Meeting Date: Tuesday 3 April 2012 Location: Committee Room 1, Level 5, Civic Centre, 1 Devlin Street, Ryde Time: 4.30pm Councillors Present: Councillors Perram (Chairperson), Li, Maggio, Petch and Tagg. Apologies: An apology was received from Councillor Campbell after the meeting. Staff Present: Group Manager – Community Life, Group Manager - Public Works, Manager – Open Space, Tree Management Officer and Councillor Support Coordinator. Councillor Li arrived during the inspection of Item 3 – Tree Management Review – 35 Elston Avenue, Denistone. He was not present for the remainder of the items. For the Motion: Unanimous Note: This is now a resolution of Council in accordance with the Committee’s delegated powers. 3 TREE MANAGEMENT REVIEW - 35 ELSTON AVENUE, DENISTONE Note: Councillor Li arrived during the inspection of this item. Report: The Committee inspected the property at 35 Elston Avenue, Denistone. RECOMMENDATION: (Moved by Councillors Maggio and Tagg) (a) That Council indicate its support for the removal of the two Eucalyptus saligna (Sydney Blue Gum) at 35 Elston Avenue, Denistone subject to a copy of a Section 91 Licence being submitted to Council prior to an approval being issued by Council for the removal. (b) That the applicant agree to replace the trees with two species that are endemic to the locally Endangered Ecologically Community that attain a minimum height of no less than 15m at maturity. Record of Voting: For the Motion: Unanimous Note: This matter will be dealt with at the Council Meeting to be held on 10 APRIL 2012 as

5 PLAYGROUND UPDATE RECOMMENDATION: (Moved by Councillors Maggio and Perram) (a) That Council endorse the proposed engagement with the community and the

Council Committees as part of the development of the Children’s Play Implementation Plan.

(b) That Council defer consideration for the replacement of equipment until the

draft Children’s Play Implementation Plan is reported to Council. (c) That the draft Children’s Play Implementation Plan list the locations of playgrounds where equipment has been removed. (d) That Council implement the removal of the playground equipment identified as unsafe in the report. (e) That Council implement the Media Plan emphasising Council’s management of playgrounds. Discussion At Council’s Committee of the Whole meeting held on 7 December 2010, Council resolved: That Council adopt the proposed revised Tree Management Process as

outlined in the report subject to the appeal fee being set at $50 and removing the need for an Arborist’s report at the Notice of Intent stage.

The current process under the existing Development Control Plan (2010) Part 9.6 Tree Preservation requires all requests for a Review of Determination to be reported directly to Council for resolution. Following a comprehensive review of the current Development Control Plan (2010) Part 9.6 Tree Preservation, at it’s meeting of 28 February 2012, Council considered the revised DCP and resolved the following: (a) That Council authorise the public exhibition of the draft Development Control Plan

(DCP) 2010 Part 9.6 Tree Preservation and its associated Technical Manual in accordance with the requirements of the Environmental, Planning and Assessment Act 1979.

(b) That Council authorise the public exhibition of the draft Urban Forest Policy. (c) That following the exhibition period of draft DCP 2010 Part 9.6 Tree Preservation

a report be prepared for Council consideration. The revised DCP proposes a trial of a new review process whereby the review is completed by an Internal Review Panel rather then the Works and Community Committee of Council, allowing for a shorter community response time and faster resolution of these applications. This trial process is to commence following the completion of the public exhibition process and adoption of the DCP by Council. In the meantime, all applications for a Review of Determination need to be considered by Council. Report A notice of intent to remove the 12 Leyland Cypress was received 25 May 2011. The Notice of Intent was subsequently refused as the reasons provided by the applicant did not comply with Ryde’s assessment criteria for a Notice of Intent. The original Notice of Intent and response can be located in ATTACHMENT 1. A Tree Management Application was received on 31 August 2011 for the removal of (12) Cupressusocyparis leylandii (Leyland Cypress) located on the property at 52 Denistone Road, Denistone. An independent consultant Arborist working for City of Ryde conducted a visual tree assessment on 19 November 2011. As a result of this assessment, Council’s Tree Management Officer approved the pruning of this tree only. The assessment criteria can be located in ATTACHMENT 1. The criteria that the consultant assessed the tree against are the same criteria that all Tree Management Applications are assessed against in City of Ryde. For more details on the reasons for the refusal for removal of the tree, refer to ATTACHMENT 1. Development Control Plan - Part 9.6 Tree Preservation notes the following as matters Council takes into consideration when determining an application and were used as the guiding principles for the decision made by the assessing officer to not grant approval for the removal of the tree: • The damage or potential damage the tree may cause in accordance with the

following: • The tree, its trunk, or its root system is causing damage to a structure and the

damage cannot be controlled by measures such as the installation of a root barrier;

• The tree is damaging other property, retaining walls and the like, and root pruning or modification of the property cannot stop further damage;

• Council will not consider the removal of trees that have entered a drainage or sewer system where the system is found to be in poor condition or in disrepair.

