Identification No. 05 of 2012-2013 1. The Executive Engineer, RWS&S Division, Sundargarh on behalf of Governor of Orissa invites sealed tenders to be
eventually drawn up in Lump sum contract form for the construction of work detailed in the table from the contractors registered with the State Government and contractors of equivalent grade/class registered with Central Govt./MES/Railways for execution of civil works, on production of definite proof from the appropriate authority. 1. Dharuadihi under Sadar block 15.00 2. Bid documents consisting of specification, the schedule of quantities and the detail terms and condition of contract and
other necessary documents can be seen in all the offices issuing documents and office of the undersigned during office hours every day except on Sundays and public holidays till last date of sale and receipt of tender papers. Interested bidder may obtain further information at the said address.
3. Bids must be accompanied by security of the amount specified for the work in the table above which will have to be in
any one of the forms as specified in the bidding document i.e. N.S.C./ K.V.P./ Postal Saving Account/ Deposit receipt of scheduled bank/ Post Office Time Deposit Account duly pledged in favour of the Executive Engineer, RWS&S Division, Sundargarh. Bids must also be accompanied by attested xerox copy of valid VAT clearance certificate in Form 612, PAN card, Contractor’s license & experience certificate failing which the tender will be liable for rejection.
4. The sale of the bid documents closes on dt. 22.01. 2013 at 5.00 P.M. where the bids have been notified to be sold. The
receipt of the bid document is up to 5.00 PM on dt. 24.01.2013. 5. Bid document(s) for the above work can be downloaded from official website of Govt. of Orissa
(http://www.orissagov.nic.in) or may be purchased from office of the Assistant Engineer, RWS&S Sub-division mentioned against the work in the table under column no. 4 as well as the office of the undersigned against a non-refundable fee towards cost of the documents as indicated in column no. 6 in the form of cash or Demand Draft issued from any Scheduled Bank payable at Sundargarh in favour of Executive Engineer, RWS&S Division, Sundargarh prepared on or before the last date of receipt along with the bid. In case of downloaded tender, the bidder should have to furnish the cost of tender paper for Rs. 6,000/-(Rupees Six Thousand only) and 5% VAT for Rs.300/- (Rupees Three Hundred only) in shape of two separate Demand Drafts in a separate envelope marked “Cost of Tender Paper downloaded” in favour of Executive Engineer, RWS&S Division, Sundargarh. In case of downloaded tenders received with any addition, alteration and deletion, the approved tender document available with the Executive Engineer, RWS&S Division, Sundargarh is binding.
. 6. 1% of the bill amount will be deducted as labour cess from the each bills of successful tenderer. 7 .In case of Engineer Contractors seeking exemption of EMD are required to submit an affidavit in original to the effect that he has not yet availed the facility for more than two works during the current financial year. The name of work for which and the authority to which the tender is being submitted must be mentioned in the affidavit failing, which the tender will be rejected. Similarly ST/SC contractors seeking price preference will also have to produce an affidavit in original to this effect. ST/SC contractors having Degree/Diploma in Engineering are not allowed to avail both the benefits. 8.The bids will be opened on dt. 25.01.2013 at 3.00 P.M. in the office of the undersigned in the presence of bidders who wish to attend. If the office happens to be closed on the date of receipt of the bids as specified in the bids, it will be received and opened on the next working day at the same time and venue.

59.The tenderer while submitting tender shall furnish an affidavit in original from competent authority along with the tender about the authenticity of the tender documents.
10. The tender should be accompanied with an experience certificate in respect of experience in successful execution of
any RCC ESR or any RCC UGR and OGR of minimum 0.50 Lakh litre capacity during last five financial years issued by an officer not below the rank of Executive Engineer failing which the tender shall be rejected summarily.
11. Additional performance security shall be deposited by the successful bidder when the bid amount is seriously
unbalance i.e. less than the estimated cost by more than 10%. In such an event the successful bidder will deposit the additional performances security to the extent of the differential cost of the bid amount and 90% of the estimated cost in shape of Post Office Saving Bank Account/N S C/Post Office Time Deposit Account/K V P/Deposit receipt of any scheduled bank.

SECTION 06
INFORMATION AND INSTRUCTION TO TENDERS
1- Availability of Tender paper:-
Detailed tender call notice along with specification and plans shall be available for sale up to 5
PM dt 22.01.2013 of Rs. 6,000/- +5% VAT (Rupees six thousand and five percent VAT) only, which
is non-refundable in the office of the Executive Engineer, RWS&S Division, SUNDARGARH/ Office
of the Assistant Engineer, RWS&S Sub-Division, Rajgangpur. Tender paper will be issued to the
tenderer having experience certificate issued by an officer not below the rank of Executive Engineer to
the effect that the contractor must have successfully completed and commissioned as mentioned in the
tender call notice.
2- Submission of Tender:-
The detailed tender call notice (DTCN) is to be returned in original duly quoted with rates and
duly singed/ sealed in each page by the tenderers along with other papers, in sealed cover, so as to
reach in the office of the Executive Engineer, RWS&S Division, SUNDARGARH,/ Assistant
Engineer, RWSS Sub Division, Rajgangpur on or before 5.00 PM of dt 24.01.2013 . Any tender not
received within the stipulated time shall be liable for rejection. The tender papers can also be sent by
the contractors by Registered post/ speed post only observing all formalities as per rules. This office
will not be held responsible for late receipt of tender due to postal delay in such cases the tender will
not be considered.
3- Opening of the Tender:-
The tender shall be opened by the Executive Engineer, RWS&S Division, SUNDARGARH or
his authorized officers in his office chamber in presence of the tenderers or their authorized
representatives on dt 25.01.2013 at 3.00 PM. The tenderers or their authorized representatives may
witness the opening of the tenders.
4.-The tenders shall comprise the following documents:-
4.1- The detailed tender call notice issued by the Department in original duly signed and sealed in
each page. Xerox copy of VAT clearance certificate/ IT- PAN card.
4.2- The earnest money amounting to 1% (one percent) of the total tendered amount in the shape of
NSC/ Kissan Vikash Patra/ Post Office time deposit/ Post Office Accounts Pass Book/ Bank deposit

receipt (i.e. STDR) of schedule bank duly pledged in favour of the Executive Engineer, RWSS
Division, SUNDARGARH .
The interest bearing securities should be hold in the name of the Tenderer only and not in then
name of the individuals taking a company, if the tenderer is a company (The earnest money deposit of
the un-successful tenders shall be returned to them after decision of the tender on application). Any
tender without EM/ EM Less than 1% of the total tendered amount/ E.M. not pledged/ E.M. partly
pledged/ any request for adjustment of E.M.D. pending in this Division shall be liable for outright
rejection.
4.3- Attested copies of valid and up-to-date income Tax/ Pan Card and Vat clearance certificate/ TIN
No.& Sales Tax clearance certificate should be submitted along with tender papers failing which their
tenders will not be considered.
4.4-An outline drawing to a scale showing clearly all the components of the ESR in plan, section and
elevation indicating all the features of the ESR should be submitted along with tender papers. In case
of Non submission of clear out line drawing, the tender will be liable for rejection. Architecturally and
aesthetically more acceptable offer shall get preference over conventional types, provided it is
economical.
4.5- Detailed description on the scope of tender offered, indicating the Grade of concrete to be used,
type of materials to be used specifications to be followed during execution is to be furnished.
4.6-A break up schedule of payment on percentage basis of tendered amount, on finished portions of
work may be given in the prescribed performa enclosed in annexure-I duly signed.
4.7-A time schedule giving the programme of completion of the work in the prescribed proforma is to
be enclosed in Annexure-II.
4.8- Declaration by the tenderer in the prescribed proforma as in Annexure-IV is to be furnished.
4.9-A statement showing the list of similar works executed so far specifying the department/
organization for whom executed indicating the year of execution and a list of works in hand should be
furnished. Besides a list of the tools and plants possessed by the tenderer shall be given in
Annexure-VI.
5. The tender should quote lump sum rates (for the work ”DESIGN, DRAWING,
CONSTRUCTION, TESTING & COMMISSIONING OF 50,000 LTR. CAPACITY RCC
ELEVATED STORAGE RESERVOIR WITH 12 MTR. STAGING FOR PIPED WATER SUPPLY
SCHEME TO DHARUADIHI VILLAGE ”. In Annexure-VIII along with item wise rates in
Annexure-III in order to have proper evaluation of the tender and for deduction as may be necessary
for less items/ quantities executed than drawing and design approved by the competent authority. The

