TENDER NOTICE Centre of Plasma Physics-Institute for Plasma Research (CPP-IPR), a reputed premier scientific research
Institute, under the Department of Atomic Energy, Government of India. Sealed tenders are invited from
reputed, experienced and financially sound parties as detailed below:
Tender Notice
TENDER FOR PROVIDING MUV & Car :
TENDER NO. CPP-IPR/04/MWCAC/2015-16/47 dated 16.10.2015 To provide initially one MUV & one CAR (Non-A/C Diesel/Petrol), in excellent condition, to the
Institute on rate contract basis for a period of two years. The vehicle model must be of 2014 or thereafter
(preferably new).
Common Information and Criteria: The requirements for the vehicles may increase or decrease during the contract period. Interested parties
having experiences and fulfilling the following criteria may submit the request for issue of tender
document along with the documentary evidence of 1) Having at least 1 MUV in the name of the firm or
the owner of the Firm or partners (Copy of RTO books to be enclosed as proof). 2) Performance/
experience certificate from reputed client indicating number of vehicles provided to other organizations.
3) Details of the office, infrastructure, staff and emergency services in case of breakdown of vehicle. 4)
All the tenderer (s) should be able to provide the MUV immediately after getting the contract.
EMD Rs.10, 000/- (for each vehicle) - payable along with Tender Document.
Written request along with documentary proof, for the issue of tender document can be made to the
Administrative Officer-I, quoting the Name & No. of the Tender Notice up to 10/11/2015 between 10.00
a.m. and 05.00 p.m. Tender documents will be issued to the eligible parties on payment of tender fees of
Rs. 500/- in form of demand draft in favour of Institute for Plasma research A/C CPP payable at
Sonapur. The tender documents may also be downloaded from the institute website www.cppipr.res.in. a
Demand Draft of Rs. 500/- in favour of Institute for Plasma research A/C CPP payable at Sonapur has to
be accompanied with the filled in tender documents, if downloaded from the website. Centre Director,
CPP-IPR reserves the right to refuse to issue tender documents to any party/parties or reject partially or
wholly any or all the tenders without assigning any reason whatsoever.

Instructions to the Tenderers
(Please read the following instructions carefully before filling up the Tender document)
1. Tenderers may quote only if they fulfill all the criteria laid down hereunder and are in a position to
provide the vehicles of 2014/2015 or brand new model from the date of starting of the contract.
2. Tenders must accompany:
(a) Proof of ownership without fail
(b) Copies of contract(s)/ work order(s), where vehicles have been provided.
(c) Copy of RTO book of at least one vehicle in the name of the Firm/Firm owner/Partner
(d) Performance certificate(s)/Experience Certificate (s)
3. All vehicles offered must be:
(a) Quite well maintained in all respect including interiors.
(b) In excellent running condition and having models of 2014 or thereafter (preferably new).
(c) The vehicles to be provided to the Centre should have commercial registration.
4. Successful Tenderer (s) will be required to maintain all vehicles throughout the period of contract to
the complete satisfaction of the Institute leaving no room for complaints.
5. Successful Tenderer (s) will be required to provide vehicles bearing registration nos. as mentioned in
the tender. The Institute at its discretion may refuse to accept substitute vehicles.
6. Successful Tenderer(s) will be required to provide drivers with valid driving license, who are literate,
neatly dressed, courteous, well mannered and disciplined.
7. The successful tenderer (s) shall provide additional vehicles as and when required at the quoted
rates on casual or long-term basis at a short notice.
8. Successful tenderer (s) shall make available at CPP-IPR all the offered vehicles for inspection before
award of contract. The Institute shall accept only those vehicles, which satisfy the above
requirements.
9. The Institute reserves the right to split the contract among two or more parties.
10. Offer may be accepted in full or in part at the discretion of the Centre Director, CPP-IPR.
11. The tenderer should sign all the pages of the tender documents before submission, as token of having
read & accepted the terms & conditions.
12. The tender document is issued to the tenderer meeting the details as specified in the tender notice,
which does not mean that they are pre-qualified to receive the contract.
13. CPP-IPR is not bound to accept the lowest tender. CPP-IPR reserves the right to choose any party
whether it is lowest or otherwise at its sole discretion.
14. On scrutiny of the documents if it is found that the party has suppressed facts or has given wrong
information/documents, CPP-IPR reserves the right to reject such tenders.
15. The tender is liable to be rejected if the response of its past or present clients are found unfavourable
as regards to the performance and services rendered to them by the tenderer.
