Challenges of Reporting on 2020 General Election in States and Regions of Burma

1. Background

The 2020 General Election was held on 8 November 2020 in Myanmar. As the 2020

General Election would be the first general election under the administration of National

League for Democracy (NLD) after the 2015 General Election, local and international

observers and media observed attentively upon the fairness and transparency of the whole

election process. Overall, we have seen the asymmetric oppression by the ruling government

on media freedom over a year before the election.

1.1. Internet Shutdown

The internet connection has been shut down in Buthidaung, Kyauktaw, Maungdaw,

Minbya, Mrauk-U, Myebon, Ponnagyun, and Rathedaung in Rakhine State and Paletwa

township in Chin State since 21 June 2019 and, for a country claiming to be democratizing, it

is inappropriately recorded as the world’s longest internet shutdown in the world. After the

internet connection in Maungdaw was restored on 2nd May 2020, it has not yet been reinstated

in the remaining townships. On 1st August 2020, although the Ministry of Transport and

Communication announced that the internet connection would be restarted, in effect it

remained disconnected as the dysfunctional 2G network which was reopened, resulted in the

same inoperable internet and was simply a public relations exercise by the Government. Even

during the COVID-19 pandemic period, the population of over 1 million in these regions cannot

access the up-to-date information about the pandemic like the other people living in Myanmar.

Similarly, the ethnic people in these regions faced limitation in accessing the information about

the election before the 2020 General Election.

1.2. Blockage of News Agencies’ Websites

Apart from internet shutdown, another controversial issue relating to media freedom in

Ethnic States in 2020 was the blocking of websites of independent ethnic media. From 19

March 2020 to 11 May 2020, Ministry of Transportation and Communication, according to

Section 77 of Telecommunication Law, ordered the telecommunication operators in Myanmar

to shut 2,147 websites down, including the websites of major independent ethnic media such

as Development Media Group, Narinjara News and Karen News, the largest independent ethnic


language news providers in their states. The websites have not been unconditionally restored

as of this report date, beyond the November 2020 election.

1.3.Prosecuting the Ethnic News Editors

Under the NLD government, the media freedom faced limitations not only on internet

but also in the ground situation. It has been over one year since Aung Marm Oo, Chief Editor

of Development Media Group, a member of BNI, and other staff were charged under Unlawful

Association Act Article 17/2 by Special Branch Police on 1 May 2019 at Sittwe Myoma Police

Station No. 1.

Also, on 31 March of this year, Khaing Mrat Kyaw, Chief Editor of Narinjara News,

another member of BNI, was charged under Counter-Terrorism Law by Sittwe Myoma Police

Station No. 1 and the reason for charge was because of the publication of an interview with

Khaing Thukha, a spokesperson of AA, in a Narinjara’s news.

The world’s longest internet shutdown for over a year in regions of Rakhine and Chin

States which are unstable due to armed conflict, blockage of independent ethnic media and

prosecution of the Chief Editors of two Rakhine State-based ethnic media were the significant

violations of media freedom. There was no improvement regarding these violations of media

freedom until the election period and even on the election day, we have seen another form of

oppression over media freedom.

2. Government Discrimination against Ethnic News Groups to Monitor inside the

Polling Stations and Compounds

According to the reporters of BNI members ethnic media agencies, it was observed that

the reporters faced several difficulties to record news near the polling stations. Through district

sub-commissions, the Union Election Commission (UEC) issued the identity cards for

reporters to cover news on the election day. According to the rule by the UEC, the reporters

would be allowed to record news inside the polling stations and the compounds only if they

wear these identity cards and the reporters who did not apply for the identity cards could only

record the news from outside of the compounds.

However, the reporters who had received and wore the identity cards faced limitations

in recording news inside the polling stations and inside the compounds on the election day. The


reporters were not allowed to record news or take pictures or video inside the polling stations

in some regions of the States including Kayin State, Chin State, Mon State and Shan State and

in some regions, the reporters could not even enter the compounds. Similarly, there were some

polling stations where the reporters were allowed to enter but not to record pictures or video.

Since the reporters were not allowed to record news or take pictures or video inside the

polling stations and inside the compounds, the reporters lost the opportunity to record the

scenes of checking ballot boxes and ballots when the polling stations were opened, counting

votes and other activities when the polling stations were closed. Therefore, the essential

transparent scenes of the election could not be included in the news and it made the reporting

of regional news media less transparent as only the scenes outside of the polling stations could

be recorded.

However, some centralized Yangon based media could record the news and take pictures and

video inside the polling stations and could publish the news with various scenes. This type of

discrimination by the government, favoring centrally based Yangon media organizations over

regional news media organizations, impedes the news’ quality of the ethnic news agencies

which are the only news organizations to report locally relevant news and in the mainstream

languages for people living in the ethnic States. This erodes the trust of ethnic populations in

independent journalism as well as trust in any elections.

3. Inconsistent Procedures between UEC and State Sub- Commissions

Although UEC released Media Guidebooks for 2020 General Election for reporters,

they were not widely distributed among reporters and sub-commissions. State sub-

commissions also could not solve the challenges of reporters in accessing the news in practical

situations. The cases like some state sub-commissions not allowing regional media

organisation reporters with identity cards to record news inside the polling stations and inside

the compounds highlights the inconsistent procedures between the UEC and state sub-

commissions. Moreover, the media guidebooks were not released with the majority languages

of each region; making rules less clear and understandable.