rates quoted shall include the soil testing, cost of design, drawing, construction, testing and
commissioning of the water retaining structure including supplying & fixing of puddle collar at
required level/ position. The rates shall also include the cost of all materials, puddle collar, labour,
T&P, royalties, taxes duties etc. Puddle collars should be confirmed to relevant IS specification. The
structural design shall be based on the use of HYSD Bars, Grade Fe-415.
6. In the event of acceptance of the tender for the entire work, the tenderer (hereinafter called the
contractor) shall enter in to an agreement with Government of Orissa, which shall be drawn up in PWD
lump sum form prescribed by the Government. The fair wage clause, letter of intent, the accepted
tender & the approved designs and drawings and specification will form part of the agreement as per
memorandum of tender documents vide Annexure-VII. For the purpose of payment for the items or
quantities beyond design and drawing approved by the competent authority shall be as per prevailing
schedule of rates.
7. Supply of materials:-
7.1 The contractor shall supply all materials, Tools and plants including cement and steel as per IS
specification/ approved samples to the extent of requirements to the entire work.
i) Cement to be used for the work should confirm to I.S.-269/1976 (REV)
ii) The steel to be used for RCC works should be tested and confirm to IS- 432 (Part-1)
1966 in case of mild steel and medium steel bars, IS- 1139-1966 in case of hot rolled deformed bars
and cold twisted bars and IS-226-1975 in case of Rolled steel made for structural steel.
7.2 The contractor has to make his own transport arrangement for conveyance of materials from
departmental stores to work site at his own cost for the materials available in the departmental store.
7.3 All taxes duties, fees, royalties, octroi transportation and any other charges required to be paid
or any materials or equipment brought to site for use in the construction work along with works tax
shall be borne by the contractor.
8. Sites:-
Suitable area close to the work site shall be provided, free of rent, for storage of materials.
Wherever possible the Department may make arrangement to supply water for construction purpose in
to the vat, which shall be constructed by the contractor at his own cost in such cases water rent shall be
charged by the Department at the rate as applicable. The Deptt. Shall however not be responsible for
delay or non-supply of water to the site where there is no water. Vat connection rates will be charged
as per prevailing rates as decided by the Engineer-in-charge. Otherwise the contractor has to make his
own arrangement for supply of water required for their construction. In case the contractor fails to pay
the water charges, the cost thereof shall be recovered from the bill of the contractor.

9. Electricity: - Neither electricity nor other kind of lighting arrangement shall be supplied by
the Department. The contractor will have to make his own arrangement at his own cost.
10. Payment:-
10.1 No advance payment shall be made on any account.
10.2 Running and final payments will be made as per the percentage break- up approved by
the accepting authority subject to availability of funds
10.3 The item rates approved by the accepting authority at Annexure-III shall be applicable
either for deduction on account of reduced quantity or extra payment on account of
excess work if done beyond final approved design, drawing and specification.
11. Deposits:-
After acceptance of the tender and on receipt of work order to take up the work, the tenderer
shall furnish the initial security deposit amounting to another one percent of the tendered amount in
addition to the one percent earnest money to be initially deposited along with the tender as referred in
clause-4.2. The earnest money (1%) submitted with the tender and initial security deposit (1%)
submitted before the commencement of work (i.e.) 2% of the agreement value) will form part of the
security for performance of the work.
11.1. In addition of the above 2%, further 5% shall be deducted from each running account bill
towards security deposit. It is left to the option of the tenderers to make an advance payment of this
five percent of the tendered amount towards security deposit. This may be deposited either in shape of
NSC/ KVP, Post office saving Pass Book Account/ Post Office time deposit account duly pledged in
favour of Executive Engineer, RWS&S Division, SUNDARGARH. Another 5% will be deducted from
each bills towards testing and commissioning.
11.2 All the earnest money and security deposit shall be refunded to the contractor after one year of
the successful testing and commissioning of the tank. Any defects detected during the execution of the
work or within twelve months after testing and commissioning the same should be rectified by the
contractor at his own cost.
11.3 1% of the bill amount will be deducted as labour cess from each bill.
12. Penalty:-
In the event of failure to complete the water tank within the contract period, penalty/
Compensation as envisaged under clauses of the conditions of the contract in F2 agreement shall be
applicable on the contract. If delay is caused due to department, the contractor shall be allowed a
reasonable period of extension of time on prior application and on submission of no claim certificate
by the contractor.

13. The contractor shall not sublet the whole or any part of the work.
14. The contractor shall bear the entire responsibility under Workman’s compensation act and
abide by the fair wage clause and contractor’s regulation incorporated in to the agreement.
15. That for the purpose of jurisdiction in the event of dispute, if any the contract would be deemed
to have been entered in to the District Head Quarters of the work site and it should be agreed that
neither party to the contract will be competent to bring a suit in regard to the matter covered by this
tender at any court of law outside the state of orissa.
16. Under no circumstances the interest is chargeable for the dues or additional dues, if any payable
to the contractor.
If any departmental materials supplied to the contractor are left unused and be
returnable to the Deptt. They should be returned forth, failing which five times the cost indicated will
be recovered from any payment which become due to the contractor.
17. The rates to be in figures and words: -
The tenderer shall quote his rate in English both in figures and in words for lump sum rate and
item rates. The rates quoted shall be inclusive of cost of all materials, labour, T&P and all taxes, duties,
royalties etc. as applicable.
18. Validity: -
Tender submitted by the tenderers shall remain valid for a period of 3 months (ninety days)
from the date of opening of tender.
19. Period of liability and Guarantee: -
The contractor shall be liable for a period of one year from the date of issue of the certificate of
completion of work by the Engineer-in-charge. This period shall be deemed as Guarantee period
during which the contractor shall be responsible for rectifying any defects that may develop in his
workmanship failing which the defects may be made good by the Department at the risk and cost of the
contractor and such cost will be adjusted against the security deposit or any amount to be payable to
the contractor.
20. Additional performance security shall be deposited by the successful bidder when the bid
amount is seriously unbalanced i.e. less than the estimated cost by more than 10%. In such in event
the successful bidder will be deposit the additional performance security to the extent of the
differential cost of the bid amount and 90% of the estimated cost in shape of saving Bank account/
National Saving Certificate/ Pot office Time deposit/ Kissan Vikash patra/ Deposit receipt of schedule

SECTION – 07
CONDITIONS OF CONTRACT
7.1 The party whose tender is accepted hereinafter called the contractor is to provide everything of
every sort and kind (with the exceptions noted in the schedule attached) which may be
necessary and requisite for the due and proper execution of the several works included in the
contractor according to the true intent and meaning of the drawings and specifications taken
together which are to be signed by the Executive Engineer, RWS&S Division,
SUNDARGARH here in after called the Executive Engineer and the contractor whether the
same may or may not be particularly described in the specification or shown on the drawing
provided that the same are reasonably an obviously to be inferred there from and in case of
any discrepancy between the drawing and the specifications the Executive Engineer is to
decided which shall be followed.
7.2 The contractor is to set out the whole of the works in conjunction with an officer to be deputed
by the Executive Engineer and during the progress of the works to amend on the requisition of
the Executive Engineer any errors which may arise there in and provide all the necessary labour
and materials for doing. The contractor is to provide all plants, labour and materials (with the
exception noted in schedule), which may be necessary and requisite for the works. All materials
and workmanship are to be the best of their respective kinds. The contractor is to leave the
works in all respects clean and perfect at the completion thereof.
7.3 The contractor shall not employ for the purpose of this contract any person who below the age
of twelve years, and shall pay to each labourer, for the work done by such labourer, fair wages.
Fair wages means wages whether for time or piece work. Prescribed by the state P.W.D.
provided that where higher rates have been prescribed under the minimum wages Act, 1948,
wages at such higher rates should constitute fair wages.
The Executive Engineer shall have the right to decide whether any labour employed by the
contractor is below the age of twelve years and to refuse to allow any labour whom he decided
to be below the age of twelve years, to be employed by the contractor.
7.4 Complete copies of the drawing and specifications signed by the Executive Engineer and the
same of copies thereof are to be kept with the works in-charge of the contractor’s agent which
is to be constantly kept on the ground by the contractor and to whom instructions can be given
by the Executive Engineer. The Contractor is not to sublet the works or any part thereof
without the permission of Executive Engineer.