16. CPP-IPR will contact the past & present clients to know about the records of vehicles provided,
performance, services or any other relevant details of the party and if it is found that any information
was suppressed or wrong the tender will be rejected.
17. A non-returnable tender fee of Rs. 500/- by cash or by a demand draft or by pay order in favour of
Institute for Plasma research A/C CPP payable at Sonapur is to be submitted at the time of
receiving of the tender documents by the parties.
18. The tenderers may seek clarification for any of the point not understood by them.
19. The tender containing too many errors and alterations are liable to be rejected. All
corrections made by the tenderer/ tenderers must be attested by him/them with his/their
authorised representative’s full signature.
20. The tender documents received later than the prescribed time will be summarily rejected.
21. Tenders not accompanied by EMD amount will be summarily rejected.
22. When the work is tendered for by a firm or by a company the tender shall be signed by the
individual authorised to enter into such commitments on their behalf.
23. The change in the composition of the firm made subsequent to the execution of the contract
will not be accepted without legal validity.
SPECIFIC TERMS AND CONDITIONS:
1. The vehicles should have clearance of RTO and should be registered for operating as
commercial vehicles.
2. The vehicles should be registered in the name of tenderer. The contractor should have at
least 1 MUV /1 Car in his name or name of firm or his partners.
3. The vehicles shall be requisitioned as per the institute’s requirement and adherence to
strict timing shall be absolutely essential.
4. The vehicles shall be placed at disposal of Institute as detailed in the schedule or as
required.
5. In case of break-down of any vehicle the contractor will have to replace immediately the
same by equally good vehicle approved by CPP-IPR authorities. Any replacement of the
vehicles shall be brought to the notice of the CPP-IPR authorities at the earliest. In case
of default by way of late running of vehicles by more than 15 minutes or for any breach
of terms and conditions, the contractor is liable to pay penalty of Rs. 1, 000/- each to
CPP-IPR for MUV & Car for per day/lapse in addition to any other loss which institute
may suffer. Moreover, if the contractor fails to provide the vehicles in a particular day
due to technical snag or any other reason the contractor should provide alternative
vehicles in good working conditions so that the institute do not suffer. The contractor
has to provide vehicles on local bandhs/strikes called by political or any parties.
6. EARNEST MONEY DEPOSIT: The tenderer shall be required to deposit Earnest
Money Deposit (EMD) of Rs.10, 000/-(for each vehicle) for along with the tender in the
form of demand draft/pay order/banker’s cheque drawn in favour of Institute for Plasma
Research A/C CPP payable at Sonapur. Tender not accompanied by EMD as stipulated
herein above shall be summarily rejected. The EMD of unsuccessful tenderers shall be
returned within reasonable time after finalization of the contract.

[1] SCOPE:
The scope of the transport contract is to provide tentatively one (1) diesel/petrol CAR and
one diesel MUV on regular basis and any other vehicles as required by CPP-IPR to
transport the staff/official visitors. The timings to be decided by CPP-IPR from time to
time. The vehicle models should be of 2014 or thereafter, with good interiors, good
working condition and should be registered for operating as commercial vehicles.
[2] PERIOD OF CONTRACT:
The contract will be for a period of two years. The tentative effective date of operation
would be December 2nd
week 2015, with an initial trial period of three months. The
performance will be evaluated during the trial period of the contract. At the sole
discretion of CPP-IPR, the trial period may be extended for a further period of three
months or more. CPP-IPR reserves the exclusive right to terminate the contract without
notice, during the trial period/extended trial period without assigning any reason
whatsoever.
The contract shall be extendable, for a period of one year or more in one or more stages
on the same agreed rates, terms and conditions at the sole discretion of CPP-IPR.
[3] TERMINATION OF THE CONTRACT:
The contract may also be terminated at any time during its pendency at the sole discretion
of CPP-IPR by giving one month’s notice to the CONTRACTOR. The CONTRACTOR
may also discontinue the services by giving three months notice in writing to CPP-IPR. If
the CONTRACTOR suspends the services without any notice to CPP-IPR, the whole
amount of security deposit shall be forfeited in addition to the loss incurred in making
alternate arrangements during the shortfall in the notice period.
The contract shall stand terminated in event of filing any legal petition against CPP-IPR
by the CONTRACTOR or any of its employees with regard to labour laws/rules or incase
of any agitation/strike initiated by the CONTRACTOR’s employees.
