He has served as the Acting Director of Global Operations for theFair Labor Association and has played advisory roles for multiple ministries of the Government of India. Hecontinues to advise brands and assist them in developing their supply chains across Asia, Africa and the MiddleEast.

➢In India, Sections 11 to 41 of The Factories Act, 1948 provide forthe requisite standards of Health & Safety.

Contract Workers
➢ The Factory Management often assumes that the Contract Workers engaged by them are the responsibility of theirContractors.
➢ Contract Workers are mostly unaware of the health & safety requirements since the factory management is dependant onthe contractor to provide training/ orientation on the same, a task which is usually neglected by the contractor.
➢ However; Section 20 of the Contract Labour (Regulation & Abolition) Act, 1970 provides that, if any amenity required to beprovided under the Act for the benefit of the contract worker employed in an establishment is not provided by thecontractor, such amenity shall be provided by the principal employer.
➢ Sub-section 2(g)(ii) of the Contract Labour (Regulation & Abolition) Act, 1970 defines a Principal Employer as the owner oroccupier of the factory.
➢ The HR Team of a Factory must ensure regular monitoring of adherence to compliances by their contractors. Contractorrecords must be reviewed weekly to ensure adherence.