7.5 The Executive Engineer is to have at all times access to the works, which are to be entirely
under his control. He may require the contractor to dismiss any person in the contractor’s
employ upon the works who may be incompetent or misconduct himself and the contractor is
forthwith to comply with such requirements.
7.6 The contractor is not to vary or deviate from the drawings or specifications or execute any extra
work of any kind whatsoever unless upon the authority of the Executive Engineer to be
sufficiently shown by any order in writing, by any plan or drawing expressly given and signed
by him as an extra or variation or by any subsequent written approval signed by him. In case of
daily labour all vouchers for the same are to be delivered to the Executive Engineer or the
officer-in-charge at least during the week following that in which the work may have been done
and no day work shall be allowed unless authorized by the Executive Engineer and no such
authority shall be given if the work is capable of being measured and being paid for at an
agreed rate. The drawing in respect of which this contract is drawn up provide for a minimum
depth of foundation for good soil as specified in the plans. Any extra depth will be paid for in
addition to the sum contract for the completed work.
7.7 Any authority given by the Executive Engineer for any alterations or addition in or to the work
is not to vitiate contract but all additions omissions or variations made in carrying out the works
are to be measured and valued and certified by the Executive Engineer and added to or
deducted from the amount of the contract as the case may be at rates in accordance with the
sanctioned schedule of rates in force at the time when the particular item of work was
commenced. In those cases in which rates do not exist, the Executive Engineer will fix the rates
& will be approved by the Superintending Engineer before payment and the decision shall be
final.
7.8 All works and materials brought and left at site by the contractor or by his orders for the
purpose of forming part of the works are to be considered to be the property of the Governor of
Orissa and the same are not to be removed or taken away by the contractor or any other person
without the special permission in writing of the Executive Engineer but the Governor of Orissa
will not be liable for any loss or damage which may happen to or in respect of any such work or
materials either by the same being lost or stolen or injured by weather or otherwise.
7.9 The Executive Engineer has full power to require the removal from the premises of all
materials which, in his opinion, are not in accordance with the specification and in case of
default, the Executive Engineer is to be at liberty to sell such materials and to employ other
persons to remove the same without being answerable or accountable for any loss or damaged

that may happen or arise to such materials. The Executive Engineer is also to have full power to
require other proper materials to be substituted and in case of default, the Executive Engineer
may cause the same to be supplied and all costs which may attend such removal and
substitution are to be borne by the contractor and may be recovered from the sale proceeds of
such rejected materials when necessary, the balance, if any being kept in deposit in the
contractor’s materials when necessary, the balance , if any, being kept in deposit in the
contractor’s favour.
7.10 If in the opinion of the Executive Engineer any of the works have been executed with improper
materials or defective workmanship, the contractor is then required by the Executive Engineer
forthwith to re-execute the same and to substitute proper materials and workmanship and in
case of default of the contractor in so doing within a week, the Executive Engineer is to have
full power to employ other to re-execute the work and the cost thereof shall be borne by the
contractor.
7.11 Any defects, shrinkage or other faults which may appear within 12 months from the completion
of the work arising out of defective or improper materials or workmanship are upon the
direction of the Executive Engineer to be amended and made good by the contractor at his own
cost unless the Executive Engineer for reasons to be recorded in writing shall decide that they
ought to be paid for and in case of default, the Governor of Orissa may recover from the
contractor the cost of making good the works.
7.12 From the commencement of the works to the completion of the same they are to be under the
contractors charge. The contractor is to be held responsible for and to make good and injuries,
damages and repairs occasioned or rendered necessary to the same by fire or other causes and
they are to hold the Governor of Orissa harmless from any claims for injuries to persons or for
structural damage to property happening from any neglect, default, want of proper care or
misconduct on the part of the contractor or of may one of his employees during the execution
of the works.
7.13 The Executive Engineer is to have full powers to send workmen upon the premises to execute
fittings and other works not included in the contract for whose operating the contractor is to
afford every reasonable facility during ordinary working hours provided that such operations
shall be carried on in such a manner as not to impede the progress of the work included in the
contract but the contractor is not to be responsible for any damage which may happen to or be
occasioned by any such fittings or other works.

7.14 The contractor is to commence work comprised in this tender immediately on receipt of orders
to commence from the Executive Engineer. The whole work, including all such additions and
variations as aforesaid (but excluding such, if any as may have been postponed by an order
from the Executive Engineer), shall be complete in every respect within 11 (eleven) calendar
months from the date of the aforesaid orders to commence and if from any cause whatever
other than willful obstruction or default on the part of the Executive Engineer or his staff and
except as hereinafter provided, the whole of such work shall not be finished to the satisfaction
of the Executive Engineer within the said period, the contractor shall forfeit and pay to
Governor of Orissa by way of ascertained and liquidated damages for each default and not by
way of penalty 0.5% (zero point five percent) of the estimated cost of the work, interim delay
not subject to scrutiny, per day for every complete day of such default and the amount of such
damage, if any, may be deducted by way of set-off from any unpaid portion of the amount
due under the contractor or otherwise recovered from the contractor and shall be brought in to
account by the Executive Engineer when settling the contractor’s accounts for his final
certificate hereinafter provided for. And further, to ensure progress during the execution of the
works, the contractor shall be bound in all cases in which the time allowed for any works
exceeds one months, to complete one-forth of the whole of the works before one forth of the
whole time allowed under the contract has elapsed, one half of the works, before one-half of the
whole time has elapsed and three-forth of the works, before three-forth of such time has
elapsed. In the event of the contractor failing to comply with this condition he shall be liable to
pay the damages of as aforesaid of 0.5% (zero point five percent) per week of the under
completed portion of the work subject to a maximum of 10% (ten percent) of the uncompleted
work, interim delay not subject to scrutiny, per day for every complete day of such default and
amount of such damages may be deducted in the way as stated above. Provided nevertheless
thus if in the opinion of the Executive Engineer that the contractor is entitled to any extension
of time on account of the works being altered, varied or added to or on account of any delay
by reason of any inclement weather or causes not under the control of the contractor it shall be
competent for the Executive Engineer by an order in writing to extend the aforesaid period or
periods for final completion of the whole work or of portions of the work as aforesaid by such
period or periods as he shall deem reasonable and the contractor is to complete the works
within such extended period or periods as aforesaid provided that the contractor shall not be
entitled to any extension of time unless he shall within thirty days after the happening of the
event in respect of which shall consider himself entitled to any extension, give to the Executive

Engineer, written notice of such claim to extension of time and of the ground or grounds and of
the amount there of unless in any case the Executive Engineer shall in his discretion dispense
with such notice and certify for an extension of time. Nevertheless and in case of any
extension of time, the aforesaid provisions and amount for damages in default of due
completion shall apply in case of non-completion of the works within the extended time.
Provided that Contractor shall not be entitled to any extension of time in respect of the extra
work involve in the extra depth of foundation mention in the paragraph 7.6.
7.15 If the contractor shall become bankrupt or compound with or make any assignment for the
benefit of his creditors or shall suspend or delay the performance of his part of the contract
(except on account of cause mentioned in Clause 7-14 or in consequence of not having proper
instructions for which the contractor shall have duly applied) the Executive Engineer may give
to the contractor or his assignee or trustee as the case may be notice requiring the works to be
proceeded with an in case of default on the part of the contractor for a period of seven days, it
shall be lawful for the Executive Engineer to rescind the contract, if necessary, and to enter
upon and take possession authorize him or them to use the plant, materials and property of the
contractor upon the works and the costs and the charge incurred in any way in carrying on and
completing the said works are to be paid to the Executive Engineer by the contractor or may
be set off by the Executive Engineer against any money due to become due to contractor. If
the assignee or trustee of the Contractor proceeds with the work, the conditions of this contract
shall be binding upon the said assignee or trustee.
7.16 A certificate of the Executive Engineer or an award of the referee hereinafter referred to as the
case may be showing the final balance due to payable to the contractor is to be conclusive
evidence of the works having been duly completed and that the contractor is entitled to receive
payment of the final balance, but without prejudice to the liability of the contractor under the
provisions of clause- 7-11.
7.17 Price Escalation Clause:
(a) “If during the progress of the work the price of any materials incorporated in the work
(not being materials supplied from the Engineer-in-charge’s stores in accordance with the
clauses thereof) increase or decrease as a result of increase or decrease in the Average
wholesale Price Index all commodities), and the Contractor thereupon necessarily and properly
pay in respect of that materials (incorporated in the works) such increased or decreased price,
then he shall be entitled to reimbursement or liable to refund, quarterly, as the case may be
such an amount, as shall be equivalent to the plus or minus difference of 75% in between the

Average Wholesale Price Index (all commodities) which is operating for the quarter under
consideration and that operated for the quarter in which the tender was opened, as per the
formula indicated below, provided that the work has been carried out within the stipulated
time or extension thereof as are not attributable to him.