[4] SECURITY DEPOSIT:
[a] The CONTRACTOR shall be required to pay Rs. 10,000/- per vehicle as security
deposit by demand draft in favour of Institute for Plasma research A/C CPP on
which no interest shall be paid. The security deposit shall remain with CPP-IPR
during the tenure of this contract and be released only after three months from the
date of expiry or termination of the contract.
[b] The whole amount of the Security Deposit shall liable to be forfeiture in case of
breach of any of the terms agreed upon by the CONTRACTOR. The security
deposit shall also be liable to appropriation against dues payable to CPP-IPR
under the agreement or damage or expenses that may be sustained by CPP-IPR as
a result of negligence, or such acts and omissions on the part of the
CONTRACTOR or the persons deployed by him at CPP-IPR.
In the event of such adjustment of security deposit fully or partly the
CONTRACTOR shall immediately pay the amount so appropriated from the
security deposit in the form of demand draft failing which it shall be adjusted
from the amount payable to the CONTRACTOR.
[c] The Security Deposit shall be held up by CPP-IPR as security for the due
performance of the CONTRACTOR’s obligations under the Contract,
PROVIDED that nothing herein stated shall make it incumbent upon CPP-IPR to
utilize the Security Deposit in preference to any other remedy which CPP-IPR
may have, nor shall be construed as confining the claims of CPP-IPR against the
CONTRACTOR to the quantum of the Security Deposit.
[5] REQUIREMENT OF VEHICLES:
[a] The present tentative requirement is one diesel Car and one diesel MUV. This is
a tentative requirement only and the actual deployment may vary from time to
time, which will be intimated to the CONTRACTOR by CPP-IPR.
[b] As this is an annual service contract and number of vehicles to be pressed into
services are not fixed and not guaranteed and the quantity is indicative only and
may vary as per actual requirement.
[6] DUTIES OF THE CONTRACTOR:
[i] The CONTRACTOR shall provide and run the vehicles for staff of CPP-IPR or
any other persons authorized by CPP-IPR at the time mentioned in the service
schedule
[ii] The CONTRACTOR shall show the proof that the vehicle has valid
commercial registration & owned by him or his Associates. The proof will be
verified by CPP-IPR along with physical check of the vehicles being offered.
[iii] The vehicle mentioned above is meant for transportation of the employees of the
Institute & its Visitors. Maintaining of proper time schedule for each and every
trip is the essence of this contract. If the normal co-ordination is not found
satisfactory, the CONTRACTOR shall deploy his representative on all working
days for effective control and co-ordination. CONTRACTOR himself shall
remain available once in a week and also whenever required.
[iv] The vehicle should be in perfect roadworthy condition with good out look and
interior. CONTRACTOR shall keep the vehicle in the good operating condition at
all times. Procurement of fuel, lubricants, spares etc. shall be arranged by him at
his own cost. Timely maintenance and upkeep of the vehicle shall be carried out
by the CONTRACTOR before it is pointed out by the CPP-IPR.
[v] The CONTRACTOR will have to maintain the log book of each and every trip for
all the vehicles and the same shall be submitted along with the bills of every
month. The signatures of users who travel in the vehicle should be obtained by the
driver immediately after completion of the journey. Proportionate deductions shall
be made if the signatures of users are not obtained in the log sheets.
[vi] The CONTRACTOR shall ensure that his driver fills the correct log book legibly
indicating name of user, starting kilometer, starting time and closing kilometer
and time on daily basis immediately on completion of every assignment. A
summary daily sheet of all vehicles indicating vehicle No., name of the user,
starting km & time, ending km & time shall be prepared by the CONTRACTOR
and shall submit the same to the officer-in-charge on the next working day.
[vii] CONTRACTOR will have to take immediate action if a particular vehicle cannot
be operated for any reason whatsoever by providing a substitute vehicle. If he
fails to do so he shall reimburse the conveyance expenses whatsoever incurred by
the staff members/CPP-IPR in addition to appropriate penalty as deemed fit.
[viii] If at any time during the pendency of contract, necessity arises to introduce more
vehicles because of increase in number of employees or due to any other
exigency, the CONTRACTOR shall provide such vehicles at the agreed rates at
minimum notice.
[ix] The rates quoted by the CONTRACTOR and accepted by CPP-IPR would be
inclusive of wages to drivers, cost of fuel, lubrication etc., expenses for
maintenance of vehicles, payment of all taxes to Government and local authority
etc. as levied from time to time. Service tax applicable, will be paid extra as per
Government norms.
