PROFESSIONAL EXPERIENCE

1. Since the commencement of my employment with Bernadt Vukic
Potash &
Getz("BVPG") –then as an article clerk- I worked independently and reported
to mainly Jeremy Tyfield and Rob Patrick (see references) of the firm. In
view of the fact that BVPG specialises in High Court litigation, from the
outset of my employment, I gained experience in this field. During the last
couple of months of my articles I began to handle certain High Court
commercial litigation matters completely independently and only reported to
my superiors for minor issues. This included an urgent spoliation application
which BVPG was instructed to defend. My attendances in this regard,
included the drafting of affidavits and pleadings, liaising and consulting with
advocates and clients on a range of fields, including (but not limited to)
contractual, delictual and family law matters. One matter worth mentioning
which I worked on with Rob Patrick during my articles is the Section 417
Enquiry into the demise of Leisurenet Ltd (Health and Racquet Group)
wherein BVPG represented Peter Gardener and Rod Mitchell. During this
period, and in view of my commercial background, I spent a couple of
months in the commercial department of the firm. Such work included the
drafting of agreements and to provide the firm’s commercial clients with
commercial advice.
2. Pursuant to my admission as an attorney, my scope as a commercial
litigator

broadened. During this time, I represented a number of BVPG's corporate
clients in High Court trials and applications (urgent or otherwise). My
attendances in this regard included the drafting of interlocutory applications
and expert witness statements, drafting of affidavits, working closely with
advocates in relation to preparing for trial and actual court attendances with
such advocates. In addition, I represented certain clients in arbitrations. My
attendances in this regard included the drafting of arbitration agreements,
appointing of arbitrators, drafting of statements of claims and the like. I
worked closely with the following advocates (refer to references): Advocates
Les Rose-Innes SC, Owen Rogers SC, Willie Duminy SC, Jeremy Muller SC,
Richard Goodman SC, Roy Gordon and Andrew Brown. The matters so
attended to included (but were not limited to) the following:
2.1 Contractual damages claims arising from a certain insurer's
repudiation of an insurance policy (Eagle Ink Cape (Pty) Ltd v
St Paul Insurance Company (Pty) Ltd & another);
2.2 Contractual damages claim arising from an unlawful eviction
(R. Pieters N.O. and another v Southern Sun Hotels (Pty) Ltd);
2.3 Delictual damages claim on behalf liquidators in relation to the
construction of a food terminal in Port Elizabeth (Gransteel
(Pty) Ltd (in Liquidation) v Kantey Templer (Pty) Ltd and
another);

2.4 Three consolidated matters in relation to the breach of a sale of
business agreement concluded between the outgoing
shareholders of the "old" Aca Joe and its "new" management
team. The matter comprised numerous claims and
counterclaims and entailed, inter alia, a plethora of
interlocutory applications, a postponement application, complex
legal issues, a vast amount of witnesses and quantum in the
amount of approximately R 8 000 000.00. I was the sole
attorney at BVPG who dealt with it. (Lionel Charles
International CC v Aca Joe Clothing (Pty) Ltd and Hilton
Weiner (Pty) Ltd);
2.5 Contractual claim for damages arising form the repudiation of a
sale agreement in respect of the acquisition of certain retail
clothing stores. This matter was originally instituted against
BVPG's client in 2001. It forms the subject matter of hugely
complex and ongoing commercial litigation. The amount at
stake is approximately R 300m. I am working on this matter
with my colleague, Carla Pinheiro. (Platinum Holdings (Pty)
Ltd v LA Group Ltd).

3. Whereas at BVPG my sole focus was on attending to commercial
litigious matters, my scope a civil litigator broadened in that at Kevin
Moodley and Associates (“KMA”) where I was confronted, to a
certain extent, not only with commercial litigious matters, but also a
more general mix of civil litigation, including the drafting of
commercial contracts and the hosting of seminars on the National
Credit Act specifically with regard to its impact on the debt
enforcement process.
4. My attendances in the above regard included the representation of the
firm’s commercial clients in the conduct of High court trials and
applications (urgent or otherwise) including, but not limited to,
representation of commercial clients in claims of a contractual nature,
a substantial opposed divorce, which included various maintenance
applications pendente lite, a contempt of court application and the
actual trial, proceedings to set aside and review a tender awarded by
Metropolitan Bus Services (Pty) Ltd (“Metrobus”), a trial in which an
erstwhile contractor claims damages from Metrobus as a result of an
alleged repudiation of an agreement as well as other matters of a
similar nature. In addition, I am in head of the department dealing
with vehicle and asset finance claim recoveries on behalf of Standard
Bank.
5. KMA’s clientele in the litigation department includes, but is not
limited to, the following: Standard Bank, MTN, Airports Company of
South Africa, Metropolitan Bus Service (Pty) Ltd, Biz Afrika (Pty)
Ltd and Nedbank Limited.
