o Results in land disturbance of greater than or equal to one acre or more or part of common plan of development,

o Either discharge to a stream segment that is on the 303(d) list for a roadway pollutant of concern or discharge to Cherry Creek Reservoir drainage basin and is exempted under Section 72.7.2 c.(4) of Regulation 72, and
o Has a 20% or more increase in impervious surface.
OR MAY BE A NEPA REQUIREMENT
