A RESOLUTION REGARDING A ZONING CHANGE ON CER-TAIN LAND LOCATED IN POTTAWATOMIE COUNTY, KAN-SAS.

WHEREAS, a petition has been made by Legatus, LLC, to amend the existing zoning designation on a tract of land from A1-Agricul-ture, to CN-Commercial Neighborhood, and

WHEREAS, the tract is described as being located in the South-east Quarter of Section 34, Township 9 South, Range 8 East of the Sixth Principal Meridian, beginning at the Southeast Corner of the Southeast Quarter of said Section 34; thence S89°08’50”W 598.92 feet along the South Line of the Southeast Quarter of said Section 34; thence N01°51’10”W 40.00 feet; thence N17°54’03”E 86.02 feet; thence N61°08’41”E 238.44 feet; thence N88°59’24”E 360.10 feet to the East Line of the Southeast Quarter of said Sec-tion 34; thence S01°00’36”E 234.39 feet to the point of beginning, containing 2.8 acres, and

WHEREAS, a public hearing was held on said petition by the Pot-tawatomie County Planning Commission on December 13, 2018 after due notice in accordance with Kansas Statutes and the Uni-fied Development Regulations of Pottawatomie County, and,

WHEREAS, as a result of said public hearing, the Pottawat-omie County Planning Commission has recommended a zon-ing change on said tract, from A1-Agriculture to CN-Commercial Neighborhood, for the following reasons: 1. The request will not substantially affect the use, value or enjoy-

ment of nearby properties. 2. The tract is suitable for the zoning requested.3. The requested zoning is compatible with the zoning and uses

of nearby properties. 4. Recommendation of approval by the Planning and Zoning

staff. 5. The zoning change conforms to the County land use plan.

WHEREAS, in accordance with KSA 12-757(f), there was no val-id protest petition filed with the Office of the County Clerk within 14 days of the completion of the public hearing, by the owners of record of twenty percent (20%) or more of the total real property located within one thousand feet (1,000) of the boundaries of the property proposed to be rezoned, excluding streets and public ways, and

WHEREAS, the facts set forth in the County Planner’s staff report and the recommendation of the Pottawatomie County Planning Commission filed in the office of the Pottawatomie County Zoning Office have been received and considered by the Board of Com-missioners of Pottawatomie County, Kansas and have been de-termined to be the controlling factors concerning the application.

NOW THEREFORE, on a motion properly made and seconded to approve the zoning change from A1-Agriculture to CN-Commer-cial Neighborhood, a vote of the Board of County Commissioners is recorded as follows:

NOTICE OF ANNUAL MEETING OF THE POTTAWATOMIE COUNTY CONSERVATION DISTRICT

To all quali�ed electors residing within the boundaries of the Pottawatomie County Conservation District, notice is hereby given that pursuant to K.S.A. 2-1907, as amended, on the 26th day of January 2019, at 12:00 p.m., an annual meeting of the Pottawatomie County Conservation District will be held at the St. Columbkille Catholic Parish Hall in Blaine, Kansas.

The meeting agenda shall include the following business items:

ONE: The supervisors of the Pottawatomie County Conservation District shall make full and due report of their activities and �nancial a�airs since the last annual meeting.

TWO: They shall conduct an election by secret ballot of quali�ed electors, there present, of one supervisor to serve for a term of three years from date of said meeting.

The term of Rayburn Stadel is expiring.

All in the county of Pottawatomie in the State of Kansas.