Wages” which is operating for the quarter under consideration and that operated for the quarter
in which the tender was opened, as per the formula indicated below, provided that the work has
been carried out within the stipulated time or extension, thereof as are attributable to him.

(c) Similarly, if during the progress of work, the price of petrol, oil & Lubricants (Diesel oil being the representative item for price adjustment) increase or decrease as a result of the price fixed therefore by the Government of India and the contractor there upon necessarily and properly pays such increased or decreased price towards petrol, oil and lubricants used for execution of the work, then he shall be entitled to reimbursement or liable to refund, quarterly, as case may be such an amount, as shall be equivalent to the plus or minus difference in between the price of POL which is operating for the quarter under consideration and that operated for the quarter in which the tender was opened as per the formula indicated below, provided that the work has been carried out within the stipulated time or extension there of as are not attributable to him. (e) Admissibility of price escalation
Reimbursement/ Refund on variation in price of materials, labour and POL as per sub clause
(a), (b) and (c) of this clause shall be applicable only in respect of contract of one year or more
provided that the work has been carried out within the stipulated time or extension thereof as are not
attributable to contractor. However, where the original contractual period becomes one year but
subsequently it has been validly extended and the period becomes one year, or more, escalation clause
shall be applicable only for the balance portion of work to be executed beyond one year provided the
delay is not attributable to the contractor.
(f) The contractor shall for the purpose of this condition keep such books of account and other
documents as are necessary to show that the amount of increase claimed or reduction available and
shall allow inspection of the same by a duly authorized representative of the Government and further,
shall at the request of the Engineer-in-charge furnish, verified in such a manner as the Engineer-in-
charge may required any document kept and such other information as the Engineer-in-charge may
require.
The contractor shall within a reasonable time of his becoming aware of any alteration in the
price of such material and / or wages of labour give notice thereof to the Engineer-in-charge stating
that the same is given pursuant to this condition together with an information relating thereto which he
may be in a position to supply.
7.18 If at any time after the commencement of the work the Governor of Orissa shall for any reason
whatsoever not require the whole thereof as specified in the tender to be carried out the
Engineer-in-charge shall give notice in writing of the fact to the contractor who shall have no
claim to any payment or compensation whatsoever an account of any profit or advantage,
which he might have derived from the execution of the work in full but which he did not
derive in consequence of the full amount of the work not having been carried out, neither shall
he have any claim for compensation by reason of any alterations having been made in the
original specification, drawings, designs and instruction which shall involve any curtailment or
increase of the work as originally contemplated.

SECTION – 8
SPECIAL INCONDITIONS OF CONTRACT
8.1 Changes in Constitution of Firm:-
In the case of tender by a partnership firm, any change in the constitution of the firm shall be forth with
notified by the contractor to the Executive Engineer/ Superintending Engineer for his information. In
case of failure to notify the change in the constitution within 15 days, the Executive Engineer/
Superintending Engineer may be notice in writing, rescind the contract and the security deposit of the
contractor shall thereupon stand forfeited and be absolutely at the disposal of the Governor of Orissa
and the same consequence shall ensure as if the contract had been rescinded thereof and in addition
the contractor shall not be entitled to recover or be paid for any work there for actually performed
under the contract.
8.2 Action where no Specification is Mentioned:
In the case of any class of items of works, for which no specification is mentioned such work
(s) shall be carried out in accordance with the detailed standard specifications of Orissa as
followed by the state PWD/ PHD and in the event of there being no specification, in such case
the said item of work shall be carried out in all respects in accordance with the instructions and
requirement of the Engineer-in-charge.
8.3 Workmen Compensation Act VIII of 1923
The Governor of Orissa shall be entitle to recover in full from contractor any amount that the
Governor or Orissa may be liable to pay under Workman’s compensation Act-VIII of 1923 to
any workman employed in course of execution of any part of the work covered by this contract.
8.4 Jurisdiction in the Event of Dispute:
That for the purpose of jurisdiction in the event of dispute if any, the contract should be deemed
to have been entered in to within the State of Orissa and it is agreed that neither party to this
agreement will be competent to bring a suit in regard to the matters covered by this contract at
any place outside Orissa.
8.5 Lighting & Sanitary Arrangement:
The Contractor at his own cost for his labour camp will make lighting & Sanitary arrangement
and supply of drinking water.

8.6 Payment of Duties, Levies & Taxes:
The Contractor shall bear all taxes including duties, levies, Central and State Sales Tax
including work contract tax entry tax, Income tax, royalties, fair weather charges, and tollages
where necessary & Governor of Orissa shall not entertain any claim whatsoever in this respect.
Statutory deduction of taxes as applicable shall be done from each running bill.
8.7 Site Clearance:
After the work is finished or completed, surplus materials and debris are to be removed by
Contractor at his own cost and preliminary works such as vats, mixing platforms level pillars,
temporary sheds and godowns etc. are to be dismantled and all such materials removed from
site. The site involved in the construction activities should be cleared and dressed properly with
outward slope away form the structure.
8.8. Works to be carried out
The work to be carried out under the contract shall include all materials, labour, tools and
plants, equipment and transport which may be required in preparation of and for in the full and
entire execution and completion of the works. The description given in the schedule of
quantities/ scope of work shall, unless otherwise stated, be held to include wastage on
materials, carriage & cartage, carrying and return of empties, hoisting, setting, fitting and fixing
in position and all other labours necessary in and for the full and entire execution and
completion of the work as aforesaid in accordance with good practice and/ recognized
principles.
8.9 Sufficiency of Tender:-
The contractor shall be deemed to have satisfied himself before tendering as to the correctness
and sufficiency of the tender for the works and of the rates and prices quoted in the schedule of
quantities (DTCN) Part-II price bid), which rates and prices shall, except as otherwise provided, cover
all his obligations under the contract and all matters and things necessary for the proper completion
and commissioning of the works.
8.10 Rates:-
The tenderer shall quote their offer on “Lump Sum” basis for the complete work in all respect
on “Turnkey Basis”. The offer shall be inclusive of cost of all materials, labour, T&P inclusive
of all duties, levels, taxes of Central and State Government including Works Contract tax with
surcharge, entry tax, tollages, royalties, packing and forwarding, transportation, insurance,
loading & unloading, storage, watch and ward delivery of the materials to the site etc. and all

other expenses incidental thereto for successful completion testing & commissioning of the
work.
8.11 Transportation:-
The contractor shall be responsible for the transportation of all materials, tools and plant,
equipment and machinery to the work site as may be required at site.
8.12 Contractor shall be responsible for safe custody of the materials at site and the Governor of
Orissa will not be responsible for any loss or damage of the property at site.
8.13 Construction Schedule:-
The contractor shall submit a detailed work schedule in the form of Bar Chart along with his
tender indicating the detailed break-up of the job. This will include all operations from
procurement of materials to final testing at site to be indicated in detailed with reference to the
time period of each.
The construction schedule as submitted by the contractor shall be revised by the Executive
Engineer and approved with necessary modification if any after acceptance of the tender. The
contractor shall furnish 6 copies of approved schedule within a time to be intimated to him
before drawal of the agreement. The approved Bar chart shall form a part of the agreement.
This approval schedule shall be binding on the contractor.
In addition the contractor shall submit PERT Chart in commensurate with the approved Bar
chart within one month of signing of the agreement. The PERT chart on approval by the
Executive Engineer shall be used to monitor the various project activities at micro level.
8.14 Security Deposit:-
The tenderer whose tender is selected for acceptance shall make an security deposit of 2% (two
percent ) of the accepted tender amount together with the earnest money deposited with the
tender which forms the initial security deposits (ISD) within 7 (seven) days of issue of letter of
intent after depositing the balance ISD. The ISD shall be deposited in shape of NSC/ POTD/
Post office saving bank account/ KVP duly pledged in favour of the Executive Engineer,
RWS&S Division, SUNDARGARH . No tender shall be accepted unless required amount of
security money is deposited.
In addition to the ISD, 5% of the bill amount shall be deducted from each bill towards the
security deposit. The earnest money deposit, the initial security deposit before the after
acceptance of tender together with the subsequent deduction from the contractor,s bill shall
form part of the security deposit equivalent to 7% of the contract value for the due fulfillment
of the contract. It is left to the option of the tenderer to make and advance payment of this

