The Embassy of the United States of America presents its compliments
to the Ministry of Foreign Affairs ofthe Republic of Poland and has the honor
to refer to the Agreement between the Government of the United States of
America and the Government of the Republic ofPoland on the Status of the
Armed Forces of the United States of America in the Territory of the Republic
ofPoland, done at Warsaw, December 11, 2009 (the "Agreement").
Following discussions between representatives of the two
Governments and in furtherance of common defense efforts, including those
conducted within the framework of the European Reassurance Initiative, the
Embassy has the honor to propose that pursuant to Article 3(1) of the
Agreement the specified parts of the following Polish Armed Forces
installations as depicted in the attachments to this Note shall be "agreed
facilities and areas" as defined in Article 2(i) of the Agreement:
• Lask Air Base ("Lask");
• Drawsko Pomorskie Training Area ("Drawsko Pomorskie");
• Skwierzyna Military Complex K-2629 ("Skwierzyna");
• Ciechan6w Military Complex K-0166 ("Ciechan6w"); and
• Choszczno Military Complex K-1267 ("Choszczno").
DIPLOMATIC NOTE
The Embassy has the further honor to propose that United States forces
shall have unimpeded access to and use of the above agreed facilities and
areas. All activities of United States forces and United States contractors,
including unimpeded access of the United States forces, shall be conducted
consistent with the Agreement and all applicable Implementing Arrangements.
The Embassy also proposes that United States forces shall be
authorized to preposition and store property, equipment, supplies, and materiel
("prepositioned materiel") at agreed facilities and areas and that United States
forces shall have exclusive control over prepositioned materiel present or
stored in the territory of the Republic of Poland and shall have the unrestricted
right to remove such items from the territory of the Republic of Poland.
The Embassy has the further honor to propose that the Government of
the United States and the Government of the Republic of Poland or their
designees may modify the agreed facilities and areas by mutual written
consent.
Pursuant to the Agreement the Parties or their designees shall enter
into further arrangements to address technical details regarding the use of
agreed facilities and areas.
If the foregoing proposal is acceptable to the Government of the
Republic of Poland, it is further proposed that this Note, together with the
Ministry's affirmative reply Note, shall constitute an agreement between the
two Governments, which shall enter into force on the date of the Ministry's
reply Note.
The Embassy of the United States of America avails itself of this
occasion to renew to the Ministry ofForeign Affairs of the Republic of
Poland the assurances of its highest consideration.

The Ministry of Foreign Affairs of the Republic of Poland has the honor to report that the
Government of the Republic of Poland is in full agreement with the above, and thus our note.
together with the aforesaid note of the Embassy. constitutes an Agreement between the Government ofthe Republic of Poland and the Govenunent ofthe United States ofAmerica concerning the agreed facilities and areas, which shall enter into force on the date of receipt of this note by the U.S. Party. In view of the above, the Ministry of Foreign Affairs of the Republic of Poland requests confirmation of the date of receipt of this note by the Embassy of the United
States of America at Warsaw, and thereby designation of the date of entry into force of the
Agreement.