This policy provides the framework within which the staff are required to operate. Council received a Review of Determination for twelve (12) Cupressusocyparis leylandii (Leyland Cypress) located on the property at 52 Denistone Road, Denistone on 23 February January 2012. The applicant’s Review of Determination supplied additional reasons as to why this tree could be removed via invoices supplied for maintenance of plumbing on the property (refer to ATTACHMENT 2). Financial Implications Adoption of the recommendation will have no financial impact. Policy Implications There are no policy implications through adoption of the recommendation. The Committee should note that, following a comprehensive review, the revised Development Control Plan (2010) Part 9.6 Tree Preservation, its associated Technical Manual and draft Urban Forest Policy have been placed on public exhibition to obtain community feedback. Subject to these documents being adopted by Council following the public exhibition process, a Review of Determination of a Tree Management Application process will be a subject to a 6 months trial.

Options That Council

(a) Retain the existing determination of the Tree Assessment Officer and authorise pruning of the tree only.

Or (b) Approve the removal of twelve (12) Cupressusocyparis leylandii (Leyland

Cypress) and request replacement planting of five suitable species that would attain a minimum height of no less than 8 metres at maturity.

Conclusion The management and the preservation of the Ryde’s urban forest and the landscape amenity of the City is an important role of Council and the Tree Management Application process is one tool to manage the contribution to the urban forest of the trees on private land. The original determination for refusal has been reconsidered by Council. In light of the replanting proposed by the applicant as an offset to the proposed removal, the application is recommended for approval.

Following a comprehensive review of the current Development Control Plan (2010) Part 9.6 Tree Preservation, at it’s meeting of 28 February 2012, Council considered the revised DCP and resolved the following: (a) That Council authorise the public exhibition of the draft Development Control Plan

(DCP) 2010 Part 9.6 Tree Preservation and its associated Technical Manual in accordance with the requirements of the Environmental, Planning and Assessment Act 1979.

(b) That Council authorise the public exhibition of the draft Urban Forest Policy. (c) That following the exhibition period of draft DCP 2010 Part 9.6 Tree Preservation

a report be prepared for Council consideration. The revised DCP proposes a trial of a new review process whereby the review is completed by an Internal Review Panel rather then the Works and Community Committee of Council, allowing for a shorter community response time and faster resolution of these applications. This trial process is to commence following the completion of the public exhibition process and adoption of the DCP by Council. In the meantime, all applications for a Review of Determination need to be considered by Council. Report A Tree Management Application was received on 9 November 2011 for the removal of one Cedrus deodara (Himalayan Cedar) located on the property of 21 Eastview Street, North Ryde An independent consultant Arborist working for City of Ryde conducted a visual tree assessment on 2 December 2012. As a result of this assessment, Council’s Tree Management Officer approved the pruning of this tree only. The original Tree Management Application and response is in ATTACHMENT 1.

The criteria that the consultant assessed the tree against are the same criteria that all Tree Management Applications are assessed against in City of Ryde. For more details on the reasons for the refusal for removal of the tree, refer to ATTACHMENT 1. Development Control Plan - Part 9.6 Tree Preservation notes the following as matters Council takes into consideration when determining an application and were used as the guiding principles for the decision made by the assessing officer to not grant approval for the removal of the tree: • The damage or potential damage the tree may cause in accordance with the

following: • The tree, its trunk, or its root system is causing damage to a structure and the

damage cannot be controlled by measures such as the installation of a root barrier;

• The tree is damaging other property, retaining walls and the like, and root pruning or modification of the property cannot stop further damage;

• Council will not consider the removal of trees that have entered a drainage or sewer system where the system is found to be in poor condition or in disrepair.