security in shape of NSC/ POSBA/ Post office time deposit/ KVP/ Bank fixed deposit duly
pledged in favour of Executive Engineer.
The security deposit is refundable after one year from the date of satisfactory completion of the
work provided that the contractor final bill has been paid. If however there is inevitable delay
in payment of final bill the earnest money deposit and initial security deposit and security
deposit forming part of the security deposit may be refunded on orders of competent authority.
8.15 Monitoring of the Project:
Time is the essence of the contract. The execution of the project shall be closely monitored to
ensure that quality; cost & time of the project are not compromised in any manner. The
contractor shall submit monthly progress reports in a format as may be prescribed by the
Engineer-in-charge. The monthly progress report shall be evaluated by Executive Engineer vis-
à-vis the approved bar chart & PERT chart and deficiency observed thereof shall be
communicated to the contractor. The contractor shall have to make up the deficiencies with in
the specific time period communicate to him by the Executive Engineer failing, which the
contractor shall be liable action as per clause-8.25.
8.16 Site Order Book:
A site Order Book shall be issued to the contractor by the Engineer-in-charge or his
representative. The contractor shall keep this Book always at site and any special order of
instruction to be issued to the contractor shall be recorded in this Book by the Engineer-in-
charge or his representative. The contractor shall sign all orders and instructions as token of his
knowledge about the same. The site order book shall be the property of the department but will
remain during the period of the progress of the work with the contactor. The safe custody of
the site order book during this period shall be the responsibility of the contractor. After
completion of the work, the book shall be returned back by the contractor to the Engineer-in-
charge, which will be enclosed in the final bill.
8.17 Guarantee:
The contractor shall furnish a guarantee to the effect that all items of the work constructed and
supplied by him shall be free from any defect both in terms materials and workmanship for
period of not less than 12 months from the date of commissioning of the work conforming to
provisions in scope of work covered under section-12. During this period, the contractor shall
replace the defective materials any or rectify the defects if any at his own cost as pointed out by
the Engineer-in-charge to the satisfaction of the later.

8.18 Land
The Department may provide at its discretion a piece of land as may be required by the
contractor at free of cost, for a period as may be deemed necessary by the Department towards
construction of temporary office, workshop & store etc. of the contractor to be used solely for
the purpose of this work. The contractor at his own cost as may be necessary shall do leveling
of the ground as well as temporary roads etc. The temporary structures shall be constructed by
the contractor as per plan to be furnished by the contractor and approved by the Engineer-in-
charge. The land shall be handed over to the contractor after issue of the work order and the
same shall be handed over back to the Department in good condition after the work is
complete, the payment of the final bills for these works shall not be made until the contractor
has handed over the land make available to him free from all encumbrances.
8.19 Unilateral stoppage of work:-
Unilateral stoppage of work by the contractor without prior written permission of the Engineer-
in-charge shall be considered as breach of contract and the Governor of Orissa reserves the
right to take such actions as it may be deemed fit.
8.20 Resident Engineer:-
The contractor shall engage for this work competent, qualified and authorized resident
Engineers and Assistants to the satisfaction of the Engineer-in-charge. The Resident Engineer
shall represent the contractor in his absence in receiving directions from officers of the
Department, which will be binding on the contractor.
8.21 Force Majeure:-
Neither the contractor nor the Executive Engineer shall be considered in default in delay
performance of its obligation if such performance is prevented or delayed because of work to
hostilities, revolution, civil commotion, epidemic, accident, fire, cyclone, flood, earthquake or
because of any law and order proclamation regulations or ordinance of the Government thereof
or because of any act of God or for any cause beyond reasonable control of the party effected.
Should one or both the parties be prevented from fulfilling their contractual obligations a state
of force majeure lasting continuously for a period of 6 months, the two parties shall consult
each other regarding the future execution of the contract for mutual settlement.
8.22 Damages to persons and property: -
The contractor shall take every precaution not to damage or injure adjoining or other property
of any persons. He shall indemnify and keep indemnified the employee against all claims for
injuries or damages to any person or any such property (including surface or land or crops in

site) which may arise out of or in consequence of any negligence or default on the
representatives and against all claims, demands proceedings damages costs, charges and
expenses whatsoever in respect of or in relation thereto. The Department does not take any
responsibility on this account.
8.23 Attention to Urgent works:-
If any urgent work in the opinion of Engineer-in-charge becomes necessary to be executed and
the contractor is unable and unwilling at once to carry out, the Engineer-in-charge may by his
own or through other agency carry it out, as he may consider necessary. All expenses incurred
on it shall be recoverable from the contractor or be adjusted against any sum payable to him.
8.24 Safety Devices:-
i) Scaffolding: Suitable scaffolding shall be provided for workmen for all works that can not be safely
done from the ground or solid construction except such short period of work as can be done safely
from the ladders. When a ladder is used an extra labour shall be engaged for holding the ladder and if
the ladder is used in carrying the materials, suitable foot holds and handholds shall be provided on the
ladder.
The Engineer-in-charge will have the right to inspect the scaffolding and centering etc. for the
work and can reject partly or fully such structure if found defective in his opinion.
ii) Working platforms: - Working platform gangways and stairways shall be constructed such
that they do not sag unduly or unequally. If the height of the platforms or gangway or stairway is
more than 3.25 meters above the ground or floor level, it shall be closely guarded, have adequate width
and suitably fenced.
iii) Safe means of access: Safe means of access shall be provided to all working platform and
other working places.
iv) Precaution against electrical equipment: Adequate precaution shall be taken to prevent
danger from electrical equipment. Hand lamps shall be provided with Mesh guard, wherever required.
v) Preventing public from accident: No materials on any of the sites shall be so stacked or
placed as to cause danger or inconvenience to any person or public. The contractor shall provide all
necessary fencing and light to protect the public from accident and shall be bound to bear expenses of
defense or any suit action or other proceedings at law that may be brought by any persons for injury
sustained owing to neglect of the above precaution and to pay any damages and cost which may be
awarded in any such suit action or proceedings to any such person or which may with the consent of
the contractor, be paid to compromise any claim by any such person.

vi) Demolition: Before any demolition work is commenced and also during process of work (a) all
roads and open areas adjacent to the work site shall either be closed or suitably protected, (b) no
electric cable or apparatus which is liable to be a source of danger shall remain electrically charged (c)
all practical steps shall be taken to prevent danger to persons employed from the risk of fire, explosion
or flooding (d) no floor roof or other parts of the building shall be so over loaded with debris or
materials as may render it unsafe.
vii) Personal safety equipment: all personal safety equipment shall be made adequately available
by the contractor for use of persons employed at the site of work and maintained in a condition
suitable for immediate use. The contractor shall take adequate steps to ensure proper use of the
equipment by persons concerned.
viii) Precaution against fire: Suitable fire extinguishers, water and sand buckets shall be provided
at the work site to tackle situations of fire.
8.25 Rescission of Contract:
Subject to other provisions contained in this clause the Executive Engineer of the Department
may without prejudice to his any other rights or remedy against thee contractor in respect of
any delay, inferior workmanship, any claims for damages and / or any other provisions of this
contract or otherwise, and whether the date of completion has or has not elapsed, recommended
the accepting authority to rescind the contract in any of the following case.
i) If the contractor having been given by the Executive Engineer a notice in writing to rectify,
reconstruct or replace any defective work or that the work is being performed in an inefficient or
otherwise improper or un-workmen like manner shall omit to comply with the requirement of such
notice for a period of seven days thereafter.
ii) If the contractor being a company shall pass a resolution on the court shall make an order that
the company shall be wound up or if a receiver or a manager on behalf of a creditor shall be appointed
or if circumstances shall arise which entitle the court or the creditor to appoint a receiver or a manage
or which entitle to court to make a winding up order.
iii) If the contractor has, without reasonable cause, suspended the progress of the work with due
diligence so that in the opinion of the Executive Engineer (which shall be final & minding) he will be
unable to secure completion of the work by the date of completion and continues to do so after a notice
in writing of seven days from the Executive Engineer.
iv) If the contractor fails to comply with the provisions of clause- 8.15 & other relevant clauses
mentioned elsewhere in this DTCN.

