RCA Claims FlandersRadio Station WouldCause Interference

K I V K R H E A D — The Radio Cor-porat ion of America in SuffolkS u p r e m e court here Mondaycharged its huge sending and re-ceiving center , located off the Mo-riches-Kiverhead road in Riverside,was in danger of becoming an"unprofitable business-' if a radiostation half a mile away in Fland-ers was allowed to operate.

Attorney Reginald C. Smith , rep-resenting RCA , told Jud ge FredJ. blunder the operation of tworadio stations near the RCA plantwili create "cross modulation thatwill interfere with reception ofradio signals."

The P a t c h o R U e BroadcastingCompany plans to operate a sta-tion at the site of the FlandersDrive-in Theatre on Flanders road.Another Station , WRIV , is alreadyoperating in down-town Riverhead.

He said the operation of bothstations would "cause so much in-terference , that the RCA stationwill become unprofitable."

Wallace F. Davidow of Patcn-ogue, attorney for the PatchogueBroadcasting Company, said theSupreme court had no jurisdictionin the matter. Mr. Davidow askedthat the complaint be tossed out.The Federal Communications com-mission , which licensed his clientsto operate in Flanders, have theonly authority and regulatory pow-ers over radio stations , he said.Judge Munder reserved decision.