This policy provides the framework within which the staff are required to operate. Council received a Review of Determination for one Cedrus deodara (Himalayan Cedar) located at 21 Eastview Street, North Ryde on 29 February 2012. The applicant’s Review of Determination supplied additional reasons as to why this tree could be removed via a Structural Engineers Report (refer to ATTACHMENT 2). Financial Implications Adoption of the recommendation will have no financial impact. Policy Implications There are no policy implications through adoption of the recommendation. The Committee should note that, following a comprehensive review, the revised Development Control Plan (2010) Part 9.6 Tree Preservation, its associated Technical Manual and draft Urban Forest Policy have been placed on public exhibition to obtain community feedback. Subject to these documents being adopted by Council following the public exhibition process, a Review of Determination of a Tree Management Application process will be a subject to a 6 months trial. Options That Council

(a) Retain the existing determination of the Tree Assessment Officer and authorise pruning of the tree only.

(Himalayan Cedar) and request replacement planting of suitable species that would attain a minimum height of no less than 10 metres at maturity.

Conclusion The management and the preservation of the Ryde’s urban forest and the landscape amenity of the City is an important role of Council and the Tree Management Application process is one tool to manage the contribution to the urban forest of the trees on private land. The original determination for refusal has been reconsidered by Council. Given that the Structural Engineer Report identifies the tree as a possible cause of destabilisation to the dwelling and that the Consultant has provided comment that root pruning is not appropriate, Council may wish to approve the conditional removal of this tree. In light of the replanting proposed by the applicant as an offset to the proposed removal, the application is recommended for approval.

4 REVISED CONCEPT DESIGN - ROWE STREET EAST UPGRADE

REPORT SUMMARY Funding has been allocated in Council’s Four Year Delivery Plan towards the public domain upgrade of Rowe Street (east) in Eastwood. In 2007 Council approved a Landscape Concept Plan for Rowe Street (east). However, as five years have elapsed since the Concept Plan was approved it was considered timely that a review of the plan be undertaken. Further, the preparation of the draft Eastwood Masterplan is currently underway, and as this project includes a public domain strategy it is appropriate that the recommendations of the Masterplan be considered in developing the design of Rowe Street (east). Construction of the upgrade works will commence during the 2013/14 financial year. An amended Landscape Concept Plan for Rowe Street (east) has been prepared for Council’s consideration and endorsement. RECOMMENDATION: That Council endorse the amended Landscape Concept Plan of Rowe Street (east) that is attached to this report as ATTACHMENT 2. Discussion On 2 August 2011, when considering a report on public domain upgrades in centres, Council resolved “that the public domain construction of Church Street Ryde (stage 1) and Rowe Street (east) Eastwood be funded from the town centre upgrade budget in the 4 year period from 2011/12 to 2014/15”. Both sites had concept plans that had been approved by Council in 2007 and 2008. The report outlined a program of works for the centres that included funding for the design and documentation of Church and Rowe Streets in 2011/12. The design development for these two projects is currently underway. A review of the concept plan for Rowe Street (east) has led to revisions of the approved Concept Plan. Approved Concept Plan of Rowe Street (east) and Railway Parade, Eastwood On 19 June 2007 Council approved the Concept Plan in the following terms:

(a) That the detailed paving and landscape design plans for Rowe Street (East) and Railway Parade, Eastwood be approved, subject to the deletion of the concrete wave pattern in the pavement.

(b) That the detailed paving and landscape designs be submitted to the Ryde Traffic Committee for further comment.

The approved Concept Plan is attached (ATTACHMENT 1). Key elements of the approved Concept Plan include:

• New brick paving to match the existing paving in the mall in Rowe Street • Street tree planting (10) within the road carriageway • Low planting of shrubs near the roundabout • New seats and bins • Installation of multifunction poles/removal of overhead powerlines on the

southern side • A mid block pedestrian crossing • Loss of 7 car parking spaces

As five years have elapsed since the Concept Plan was approved, it was considered timely that a review of the plan be undertaken. Further, the preparation of the draft Eastwood Masterplan is currently underway, and as this project includes a public domain strategy it is appropriate that the recommendations of the Masterplan be considered in developing the design of Rowe Street (east). It is noted that upgrading works on Railway Parade were implemented in 2009. Draft Eastwood Masterplan The preparation of the draft Eastwood Masterplan commenced in July 2011. The Masterplan is based on an urban design study that will be translated into a suite of strategic documents, including LEP and DCP provisions and a public domain plan.

