1. Introduction 1.1 At its meeting on 2 September 2014, the Educational Services Committee

of West Dunbartonshire Council agreed to proceed to statutory consultation under the terms of the Schools (Consultation) (Scotland) Act 2010, as amended in 2014 on the following proposals:

a) to discontinue education at the current Jamestown Primary School and Haldane Primary School and amalgamate Haldane and Jamestown Primary schools into a new establishment, the name of which has yet to be determined, to be constructed on the present site of St Kessog’s Primary School;

b) to construct a new St Kessog’s Primary School, to be co-located

with the new amalgamated school on the current St Kessog’s site; c) temporarily to decant St Kessog’s Primary School either into the

present Haldane building or into the Jamestown Primary School building, with Jamestown Primary School moving temporarily to the Haldane building to allow the clearing of the St Kessog’s site in advance of the construction of the new campus;

d) to construct on the same site a new replacement for Jamestown

Early Education and Childcare Centre;

e) to construct on the same site a new Additional Support Needs (ASN) base capable of supporting children with a range of needs. This will relieve the pressure on the demand for specialist provisions in the authority for primary aged pupils as well as reducing the need for external placements;

f) to approve a recommendation that the consultation period should

run from Friday 12 September 2014 to Friday 7 November 2014; g) to note the financial implications identified in section 6 of this

report; and

h) to agree that a report outlining the results of the consultation and making appropriate recommendations be presented to a future meeting of the Educational Services Committee.

2. The Proposal 2.1 West Dunbartonshire Council is proposing, subject to the outcome of the

consultation process:

to discontinue educational provision at the existing Jamestown Primary School and Haldane Primary School;

to construct a new primary school for the pupils from the two discontinued schools on the campus of St Kessog’s Primary School building;

to construct a new St Kessog’s Primary School, to be co-located with the new amalgamated school on the current St Kessog’s site;

temporarily to decant St Kessog’s Primary School either into the present Haldane building or into the Jamestown Primary School building, with Jamestown Primary School moving temporarily to the Haldane building to allow the clearing of the St Kessog’s site in advance of the construction of the new campus;

to construct on the same site a new replacement for Jamestown Early Education and Childcare Centre;

to construct on the same site a new Additional Support Needs (ASN) base capable of supporting children with a range of needs;

the new arrangements to come into force in August 2017 or as soon as possible thereafter.

3. Background to the Proposal

3.1 West Dunbartonshire Council currently has 34 primary schools, many of

which are very small, in poor condition and with significant levels of under-occupancy or spare capacity. There is a strong educational and social argument for educating as many young people as possible in attractive, modern, fit for purpose buildings.

3.2 The fact that these schools are generally small, in poor condition and

have large unoccupied areas means that they are expensive to maintain and run. The average cost of running a West Dunbartonshire primary school is £5,248 per pupil per year, as against a Scottish average of £4,752 (in school session 2012/13, the last year for which figures are available). This means that the only Scottish councils where primary education is more expensive than it is in West Dunbartonshire are Eilean Siar (The Western Isles), Shetland, Orkney, Argyll & Bute and Dumfries & Galloway. Some other very rural councils, with scattered communities and many very small schools, such as Highland and Scottish Borders, have lower costs per pupil than West Dunbartonshire.

3.3 At a time of significant financial pressures, this is an unsustainable situation for a largely urban Council with the second smallest geographical area of any council in Scotland. It is worth noting that the only council with a smaller geographical area, Clackmannanshire, has the

lowest running costs of any Scottish Council, with an average annual cost per pupil in 2012/13 of £4,084.

3.4 In a recent report, Audit Scotland has criticised councils for failing to

minimise the running costs of schools. 3.5 The Scottish Government has indicated that it expects local authorities to

move as many young people as possible from school buildings which have Condition ratings of D (unsatisfactory) or C (poor) to buildings with A (Good) or B (Satisfactory) ratings. The Government has developed a scheme which allows local authorities to free up additional capital to fund such initiatives.

3.5.1 In the case of West Dunbartonshire, the Scottish Government has offered

to increase the funding for the new Our Lady and St Patrick’s High School from 67% to 100%, provided councils agree to use the additional capital released by this offer to move as many pupils as possible from schools with Condition ratings of D or C to buildings with A or B ratings.

