1. EXECUTIVE SUMMARY
1.1 Torbiouse Solutions CC was appointed by ATC South Africa Wireless Infrastructure (Pty) Ltd to compile and submit an application in terms of the Spatial Planning and Land Use Management Act, 2013 (Act No. 16 of 2013), in terms of Category 3 of the eThekwini Municipality Planning and Land Use Management By-Law 2016 (Municipal Notice 114 of 2017), read with the Inner West Scheme of eThekwini Municipality, 2012 (Reviewed 2019), to the eThekwini Municipality for Special Consent.
1.1 ATC South Africa Wireless Infrastructure (Pty) Ltd entered into an agreement with the registered owner of the subject property for the lease of a part of said property for the purpos of a telecommunication mast and base station.
1.2 The application to obtain consent for special consent to eThekwini Municipality for the
construction and operation of the aforesaid telecommunication mast and base station is lodged on behalf of ATC South Africa Wireless Infrastructure (Pty) Ltd with consent of the owner of the subject property. ATC South Africa Wireless Infrastructure (Pty) Ltd will also be responsible for the construction of the said telecommunication mast and base station according to engineering standards. Annexure 3 hereto contains the power of attorney signed by the owner of the subject property.
2. PROPERTY PARTICULARS
2.1 PROPERTY DESCRIPTION, OWNERSHIP AND SIZE 2.1.1 The subject property is described as Erf 2034 Queensburgh in terms of Deed of Transfer
no. T35954/2013 (Attached herewith as Annexure 4).
2.1.2 The subject property is registered in the name of Nichollas Shaun Patterson, married out of community of property, as confirmed in the abovementioned deed of transfer.
2.1.3 The subject property measures 1683m² in extent. Also, refer to the Title Deed attached
hereto as Annexure 4.
2.2 LOCATION 2.2.1 The subject property is situated at 3 Dale Place. The location of the subject property is
illustrated on the preliminary building plans, attached herewith as Annexure 13. The coordinates for the proposed telecommunication mast and base station are:
2.2.1.1 Latitude: .00 . (Degree, Minutes, Seconds), or 2.2.1.2 Latitude: 29.86676 S and 30.89750 E (Decimal Degree)
2.2.2 The proposed location was determined by ATC South Africa Wireless Infrastructure (Pty)
Ltd. This location was identified as the location at which erecting a telecommunication mast and base station will best achieve goals with regard to network coverage.
2.2.3 There are currently two other telecommunication masts in the vicinity from 1000m of the proposed telecommunication mast:
2.2.3.1 The closest BTTS is approximately 801m South of the proposed Telecommunication Mast and Base Station (BTTS), constructed as a Monopole mast. Due to the deep valleys (topography) of the area, this site does not provide sufficient coverage with in the area of the proposed new Telecommunication Mast and therefore the proposed

Telecommunication Mast will fill the coverage gap, especially high speed data and improve the quality of their speech offering. 2.2.3.2 A second BTTS is approximately 806m South-West of the proposed Telecommunication Mast and Base Station (BTTS). Due to the deep valleys (topography) of the area, this site does not provide sufficient coverage with in the area of the proposed new Telecommunication Mast and therefore the proposed Telecommunication Mast will fill the coverage gap, especially high speed data and improve the quality of their speech offering Please refer to the 1km Radius Map, page 8 of 8 of the preliminary building plans indicating the location of existing telecommunication masts within a radius of 1000 meters from the proposed telecommunication mast, attached herewith as Annexure 13.
2.2.4 New telecommunication masts and base stations are not always built in an area to improve
the signal quality, but also to service the volume of users within the vicinity of the telecommunication mast. Each telecommunication mast can only accommodate a certain capacity of users at a specific time. The quantity of users also varies between voice calls and data users. With the latest telecommunication technology and devices, telecommunication masts also need to accommodate data users and not only voice calls. The latest equipment and technology used for telecommunication mast and base station has a maximum penetration radius of 400 to 500 meters for radio frequencies, also depending on the topography of the surrounding area that could impact the coverage area, please refer to the radio plan attached herewith as Annexure 10. Therefore with the latest telecommunication technology available and the topography of the surrounding area it will not be sustainable to locate telecommunication masts 1 kilometre and further away from other existing telecommunication masts as the proposed telecommunication mast will not be able to operate to its full potential and within the area needed most as it will not comply to the demand of data users in the vicinity of the proposed telecommunication mast. Locating telecommunication masts further than 500m away from other existing masts could result into data speed dropped and or no connection.
2.2.5 The telecommunication user base is still increasing (quantitative growth) and users must be able to choose the services rendered by any of the licensed operators anywhere in South Africa (choice and availability). The expansion of service types and content (content and technology growth) furthermore requires continuous equipment and network fine-tuning, upgrades and expansion. The user base also expects a continuous quality service to be provided and therefore network capacity and capabilities are under constant review to maintain or improve quality coverage (qualitative growth). ATC South Africa Wireless Infrastructure (Pty) Ltd network have identified an essential requirement in terms of the above objectives in the immediate surroundings of the planned telecommunication mast and base station. Please refer to the Radio Plan attached herewith as Annexure 10 which indicates the need for the proposed telecommunication mast in the area.
2.2.6 The population in this area is reasonably dense, with a dominant segment of middle age, medium to high income group. The population segment is likely to use more data for application such as Instagram, Whatsapp, Snapchat, e-mails and much more, on smart phones and other devices. They are also likely to have school going children who requires digital connectivity for research purposes. The proposed location is therefore a good location to fill in the gap between existing towers.
2.3 ZONING AND LAND USE SCHEME