This process has included extensive consultation with the local community which has resulted in recommendations for improvements to the public domain. The community strongly supported an increase in community space for social interaction. A report on the draft Eastwood Masterplan will be brought to Council later this year. Design opportunities have been identified for Rowe Street (east) that include the potential widening of the footpath on the southern side. The footpath widening would promote outdoor dining and social interaction and provide sufficient pavement space clear of awnings for the planting of street trees. It is considered that there is merit in this recommendation as it would help to enhance Rowe Street’s role as a regional destination for multi-cultural cuisine and would help to establish a lively character for the eastern side of the centre that is commensurate with that of the western side. Amended Concept Plan of Rowe Street (east) Footpath widening The approved Concept Plan does not include any footpath widening. The amended Concept Plan (ATTACHMENT 2) includes a widening of the footpath on the southern side by 1.5m to approximately 5 metres. This widening will still allow for two traffic lanes of 3m width and two parallel parking lanes of 2.5m width. Unlike the approved Concept Plan, the planting of street trees will not result in the loss of any kerb side parking spaces. The southern side of Rowe Street (east) already has numerous cafes and restaurants and is the sunny side of the street. The proposed generous width of the footpath will readily accommodate outdoor dining spaces and so will help to establish an “eat street” character on the east side of Rowe Street. The amended Concept Plan also proposes a narrowing of Rowe Street’s carriageway where it intersects with Railway Parade. The purpose of the narrowing is to establish a special community place within Rowe Street that would replicate the highly successful mall on the western side of Rowe Street. It is proposed that an overhead structure be installed within the street to reference the spatial quality of the wisteria covered trellis within the mall. It is anticipated that the structure would be of a contemporary design and include elements that would add a festive note to Rowe Street such as lighting or colour (ATTACHMENT 3). This structure would help to visually link the 2 sections of Rowe Street. Parking The approved Concept Plan resulted in the loss of at least 7 parallel parking spaces, particularly as trees were to be planted within the road carriageway. This issue has been re-examined, and the amended Concept Plan loses a maximum of 5 spaces at the western end of Rowe Street, depending on the detailed design of the widened footpath. When compared with the approved Concept Plan the loss of up to five spaces is considered acceptable, especially given the benefits of the amended scheme. It should be noted that the Aldi development, currently being constructed, will provide a new large parking area in Rowe Street.

Undergrounding of power and street trees As per the approved Concept Plan, the amended Concept Plan undergrounds the power on the southern side of the street and installs multifunction poles. It is proposed that a significant line of trees be planted within the widened footpath area to provide shade and amenity for the street. It is noted that there are also powerlines on the northern side, but because they are high tension lines it is not possible to underground them, and hence no street trees are proposed on the north side. It is considered that the amended Concept Plan will deliver a superior public domain outcome when compared with the approved Concept Plan. Traffic Committee The amended Concept Plan was referred to the Traffic Committee on 29 March 2012 for endorsement. This committee was supportive of the plan and made recommendations regarding pedestrian safety and traffic calming. These comments have been incorporated into the design. Consultation The approved Concept Plan prepared in 2007 was developed in consultation with shopkeepers, property owners and local residents. Targeted consultation on the amended Concept Plan 2012 has commenced with a meeting in the Eastwood Hotel on 27 March 2012. This meeting was attended by representatives of the Eastwood Chamber of Commerce, the Korean Chamber of Commerce and the Eastwood Chinese Seniors’ Club; restaurant owners, other local

business owners, property owners and residents. There was also a journalist from the Korean Daily newspaper. The Concept Plan was explained to attendees and a presentation was made by the public artist employed by Council for the upgrade. Generally the Concept Plan was well received and issues discussed included paving, street trees and multifunction poles. Deciduous trees were supported for summer shade and winter sun, and banners were thought desirable on the multifunction poles. It was noted that narrowing of the road would help to decrease vehicular speed and thus improve pedestrian safety. The issue of outdoor dining was discussed, in light of the fact that Rowe Street is currently a ‘no alcohol zone’. There was no strong objection to the potential loss of up to 5 car parking spaces. Regarding seating one attendee suggested that grouped, block-type seats were more conducive to social interaction than Council’s standard bench seat. This issue will be investigated during detailed design of the wider area of pavement at the intersection with Railway Parade. Financial Implications It is anticipated that the cost of constructing the amended Landscape Concept Plan will be $2.5 million which will be covered by the Town Centre Upgrade budget allocation for this project over the 2013/14 and 2014/15 financial years. However the final cost estimate cannot be calculated until the detailed design is complete. The cost of the proposed overhead structure is unknown at this stage. The concept for the structure needs to be further developed as part of a broader public domain strategy for Eastwood that would include the popular wisteria arbour in Rowe St (west), thus helping to link the two sides of Rowe Street. Funding for such a structure would be in addition to the allocated $2.5million.
