United States of America, the class action brought against the SEC for negligently failing to act on available information to prevent the Stanford Ponzi scheme. After an intense oral argument on September 11, 2014, the Court of Appeals handed down its decision today, March 30, 2015. A copy of the judgment is attached In its decision, the Court notes that the SEC’s failure to act was regrettable and makes clear that it does not condone their actions – or more accurately inaction. Unfortunately, the Court held that the specific laws on immunity for Government action applied to this case to shield the SEC, however bad their conduct may have been. While the decision essentially acknowledges that the application of this law does not necessarily result in a fair outcome, it holds that it is for lawmakers to remedy this type of injustice, rather than the courts. KLS vigorously disagrees with the Court’s reasoning in its decision, however, the ability to appeal it to the Supreme Court is extremely limited. At this stage, we are considering the merits of such appeal – which is just one aspect of our work on recovering innocent Stanford investor funds – any further. KLS will nevertheless continue our tireless efforts to seek recovery for investors by any other means possible.     Como saben por nuestros ltimos avisos, KLS present su apelacin en Zelaya, et al. Contra los Estados Unidos, la accin de clase interpuesta contra la SEC por negligencia en no actuar con la informacin disponible para evitar la esquema de Ponzi por Stanford. Despus de un intenso alegato oral el 11 de septiembre de 2014, la Corte de Apelaciones dict su decisin el, 30 de marzo de 2015. Se adjunta una copia de la sentencia

    En su decisin, la corte seala que la manera que el SEC actu fue lamentable y dejo en claro que no aprueba sus acciones - o ms ciertamente la inaccin. Desafortunadamente, la Corte sostuvo las leyes especficas sobre inmunidad de por accin del Gobierno es aplicada a este caso para proteger a la SEC, por mala su conducta pudo haber sido.