4. Impacts of COVID-19 Related Restrictions on Reporters

As government announced stay at home orders in late September 2020 when the time

the second wave of COVID-19 initiated, reporters had worked at home since journalism and

media were not included in the list of essential businesses. Hence, there were limitations during

the election period to access news in different towns. If reporters were exempted, as an

exceptional case, from the restrictions to control COVID-19 such as quarantine during the

election period, it would have been more efficient in publishing news.

5. National Political Parties, including NLD, Blocked Access to Information during the

Election Period

Another election-related challenge that ethnic news media met was blockage to access

information. The NLD and other national parties did not answer the phone and ethnic news

media found it difficult to reach them after the election. The NLD even did not allow ethnic

media to attend election speeches given in Karen State villages. Moreover, the NLD and other

national parties did not provide information or press conferences in the majority languages of

each state and region, which made their official policies unclear to local population and more

able to be misrepresented by various candidates or allies.

6. Conclusion

In the election period where political leaders are selected to seek ways to end Burma’s

70 year long civil war, it is extremely important for reporters to have unlimited access to

information in order to publish the accurate news and information to the people who live in

any regions of the country. The crucial role of the independent ethnic regional based media

sector to assist free and fair elections was severely weakened due to Government led

restrictions and persecution of ethnic news groups reporters in monitoring the election.

Overall, these restrictions by the Government and ruling party, placed limitations

against region-based ethnic news groups ability to cover the election. Indeed, all media

agencies, not only Yangon based news agencies with Burmese language but also ethnic media

agencies, deserve the media freedom to perform their crucial role as the fourth pillar of the

country. In order to conduct free and fair elections in future, the newly elected government

must adopt the policies that guarantee the free access to information and free expression of all

media groups, no matter where they are based or with which language they report.

(၁၇/၂) ြဖင စစေတ အမတ (၁) ရစခနးတင အမဖငထား ခသညမာ ယခဆလင တစစေကျာပြဖစသည။

၄။ သတငးမဒယာသမားများအေပ COVID-19 င ပတသကသည ကနသကမများ၏ သကေရာကမ

COVID-19 ဒတယလငးစတငပး မကာမ စကတငဘာလေ ငးပငး အစးရက ေနအမတင

ေနထငေရး အစအစက ေကညာခရာ၌ သတငးမဒယာလပငနးက ခငးချကမေပးခသညအတက

သတငးသမားများအေနြဖင မမအမ၌သာေနထင၍ အလပလပကငခရသည။ ထေကာင

ေရးေကာကပကာလတင မမေနထငရာမ မဟတသည အြခားမ၏ ေရးေကာကပသတငးရယရာတင

အကနအသတများ ရခပါသည။ အသားအလာကန သတြခငးကသေသာ COVID-19 ေရာဂါ

ကာကယထနးချပေရးဆငရာ ကနသတချကများက ေရးေကာကပကာလ အတငး၌


သတငးေထာကများအေပ ခငးချကအေနြဖင ေြဖေလာေပးခပါက သတငးရယထတြပနရာတင ပမ

၅။ ေရးေကာကပကာလတငး NLD အပါအဝင ပါတများင ဆကသယရရရန ခကခြခငး

ေရးေကာကပင ပတသက၍ တငးရငးသားသတငးမဒယာများ အများဆးကေတရသည

အြခားစနေခမတစခမာ သတငးအချကအလကရယရန ခကခြခငးြဖစပါသည။ ေရးေကာကပ

ကျငးပပးချနတင သတငးရယ ရနအတက NLD အပါအဝင အငရပါတများင အြခားပါတများက

ဆကသယရာတင ဖနးလကခမေြဖကားြခငး၊ အဆကအသယရရန ခကခြခငး စသညစနေခမများက

တငးရငးသား သတငးမဒယာများက ကေတခရေကာငး သရရပါသည။ NLD အေနြဖင ကရငြပညနယတင

ကျငးပခသည ေရးေကာကပ မနခနးေြပာကားပကပင တငးရငးသားသတငးမဒယာများက တကေရာကခင

မြပခေပ။ ထအြပင NLD င အြခားပါတများသည ြပညနယင တငးေဒသကးများ၌

သတငးအချကအလကများ ထတြပနြခငးင သတငးစာရငးလငးပများ ကျငးပရာတင ေနထငသ လအများစ

အသးြပသည ဘာသာစကားက အသးြပြခငးမရသညအတက ေဒသခများအေနြဖင ၎ငးတ၏ တရားဝင

မဝါဒများက ေသချာန းလညငရန ခကခပး များစာေသာ ကယစားလယေလာငးများင

မတဖကအဖများ၏ လမားစာ ကယစားြပြခငးက ခရငပါသည။

၆။ အစချပ

ြမနမာငင၏ စေပါငး ၇၀ ကာ ြပညတငးစစက အဆးသတငရနအတက နညးလမးရာေဖရန

ငငေရးေခါငးေဆာငများက ေရးထတေပးလကသည အေထေထေရးေကာကပကသ ကာလများတင