3.5.2 This offer by the Scottish Government releases an additional capital sum

of approximately £8.150m for West Dunbartonshire Council to invest in primary schools. In addition, the Council is expected to add at least £4.075m of its own funds, making at least £12.225m available to invest in schools with a Condition rating of C or D.

3.5.3 There are currently no schools in West Dunbartonshire with a Condition

rating of D. However, 16 primary schools (including St Peter’s and Aitkenbar, which will be replaced in 2016) have condition ratings of C. Of these, 10 are in the Vale of Leven area, which is also the area where there is the greatest over-capacity in the primary schools estate. It is therefore logical to concentrate on regeneration in the Vale of Leven area.

3.6 On 13 August 2014, Council approved a strategic plan for the

regeneration of the primary schools estate (“Regenerating Learning”). The proposals contained in this paper are in line with the principles outlined in that report.

4. Current Position 4.1 The rolls, working capacities, percentage occupancy rates, and Condition

and Suitability ratings of the 3 schools referred to in this report are as follows:

Condition C C C Opened 1864 1958 1961 4.2 The under-occupancy and poor conditions of all three schools, together

with their very close geographical proximity, are powerful arguments for a reconsideration of primary school provision in the Jamestown/Haldane area.

4.3 The educational and other arguments for these proposals are further

detailed in Section 6 of this report. 5. Proposed new arrangements 5.1 The new school, formed by the amalgamation of Haldane and Jamestown

primary schools, to be located on the current St Kessog’s campus and whose name has yet to be determined, would have a roll of approximately 300 pupils.

5.2 The new St Kessog’s Primary School would have a roll of approximately

170 pupils. 5.3 The new Jamestown Early Education and Childcare Centre (EECC),

would have capacity for 120 children (60 morning and 60 afternoon) and would remain a separate educational establishment, with its own head of centre.

5.4 The new base for children with additional support needs, which would be

managed by the head teacher of St Kessog’s Primary School, would have capacity for 36 full time children.

5.5 The total capital cost of the new build will be £15.376m.

6. Educational Benefits Statement 6.1 Introduction 6.1.1 West Dunbartonshire Council believes this proposal will provide a range

of educational benefits and enhance the Council’s efforts to meet statutory obligations enshrined in:

the Education (Scotland) Act 1980;

the Standards in Scotland’s Schools etc. Act 2000;

the Local Government in Scotland Act 2003;

the Education (Additional Support for Learning) (Scotland) Act 2004;

the Educational (Additional Support for Learning) (Scotland) Act 2009;

the Children and Young People Act 2014; and

the Equality Act 2010.

6.2 Likely effect of proposal on pupils currently attending or expected to attend Jamestown and Haldane Primary Schools

6.2.1 The pupils of Jamestown and Haldane Primary Schools will benefit from

moving from C (poor) Condition school buildings to a new, purpose-built school with a Condition rating of A.

6.2.2 Haldane Primary School is currently housed in a very unattractive school

building, opened in 1958, with poor or no accessibility to large parts of the school for children, staff and parents with physical disabilities.

6.2.3 The present Jamestown Primary School building is 150 years old.

Although it is a listed building, it is a very inflexible building which is no longer suitable for the delivery of modern education. There is also poor or no accessibility to large parts of the school for children, staff and parents with physical disabilities. Part of the school is housed in a hut in the playground.

6.2.4 With a projected school roll of approximately 300, pupils transferring to

the new school would have access to a wider range of teaching and support staff than they have in their current schools, which have rolls of 160 (Jamestown) and 143 (Haldane). The larger combined roll will also afford pupils the opportunity to broaden their social circles. The larger staff complement will also allow greater scope for professional dialogue among teaching and support staff.