v) If the contractor fails to complete the work within the stipulated date or items of the work with
individual date of completion, if any stipulated, on, before such date(s) of completion and does not
complete them within the period specified in a notice given in writing in that behalf by the Executive
Engineer.
When the contractor has made himself liable for action under any of the case aforesaid, the
accepting authority (Executive Engineer) shall have the powers.
(a) To rescind the contract as aforesaid (of which rescission notice in writing to the contractor
under the hand of the Executive Engineer shall be conclusive evidence). Upon such rescission the full
security deposit recoverable under the contract shall be liable to be forfeited & shall be absolutely at
the disposal of the Governor of Orissa. If any portion of the security deposit has not been paid or
received it would be called for and forfeited.
b) After given notice to the contractor to measure up the work of the contractor or to take such
whole, or the balance or part thereof as shall be un-executed out of his hands and to give it to another
contractor to complete in which case any expenses which may be incurred in excess of the sum which
would have been paid to the original contractor if the whole work had been executed by his ( of the
amount of which excess the certificate in writing of Executive Engineer shall be final & conclusive)
shall be borne and paid by the original contractor and may be deducted from any money due to him by
Governor of Orissa under this contract or on any other account whatsoever or from his security
deposit or the proceeds of sales thereof or a sufficient part thereof as the case may be. If the expenses
incurred by Department are less than the amount payable to the contractor at his agreement rates, the
difference shall not be paid to the contractor. In the event of any one or more of the above courses
being adopted by the Executive Engineer, the contractor shall have no claim to compensation for any
loss sustained by him by reasons of his having purchases or procured any materials or entered into any
engagements or made any materials or entered into any engagements or made any advances on
account or with a view to the execution of the work or the performance of the contract. And in case
action is taken under any of the provision aforesaid the contractor shall not be entitled to recover or be
paid any sum for any work thereof or actually performed under this contract unless & until the
Executive Engineer has certified in writing the performance of such work & the value payable in
respect thereof and he shall only be entitled to be paid the value so certified.
Provided further that if any of the recoveries to be made while taking action as per (b) above, are in
excess of the security deposit forfeited, these shall be limited to the amount by-which the excess cost
incurred by the Department exceeds the security deposit so forfeited.

26. Conditions for Reimbursement of Levy/ Taxes of Levied after Receipt of Tender.
i) All tendered rates shall be inclusive of all taxes and Levis payable under respect status.
However , pursuant to the constitution (46th Amendment) Act, 1982, if any further tax or levy is
imposed by Statute, after the last stipulated date for the receipt of tender including extensions if any
and the contractor thereupon necessarily and properly pays such taxes/ levies the contractor shall be
reimbursed the amount so paid provided such payments, if any, is not in the opinion of the Chief
Engineer, RWSS, Orissa whose decision shall be final and binding on the contractor) attributable to
delay in execution of work within the control of the contractor.
ii) The contractor shall keep necessary books of accounts and other documents for the purpose of
this condition as may be necessary and shall allow inspection of the same by a duly authorized
representative of the Department and / or the Engineer-in-charge and further shall furnish such other
information/ document as the Engineer-in-charge may require from time to time.
iii) The contractor shall, within a period of 30 days of the imposition of any such further tax of
levy, pursuant to the constitution (Forty sixth amendment) Act, 1982, give a written notice thereof to
the Engineer-in-charge that the same is given pursuant to this condition, together with all necessary
information relating thereto.
8.27 Fair wages clause:-
Clause 34 (a) The contractor shall not employ for the purpose of this contract any person who
is below the age of twelve years and shall pay to each labour for work done by such labourers
fair wages.
Explanation – “Fair Wage” means wages, whether for time or piece work prescribed by the
State Public Works Department provided that where higher rates have been prescribed under
the minimum wages Act 1948 wages at such higher rates should constitute fair wages.
The Executive Engineer shall have the right to enquire into an decide any compliant alleging
that the wages paid by the contractor. To any labourer for the work done by such labourer for
the work done by such labourer is less than the wages as per sub-paragraph-I above.
(b) The contractor shall, not withstanding the provisions of any contract to contrary, cause
to be paid a fair wage to labourers indirectly engaged on the work including any labour
engaged by his sub-contractors in connection with the said work, as if he had immediately
employed the labourers.
(c) In respect of all labour directly or indirectly employed in the works for the performance
of the contractor’s part of this agreement, the contractor shall comply with or cause to be

complied with all regulations made by Government in regard to payment of wages, wage
period deductions from wages, recovery of wages not paid and deductions unauthorized made,
maintenance of wage register, wage cards, publication of scale of wages and other terms of
employment, inspection and submission of periodical returns and all other matters of like
nature.
(d) The Executive Engineer or Sub-Divisional Officer concerned shall have the right to
deduct, from the money due to the contractor, any such required or estimated to be required for
making good the loss suffered by a worker or workers by reason of non-fulfillment of the
conditions of the contract for the benefit of the workers non-payment of wages or of deductions
made from his or their wages, which are not justified by their terms of the contract or non-
observance of the regulations. Money so deducted should be transferred to the workers
concerned.
(e) Vis-à-vis, the Government of Orissa, the contractor shall be primarily liable for all
payments to be made under and for the observance of the regulations aforesaid without
prejudice to his right to claim indemnity from his sub-contractor.
(f) The regulations aforesaid shall be deemed to be a part of this contract and any breach
thereof shall be breach of this contract.
Orissa PWD/ Electricity Department Contractor’s Labour Regulations:-
1.Short title- These regulations may be called “The Orissa Public Works Department/ Electricity
Department Contractor’s Regulations”.
2. Definitions- In these Regulations, unless otherwise expressed or indicated the following works and
expressions shall have the meaning here by assigned to them respectively, that is to say-
(1)”Labour” means workers employed by a contractor of the Orissa Public Works Department/
Electricity Department directly or indirectly through a sub-contractor or other person, or by an agent
on his behalf.
(2) “Fair wages” means wages whether for time or piece work prescribed by the State Public Works
Department provided that where higher rates have been prescribed under the minimum wages Act,
1948 wages at such higher rates should constitute fair wages.
(3) “Contractor” shall include every person whether a sub-contractor for headman or agent
employing labour on the work taken on contract.
(4)”Wages” shall have the same meaning as defined in the payment of wages Act and include time and
piece rate wages, if any.

3. Display of notice regarding wages, etc.
The contractor shall-
(a) Before he commences his work on contract display and correctly maintain and continue to
display and correctly maintain, in a clean and legible condition, in conspicuous places on the work,
notices in English and in the local Indian language spoken by the majority of the workers, giving the
rate of wage prescribed by the State Public Works Department/ Electricity Department for the district
which the work is done.
(b) Send a copy of such notice to the Engineer-in-charge of the work.
4. Payment of wages:-
(1) Wages due to every worker shall be paid to him direct.
(2) All wages shall be paid in current coin or currency or in both.
5. Fixation of wage period:-
(1) The contractor shall fix the wage period in respect of which the wages be payable.
(2) No wage period shall exceed one month
(3) Wages of every workman employed on the contract shall be paid before the expiry of
ten days, after the last day of the wage period in respect of which the wages are payable.
(4) When the employment of any worker is terminated by or on behalf of the contractor, the
wages earned by him shall be paid before the expiry of the day succeeding the one on
which his employment is terminated.
(5) All payments of wages shall be made on a working day.
6. Wage book and wages cards, etc-
(1) The contractor shall maintain a wage book of each worker in such form as may be
convenient, but the same shall include the following particulars:-
(a) Rate of daily or monthly wages (b) Nature of work on which employed (c) Total number of days worked during each wage period (d) Total amount payable for the work during each wage period (e) All deductions made from the wages with an indication in each of the ground for which
the deduction is made. (f) Wage actually paid for each wage period.
(2) The contractor shall also maintain a wage card for each worker employed on the work
(3) The Executive Engineer may grant an exemption from the maintenance of wage bond, wage
cards to a contractor who, in his opinion-may not directly or indirectly employ more than
100 persons on the work.

