the stickers. I explained that if a car is in for service and not on the lot any more time required to repair or service, I could work with that on an each occurance basis . I will have to monitor this as I feel that Mr Prather is not being completely straight with me. 8-25-15 dp I received information that a barber had set up shop in this location. We have received no Occupancy Permit applications. This individual is Marlon Walker, he had set up the same business at 11 N walnut St earlier this year and I was notified by the landlord. He was serving food on Saturdays from the Walnut St location and I alerted the Miami County Health dept and I was also informed that Mr Walker was cutting hair with no State License, so I emailed them as well. I also found out that the lease and water for this location are in Denise Colemans name. I have no knowledge if she has a license or not and we believe this is a front for Mr Walker. I stopped in 8-20-15 and told Mr Walker that he must have the proper permits to operate a business in troy and left the forms with him. I gained information today tha t Mr Walker is now in jain in Miami county on warrants of Practicing as a barber with no license and a domestic charge in Piqua. I will send a violation letter to this location to both parties and send a copy to the property owner whom I also spoke with today regarding this issue. Follow up in 30 days and if no permits are applied for, I will request the Police go with me and we will close this establishment down. 8-25-15 sb Stopped and talked to Johnathan Miller, as he is Building a fence with no permit. I told him he needs a permit and fence can Not be higher than 6' 2". He wants parts of it 8' tall. 8-25-15 sb Miller in to talk to Tim. Going out today with Neil and Tim to take another look. 8-25-15 sb Met with Jill, Neil, Tim, myself. Decision was made to not allow Miller to mound up dirt to build the fence b/c of drainage issues. Unless his neighbor allows him to put fill on their property. If they don't, he has to go to BZA. 8-25-15 sb he applied for a permit. I am approving only the portion that will be 6' tall. He will need to re-apply for the other section of fencing once it is decided what he will do. He is to talk to his neighbors tonight and see if they will allow the fill. 8-27-15 sb Karen Smith, neighbor tel. 937-339-7549. Miller did not talk to them last night. She said that he installed the first section of fencing in the front and it is taller than 6' and the ugly side is facing out. Her husband told him last night he was doing it wrong and he replied by telling them, "this is the way I want it." I told Mrs. Smith her options, allow the fill and he can build the fence so it doesn't go above 6' or deny the fill and he has to go to BZA where she and the other neighbors who don't like the fence will have a say before the Board. She told me she was going to wait and see if Miller approaches them about the fill and then would let me know what they decide. I did tell her that if she decides to allow the fill, we will need something in writing from them. 8-27-15 sb Johnathan Miller asked that I stop by. I stopped by and he stated that he decided to just build the fence at 6' because it wasn't worth trying to talk to his neighbors anymore about putting fill in. He asked about putting in a shed and I told him the regulations. 8-31-15 sb Out again at the property with Neil. Told Mr. Miller no fill under the fence, which he already had put down. He said that he had always planned on putting fill under the fence even after he told me that he would just go 6' with the fence. I told him that was not what was explained to me when I was out. He told me he would go 6' because it wasn't worth fighting with the neighbors about the fill. He then said he told me on Friday when I was out that he wanted to put fill in his yard so he could build a shed. I told him that he never said anything to me about the fill in the yard for the shed. We told him that his excavator would need to provide us with a plan showing the drainage arrows for the fill, apply for a permit for the shed, and apply for a permit for the 2nd half of the fence since he has placed fill. We told him our concern all along was how would he keep the dirt off of his neighbors property. Before we left Neil and I both told him that he was to not work on the fence at all until he received a fence permit and we had seen the plan from the excavator.