6.2.5 The pupils attending the new school would benefit from the Council’s

recent experience in constructing new primary schools. Among the improved facilities from which pupils will benefit and which do not apply to the current schools are:

attractive, well-designed classrooms with teaching walls including interactive white boards and break-out spaces to allow flexibility in teaching methods and a range of learning approaches;

accommodation which is well heated, ventilated and lit and which maximises the use of natural light;

up-to date ICT provision, including full wireless functionality; properly designed circulation space; attractively designed and easily accessible areas for outdoor

learning and informal play; a 3G multi-use games area; custom-built, modern kitchen and dining areas, with outdoor eating

facilities. 6.2.6 The fact that the new campus will comprise two primary schools, an EECC and an (ASN) base will allow sharing of experience, expertise and

leadership capacity among mainstream school, EECC and ASN staff, for the educational benefit of all children attending the campus. 6.2.7 In terms of the communities which these two schools serve, this proposal

ensures the continuation of non-denominational primary education in the Haldane/Jamestown area for the foreseeable future.

6.3 Likely effect of proposal on pupils currently attending or expected

to attend St Kessog’s Primary School 6.6.1 St Kessog’s Primary School is currently housed in an unattractive, flat-

roofed building and was opened in 1961. Although some improvements have been made to the fabric of the building in recent years, including the replacement of some of its windows, the building remains in poor condition.

6.3.2 The pupils attending the new St Kessog’s will benefit from the Council’s recent experience in constructing new primary schools. Among the improved facilities from which pupils will benefit and which do not apply to the current school are:

attractive, well-designed classrooms with teaching walls including interactive white boards and break-out spaces to allow flexibility in teaching methods and a range of learning approaches;

accommodation which is well heated, ventilated and lit and which maximises the use of natural light;

up-to date ICT provision, including full wireless functionality; properly designed circulation space; attractively designed, secure and easily accessible areas for

outdoor learning and informal play; a 3G multi-use games area; custom-built, modern kitchen and dining areas, with outdoor eating

facilities

6.3.3 The fact that the new campus will comprise two primary schools, an EECC and an Additional Support Needs (ASN) base will allow sharing of experience and expertise among mainstream school, EECC and ASN staff for the educational benefit of all children attending the campus. 6.3.4 The temporary decant of St Kessog’s Primary School into either the

present Haldane building or into the Jamestown Primary School building is necessary in order to clear the St Kessog’s site in preparation for the construction of the new campus. A part of this process, approximately £0.100m will be spent on the Haldane building to ensure there is no detriment to the education of the pupils of St Kessog’s (or Haldane) Primary school and that their education can continue as planned.

6.3.5 Because this proposal involves straight replacement for the St Kessog’s building, but no change in status for St Kessog’s Primary school, there will

be no detriment to the education of the children who attend the school. Staffing levels, for both teaching and support staff, will remain unchanged.

6.3.6 This proposal ensures the continuation for the foreseeable future of Catholic primary education in the Balloch/Haldane/Jamestown area. 6.4 Likely effect of proposal on pupils currently attending or expected

to attend Jamestown Early Education and Childcare Centre (EECC) 6.4.1 The current Jamestown EECC is housed within the Jamestown Primary School building. 6.4.2 The Council has recent experience in designing and constructing new

EECCs (St Eunan’s EECC, which opened in 2010 and the new Bellsmyre EECC, which is scheduled to open in 2016). Children attending Jamestown EECC will benefit from this experience, should this proposal be accepted and would move into a new, purpose-built facility which would have:

attractive, bright and well-designed rooms, suitable for early learning and for structured play;

accommodation which is well heated, ventilated and lit and which maximises the use of natural light;

up-to date ICT provision, including full wireless functionality; attractively designed, secure and easily accessible areas for

outdoor learning and informal play; access, on a planned and timetabled basis and where appropriate,

to the facilities of the two schools.

6.5 Likely effect of proposal on pupils currently attending or expected to attend other specialist ASN provision in West Dunbartonshire