2.3.1 The predominant zonings of the surrounding properties are presumed to be residential. The majority of the properties in the surrounding area are mainly utilised for dwelling purposes. The preliminary building plans is attached herewith as Annexure 13.
2.3.2 The subject property is zoned Special Residential 1 West Scheme of Ethekwini Municipality, 2012 (Reviewed 2019), and utilised for the purposes of a dwelling house. The zoning certificate is attached herewith as Annexure 6.
2.4 CONDITIONS OF TITLE, AND SERVITUDES 2.4.1 The deed of transfer of the subject property contains no conditions of title restricting the
construction of the proposed telecommunication mast and base station at its current location. Please refer to Annexure 4 for further details.
2.4.2 There are no servitudes registered against the Deed of Transfer of the application property
that affects the placement of the proposed telecommunication mast and base station.
3. APPLICATION PARTICULARS 3.1 This application is submitted in terms of the Spatial Land Use Management Act, 2013 (Act No.
16 of 2013), in terms of Category 3 of the eThekwini Municipality Planning and Land Use Management By-Law 2016 (Municipal Notice 114 of 2017), read with the Inner West Scheme of Ethekwini Municipality, 2012 (Reviewed 2019), for the granting of special consent by the EThekweni Municipality pertaining to a part of the subject property. The documentation provided complies with all applicable requirements contained in the Spatial Planning and Land Use Management Act, 2013 (Act No. 16 of 2013), in terms of Category 3 of the eThekwini Municipality Planning and Land Use Management By-Law 2016 (Municipal Notice 114 of 2017), read with the Inner West Scheme of Ethekwini Municipality, 2012 (Reviewed 2019).
3.2 The proposed telecommunication mast and base station is located on the north-western side of the subject property to provide 24 hour access via Dale Place for maintenance purposes and due to sufficient space available without hindering current development on the subject property.
3.3 The abovementioned approval is required for the approval of building plans for the proposed
telecommunication mast and base station. The building plans will be formally submitted for approval in terms of the National Building Regulations and Building Standards Act, Act 103 of 1977, once approval for the application for special consent is obtained.
3.4 The proposed telecommunication mast will be approximately 35m high, constructed as a
camouflage tree-type mast to compliment the aesthetics of the surrounding built and natural environment. The proposed base station site measures approximately 100m² in extent. For further details in this regard please refer to the preliminary building plans, attached herewith as Annexure 13.
4. PARALLEL APPLICATIONS, APPROVALS AND/OR PERMISSIONS 4.1 Approval of the Department Economic Development, Tourism and Environmental Affairs
(EDTEA) was obtained, attached herewith as Annexure 8.