7. Fines and deduction which may be made from wages- (1) The wages of a worker shall be paid to him without and deduction of any kind except the
following (a) Fines (b) Deductions for absence duty, i.e. from the place of places whereby the terms of his
employment he is required to work. The amount of deductions shall be in proportion to the period for which he was absence.
(c) Deductions for damage to or loss of good expressly entrusted to the employed person for custody or for loss of money for which he is required to account where such damage or loss is directly attributable to his neglect of default.
(d) Any other deductions which the Orissa Government may from time to time allow.
(2) No fines shall be imposed on a worker and no deduction for damage or loss shall be made from
his wages until the worker has been given an opportunity of showing causes against such fines
or deduction.
(3) The total amount of fines which may be imposed in any one wage period on a works shall not
exceed an amount equal to five paise in a rupee of the wages payable to him in respect of that
wage period.
(4) No fine imposed on any worker shall be recovered from him by installments, or after the expiry
of 60 days from the date on which it was imposed.
8. Register of fines, etc:- (1) The contractor shall maintain a register of fines and of all deductions for damage or
loss. Such register shall mention the reason for which fine was imposed or deduction for
damage or loss was made.
(2) The contractor shall maintain a list in English and in the local Indian language, clearly
defining acts and omissions for which penalty of fine can be imposed. It shall display
such list and maintain it in a clean and legible condition in conspicuous places on the
work.
9. Preservation of register:- The wage register, the wages cards and the register of fines, deduction required to be
maintained under these regulations shall be preserved for 12 months after day of the last entry
made in them.
10. Powers of Labour Welfare Officers to make in investigation or enquiry:- The Labour Welfare Officer or any other persons authorized by the Government of Orissa on
their behalf shall have power to make enquires with a view to ascertaining and enforcing due
and proper observance of the fair wage clauses and the provisions of these regulations. He
shall investigate into any complaint regarding default made by the contractor, sub-contractor in
regard to such provisions.

11. Report of Labour Welfare Officers:-
The Labour Welfare Officer or others authorized as aforesaid shall such a report of the results
of his investigation or enquiry to the Executive Engineer concerned, indicating the extent, if
any, to which the default has been committed with a note that necessary deductions from the
contractor bill be made and the wages and other dues be paid to the labourers concerned.
12. Appeal against the decision of Labour Welfare Officer:-
Any persons aggrieved by the decision and recommendation of the Labour Welfare Officer or
other person so authorized may appeal against such decision to the labour Commissioner within
30 days from the date of decision forwarding simultaneously a copy of his appeal to the
Executive Engineer concerned but subject to such appeals, the decision of the officer shall be
final and binding upon the contractor.
13. Inspection of register:-
The contractor shall also inspection of the wage book and wage cards to any of his workers or
to his agent at a convenient time and place after due notice is receive, or to the Labour
Commissioner or any other person authorized by the Government of Orissa on his behalf.
14. Submission of return:-
The contractor shall submit periodical returns as may be specified from time to time.
15. Amendments:-
The Government of Orissa may from time to time, add to or amend these regulations and on
any question as to the application, interpretation of effect of these regulations, the decision of
Labour Commissioner or any other person authorized by the Government of Orissa in that
behalf shall be final.
8.28. The terms and conditions of the agreement have been read by me/ we and I / we certify that I/
We clearly understand them and agree to abide by them.

GENERAL INFORMATION &
SCOPE OF CONTRACT
1. Location : The work shall be located at a Place DHARUADIHI village b Accessibility By Road c State Orissa 2. Description : Design, Drawing, Construction, Testing and Commissioning of 50,000s ltr. Capacity RCC
Elevated Storage Reservoir with 12 mtr. Staging for piped water supply scheme to DHARUADIHI
village . The area is well connected by road. Tenderers are above to visit the site and make a through
study of the site and the date furnished herein before submission of tender.
3. Scope of Contract : The scope of the contract is as follows : -
i) Design, Drawing, Construction, Testing and Commissioning of 50,000s ltr. Capacity
RCC Elevated Storage Reservoir with 12 mtr. Staging for piped water supply scheme to
DHARUADIHI village .
ii) Excavation of foundation in all kinds of soil including of rocks shoring and shuttering
wherever required, site dressing and leveling the surroundings ground to the proposed
final ground level up to the limit of contract.
iii) Supplying, erection, fitting and fixing of C I Class – A (inlet, outlet, overflow and
Scour) puddle Collars, Specials and valves of required size including embedding in
R.C.C. Wall and / or floor of the reservoir wherever necessary, excavation of trench for
laying of pipe line upto the limit of contract, construction of valve chambers, testing and
commissioning the pipe line.
iv) One set of mechanical type (float type) Water level indicator shall be provided.

v) Manhole with cover, access ladder, lighting arrestors etc, shall be provided as per
detailed specification given at Clause – 5 below.
vi) The limit of contract is up to a distance of 5 M. from the outer face of the structure.
4. Soil Investigation Report : -
i) SBC for structural design of the overhead Reservoir shall be taken as at 1.50 Mtr. Depth
below the lowest R.L. of the virgin ground level at the proposed site. While designing
the ESR it shall be ensured that the weight at structure with foundation and water
including weight of earth over burden as foundation/ Slab/ Raft, as applicable shall be
within the permissible SBC allowed by the department.
ii) The ground water table at the ESR shall be taken as 1.50 Mtr. below the existing G.L.
5. Design Criteria and Specification : -
i) Capacity of the reservoir shall be the volume of water stored between the full supply
level and the invert of the outlet pipe. Due allowance shall be made for plastering the
inside surface of the wall and floor, while calculating the net capacity of the reservoir.
ii) The elevated RCC reservoir shall be with RCC shaft, shaft staging in the type container.
The container proper and shaft shall be so proportioned to give architecturally aesthetic
view.
iii) Height of the staging of the elevated reservoir shall be 2.00 Mtrs. between lowest
supply level and the final ground level at the reservoir site.
iv) Free board shall be minimum 300 mm.
v) Minimum dead storage of 80 mm shall be provided in the reservoir.
vi) Design shall be based on accepted norms and method of design and the provision
contained in the latest versions of I.S. 456, I.S. 33870, I.S. 875, I.S. 1893 etc.

vii) No age factor shall be allowed in the designed in the design of structure.
viii) Plain Cement concrete of grade M-10 thickness not less than 1200 mm. shall be
provided below the footings / foundation.
ix (A) The minimum thickness of the structural members shall be as follows :
a. Wall of Reservoir.
i. Up to 5 M. Water Depth : 150 mm.
ii. Up to 6 M. Water Depth : 180 mm.
iii. Up to 7 M. Water Depth : 200 mm.
b. Floor of the Reservoir : 150 mm.
c. Wall of load bearing Shaft
in case of Elevated Reservoir : 150 mm.
d. Roof slab, if designed as shell: 100 mm.
e. Roof slab flat : 125 mm.
ix (B) For the R.C.C. Shaft of ESR minimum thickness :
150 mm. Reservoir shall be of R.C.C. M-20 grade and shall be except the container
with its components like walls, base slab, roof slab and lean beam which shall be of M-
25 grade.
x. The design calculations and drawing shall be worked out either metric or in S.I. Unit.
xi. The water retaining, component / member including member subject to condensation
like Roof slab shall be designed as uncraked section with M-25 grade concrete.
xii. The minimum depth of foundation of elevated reservoir shall be 1.5 mtr. below the
virgin Ground level.
xiii For access in to the overhead reservoir there shall be R.C.C./M.S. stair case with
landing at suitable intervals to be located inside the shaft/column. The width of the stair and
landing shall be not less than 800 mm. The stairs shall be provided with M.S. hand railings of