6.5.1 Existing Specialist Provision for primary pupils in West Dunbartonshire Council consists of the following. a) Kilpatrick Primary. Capacity in the Primary building is 60. Current roll is 68 as a class has been created in the secondary building to create additional capacity. Kilpatrick Primary takes children with a variety of complex needs including children on the Autism Spectrum. b) Cunard School. Capacity is 18 and it is currently full with 18 children. Cunard supports children with behavioural difficulties including ADHD and also supports children on the Autism Spectrum. c) Renton Language and Communication Unit. This unit caters for children on the autistic spectrum and children with Specific Language Impairment. Although the capacity can be

marginally fluid (depending on the mix of pupils) the capacity of the unit is 24FTE. Places can be full time or part time. Part time places operate on a sliding scale to time spent in the unit or in the home school depending on the profile and needs of the child. The limited and generic nature of the accommodation within the Unit limits the numbers and profile of children that can be placed here. There are currently 31 pupils enrolled in the unit, 12 of whom are part time. The unit is therefore full. Across the range of specialist placements that exist within WDC capacity has been reached. Specialist places with private providers have had to be sought, at significant additional expense, in order to be able to meet our statutory duty in relation to ASN. A particular area of need and demand is for places for children on the Autism Spectrum. 6.5.2 The Council has recent successful experience of constructing a new

facility for pupils with Additional Support Needs, namely Vale of Leven Academy’s Communication Base, opened in 2009. The Council is also currently involved in designing a new Kilpatrick. Pupils attending the proposed new Additional Support Needs unit on St Kessog’s campus would benefit from these design experiences. The new facility would have a number of advantages for children who attend it, including:

classroom, break-out and circulation space designed specifically with the needs of children on the autistic spectrum in mind, including clear lines of sight, muted colour patterns, floor markings and sound deadening measures;

a specially designed sensory room; access, as appropriate, to the facilities, including outdoor sports

areas, of the two mainstream schools on the campus; the opportunity, for those children capable of doing so, to integrate

with the mainstream classes of the two primary schools on the campus;

the opportunity to join whole school activities run by the two primary schools on the campus.

6.6 Likely effect of Proposal on Other Users of the Schools

6.6.1 As part of West Dunbartonshire Council’s efficiency measures, the

Council has greatly reduced the number of external lets in primary schools, instead concentrating lets in secondary schools which are generally already open in the evenings.

6.6.2 There are currently no sessional lets in St Kessog’s Primary School or

Jamestown Primary school and EECC. 6.6.3 The following groups and individuals have sessional lets in Haldane

Primary School: Haldane United (a youth football team);

Age Concern; one local elected member (for surgeries).

These lets would continue to be available during the two years when Haldane Primary and St Kessog’s Primary would be sharing either the present Haldane building or the Jamestown Primary School building. Thereafter, the lets could switch to the new campus, as could lets for groups who apply for occasional use of the school facilities.

6.6.4 The following group uses accommodation (2 classrooms) in Haldane

Primary School during the school day: Haldane Youth Services.

Consideration will have to be given to finding alternative accommodation for this group when the new schools open, since they will not have the capacity to house this service.

6.7 Likely effect of Proposal on other pupils across West

Dunbartonshire schools 6.7.1 The likely effect of the proposal on other pupils across West Dunbartonshire Council schools will be minimal. The proposal for the three affected schools will assist the Council to direct the Education revenue budget towards learning and teaching resources and the provision of high quality space, rather than supporting the over provision of space and higher running costs associated with older un-refurbished buildings. 7 Financial Implications 7.1 The capital cost of the new campus would be £15.376m, with a further

£0.100m for the temporary decant costs. 7.2 Annual revenue savings resulting from the amalgamation of Jamestown

and Haldane are estimated to be £0.436m. 7.3 It is estimated that the sale of the Haldane site would generate a capital

receipt of £0.650m. It is proposed that this capital receipt would be used to part fund the project and therefore the net cost of this project would be £14.726m.

7.4 The 10 year capital plan has indicative capital spend of £60m from

2017/18 to 2022/23 for the School Estate Management Plan. 7.5 As noted above, the Council has agreed to provide a minimum of

£4.075m of “match” funding as an additionality to the £8.150m of already agreed capital budget freed-up from the Scottish Government’s agreement to fund 100% of the build costs for OLSP.

This means that we would require to realign £12.225m to meet the conditions of the SG’s proposal. This report recommends projects to the net value of £14.726m.