4.2 No historical buildings or land marks will be affected by the proposed telecommunication mast and base station, therefore the approval of the Amafa aKwaZulu-Natali Heritage Council is not required for the approval of the said application.
4.3 No mineral resources will be affected by the proposed telecommunication mast and base
station, therefore the approval of the Department of Minerals and Energy Affairs is not required for the approval of the said application.
4.4 Approval of the South African Civil Aviation Authority was obtained, attached herewith as Annexure 9.
4.5 Permission from the South African Council for the Architectural Profession confirms that the person submitting drawings for the installation of telecommunication base station are exempt from registering with this council, attached herewith as Annexure 12.
4.6 A letter from the Department of Health indicated there are no confirmed scientific evidence of health hazards related to low public exposure to a cellular base station, attached herewith as Annexure 11.
5. ENGINEERING SERVICES
5.1 CIVIL ENGINEERING SERVICES 5.1.1 The proposed telecommunication mast and base station does not require water and sewer
engineering services to function. No upgrading of the civil engineering services infrastructure will therefore be required as a result of the approval of this application.
5.1.2 Access to the part of the subject property, on which the proposed telecommunication mast
and base station will be situated, will be gained via the existing entrance from Dale Place. There will be no noticeable increase in traffic volume as a result of the approval of this application. No upgrading of the roads infrastructure will therefore be required as a result of the approval of this application.
5.1.3 Therefore, no upgrading of the civil engineering services infrastructure as a whole will be
required as a result of the approval of this application.
5.2 ELECTRICAL ENGINEERING SERVICES 5.2.1 The electricity currently available on the subject property is deemed to be sufficient for the
operation of the proposed telecommunication mast and base station. No upgrading of the electrical engineering services infrastructure will therefore be required as a result of the approval of this application.
5.2.2 The connection required for this application will be obtained to the current connection of the property, subject to the approval of the electricity department.
6. GENERAL CONSIDERATIONS AND MOTIVATION 6.1 Cellular telecommunication technology is an integral part of modern day life and licensed
cellular telecommunication service operators have an obligation in terms of their license agreements, as stipulated by national government, to provide the services throughout South Africa within the allocated bandwidth spectrum. The cellular telecommunication user base is still increasing (quantitative growth) and users must be enabled to choose the services

rendered by any of the licensed operators anywhere in South Africa (choice and availability). The expansion of service types and content (content and technology growth) furthermore requires continuous equipment and network fine-tuning, upgrades and expansion. The user base also expects a continuous quality service to be provided and therefore network capacity and capabilities are under constant review to maintain or improve quality coverage (qualitative growth).
6.2 The South African broadband policy requires all telecommunication operators to provide high-speed broadband connectivity of 100 Mbps by 2030. The target that was set to be reached by 2016, was an average speed of 5Mbps to be available to 50% of the population in 2016, and available to 90% of the population in 2020. With only a decade left to reach these targets of 100 Mbps, additional sites need to be located closer together, as the signal strength is directly proportional to the date rates achievable
6.3 The immediate benefits of the activity to society in general can be summarised as follows:
Increased national telecommunication network coverage footprint enabling users to communicate on the preferred network wherever they are.
communication network grids and services as part of a sustainable economic growth pattern.
New infrastructure development within an established area is likely to rejuvenate the area and lead to the increase in property values.
Creating jobs and alleviating poverty.
Enhancing the safety and security of residence and businesses within the area of the proposed application.
6.4 The motivation and benefits to society in general above apply to the local community directly.
It will furthermore ensure that the communication capability and capacity of the community will keep pace with the ever growing and availability of communication facilities nationwide.
6.5 The placement of the base station must be seen as a part of a whole network of
telecommunication masts in and around the area that enables the whole network base to benefit from the enhanced communication infrastructure and internet data transferral. Therefore all the separately placed base stations enhance the effectiveness of the whole network.
6.6 The proposed position of the mast will have little or no impact on the current alignment of the
road and possible future upgrading. There will be no increase in the current traffic volumes nor future traffic volumes, for further detail please refer to Annexure 13.
6.7 The proposed telecommunication mast and base station make provision to be shared by other
service providers. For further details in this regard please refer to the preliminary building plans, attached herewith as Annexure 13.
6.8 The subject proposal will furthermore promote integrated land development between rural and
urban areas in support of each other by improving connection and communication potential between said areas via telecommunications.
6.9 The proposed telecommunication mast and base station is in line with the Development
Principles, Section 7, of the Spatial Planning and Land Use Management Act, 2013:
6.8.1 The Principle of Spatial Justice: The operation of a telecommunication mast will therefore improve well needed telecommunication services in such areas thereby integrating rural and urban areas on a technological and communicative level.
6.8.2 The Principles of Spatial Sustainability: The proposed telecommunication mast development promotes spatial sustainability by improving the telecommunication network base within the areas allowing users to communicate anywhere they want at

any time. The placement of the base station must be seen as a part of a whole network of telecommunication masts in and around the area that enables the whole network base to benefit from the enhanced communication infrastructure and internet data transferral. Therefore all the separately placed base stations enhance the effectiveness of the whole network.
6.8.3 The Principles of Efficiency: The proposed telecommunication mast and base station