[x] The CONTRACTOR shall be responsible for the acts of omissions and
commissions / accidents by the persons employed by him either inside or outside
the CPP-IPR premises. He should verify the antecedents of the persons employed
by him, before deploying them. The CONTRACTOR shall ensure that the persons
deployed by him are courteous and their behavior and manners are good towards
the employees of CPP-IPR. In case of any complaint of in-discipline or
misbehavior, the CONTRACTOR shall replace the concerned driver forthwith.
[xi] The CONTRACTOR shall ensure that his personnel shall honour and obey all
relevant instructions as and when given from time to time.
[xii] All the vehicles hired shall have to display the following board:

and placard to exhibit the same while receiving any officer / guest.
[xiii] The CONTRACTOR shall ensure that the persons deployed by him are free from
all communicable, contagious, infectious and other diseases and the
CONTRACTOR shall have them medically examined in case of illness at his own
cost. CPP-IPR also reserves the right to get his persons medically examined by a
physician approved by CPP-IPR at the sole expense of the CONTRACTOR. If,
in the opinion of the CPP-IPR any person deployed by the CONTRACTOR is
found to be suffering from any such communicable diseases or if any of the
employees of the CONTRACTOR is found to commit any misconduct or
misbehavior, the CPP-IPR in its sole discretion may restrain such persons from
entering its premises.
[xiv] Drivers:
[a] The MUV & Car provided shall be driven by the drivers having valid
licence for a period not less than 5 years and having sufficient driving
experience. Copy of the driving licence is to be submitted to the office for
records.
[b] The Driver should be well behaved, well groomed and polite. Working
knowledge of Hindi / English is desirable.
[d] If the Driver is found to be driving rashly the CONTRACTOR shall have
to replace the Driver forthwith as per the advice of the officer-in-charge.
[e] The driver should wear the uniform, shoes and display the Photo Identity
Card for identification of CONTRACTOR’s employees for the security
and safety of CPP-IPR while on duty. Uniform should bear the name of
the CONTRACTOR.
[f] The Driver shall move only as per instructions from the Officer–in-Charge
and shall not leave the duty place without his consent.
[xv] In case the vehicles earmarked for CPP-IPR are under repairs or replaced for any
other reasons, the replaced vehicles should also fulfill all the requirements
mentioned in this contract.
[xvi] The CONTRACTOR shall be responsible for all disputes, issues, claims, &
matters related to employment, non-employment & terms of employment as far as
employees which includes their drivers engaged by him are concerned.
[xvii] There shall not be any privities of contract between CPP-IPR on one side &
employees engaged by the CONTRACTOR on the other side and
CONTRACTOR alone should be responsible for all matters arising out of
employees engaged by him.
[xviii] The CONTRACTOR shall be responsible for satisfactory performance of the
contract. The CONTRACTOR shall be fully accountable, responsible and liable
for any damage, loss destruction, theft, pilferage etc. caused due to negligence of
his personnel.
[xix] Statutory Requirements:
[a] The CONTRACTOR shall have full and exclusive liability for payment of
Govt. taxes, comprehensive insurance, RTO permits, RTO licence, service tax
and any other fees / taxes payable from time to time during the pendency of the
contract. The CONTRACTOR shall produce the above referred documents
along with monthly bill for verification by the CPP-IPR authorities.
[b] The CONTRACTOR shall have to pay minimum wages as prescribed by the
State/Central Government to all his operating crew and the Supervisors. The
CONTRACTOR shall be responsible for fulfilling the requirements of all the
statutory provisions of Contract Labour (Regulation & Abolition) Act,
Employees Provident Fund Act, Motor Vehicles Act, Payment of Wages Act,
Minimum Wages Act, Bonus Act, Gratuity Act and other industrial enactments
at his own cost and risk, in respect of all staff employed by him. If due to any
reason whatsoever, the CPP-IPR is made liable, it shall be payable by the
CONTRACTOR and all such liabilities shall be recovered by CPP-IPR from
any dues payable by the CPP-IPR to the CONTRACTOR and /or from the
Security Deposit of the CONTRACTOR and available properties and sources
of the CONTRACTOR through process of law.
[c] The CONTRACTOR shall maintain various registers as per the Contract
Labour (R & A) Act and shall produce the same for inspection as and when
required.
[d] The CONTRACTOR shall obtain the Insurance policy in respect of the
workmen engaged by him for the job. The CONTRACTOR shall indemnify
CPP-IPR under the workmen’s Compensation Act, 1923 and its amendment of
all liabilities like death / disablement of the workmen. The CONTRACTOR
shall be permitted to start the job only after obtaining adequate insurance
coverage from the authorised insurance companies.