approved design for a minimum height of 800 mm. with two rows of horizontal runners at aech
side holding the vertical posts. There shall be either a Central access inside the tank or a cat
walk with suitable guard rails all around. In both the cases access to the roof and inside bed of
the reservoir shall be provided.
xiv. The roof of the overhead reservoir shall be provided with handrails at the edges by
means of M.S. or R.C.C. posts and M.S. or G.I. railings for minimum height of 800
mm. with two rows of horizontal runners holding the vertical posts.
xv. The overhead reservoir shall be provided with suitable ventilation arrangements at the
roof. The openings of the Ventilators shall be protected with mosquito proof wire net
made of copper wire mesh.
xvi. One set of Mechanical Water Level Indictor float type shall be provided to indicate the
Water Level of the Reservoir.
xvii. One lightening arrester shall be provided on the roof of the elevated reservoir as per ISI.
2309. The same shall be suitably earthed with aluminum tape conductor as per I.S.
specifications.
xviii. Two nos. of C.I. lockable hinge type manhole covers of minimum 500 mm. dia with
frame shall be provided on the roof of the elevated reservoir.
xix. All R.C.C. works shall be finished perfectly smooth at his own cost the inside surface of
Walls and floors shall be rendered with 12 mm. thick cement plaster (1:3) after
necessary surface cleaning.
xx. All exposed faces of the concrete shall be given two coats of water-proofing cement
paint of approved quality and shade over a coat of primer. All exposed iron works
outside the reservoir shall be painted with two coats of approved synthetic enamel paint
over coat of primer. All exposed iron work inside the reservoir shall be painted with two
coats of approved anti-corrosive paint over a coat of painting.

xxi. In case of elevated reservoir is supported on a load bearing shafts, there shall be no
entrance door in the shaft wall of size not less than 2.00 mm. x 1.10. There shall also be
windows of suitable size in the shaft wall at different levels. Concrete floating shall be
provided inside the shaft at a height of 600 mm. above the finished ground level. The
doors shall be provided with wooden angle frames and M.S. plate shutters of
appropriate size to be approved by the authority.
6. Machine mix shall be used in concrete works of structure. Design mix concrete shall be
preferred to the nominal mix. Vibrators of appropriate type shall be used for compaction of the
concrete.
7. The cement shall be of minimum OPC 43 grade/PPC/PSC conforming to relevant I.S.
specification.
8. The steel / reinforcement shall be of TISCO / VIZAG / SAIL make of Fe 415 grade conforming
to relevant I.S. specification.
The contractor shall give at his own cost concrete cubes to the department made from surplus
of fresh concrete taken as per I.S. 1199 cured for 7 days and 28 days for testing by the
Department at his cost at any recognized testing laboratory, selected by the department.
Besides the above arrangements, contractor shall also carry out such tests as required by the
department at regular intervals at his cost. Samples shall be taken from the concrete prepared
for use in the following components of the structure.
a. Foundation.
b. Each lift of supporting structure (Staging) in case of elevated reservoir.
c. Floor beam.
d. Floor.
e. Each lift of the wall.
f. Roof slab.
g. Any other portion of the structure as required by the Engineer-in-charge. In the
event of deviation from the desired strength the contractor shall dismantle the
defective parts of the construction and make good the same at his cost.

9. The testing for water tightness of the structure shall be conducted as per 1S.3370 and the result
shall have to satisfy the relevant provisions of the above code.
10. The Engineer-in-charge or his authorized representatives shall have the right to inspect and test
the materials collected by the contractor for use in the work. The materials not conforming to
the relevant specification shall be rejected and the contractor shall have to replace the defective
materials immediately.
11. The Engineer-in-charge shall have the authority to reject or accept any or all the work and
materials and to direct the contractor to stop the work if the work is not up to specifications.
The Engineer-in-charge shall also have the authority to suspend a part or whole of the work
at any time due to reasons arising out of the above and no claim whatsoever on this account
made by the Contractor shall be entertained. In case of any dispute the decision of the
Superintending Engineer, RWS&S Circle, Sambalpur/ Chief Engineer, RWS&S, Orissa,
Bhubaneswar shall be final and binding.
12. The tenderer shall give their own outline drawing of the reservoir (intz type of shaft) to
scale and with dimension showing all the features of the structure basing on the tentative
drawing. The proposed structure shall give an architecturally imposing view having better
architectural and aesthetic view.
13. (a) Detailed Designs & Drawing of works, their submission and approval.
i) Design Submission guidelines: -
1. All designs shall be submitted in the form of booklets in complete shape along
with relevant drawings and in a presentable manner neatly type written /
Computer printed on A-4 Size Bond Paper.
2. All designs calculations / findings shall be supported with illustrative drawings
in from of Plans, Sections etc. as applicable which shall form a part of the
design booklet.
3. All references made in the designs shall be indicated in “Reference Chapter” of
the Design booklet. On demand the Contractor shall furnish reference materials
to the Department to facilitate checking of the designs.
4. All drawings shall be with black lines on white tracing papers in metric scale in
size 560mm. x 810 mm. and shall be titled, cross reference and fully explanatory
with the Contractor’s name date seal and signature on it. Additionally each

drawing shall contain the title at the bottom right hand corner. Alternatively, the
contractor may submit computer aided drawings design of different columns
conforming to other specifications as described above.
5. In case of computer aided designs, the firm shall also additionally submit the soft copy
(CD) containing the software and the design to the Department of facilitate checking of
the designs. The contractor shall also furnish the design calculations through manual
methods if demanded by Department.
ii) Design Basis: -
All designs shall be based on the best modern practices enumerated in the standard text
books / reference books and hand books by authors of International & National repute.
Reference books like the Manual of Water Supply & Treatment by CPHEEO, Government of
India, latest Indian Standard Codes of Practices and Specifications, norms fixed by population
Boards of State / Central & Central Electricity Authority European Union / British / AWWA
Standards shall also be followed wherever required. In case of any contradiction, the decision
of the Competent Authority of the Department shall be final.
For computer aided design, the contractor shall use only widely accepted standard
software of International / National repute.
Thumb rule designs based on the contractor’s own experience / sub-standard Books and
literature / sub-standard software shall be out rightly rejected.
13. (b) Approval of the design and drawings : -
i) On acceptance of the tender, the letter of acceptance of the work order shall be
communicated to the successful tenderer.
ii) The Contractor shall submit to the Department two sets to General arrangement
drawings showing the Plan, Elevation and prospective views general arrangement of the
structure with piping and valves etc. and structural, designs and drawing in keeping
with the specification in this DTCN and in a manner as described in the Clause 13 (A)
within 15 days of issue of letter of intent event if he fails to sign the agreement within
stipulated period of 7 days provided the firm has deposited the initial security deposit.
However, if the agreement is not signed eventually the contractor shall have no claim
on account of whatever design and drawing, the firm has furnished.

iii) The drawing and design shall be scrutinized and preliminarily approved by the
Department after obtaining clarification and / or revisions of the same as required, from
the tenderer. One set preliminary approved designs and drawings shall be returned to
the tenderer.
iv) On receipt of preliminary approved designs and drawings, the tenderer shall within
fifteen days submit two more sets of corrected designs and drawings to the department.
v) These designs and drawing shall again be examined by the department with reference of
the preliminary approved and shall be finally approved. One set of finally approved
designs and drawing shall be returned to the tenderer.
vi) On receipt of finally approved designs and drawings, the tenderer shall within 10 days
submit further 5 sets of final designs and 10 sets of final drawings to the department for
onward transmission to the field officers.
vii) The department reserves the right to make minor modifications in the drawing not
involving major revision of designs at any stage during execution of work.
viii) In case the Contractor fails to submit the design and drawings in proper order, within
the stipulated time, the letter of acceptance of the tender is liable to be cancelled and
earnest money is liable to be forfeited.
ix) The design shall be prepared by qualified and experience Engineer employed or
engaged by the Contractor. The approval of the design and drawings by the department
does not absolve the responsibilities of the contractor on structural stability.
14. Safe Bearing Capacity of Soil : -
The SBC of soil shall be taken as 10 MT/m2 (For tendering purpose) at a depth of 1.5 mtr.
below the lower virgin ground level. The ground water table 1.50 M. below lowest Virgin G.I.
While designing the structure with water and foundation slabs/ raft shall be within the
permissible SBC allowed by the department. The SBC test report is attached.