6.8.4 The Principle of Spatial Resilience: The proposed telecommunication mast and base
station adheres to the objectives by potentially contributing to economic growth and infrastructure development resulting in the improvement of livelihoods on a technological and communicative level. Telecommunications can be viewed as a result of residential and employment opportunities due to access allowed for the integration between places of work and places of residence allowing one to work from wherever.
6.8.5 The Principle of Good Administration: Is addressed as the proposed telecommunication mast and base station is in line with the Spatial Planning and Land Use Management Act, 2013 (Act No. 16 of 2013), in terms of Category 3 of the eThekwini Municipality Planning and Land Use Management By-Law 2016 (Municipal Notice 114 of 2017), read with the Inner West Scheme of Ethekwini Municipality, 2012 (Reviewed 2019).
6.9 To conclude, the application is aimed at promoting the integration of social, economic, rural
and urban development by means of providing improved and sustainable telecommunication services.
7. CONCLUSION
7.1 The applicant has demonstrated that the application for special consent for the proposed
telecommunication mast and base station on the subject property can be regarded as being desirable and sustainable.
7.2 The application, with supplementary documentation, was compiled in accordance with the regulations of the Spatial Planning and Land Use Management Act, 2013 (Act No. 16 of 2013), in terms of Category 3 of the eThekwini Municipality Planning and Land Use Management By-Law 2016 (Municipal Notice 114 of 2017), read with the Inner West Scheme of Ethekwini Municipality, 2012 (Reviewed 2019).
7.3 The applicant is of the opinion that the application deserves the favourable consideration of
the Municipality.

This is an Organic Nominal Position developed by ATC South Africa. Leasing and Permitting undertaken
independently.

Recommendations:
The ground is undulating with some deeper valleys and associated hills. The existing sites in the area leave
a weak spot where the proposed ATC structure is to be built, as can be seen from the predicted coverage
of the existing coverage from all operators. The new ATC structure will allow network operators to expand
their network to provide high speed data and improve the quality of their speech offering and improve
their coverage in this area.
The population is reasonably dense in this area. The dominant age is in the middle age group to. This
population segment is likely to be using applications like Instagram, Whatsapp, Snapchat, email and a host
of other apps. on their phones. They are likely to have school going children with homework research
requirements so digital connectivity in this area is very necessary.
This area is medium to higher income, urban population.
Based on the population density and the schools located in the area, the selected site is a good location
to fill in the gap between the existing towers. There still remains a weak area to the North and North West
of the new ATC location that will be underserviced as the new site will not be able to reach into that area.
I expect that there should be another site placed in that area at some future date to provide continuous
coverage.
Coverage Mapping:
The South African broadband policy requires all telecommunications operators to provide high-speed,
broadband connectivity of 100 Mbps by 2030. Targets have been set starting with an average user
experience speed of 5 Mbps to be reached by 2016 and available to 50% of the population and, by 2020,
available to 90%. To allow wireless providers to attain the targets, additional sites on a much closer
nominal site spacing are essential. Sites will need to be located closer together as signal strength is directly
proportional to the data rates achievable. The stronger the signal received by the mobile device (acting
as the router), the
operators are currently incapable of providing the required capacity that this broadband policy requires
as they would require a massive rollout of optic fibre to all homes to increase their broadband offering.
The cost and upheaval would be immense! That leaves most of the connectivity requirements in the hands
of wireless providers. Companies such as ATC are uniquely positioned to facilitate the higher density
network requirements. Without a site sharing vendor, each and every cellular and wireless broadband
company would need to install antennas on virtually every street corner and light pole. A common high
site on a logical, nominal layout, which unrelated operators can use to prevent unnecessary visual clutter
is a far more elegant and controlled solution.
a) Coverage from existing towers:
Predicted existing coverage (average) provided by all of the operators before activating the new
ATC Structure. The nearest site is BS-T-4147 Escombe VC, 801m South of the new ATC location.
There are oth but, their coverage does provide sufficient service
where the ATC site will be placed and beyond.

- Red Limited to no coverage in some areas only 2G will be available (voice)
b) Predicted new Coverage after the Installation of the new ATC structure:

As can be seen, the signal quality and data speed will be improved for the population within the coverage
footprint of the new ATC structure. The addition of the ATC site will fill in the coverage gap and alleviate
congestion issues with speech and low data rates from the existing sites.
Note that the new ATC site is available for any operator to use.
The overall goal is to achieve a universal average download speed of 100 mbps by 2030. To reach this