[e] The vehicle shall be comprehensively insured for coverage of all kinds of risks.
[f] The CONTRACTOR shall visit CPP-IPR whenever he is called upon to do so
by the authorized officials of CPP-IPR.
[g] The decision of CPP-IPR, as to whether the CONTRACTOR has adhered to the
above obligations or as to whether the CONTRACTOR has committed any
breach of the terms and conditions, will be final and binding on the
CONTRACTOR.
[h] Whenever required it will be the duty of the CONTRACTOR to get the
necessary permits, approvals and liason with the concerned authorities like
RTO or the Commissioner of Police Office.
[7] On commencement of the contract, the CONTRACTOR shall provide the names of the
drivers/ persons along with their contact numbers licence. The contractor shall also
provide a copy of the Registration Book of the vehicle, PUC, Insurance, RTO Taxi
Passing, RTO Fitness certificate, and the driving licence of the driver etc. Any
subsequent change in the above shall be intimated forthwith to the Officer-in-charge.
[8] INDEMNITY:
The CONTRACTOR will indemnify CPP-IPR from all claims, suits, inability &
procedure which may be identified/initiated by the employees engaged by the
CONTRACTOR shall keep CPP-IPR harmless from all such rules, procedure liabilities.
The CONTRACTOR shall also indemnify CPP-IPR from all or any legal implication or
consequences that may arise out of labour laws/rules and any consequence that may arise
out of misconduct of any of his personnel. The decision of the Centre Director, CPP-IPR
in this regard shall be final and binding.
[9] INCOME TAX & OTHER DEDUCTION:
Income tax and any other statutory deductions shall be deducted from the monthly
bill/bills as per the provisions. Necessary income tax certificate will be issued to the
CONTRACTOR after depositing the amount to the Income Tax Dept.
[10] RATES:
[a] The CONTRACTOR shall be paid the rates as quoted in the tender document.
[b] The rates quoted by the CONTRACTOR shall be deemed to include all expenses
whatsoever that the CONTRACTOR may be required to incur for providing and
running of vehicles.
[c] The rates will remain firm throughout the period of contractor and also during the
extended period of contract.
[d] Under no circumstances, during execution of CONTRACTOR or upon it’s
termination, the CONTRACTOR shall be entitled to claim any indirect costs/
damages including loss of profit or claim towards idle manpower or vehicles and
it is an express term of the contract that the CONTRACTOR has waived it’s
rights, if any, to that effect.
[e] Whenever extra vehicle is called, the rates of regular vehicles would apply.
[f] The vehicles may also be required to work in shifts or at times for 24 hours. In
this case the overtime charged would be for the time exceeding the working hours
mentioned in the respective rate schedule of the vehicle. No night halt charges
would be payable in that case. Night halt charges may only be payable in case the
vehicle is hired for outstation journey for more than 24 hours.
[11] PAYMENT:
The CONTRACTOR shall submit the bills in duplicate along with the log sheets / books.
CPP-IPR will make the payment after verification by an Account Payee Cheque
preferably within one month from the date of receipt and verification of the bills. No
Claim for interest shall be entertained by CPP-IPR in respect of any payments or deposits
which may be held up with CPP-IPR, or in respect to any delay on the part of CPP-IPR
in making monthly payments or otherwise.
[12] SUB-CONTRACT:
That the CONTRACTOR shall not assign or sublet contract or any part there-of. If he
assigns or grants sub-contract to any person without obtaining prior consent of CPP-IPR,
he shall be doing so at his own risk and that shall not relieve the CONTRACTOR of any
obligation, duty, or responsibility under the contract.
[13] INDEMNITY AND GUARANTEE:
That the CONTRACTOR shall at all times indemnify and keep indemnified the CPP-IPR
and its officers, servants, guests and agents from and against all the third party claims
whatsoever (including but not limited to property losses/ damages, personal accident,
injury or death of/to property or persons of any sub-CONTRACTOR and or servants or
CONTRACTOR and/or the CPP-IPR and the CONTRACTOR shall at his own cost and
initiative at all times till the successful completion of the contract period, maintain
insurance policies in respect of all insurable liabilities, under the Motor Vehicle Act,
Workmen’s Compensation Act, Fatal Accidents Act, Personal Injuries Insurance Act.