7.6 There is another report being presented to this Committee regarding

another set of proposals for other schools. That report advises that a net capital receipt of £0.319m is anticipated from that project. If both of these options per this report and the other report to this Committee were approved to proceed it would be recommended that the net capital receipt from the options described in the other report be used to partially fund the options described in this report and would therefore require the Council to fund a net investment of £14.407m. This would have a revenue impact in terms of the cost of financing this net cost of £0.893m.

However as noted at 6.4 above the Scottish Government decision to fully fund OLSP has released £8.150m of already planned capital funding with the revenue impact of such investment already agreed and integrated into revenue projections. This therefore reduces the level of additional revenue impact to the additional cost over the £8.150m, i.e. £6.257m. In addition, as noted above, the Council has an outline £60m future capital plan for schools estate management and it is anticipated that, if this project was to proceed then the permission would be sought to bring forward £6.257m of the future capital provision – reducing that future provision to £53.743m. Therefore the additional cost of the above proposal, over what has already been agreed for OLSP, would bring forward an additional revenue impact of £0.388m.

7.7 Financial information relating to this proposal is attached to this document

in accordance with the requirements of the recent amendments to the Schools (Consultation) (Scotland) Act 2010.

8 The Consultation Process

8.1 At its meeting on 3 September 2014, West Dunbartonshire Council authorised the Executive Director of Educational Services to undertake formal consultation in terms of the Schools (Consultation) (Scotland) Act 2010 in relation to the Proposal specified in section 2 above and the arrangements noted below have been made to discharge that instruction.

8.6 A public notice to advertise the consultation will be placed in the

8.7 A public meeting will be held in the Assembly Hall of Vale of Leven

Academy on Wednesday 22 October 2014 at 7.00 pm, at which representatives of West Dunbartonshire Council’s Educational Services Department will be in attendance to present the details of the Proposal, answer questions and record comments/representations from those in attendance at the meeting.

8.8 Comments/representations are invited through use of an online form, this

will also be available in hard copy if required. Hard copy responses can be returned to Terry Lanagan, Director of Educational Services, West Dunbartonshire Council, Council Offices, Garshake Road, Dumbarton, G82 3PU. The online response form will be available for completion through the Council website and also issued on the Council’s Facebook and Twitter pages. 8.9 At the end of the consultation period, the Executive Director of Educational Services will submit a copy of all written comments/representations, together with oral comments/representations made at the public meeting, to Education Scotland who will prepare a professional and independent report on the educational aspects of the Proposal.

8.10 The Executive Director of Educational Services will consider all written

and oral comments/representations received in relation to the Proposal which have been received during the consultation period, together with Education Scotland’s report, and prepare a Consultation Report.

8.11 The Executive Director of Educational Services shall publish the

Consultation Report which will be made available on Council’s website; it will also be available in printed format from the reception points at West Dunbartonshire Council buildings specified in section 7.4 above.

8.12 The Consultation Report shall be published to allow a period of no less

than 3 weeks prior to the Council’s Decision to either implement or reject the Proposal.

8.13 The Executive Director of Educational Services shall immediately notify

Scottish Ministers if the Council’s Decision is to implement the Proposal to amalgamate Jamestown and Haldane Primary schools.

8.14 Representations (from consultees) can be made to Scottish Ministers

within 3 weeks of the Council Decision to request Scottish Ministers ‘call-in’ the Council Decision.

8.15 West Dunbartonshire Council can only implement the Council decision 8

weeks after the date of the Council Decision or in the event that earlier notification is received from Scottish Ministers that the decision can be implemented.

8.16 Ministers have the power to “call in” decisions if it appears that the

Council has failed in a significant way to comply with the Act or if, in coming to its decision, it has failed to take proper account of a material consideration relevant to the proposal.

8.17 Where a proposal is called in by Ministers, it will be referred to the

Convener of the School Closure Review Panel who will be required to constitute a School Closure Review Panel to consider the case and make a decision within 8 weeks.

8.18 Consultees are invited to indicate whether or not they are in favour of this proposal to amalgamate Jamestown and Haldane Primary Schools on the current St Kessog’s Primary School campus and to co-locate a new St Kessog’s Primary School on the same site, together with a new Jamestown Early Education an Childcare Centre and a new Base for West Dunbartonshire primary school pupils with additional support needs.

Consultees may also wish to provide reasons for their opinions.