[14] ARBITRATION:
[a] Any dispute arising out of a Notified Claim of the CONTRACTOR included in the
Bill of the CONTRACTOR and any dispute arising out of any Claim(s) of CPP-IPR
against the CONTRACTOR shall be referred to the arbitration of a Sole Arbitrator
selected in accordance with the laid down provisions. It is specifically agreed that
CPP-IPR may prefer its Claim(s) against the CONTRACTOR even if a Notified Claim
of the CONTRACTOR has not been referred to arbitration. The CONTRACTOR shall
not, however, be entitled to raise as a set-off defense or counter-claim any claim which
is not a Notified Claim included in the CONTRACTOR’s Bill.
[b] The Sole Arbitrator referred to in above shall be selected by the CONTRACTOR out
of a panel of 3 (three) persons nominated by CPP-IPR for the purpose of such
selection and should the CONTRACTOR fail to select an arbitrator within 30 (thirty)
days from the panel of names of such nominee being furnished by CPP-IPR for the
purpose, the Sole Arbitrator shall be selected by CPP-IPR out of the said panel.
[c] Any dispute(s) or difference(s) with respect to or concerning or relating to any of the
following matters are hereby specifically excluded from the scope, purview and ambit
of this Arbitration Agreement with the intention that any dispute or difference with
respect to any of the said following matters and/or relating to the Arbitrator’s or
Arbitral Tribunal’s jurisdiction with respect thereto shall not and cannot form the
subject – matter of any reference or submission to arbitration, and the Arbitrator or the
Arbitral Tribunal shall have no jurisdiction to entertain the same or to render any
decision with respect thereto, and such matter shall be decided by the Centre Director
of CPP-IPR prior to the Arbitrator proceeding with or proceeding further with the
reference. The said excluded matters are:
(i) With respect to or concerning the scope or existence or otherwise of the
Arbitration Agreement;
(ii) Whether or not a Claim sought to be referred to arbitration by the
CONTRACTOR is a Notified Claim;
(iii) Whether or not a Notified Claim is included in the CONTRACTOR’s Bill.
(iv) The issue on which the decision of officer-in-charge of CPP-IPR is final and
binding.
[d] The provisions of the Indian Arbitration & Conciliation Act, 1996 and any re-
enactment(s) and/or modification(s) thereof and of the Rules framed there under
shall apply to arbitration proceedings pursuant hereto subject to the following
conditions:
(i) The Arbitrator shall give his Award separately in respect of each Claim and
Counter-Claim and
(ii) The Arbitrator shall not be entitled to review any decision, opinion or
determination (howsoever expressed) which is stated to be final and/or binding on
the CONTRACTOR in terms of the Contract Documents.
[e] The venue of the arbitration shall be Guwahati, provided that the arbitrator may
with the consent of CPP-IPR and the CONTRACTOR agree upon any other
venue.
[15] GENERAL: If at any stage during the currency of contract, in any case involving moral
turpitude, the CONTRACTOR or their employees is/are convicted, the CPP-IPR reserves
the exclusive and special right to terminate the Contract and in such event the
CONTRACTOR shall not be entitled to any compensation from CPP-IPR.
[16] JURISDICTION:
Notwithstanding any other court or courts having jurisdiction to decide the question(s)
forming the subject matter of the reference if the same had been the subject matter of a
suit, any and all actions and proceedings arising out of or relative to the contract
(including any arbitration in terms thereof) shall lie only in the court of competent civil
jurisdiction in this behalf at Guwahati and only the said Court(s) shall have jurisdiction to
entertain any try and such action(s) and/or proceeding(s) to the exclusion of all other
Courts.
[17] WAIVER:
No failure or delay by CPP-IPR in enforcing any right to remedy of CPP-IPR in terms of
the Contract or any obligation or liability of the CONTRACTOR in terms thereof shall be
deemed to be a waiver of such right, remedy obligation or liability, as the case may be, by
CPP-IPR and notwithstanding such failure or delay, CPP-IPR shall be entitled at any time
to enforce such right, remedy, obligation or liability, as the case may be.
[18] ACCEPTANCE OF TENDER: The acceptance of tender shall be communicated to the successful tenderer(s) through a
letter of intent.
[19] EXECUTION OF AGREEMENT: The tenderer(s) whose tender(s) is./are accepted shall be required to be present at the
Institute in person or if it is a firm or company then by their authorised representative to
execute an agreement on non-judicial stamp paper of Rs.100.00 for satisfactory running
of the contract. Failure to do so shall constitute breach of contract affected by the
acceptance of the letter of intent, in which case the EMD shall be forfeited by the
Institute.
